Join politics, Ronnie tells vocal NGOs

GOVERNMENT has challenged civil society organisations, which yesterday resolved to honk against the acquittal of former president Fredrick Chiluba every Friday, to come out in the open and form a political party.

Chief Government Spokesperson Ronnie Shikapwasha said the civil society organisations, which also demanded the resignation of Vice-President George Kunda and Director of Public Prosecutions (DPP) Chalwe Mchenga had lost direction.

And Dr Chiluba said the objectives of the organisations were to use his name in an attempt to bring down a legitimate government.

Yesterday 17 civil society organisations urged citizens to honk and wear black clothes every Friday to express their displeasure over the Government’s position not to appeal against the acquittal of Dr Chiluba.

Speaking during a Press briefing in Lusaka yesterday, spokesperson for the 17 civil society organisations and Caritas Zambia executive director Sam Mulafulafu said the organisations were further calling for the resignation of Mr Kunda and Mr Mchenga claiming they had failed the nation.

But Lieutenant General Shikapwasha said the civil society should instead form a political party so that they could squarely be met in the political arena.

He said by honking and holding campaigns, they were in a way agitating for anarchy in the nation and that the Government would not allow such.

“It is sad that even respected NGOs have lost direction and have joined in this dirty campaign over Dr Chiluba . The best they should do is form a political party so that we can meet in a political arena,” Gen Shikapwasha said.

He said if the civil society grouping had an issue against Dr Chiluba, they should seek legal redress than resorting to demonstrations and anarchy.

Gen Shikapwasha however warned that the Government would not sit idle and watch the civil society disturb the country’s peace.

In an interview, Dr Chiluba’s spokesperson Emmanuel Mwamba, said the Government should be wary of the NGOs, which were using Dr Chiluba’s name to fight President Banda’s Government.

Dr Chiluba said as far as he was concerned, the acquittal meant that he was cleared of all criminal cases and that his immunity would be automatically restored.

“We are aware that this plot by the NGOs is a disguise of a plot against President Banda’s Government and are just using Dr Chiluba’s case to achieve their hidden agenda,” Mr Mwamba said.

Mr Mwamba said following the acquittal, the immunity was automatically restored and those with issues against the former president should seek parliamentary intervention to lift Dr Chiluba’s immunity.

Currently, he said, there was no criminal case against Dr Chiluba as the case in London was a civil matter.

“It’s saddening that the NGOs which are supposed to be protecting human rights are in the forefront abusing the laws,” Mr Mwamba said.

Among the civil society groups were the Transparency International Zambia (TIZ), Non Governmental Organisations Coordinating Council (NGOCC), Women for Change (WfC), Foundation for Democratic Process (FODEP), Jesuit Centre for Theological Reflection (JCTR), Young Leaders Integrity Alliance (YLIA), Zambia Council for Social Development (ZCSD), Citizens Forum (CF), Zambia Civic Education Association (ZCEA), and Anti-Voter Apathy Project (AVAP).

“We call upon all Zambians who love this country and are worried about corruption to wear black and honk or whistle every Friday at 17:00 hours for 10 minutes. We call upon all ministers and senior Government officials who hate corruption to join in this campaign,” Mr Mulafulafu said.

FTJ was taken to the London court over corruption by the late LPM who died after a reoccurrent brain stroke, He was found guilty by the late Judge Smith who died of a heart attack, the case was being registered in the Zambian courts by the late judge Japhet Banda who died in a road accident at the time of these events the Chief of Police who was a member of the Task Force by virtue of his office was Wazakaza Nguni, he died in a road accident. It is not clear which judge is currently handling the matter if any. President Chiluba is a former President and an evangelist, he has repeatedly pronounced that he is a prophet standing on solid rock and that whoever fights his Godly ways shall be crushed. It is yet to be known whether his prophecies are true or are yet to occur.

Parliament was pressured to remove Kafupi’s immunity by the NGOs and of course 70 percent of the MPs bowed to pressure. The late president Levy Mwanawasa raised 69 preliminary issues that where to be used as a basis to prosecute Chiluba. Do you know what happened later? All of them where were declared “nolle prosequi”. That in itself was extremely embarrassing to the late and the worst part of it was that the man was extremely under pressure from several quarters; notable amongst them THE POST (From Chiluba is a thief case). The man had no choice but to create another case to save his face.

When you take a case before the courts, you don’t do so with a fixiated mind that unless the verdict is against my enemy then only has the due process of the law been exercised.Chiluba had his immunity stripped irregulary and subjected to dehumanizing judicial process for eight years yet nothing substantiative has been found but hate groups and anarchists gaining through heft legal fees trickle down arrangements.Does it have to take US $ 5 billion and 20 years to settle a court case in a functional society?   17. Tell me something guys, why haven’t the press taken over to find more evidence of Chiluba’s misappropriation of funds. Our press is a let down also. Baroness Scotland’s case is an example. She defended her case of employing her cleaner without a valid Visa by saying she forgot to photocopy the passport. The press has helped by recording a live interview with the worker involved, and the witness says she never checked her passport.

    I guess these Civil Societies will register to become a party and would win the election like the MMD was just a movement, but, they would become the same if not checked. Its the same Government that is associating with Chiluba and when his acquittal is criticised, you say we are trying to get back at RB. Our peace should not be taken for granted. I thought police are there to keep vigil on demonstrations and whoever, becomes violent, police are there to keep law and order. As government you can only gain popularity by acting right. However, this to me is a created reality that has no bearing whatsoever to the well being of the majority of the Zambians. The dual process of the law does not mean abusing the judiciary.Taking any immaterial case before the courts which has recorded 98.5% some Nolle prosequi on almost all its submissions is lacking a sense of responsibility.This cannot be the case of just appeasing hate groups or deliberate incovinience of the accused when offices of the Solicitor General, Attorney General and Public prosecutor General are staffed and functional in a successful model democratic society.Mwanawasa closed all cases against Katumbi over Chiluba and lost 98.5% hence spamming silent nolles and persuade FJT for an out of court compromise which wisely the accused refused because he realized that the accuser used emotions than legal facts to abuse him in the court of public opinion.

    Why can’t NGOs in Zambia be able to criticise the government without being labelled “anarchists”. If everyone else can speak out, why should an NGO keep silent? It does not disqualify it’s non-governmental status by defying the injustice of the country it serves.
    Whatever happened to the concepts of “protest” and “demonstration” , which have always been a part of Democracy ever since? They only seems to exists in the scheduling of weak vs weak, strong vs strong, but how do the weak stand against the strong in a democratic state?

    Your confusion is out of failed ability to synthesize simple yet clear legal procedures.The failed Lusaka cases were all criminal while the Smith ones as dependent variable to the criminal ones was a civil case. When the criminal case which is independent variable fails, the dependendent civil case has no grounds for registration in our courts.Again, its would be abuse of the justice system to register it regardless of the barkings in the street.Justice is not delivered from the streets but judicial institutions in a successful democracy.The streets deliver anarchy and failure.
