FTJ to lose house in Corruption case

chiluba23.jpgFormer President Frederick Chiluba must surrender his house to the government as partial payment on the $58 million he was ordered to pay in a corruption case, the attorney general said on Monday.

British Judge Peter Smith issued the forfeiture order on Monday during a hearing to determine how Chiluba would pay the money that a British court ruled he stole while in power from 1991 to 2001, Attorney General Mumba Malila told state media.

“(The court has ordered) that the former president gives up possession of (his house) together with all chattels purchased on 14th December 2001 in the sum of $297,580,” Malila said.

Judge Smith raised the amount that the ailing former Zambian leader must pay last week from $41 million, the original sum set when the verdict was handed down earlier this year, to account for interest and legal costs.

Zambia had brought the civil case against Chiluba in Britain in the hope of recovering properties allegedly purchased with stolen funds in Britain and other European nations. A separate case in Zambia has yet to go to trial.

The charges against Chiluba stem from an anti-corruption campaign launched by his successor, President Levy Mwanawasa. Chiluba has said he is the victim of a political witchhunt and can never get a fair trial in Zambia.

He has also said that he does not recognise the authority of the British court and would block the registration of its ruling in Zambia

These made most of us proud for shall be taken to UK to answer charges against national plunder.The house so cheap that every Zambian who had practiced corruption at that time could buy more than one house.

    Cobra is in a serious fix unless he survives his cover in Oasis forum which i doubt 99%. Soon we should not be surprised to see internal rivalry pushing for democratization in PF held at Gun point by Sata for 6 years without internal elections.

  25. As a Zambian living outside the country, I am baffled with the way this case has been handled. Even though Chiluba is a thief, he needs to be given a fair hearing. This is what democracy and human rights mean. If Chiluba is given a fair trial he might tell the public information which can provide a clue of how public funds were stolen. He might implicate the entire political system currently operating in Zambia. We have several checks and balances to avoid theft. If Chiluba stole, then what hapenned to the Minister of Finance, Auditor General, etc. We need him to have a fair trial so that we can understand this spider web and how funds were stolen.

The bottom line is nobody has heard the side of Chiluba and how can we be proud that justice has been done. It’s like Zambia beating a Brazillian Team 10 -0 that features men over 80 years old and running around screeaming we are a great team we beat the world champions. How foolish! This judgement is hollow and the jury is still out as to whether Chiluba really did steal from the Zambians. We need to hear his side and the guy has not been given a chance.

    There are more people involved in this racket. The money to buy those 150 vehicles to make LPM come into power ..do you think it grew on trees. All those brown envelopes to bribe voters that voted LPM..where did that money come from. Handing title deeds at a rally to introduce LPM ..where did all those resources come from.

    It is unfortunate that some make contributions on FTJ out of hate. FTJ certainly made mistakes both big and small, just as much as LPM and KK or indeed any other leader. But to treat him like this just for political expedience is out of the ordinary. But of course he can be made to answer for his wrongs by way of letting the judicial process take its course. Unfortunately what we are seeing falls far short of the expected standards of justice. LPM needs to introspect, is he being humane to his predecessor?   49. Guys, Zambia has not yet heard the truth. All we have heard is one and all the ‘judgement’ is based on this side. When the defency begins then we will hear what the truth is. For me I will not sink so low to hit the man for what still appears to be mere allegations. I will only do so from an informed position. So far all we have heard are voices of his foes concerning this judgement. Suppose it turns out that infact the $41m include MMD vehicles, LPM’s election campaign envelopes, etc is the attorney general going to ammend his claim to include MMD, LPM and other beneficiaries of Zamtrop likes of VJ etc. If so then FTJ will have it easy to pay back as he will simply collect from these pipo. Then for what he spent on peace in DRC and Angola, he can appeal to the now peaceful countries to come and help pay back. Then for what he spent on his family, they can subtract from his pension. Thereafter create another task force on LPM, then KK. We need all the money back. No immunity for anyone

