THE Lusaka High Court Judge Mungeni Mulenga has adjourned the case in which Matero Member of Parliament Miles Sampa is requesting the Lusaka High Court to join him to the Consent Judgment
Judge Mulenga stated that she has criminal cases pending and would spend the whole day on Friday hearing the matters.
The court spent the morning hearing a preliminary application whether contempt case should be heard first before an application to hear Sampa’s application for him to join the Consent Judgment.
During the session Sampa’s Lawyers insisted that their client’s application be heard first before contempt case. Mr Sampa’s Lawyers Sebastian Zulu stated that Miles Sampa’s application for a joinder must be heard first notwithstanding the contempt charges before Court.
“The Supreme Court remitted this case back to this court to allow our client to be heard. The instructions from the higher court are that Mr. Sampa be heard. We should not assume that my client disobeyed the court order when they held a General Conference. That has to be established. This is not a normal situation. The nominations for presidential candidate is public knowledge and the court should take this matter in consideration.” Mr Said said
“We would wish that the contempt proceedings be heard first but the circumstances regarding our client are urgent”
And Eric Silwamba submitted that the application to stay proceedings had not been properly been dealt with. He insisted that the application before court was that of a joinder and the objection to the hearing was misplaced.
“Affidavits before court by Inonge Wina describe the plaintiffs as respondents meaning they recognise our client that he has joined to the case. By this description they desire that we be joined to the case.”
“It has been submitted with gusto that leave was granted to institute contempt proceedings but that requires that the court issue a motion in an appropriate fashion and served personally. Our Intending Intervenor, Miles Sampa and others, has not been served personally and he is not in contempt, ” he argued berfore adding: “He has to be found guilty first in order to purge the contempt.”
Joseph Jhalasi also submitted that the contemni is only obliged to purge the contempt only after he has been found guilty or he has been found in Contempt by the Court. He stated that his client was NOT in Contempt yet.
Makebi Zulu also submitted that the Court had only issued authority to hear contempt charges but such proceedings were not before the court.
He insisted that his clients were entitled to the right of innocence, saying this court granted leave to cite Miles Sampa, Daniel Munkombwe, Sylvia Masebo, and Anthony Kasolo for contempt of court.
In response to the submission made by Sampa’s lawyers, Lungu’s lawyers led by Sukwana Lukangaba submitted that:
“The Supreme Court didn’t give time frame as to when the proceedings must be heard. Miles Sampa was served with the charges. No arguable reason has been given to why the contempt charges should not be heard first”.
“We submit that there are contemnis in this court before any other application is heard”
It is law that contact charges be heard.
He stated that the High Court Injunction was served and all parties were aware of the Order as demonstrated by Germano Kaulongombe who confirmed that service of the Injunction was done.
He also submitted that Sampa and others were facing contempt charges and should exonerate themselves. He stated that the contemnis didn’t need to be found guilty before they could be considered that they were facing contempt of court.
“We made a typing error. This party has not been joined to. In order to effectively litigate on this matter the contempt charges ought to be heard”
“The issue of contempt is primary and is heard first. It will be anarchy and lead to chaos if the propasal to hear other matters is entertained”
Tresford Chali also submitted that a contemni is not only one that has not been served. A contemni is one who has been issued with contempt and not one who has been found guilty.
“By virtue that the Supreme Court has remitted the matter to this court doesn’t take away procedures and regulations. Also the notice for contempt can be raised orally”.
“We are submit that the principle of equity must be followed. The party should come to court with clean hands”

Our judicial system in Zambia is rotten. What time did that injunction given to EL restrain VP from going ahead a convention? and time was it served to Guy Scott? The judges handling this matter know that this Saturday that’s when PF presidential candidate is supposed to file in and have pushed Sampa’s case to 22nd December. If some miracles happened and Sampa wins, what will follow? Who was Lungu competing with at the convention and were any ballot boxes which is one of the prerequisites. No wonder General Kanene is still in prison because of quality of some of our judge without sufficient evidence, decided willing to jail the poor boy.

Miles Sampa must now obtain an injunction to stop the ECZ from holding nominations for PF until this legal process is settled. They need to go to another Judge and they need to start today so that they have time to take it to the Supreme court if need be. An injunction should be easier to obtain and ECZ will respect an injunction. I have no doubt that Lungu is more Popular in PF than Sampa, but Sampa followed a more sensible process than Lungu. Remember there was also an injunction against Lungu’s convention and I don’t know why Sampa’s lawyers are not raising that point. It is not about Judge Mulenga’s Pride and “admitting” to have made a mistake. if you consider this objectively, you will find that Sampa is trying to “circumvent” the issue of the “disobeyed injunction”.
Sampa and the convenors of the 2nd Conference had the opportunity to be heard and argue against the injunction through Bridget Atanga on the 2nd Dec as set by the Courts (when it issued the injunction). This is standard in ex -parte injunctions. But Bridget didnt turn up and therefore “confirmed by default” that the 2nd Conference had no objections against the injunction, Hence Lungu went ahead to close of the case with the consent order.
And as a Judge she is aware of this and hence avoiding the manueovres (Im guessing here) by Sampa team.

Sad! How can case be adjourned when nominations are this Saturday. Judge is clearly on Lungu’s side? The criminal cases am sure could have been adjourned. I don’t support Sampa or PF but this is blatant injustice!

