Barotse National Freedom Alliance reminds President Lungu to honor the Barotse Agreement

ACTUALIZATION OF BAROTSELAND STATEHOOD

Accept our compliments of the season and congratulations on your assumption of office of President of Zambia following the 20th January 2015 Presidential elections. We write to you regarding the above subject and welcome you to the reality of assuming the Presidency of a failed unitary state of Zambia.

We trust and hope that you will not run away from this reality as did your predecessors but engage us in the transition process of actualizing Barotseland statehood in a pacific manner.We have a rich understanding of what constitutes the Republic of Zambia—going back to the amalgamation of the territories of North-Eastern Rhodesia and Barotseland-North-western Rhodesia in 1911 to create the Protectorate of Northern Rhodesia, the forerunner jurisdiction to the Republic of Zambia. This was based on several treaties, the last of which was the Barotseland Agreement 1964 which facilitated for Northern Rhodesia to proceed to independence as one country and one nation, as opposed to dissolution into its former constituent territories as a consequence of the termination of the unifying colonial treaties.

To verify the foregoing assertion, we invite Your Excellency to carefully read, in sequential order, the following provisions of the constitutive statutes of the Republic of Zambia:-

  1. The preamble to the Barotseland Agreement 1964 as well as its clause 1;
  2. Section 1 and 8 of the Zambia Independence Act; and
  3. Section 20 of the Zambia Independence Order.

The road to independence in 1964 and the role Barotseland played in that process is well known and well documented, even though the first President, Dr. Kenneth David Kaunda tried to make it his entire life project to suppress it from the Zambian people and prevailed on his successors to continue oppressing the people of Barotseland.Since independence, the people of Barotseland have watched with great dismay how successive Zambian regimes violated the Barotseland Agreement 1964; the very fabric of the basis of the unitary
state of Zambia thereby leading to its unilateral repudiation in 1969, and, thereafter, continued violations of the human rights of the peoples of Barotseland.

It has always been the desire and expectation of the people of Barotseland to have that Agreement, embodying their human and minority rights, respected by the people of Zambia and successive Zambian regimes but such expectation has proven to be in vain.

It was against that background that the peoples of Barotseland, through the March 2012 Barotse National Council (BNC), resolved to accept the repudiation of the Barotseland Agreement 1964 and,thereby, set in motion the process of separating the territories of Barotseland and the rest of Zambia.

We do not understand why the rest of Zambian people, Zambian politicians, Zambian government, and Dr. Kenneth Kaunda and his successors fail to understand that without the Barotseland Agreement 1964, there is no unitary state called Zambia. As it were, the Barotseland Agreement 1964 is no more.Barotseland has since taken steps to engage the leaders of Zambia with a view to working out transitional arrangements towards self-determination and self-rule for Barotseland, but the Zambian regime has responded with more human rights abuses against the peoples of Barotseland while running away from international arbitration.

Additional steps taken include:

  • ? Formation of the Barotse National Freedom Alliance (BNFA), an umbrella Organization which brings together all serious activist groups and individuals at home and abroad for a common purpose;
  • ? Petitioned the African Commission for Human and Peoples’ Rights (ACHPR) in Banjul, The Gambia, the Commission determined to be seized by the petition, which is currently on
    admissibility stage. Suffice to mention that the Zambian government has failed to submit counter evidence in support of its intransigence over the issue;
  • ? Joined membership of the Unrepresented Nations and Peoples Organization (UNPO);
  • ? Challenged the Zambian government through our international Lawyers to sign a submission Agreement to allow for the implications of the Zambian government’s unilateral abrogation of the Barotseland Agreement 1964 and Barotseland’s acceptance thereof and declaration of statehood to be determined by the Permanent Court of Arbitration (PCA) in The Hague.

Needless to say that while we collected more than 10,000 signatures from Barotse nationals in support of the PCA process, the Zambian regime under the immediate past and late President Michael Chilufya Sata chickened-out by refusing to append its signature, which was in essence an admission of guilty.It is in view of the foregoing that we feel this time round, we have to get going on day-one of your assuming office as regards matters that the people of Barotseland dearly and strongly look up to.

Specifically, we challenge you:

  1. To immediately engage the people of Barotseland and Barotse Civil Society Organizations with the sole purpose of working out the transitional arrangements towards self-determination and self-rule for Barotseland;
  2. To append your signature to the Permanent Court of Arbitration submission Agreement process to allow the International Court of Arbitration to rule on the unilateral abrogation of the Barotseland Agreement 1964 by the Zambian government in 1969 and the declaration of self determination and self-rule by Barotseland following its acceptance thereof through the Barotse National Council resolutions of March 27, 2012. In this regard, our Lawyers will soon be mailing to you the facilitating documentation to enable Your Excellence append your signature to the submission Agreement;
  3. Not to interfere in the governance and administration of the nation of Barotseland as well as in the re-organization and modernization of Barotseland governance institutions;
  4. To recognize the human rights of the peoples of Barotseland to self-determination and self-rule;
  5. To make a public affirmation that it is not treason to advocate for an independent state of Barotseland;
  6. Release and free all Barotseland nationals sentenced or incarcerated in Zambia jails for offences related to Barotseland statehood;
  7. To release and cause publication of the Chongwe Commission of Inquiry report on the genocide committed by the government of Zambia on 14th January 2011, including the minority report;
  8. Inform us on the whereabouts of the missing persons on the fateful day of 14th January 2011;
  9. Allow for freedom of assembly, association and organization in Barotseland;

We trust that among your first tasks as President will be to address the foregoing matters and eagerly await your reaction to this communication.

