The Lusaka High Court last night granted an injunction to MMD National Secretary Muhabi Lungu and Deputy National Secretary Chembe Nyangu restraining party President Nevers Mumba from expelling them.

Lusaka High Court Judge In-charge Isaac Chali has also restrained the newly appointed National Secretary Mwansa Mbulakulima and his deputy Winnie Zaloumis from performing their duties until the matter is heard inter-parte this morning.

The injunction also restrains the Electoral Commission of Zambia (ECZ) from receiving nomination papers from MMD President Nevers Mumba until the party’s National Executive Committee ratifies the candidature.

And MMD National Secretary Muhabi Lungu has written to the ECZ to have the MMD file the nomination on Tuesday after the NEC meeting to be held on Monday.

Yesterday, Mr Nyangu has described Dr Mumba’s action as illegal because the party president has no power to expel anyone from the party and that only the national executive committee (NEC) has the capacity to do so.

Reacting to the expulsion, Mr Nyangu accused Dr Mumba of destroying the MMD and treating it like a ‘Kantemba’.

If Dr Mumba wanted to make money using the MMD, Mr Nynangu said he should just go ahead without victimising others.

He said the MMD was a democratic party but was being destroyed by Dr Mumba who was treating the party as his own.

The MMD NEC had discovered that Dr Mumba was not sellable and would lose the forthcoming presidential election, hence the move to bring in Mr Banda.

Mr Nyangu said the MMD was run constitutionally. Political parties should be allowed to choose leaders and courts should not be allowed to impose leaders on political parties.

“Dr Mumba will not get support from any one. If you impose a leader, Nevers Mumba will be the last in this coming election. We are all moving away and will leave the MMD for him,” he said.

  1. Just move guys, whats the problem, Muhabi, what are you fighting so hard for? cant really understand. If he doesn’t win the elections, will he be the first MMD candidate to loose, RB lost badly but you want him back. You are also saving your own interest. You and others, you want your own that will give you big posts. You think we don’t know what the fight is about. Just go and join HH, stop running around pls!

  2. This High court is also serving some political agendas, they keep on making all these injunctions against MMD, they are playing a game also. Where you not embarrassed by the Supreme court judgement yestarday!

    • RB has not endorsed anyone and he may not do so for obvious reasons. He enjoys a very cordial relationship with both EL and HH but he is a living witness that HH has signed a deal with arms dealers and Marikana mining massacre owners. HH’s Presidential bid has blood money on it.

  4. Mr Nyangu dont dull you guys voted Nevers now that Banda is flashing some money you want to turn against a voted President even Banda will be number last we whole know but because you want to eat his money you lying to him

  5. “It is not true to suggest that people have decided to kick out Dr Mumba. We want to be able to fix the national secretariate so that we can create a vehicle by which it can sale the president properly and reorganize the party as we have been having difficulties with that according to the party”. Mr Lungu explained.

  6. Nevers Mumba will NEVER be President of Zambia. Never!!!!. This arrogant little fellow should look for another job. As a former man of God, he lied before God telling Zambians that being President is a demotion, he would rather be a Preacher. He never apologized to his followers after abandoning the ship!

  7. Un argueably point Muhabi Lungu raises. MMD is a party with solid principles that have been misunderstood, misapplied, violated and contaminated with personal egoistic biasness. If rennaiscence is to take place in MMD, the beginning is to be done through RB. Not that he is the best out of all the others, but because he would represent CHANGE IN THE OFFING for MMD.

  9. Under the MMD constitution, only the NEC can decide who the party presidential candidate is. Not the courts and not the party President. The party president is not automatically the Presidential candidate.

  10. This Mumba has a habit of scoring own goals. Why could he not wait until after filing in his nomination to fire Muhabi. Also, how can he not know the provisions of his party’s constitution? On what grounds did the supreme court nullify Banda’s nomination? What that not agreed upon by the NEC?

  11. Prophet TB Joshua prophesied that one Political Party will fail to fill in Nomination papers in Southern Africa. Could this be the fulfillment? Lets wait and see.

  12. At this point, the South African business cartel has almost got its way. HH is well ahead and whatever is happening in PF and MMD is academic. The guys who agreed to put the spanners in the works are guaranteed to be paid at least 75% of the agreed sums. RB is not bothered and ML is just playing devil’s advocate. It’s game over, unless the PF camp pull out a rabbit out of their bag. It is a very sad spell in the history of our democracy, although this goes back to the One-Party state. We have seen FTJ mess up MMD, then Mwanawasa bring in his cartel and relatives, RB deface and abuse his role, and then PF get hijacked by political prostitutes. Things seem to be falling apart for a country with so much promise. Fifty years and still immature!

  13. ITS TRUE COURTS SHOULD NOT SUPPORT CANDIDATES WHO ARE NOT POPULAR THRU THE COURT PROCESS OTHERWISE IT SHOWS IN THE END HOW IT BECOMES A BURDEN

    LET THE CONSTITUTIONAL DEMOCRACY OF THOSE WHO ASCRIBE TO PARTICULAR RULES GOVERN THEMSELVES AND ONLY LIGITIMATE INJUNCTION

    ITS LIKE TURNING THE COURTS OF LAW INTO A PLAY GROUND EVEN IF I LOOSE EVEN WHEN I KNOW SINCERELY CANNOT WIN INSTEAD OF EXERCISING HUMILITY AS A SIGN OF DEMOCRACY I HEAD TO THE COURTS OF LAW ITS TIME LAWYERS REEXCUSED THEMSELVES FROM THIS MOCKERY OF THEIR PROFESSION

    DEMOCRACY IS RULE OF PEOPLE ACCORDING TO THE PEOPLE AS INSCRIBED

    ELDERS SHOULD ALSO GO FOR CIVICS REFRESHER NOW ITS LIKE FORGOTEN

  14. The real MMD should reform and re-brand. The movement is over, leave Nevers with his empty shell to do as he pleases. Form another party and target 2016 elections.

  15. Dr Nevers Mumba is not magnanimous in character for what it takes to be leader and lead a party. He pledged no vindictiveness and victimisation over party squabbles. Lo and behold, as soon as he finished saying it, he went ahead to do the very opposite of his own words.
    That betrays his confidence and trust to people he purport to lead and fails the mark of leadership character.

  16. Some people dont learn. Muhabi is traitor and liability to the party mmd. The chap has not brought any improvement to the former ruling party. Even kachingwe did far much better. Nevers Mumba is on the right truck trying hard to reform this old horse called mmd but many of its leaders are rigid selfish and indiscplined. Failure to recognise your own president is foolishness especially during elections. Infact MMD should flash all those supporting other candidates and ensure that they are dealt with in 2016 by elections by the lower organs of the party. Flash them out so that new people come in.