Justice delayed is Justice denied! This is a miscarriage of justice.Firstly I thought this judge recused herself from handling the case because she is related to Lungu. Our judicial system is rotten.I don’t support Miles Sampa but I think he should have lost fair and square.
This High court Judge is clearly trying to delay the process so as to deny Miles Sampa based on a technicality. I believe there is still time to settle this issue. Sampa should get an injunction against ECZ (not against Lungu) to stop them from holding nominations for a PF candidate until this process comes to its logical conclusion. I think that would be the fair thing to do for everybody. Lungu’s lawyers must not delay the process because they will only hurt their candidate as he is losing time everyday they spend in court and not on the campaign trail. Its amazing how cheap politics seems to cloud our minds as Zambians. We should be seriously concerned that the judiciary in the country seems compromised and plays to the political powers in office. Whether MS has a case or not is irrelevant at this moment, the most important part is that the judiciary should carry out their work with diligence and be impartial to anyone. Nominations have been clearly stated to end on the 20th of December, the judge should have understood that this matter needed to be decided upon immediately so that come Saturday there is clarity as to what is the position for the PF nomination. However as usual we have a judge playing politics. It is dangerous and as Zambians we must demand and independent judiciary not this circus.

Can I remind you; that is why Judge Chali refused to hear him, because he wanted to deal with his case urgently as he stated. He went to Supreme Court. The Judiciary is not for quick relief. It were better he had not taken part in a Contemptous convention like, Kambwili, Lubinda did.

@Tekton, I believe PF brought this on themselves. Their foolery, greediness, confusion and sense of entitlement should not be spilled over to our court systems. If I were the judge, I would adjourn this to next year, well after the elections and it would be within my rights. As a matter of fact, PF can withdraw all the court cases, chose a new presidential aspirant on their own and let the courts deal with other cases and save us all from this unnecesary drama!

Surely the court is aware that filling day for the PF nomination is Saturday 20/12/2015 what was the point of the adjournment any hearing or ruling past Friday 19/12/2014 will be merely academic and still does not resolve the legitimacy issues of either PF candidate. I would have thought being professional would have meant no sleeping for the lawyers and judges until all matters/cases to resolve the legitimacy of the PF candidates are resolved in time for Saturday! Where is the passion in our jobs to do what’s right or be seen do what’s right or even be seen to want to do what’s right!

Personally, I am very proud of our Judiciary. They have had some very unprincipled Politicians trying to assert their perceived Righteousness to lead. In a Democracy the Will of the Majority confers that Righteousness.
This case is unsettling because of the very obvious wrongfulness of Sampa, GBM, Phangula. Every ordinary citizen can judge for themselves, one need not have studied Law to see what is a matter of Morality.

I wish the UPND was not a regional party, a Bantustan party, it’s victory would have been assured in this election. But equally, it won’t be easy for them because they have done nothing to extend the influence and appeal of their political party beyond the borders of their Bantustan. They are now trying frantically to recruit a few personalities here and there to give them the appearance of a national character. Such desperate moves often don’t work. Instead of addressing the challenges of their regional character, they became defensive. If they had positively taken the criticism of their party having a regional character and taken positive measures to address it, this election would be a walkover for them.
Moral of this story/PF fracas is that if you or your family gets offended/robbed/defiled/raped etc dont go to OUR COURTS. Settle the dispute outside court with some payment to of some kind. It was possible for EL to win the case even without involving his relative judge & all these legal gyminastics. The way our judiciary has behaved has been very damaging. On the political side the moral of this fracas is that vote for a party that exhibits discipline & democracy from start even before the get into power. We knew that Sata dictated everything in PF even b4 he got into power but we ignored. In this regard although UPND looks attractive & MAY win the bye-election they need to work on the tribal tag suffice to say PF is tribal as well. Just giving a piece of my mind!

You dunderheads with kilometre-long noses, read the real message from the courts including the Supreme Court of Zambia. The wise Mafumu are telling you that politicians should settle political matters within their parties. These are not matters for the courts at all.
1. The Mafumu are confused and cannot rule either way because there is no right or wrong side in these political matters.
2. If the Mafumu had to judge correctly they need time to study and scrutinise both sides of the arguments – some three to six weeks to come up with a reasoned judgment.
3. You are the same long-nosed litigants who were not happy when Judge Mungeni Mulenga ruled in favour of Lungu, what if it was the other way, the Judge would still be in the same position of being criticised by the other party.
1. And why should Judge Mungeni give priority to these shameless long-nosed politicians at the expense of those facing criminal charges and are spending nights in filthy cells while politicians are sleeping comfortably in their five star bedrooms?

He must be very happy now that SAMPA must answer Contempt (criminal) charges first before pursuing Consent Judgment (civil) case.
This has made Guy Scott very proud, as he will have the law take its course.
At the same time LUNGU is happy with the turn of events, as he is now going to file his nomination.
Conclusion: Both Guy Scott and LUNGU are extremely happy as both their objectives have been met.
Mark the following points and honestly analyse them:
1. EL has gone through a difficult period and has pulled
through. He has been tried in fire;

this crucible because Tongas made it very clear that

This judge should no longer be trying a case that involves someone she admitted is her relative. At this stage, this should have been referred to another judge and expedited in view of the nomination day coming up.
As far as I am concerned, the ‘dealings’ of the judiciary during PF rule, have not inspired any confidence in whether Zambia has an independent judiciary.
Finally, Lungu’s adoption will forever be tainted with this circus and disregard of natural justice and the rule of law.
Sampa may not be my favorite contestant but he has been played bad. Not fair.
