LAWYERS representing Patriotic Front (PF) party president Edgar Lungu now want the High Court to first deal with the case in which presidential hopeful Miles Sampa has been charged with contempt for allegedly ignoring a court order not to proceed with the general conference, where he was elected president.

On Tuesday, Mr Sampa, Kasama member of Parliament (MP) Geoffrey Mwamba and former diplomat Salemani Phangula filed an application to stay execution of a consent judgment delivered by the High Court declaring Minister of Justice Edgar Lungu as president of the PF.

In this case, the High Court had granted an injunction restraining eight PF officials from holding another general conference, which elected Mr Sampa as PF president.

The eight are former secretary general Bridget Atanga, deputy secretary general Anthony Kasolo, chairperson for elections Sylvia Masebo, Southern Province Minister Daniel Munkombwe, returning officer Germano Kaulung’ombe, president claimant Mr Sampa, Mr Mwamba and Captain Phangula.

Mr Sampa has also asked the court to join the case, where a consent judgment was granted declaring Mr Lungu as president of the party as intended intervener.

According to an affidavit in support of inter parte summons to stay proceedings, PF national chairperson Inonge Wina has asked the court to stop the proceedings until the contempt proceedings have been concluded.

Mrs Wina asked the court to order that the intended interveners cannot be allowed to seek any redress before it pending determination of the proceedings in line with the law on contempt.
She said according to the rules of the Supreme Court contemnors are prohibited from being heard until contempt allegations have been determined.

“The record will show none of the contemnors have purged their contempt, therefore, as guided by the law; they should not be heard relating to this matter until the contempt proceedings are determined,” Mrs Wina said.

She added that the alleged contemnors have continued to justify the legality of the December 1 general conference despite the injunction that restrained it and the consent judgment that affirmed the injunction.

And Mr Kaulung’ombe admitted that the court order restraining delegates at the December 1 general conference from electing another president was served on the PF leadership five hours before voting began.

He said he did not make the declaration that Mr Sampa was president of the PF after voting had closed because he was aware of the court injunction.

“I never declared any candidate as duly elected Patriotic Front president and news clips are evidence enough to confirm that no such declaration was ever made by me,” Mr Kaulung’ombe said.

He added that the December 1 general conference was not duly constituted as it failed to form a quorum.

It’s adjudication has to be done with unparalleled holistic judicial skills and mindset free of contemptuous instructive orders. At an inflection point, the learned Jurists’ impartial rulings have become the heart beat of a Zambia’s political order and national peace. Any influenced judgement detached from responsible and professional conduct could easily plunge our country in turmoil God forbid.

      Both EL and MS elections were flawed!
      EL was elected by even non-party delegates like ABZ president Father Bwalya. Moreover, in the interest of democracy, Edgar Desperado Lungu (EDL) should not be proud about his election when he made sure to go unopposed! We know the thuggery that his campaign manager engineered on the streets. MS election was more credible bcoz he had contenders except for EDL’s pulling of his leg through a court injunction.

      The court should have ruled that both processes were flawed and call for a run off election in 48 hrs in time 4…

Initially MO while in Kabwe, before the second conference said, he never saw the injunction restraining his group from holding the second convention. MUZUNGU OPUSA LIED. His own returning officer has confirmed that papers were served 5 hours before voting begun. When muzungu opusa realised that his plans were falling apart he wrote to the Chief justice requesting her to postpone the filling of papers by the PF candidate. At the time of writing the letter MO was the Vice president of the PF and not President or SG. Did M O meet the PF central committee to raise the issue of writing to the CJ, my guess is NO. Being white he thinks he is superior to other members of the PF central committee.

We’re able to create reasonably accurate pictures of the candidates complete with their vision, motives and goals because we have access to information.

    However, the vast majority of the electorate do not have this kind of access. All they have are national tv and radio programs that rarely paint true pictures of the political landscape. On voting day, they get in long lines to cast their powerful vote based on politics of the belly, not issues. And who can blame them?…

Some will vote based on tribe or which candidate made the most noise at rallies. Others will vote as result of being intimidated by panga carrying cadres. All because they lack knowledge.

    Despite the high levels of poverty in Zambia, many have access to mobile devices that can access web based applications.     I do not even know if Sata was in state to reason when he was handing over instruments of powers. That man was very sick at that time and these chaps ( Chikwanda etc might have manipulated and took advantage of the sick man.

    Me and my family are resolved not vote for a chakolwa or any one left with instruments of powers but to vote for some one who will convince us why he should go to state house. Now, Mr. Edgar Lungu says he will repeal the law on retirement at 65 yet he was a member of the same cabinet that crafted and approved that law. Mr Edgar Lungu has never publicly condemned the violence of the PF cadres, has not commented on the high cost of living PF has presided in Zambia’s recent history and Mr Lungu does not even want to talk about how the PF misled the whole country on the illness and subsequent death of Mr. Sata.       The answer is simple. They have seen how easy it is to cause confusion and steal Zambians wealth. They have even BORROWED another 8.2 Billion Dollars so they can steal EVEN MORE!