All politicians take credit for trying to keep the country together and will always not allow the country to be devided. Losing any or even a small area of the country becomes a crisis and people can lose confidence in a leader who accepts division. The people of barotseland could be that they are iliterate and needs some education to help them follow whats going on around the world. Time has gone when people used to draw borders and to draw new ones now can not be good for all. HH himself will also find it a problem despite trying to get rid of policies by the PF gorvernment will are percieved to be very unfortunate.

People have spoken, the last elections has left the country divided and let the issue of regional support be settled in a democratic way .     If they want to have their own nation, they should pack up and get out of Zambia. Be like Christopher Columbus; explore and “discover” another country.

    • The 1889 Orders in Council enacted for the two territories namely –
      1. North Western Rhodesia Order in Council and
      2. North Eastern Rhodesia Order in Council.
      The 1911 Northern Rhodesia Order in Council merged the two territories became one political unit under the name of Northern Rhodesia.
      The 1911 Order in Council divided the Country into two parts, viz; land within Barotseland and other land. In Barotseland the Litunga had authority in tribal matters.
      On 18th May 1964, an agreement known as the Barotseland Agreement 1964, was entered into between the Government of the Republic of Zambia and the Litunga of Barotseland allowing for the birth of Zambia on 24th October, 1964.

  4. Western Province constitutes other tribes as well such as the Nkoya, Mbunda etc who do not agree with BRE idea and they have said let them have only Mongu only. So how are you going to do it. Infact the territoriy included parts of Southern, Copperbelt and North Western. Really is it practical. I think it has been over taken by events. If they had implemented it then, it would have made some sence not in this era where the way everyone is going is democracy. The Monarchy has been done away with

    • I am of Nkoya, Toka, Kwanga and Luyi descent. I consider myself very much Lozi. Many of aluyi people of Western province who
      migrated from Western Congo are of mixed parentage, when the Luyis settled in Barotse they intermarried across tribes. Lozi is just a lingua franca which is a mix of luyana and kololo. In luyana fine is, “Bwino”

      The agreement has nothing to do with being a Lozi it is a legal document which needs to be addressed so.

      I was not raised in Western Province and not married from there either, but that does not take away my rights or that of my spouse and children who are half Lozis, those who say so merwant to
      instil fear and division. Late Nkomeshya spokesman of the Nkoya people spoke fluent Lozi.

      Best to view the BA64 in its legality not as a tribal doc.

  7. The unitary failed state. Surely Zambia is a failed state. Believe me brothers and sisters mere talking will not help on this matter. we need a solution to this and many other problems such as tribalism that is being poured on our tribes whenever we try to exercise our democratic rights.
    Zambia is a divided country and nothing will work for us as long as they continue to marginalise our existence. when the accepted way of doing things does not make sense, then something has to be done.
    The barotse issue should not just sleep. its time to rise to the challenge and confront each other head on.

I know that some of us are failing to read between the lines and instead taking this matter very lightly. If you notice how we voted, you will agree that the voting was not issue-based but tribal-based and every serious Zambian must get concerned. I am actually from Muchinga Province but I am not very pleased with the way things turned out after the elections. Zambia seems to be more divided than ever before and Edgar Lungu and his administration must address this matter very seriously and expeditiously. If they decide to ignore, it will be at their own peril. We need to unite. Right now there’s too much tension in the country. PF must tame its cadres else the country will erupt.

  10. A very complicated matter when you consider that the whole of southern and north-western provinces are part of Barotseland as well. Worse if support to cessation is joined by the two provinces who I am sure feel cheated by the last election and a growing resentment for not having one of their own leading in fifty years of independence.

For example, since when did Zambia become a failed state? In any case, Lungu as President of the Republic of Zambia has no power to honor your request to secede without violating his oath of office, or indeed, the republican constitution. Remember that he swore to preside over Zambia which is a unitary state, not a failed unitary state as you put it. Therefore, the only president who can help you is one who has not taken the oath of office. But does a president who has not been sworn exist? I am afraid not, so your matter will only remain a campaign promise.

  18. I have always said that just appointing of individuals to positions is not enough to solve some of the problems. The big problem is that some people think that certain sections of society have been marginalised in running the affairs of the country. This is what we need to address and find how inclusive every one will feel they are participating in the running of the affair of the country.

    I believe these people have been hit to the bottom of their hurts. They have been very consistence. Just to brush aside the concerns and label them tribe is very dangerous.

    Look at North Western province with all the copper mines and see how they voted. They are now aligning themselves to other groups and this group is growing. Ignore this at your peril

What is democracy if after these so called election 40% of the population is left with ill feelings against their own brothers that they are dominating the running of the affairs of the country.     Look at some of the rebellion or reactions in these province and this should tell you that the current governance system may not be good:

    (1) Mushala rebellion in North Western Prov
    (2) The Barotse issue in Western prov

The government is broke, we will see how you will fight each other, hope you don’t start eating each other.   31. In support of Salamat @ 3.1 .Am abit lost,what I learnt in History of Zambia at the University , I learnt that the Barotse Agreement which was tabled and signed in England in presence of Dr. Kaunda, king Lewanika Sir Mwanawina 3rd and a British Minister of Colonies.
    In the fore said Dr. Kaunda is alive, the Lozi Royal Establishment is alive, why cant we get to the bottom of this. I want to correct what I learnt if its wrong after 50 years.So we can focus on real issues . I thank you all.

  32. when it is time it is really indeed time and no one can say no.
    First and formost,zambia is a large nation holding holistic groups and tribes of people but the question is,is there equality in the way of governance ?or it is one zambia one tribe plus the other tribe??no one is perfect even though you blame lozis and tongas to be tribalists..
    no fairness at all.Hence its good for them to govern themselves in balozi land kuna..
    period…..