  55. Problem with the amount ‘stolen’ is that its keeps changing all the time. It appears the court/persecutors dont know how much they are looking for. Pipo you mean FTJ can finish spending $41m in a few years. It it was really stolen which bank the money banked in. They are not saying. FTJ given a chance or is chances-of course not in a foreign court. FTJ has been willing to defend himself in Zambian courts just as in other cases. Look for the money to go to Zamtrop it came from Zambia in the first place. All they could have done was to get evidence from London and elsewhere in Europe if any, then present it in Zambian courts. Zamtrop was held at a branch of ZANACO not a British or any other bank. Govt’s reason was that there is a ‘reciprocal’ arrangement between ‘ZED’ and UK, it this is true then a judgement obtained in Zambia can be registered in the UK court for enforcement on properties their, including those of other UK based defendants. Why would Britain refuse ‘Zedian’ courts trying UK citezens (including firms) by ‘Zedian’ courts yet it accepts to try Zedians? Sheer Nonsense! Viva Zambia!!!!

So that passed judgement based on the prosecution’s side. In fact as we talk Bulaya’s case has gone to the higher court. The conviction has been inconsequential. BA Pundit, I concur with you if you now suggest that the reason to take the case to UK is because of the incompetence of the local courts. This is what is in dispute and will have to be proved in unfortunately the ‘incompetent’ court you have refered to. Personally I do not subcribe to such thinking about our courts as it amounts to an inferiority complex.

    LPM hasn’t indicated how much it will cost us to recover what has been misappropriated & whether on a financial basis this would have been in the interest of the nation that is struggling to shore its economy & provide essential services to its desparate population.   109. The London Judgement has been registered in the High Court of Zambia by the AG. This is according to the latest reports from ZNBC. By implication of this, the provisions of the judgement will take effect against ka fupi. I hope they don’t include ba Regina Mwanza as part of the assets to be seized since as we all know, she was acquired on a public platform using public funds and state transport. At least let them spare his major source of comfort after Bashikulu ba Kobra dumped him.

No amount of political engineering is gonna get Fred out of this one!!Amazingly the AG has moved swiftly and we now get to watch poor Fred squirm!!Maybe now he will be encouraged to unravel the matrix for us,if only to save himself!!I’m sure we would welcome FTJ as a State Witness!!Many would agree, without the involvement of Smith & Co we would be nowhere near a conclusion of this saga.LPM did offer amnesty and he was never taken seriously…..now the long arm of the law will visit these criminals.Next step is to give more power to the Auditor General and the Public Accounts Committees.If this is done we can look forward to discussing the rampant misuse of public funds as well as commenting on how severe the punishments meted out should be.I don’t always agree with LPM and the current MMD, but they have handled the FTJ theft case rather well.

  116. Zambia scouts for $550,000
    The Zambian government needs $550,000 to carry out a nation-wide measles campaign this year, targeting 200 million children.
    Health Minister, Brian Chituwo, says Zambia has contributed $182,255 towards the campaign.

    Dr. Chituwo said other major co-operating partners, such UNICEF and the World Health Organisation (WHO) have also contributed to the campaign.

    The Minister was speaking in the Zambian capital, Lusaka, Tuesday at a Measles Partners Advocacy meeting.

    Dr. Chituwo said Zambia has taken the measles immunisation drive to ensure all children under five years are vaccinated against the disease.

    He has urged the business community and other well wishers to support the campaign against measles.

    And WHO country representative, Dr. Stella Anyangwe said the world should not let children die of measles when this can be prevented through vaccination.

    And UNICEF Deputy director Elspeth Erickson called for integration of the measles vaccination exercise into the education curriculum.

    LPM is still struggling with poverty and we havent made any progress in lifting the lives of our citizens. A good example is the university problems that continue to ravage the country. Every don is poor and you want proffessionals to come back to the country which only gives good incentives to the politicians. We actually make the politicians become small gods. They are not accountable to the electorate. INSTEAD they become masters when they are suppose to be servants. Forgive and move forward.

  119. Maybe i don’t understand this whole issue, does it mean Chiluba was staying in his own house all this time? If so, wasn’t he entiltled to a government house after leaving office or he to stay in his until the government builds one for him. Counsels, where are you? What does the current law provide for the housing of the former prsident? Guide us. The other thing is that i do not seem to raelly understand how sata is not part of this plunder coz he know him for a close ally to Chiluba during those days when this plunder was taking place.