  35. I am posting my thoughts here for the first…Please welcome me as I intend to be here for long.

    I would like to urge all supporters of HH to, at least, do two jobs.

    1. Continue blogging on social media and explain the need to vote for HH and continue outlining as to why PF as a whole is ineptitude and that it does not need to be voted for agai.

    2. I bet that you have friend or relative in the shanty compound. This is where the problem is. Reach out to them too and make them understand that HH is the best candidate for the Presidency in Zambia. Bogging alone will really not help things. Come out of those offices or off your phones/ipads etc…God bless Zambia via HH

    MY OFFICIAL POSITION REGARDING THE VOTE OF NO CONFIDENCE BY CABINET IN Dr. GUY LINDSAY SCOTT.

    Goodmorning dear patriots, countrymen and women.

    As you all may have heard, by now, about a meeting that was held at cabinet office where cabinet passed a vote of no confidence in the leadership of Dr. Guy Scott as Acting President of Zambia; I want to say the following:

    1. I Totally agree with the decision by our cabinet to pass a vote of no confidence in Dr. Guy Lindsay Scott on the same grounds that were issued. I am 100% part of the decision and the endorsement of that decision by our gallant cabinet.

  41. Did you guys know that apart from a few isolated cases, voters have already decided where they will put their finger on polling day 20 January 2016? This is because the voters have always knows that UPND, PF and MMD are the parties to choose from. The voters even know which individual candidate they will choose once the legal wrangles in the affected parties are resolved. On the face of it, it boils down to RB, HH and EL, unless something dramatic takes place by close of nominations on Saturday 20 December 2014.
    – The isolated cases are too insignificant to make any significant impact on the outcome of the election.
    – Meanwhile the voters attend campaign rallies more for entertainment than choice.
    One cannot help but pity our hardworking politicians.

  43. if EL is popular he should have done away with Kabwe hand raising election and bring all Pf Presidential contender in one convetion and defeat them.Rather than using threats of contempt of court.When Sata was hearding Pf all party members of Pf were behind his candidature there were no division.

  45. Those who don’t like LUNGU must understand that liking LUNGU is not important.
    What is important, however, is that he is winning the 20 January, 2015 elections.
    After the elections he becomes that 6th Zambian president.
    Conclusion: LUNGU will be your president after Jan. 20th, 2015.
    You may say you hate to hear this – so what? You will be ruled by the one you hate, period.

  46. @43, Guy Scott doing a great job, you kidding? Scott is part of the current mess in PF and the country. He never raised a finger or blinked an eye when Sata and PF were abusing the POA etc and making jokes about the Constitution which they had promised us. You forget his silly answers in parliament whenever he was asked serious questions? You forget how that earned him the tag muzungu opusa by HH? The only reason he is acting like this is because he and his masters the cartel are disappointed at their miserable failure to install their preferred puppet candidates namely Kaseba and Sampa in that order. Scott is still hoping that Sampa can make it through the courts. That is what he meant in his shameful letter to the acting CJ. Is that what you mean by acting responsibly?

  47. Problem is EL is using unorthodox means to get his desired outcomes or getting undesirable outcomes through legitimate means; but does not accept others doing the same. This is the route cause of the mess in PF. We see unprecedented chaos synonymous with a kindergarten deprived of a caretaker. Grow up and stop this hyena style desperation for a chuck of meat.

    The other team is always getting confused and being left behind each time Wina pulls a surprise.

    For sure, how can you allow a person facing contempt charges to be accorded case hearing on other matters before clearing them of contempt charges.

    Of course, that means Lungu remains unchallenged until the contempt charges are cleared of Sampa (if he is not sent to jail) then the issues of hearing the application for inclusion in the consent can commence.

    This means that the consent issues may come even way after elections, or at least after Lungu has already filed his nomination. And such hearing will have failed to save its purpose as consent judgment may not work retrospectively.

  51. Thousands of comments before we come in who are the new comers? Before I forget Iam told to remind you to vote for change(hh). The mcc can sort the Lungu/Sampa thing. Kanshi Sampa was not declared pf prsido. What a waste of time.
    Another postponement on Tuesday can do better as to allow more time for all judges and interested parties to prepare adequately. 23/01/2015 can be the best date to rest the case.
    Sampa just allow EL to go ahead and decampaign him to lose. You are still young. More time. 2016 is very soon.

  52. Miles Sampa was elected through a contemptuous process. One from which other presidential aspirants such as Kambwili and Lubinda decided to walk away from during the process because they realized it was illegal. Lawyer Germano Kaulongombe, the Returning officer who conducted the second General Conference admitted that Miles Sampa was not declared as winner because the court injunction barring the holding of the General Conference was also served on him as Returning Officer. Sampa disregarded the court order now he is rushing to court to seek relief. He who seeks equity must do equity. Equity follows the law.
