Veep regrets failure by investors to help communities

Vice President, Rupiah Banda, is disappointed at the failure by some investors to assist communities in which they operate.

Mr. Banda regretted that despite making huge profits, most local and foreign
companies,  profits were not supplementing government efforts in assisting
vulnerable communities particularly in the area of education.

The vice president was speaking at Mushindike Basic School in Mwansabombwe today
when he received a donation from Celtel of 40 school desks worth K20 million.

The donation by Celtel  is part of the company’s ‘build the nation’ project launched
two years ago.

Mr. Banda urged other business houses to emulate Celtel and assist the vulnerable
communities around the country.

And Celtel Marketing Manager for Services, Kennedy Mambwe, said the company will
remain a partner to government in its quest to provide quality education for all
throughout the country.

Mr. Mambwe said universal education for all requires the effort of a stakeholders
not only to ensure access to education but also achieving a good learning
environment.

Celtel has so far spent over K400 million in assisting schools in various
communities around the country through the donation of books, desks and
infrastructure rehabilitation.

  2. Whose responsibility is it to support the local community?.
    No law says businesses should donate some of their profits to the community. They are doing enough already by paying their taxes.

  3. It’s not only foreign companies that are supposed to pay back to communities. ZCCM used to do so by sponsoring students for tertiary education, and sports. The only problem with MMD govt is that, it’s only concerned about the reduction of unemployment once investors come into the country and forgetting the role of “pay back to community” which is not to be done once when MMD chaps make a country tour, let it be a prerogative of any company whether foreign or local to pay back to community at any time rather than in presence of the veep.

  4. Its GRZ’s responsibility to create social amenities for the people and not the companies. Companies are just there to supplement what the GRZ is doing. It shouldn’t be a condition to would be investors that they should automatically give back to communities. The companiese do so at their own gesture because they appreciate what the community does for the companies. Companies already gives back to communities by paying taxes and creating employment for the local people. The problem is Chuchu and his cloonies like Chitoba start abusing what these companies are giving back to the people.

I would love to see even such firms contributin money to opharns and hospitals not always waiting for donation. Celtel this is a good marketing strategy pipo will recognise you.

  6. The key is that Government should put it into legislation. The UK has Section 106 agreements and Section 278 that mandate such contributions legally.

Celtel is doing a commendable job by pumping some of their profits back into the community.Gov should realise though that it`s not any company`s responsibility to take care of the communities but the government.Mr VEEP,why do you think companies and individuals pay taxes to the gov?It`s certainly not for you to trot arround at such a high cost to the taxpayer presenting desks worth K20 million.All the gov needs to do is to rearrange it`s priorities and we`ll have communities to functinal levels.You have gov`s billions sitting idle in banks,CHITOBA helping himself to the loot or even worse still billions spent on unneccessary by elections and yet expect our education system to thrive.The bible even says that you reap what you sow.

    LUSAKA City deputy mayor Charles Msiska has urged Patriotic Front (PF) president Michael Sata to allow his councillors handle local authority matters without undue influence from him (Sata).Meanwhile, the PF is seeking the help of Catholic Vicar General Rev. Fr Oliver Mukunta to trace ‘rebel’ PF members of parliament who said their president, Michael Sata, was a dictator.But Zambia Episcopal Conference (ZEC) spokesperson Fr Paul Samasumo said Radio Yatsani would protect its news sources.In an interview ahead of the civic year ending August and the mayoral elections that would be held thereafter, Msiska said it would be important for Sata to allow democracy to flourish, particularly in PF controlled councils. Msiska, who is PF Kabulonga Ward 16 councillor, said during the last mayoral elections, he contested the position of deputy mayor even though Sata preferred a lady for the position.However, Msiska said most PF councilors chose to uphold democracy by voting for him.He said he hoped Sata would allow democracy to flourish during the upcoming mayoral elections.“It’s my humble prayer that my president this time around will be more understanding over the prevailing circumstances and it’s my humble appeal that he will let the councillors handle their affairs without undue influence from him because by doing so, councillors will choose who is their best leader,” Msiska said. “My president preferred that there should be a woman on my position. At the last mayoral elections he told us that the deputy should go to a woman, Mary Phiri of Ngwerere Ward.”Msiska said he contested the position not because he disrespected Sata but because he believed that democracy should flourish.
    “Why I did that was to open the party because often times we have been accused that we are not democratic,” Msiska said. “There is a deliberate policy that there should be a man and woman for the position of mayor and deputy mayor but…it’s the question of people having confidence in you.”Msiska also disclosed that he would contest the position of mayor during the upcoming mayoral elections. Msiska was elected deputy mayor last month when he polled 18 votes against his closest rival Mary Phiri’s 14 votes.But when contacted for comment, Sata said he could not be reduced to answering what a councillor was talking about.“I was a councillor a long time ago in 1983, I can’t be answering what my councillor is talking about,” Sata said.However, Sata said he wanted Phiri for the position because he wants to ensure gender balance in the party.“You the media are the people making lots of noise on gender equality so when you have a female councillor, the only one for that matter, is it wrong to make her not even mayor but deputy mayor? PF has more women in Parliament than any other party. So we don’t talk, we act,” said Sata.
    Sata said his party’s position was that women should be given equal opportunity to men.
    “If we don’t do it when we are in the party, what about in government?” Sata asked.
    And according to a letter to the Vicar General and copied to Archbishop of Lusaka among others, PF lawyer Mathew Pikiti of Pikiti and Company stated that the members of parliament had threatened to resign. Some members of parliament from PF had threatened to resign from the party but before they could do so, they intend to go back to their constituencies to sensitise their constituents. Lusaka’s Catholic Radio station Yatsani carried the story on July 14th, 2007.”The news item was an allegation against Mr. M.C. Sata, president of Patriotic Front, that he is a dictator, who is concentrating on removing President Mwanawasa and ignoring the development in constituencies. Those alleged members of parliament threatened to resign from Patriotic Front but before they do so, they intended to go back to their constituencies to sensitise their constituents before they resign from the party,” stated Pikiti.”We have been instructed by the aforesaid party to approach you with a request that you undertake investigations to establish the names of the members of parliament who issued such a story for the integrity of the Catholic radio which must be factual and transparent as the Catholic church preaches.”But Fr Samasumo said Lusaka Archdiocese had since engaged lawyers to respond to Pikiti and Company.
    “Suffice to say that in its own investigations, Radio Yatsani will be guided by journalistic ethics which seek to protect its news sources,” he said.Fr Samasumo said the Vicar General was in possession of the letter addressed to him.Sources said there was agitation in PF because of the way Sata was bulldozing members of parliament and councillors.
    “He cannot be questioned, he is always right and most of us are beginning to feel he is more of a dictator than President Mwanawasa,” said one source.

    HIGH COURT NULLIFIES NDOLA CENTRAL POLLS
    THE Ndola High Court has nullified the election result of Patriotic Front (PF) Ndola Central constituency member of Parliament (MP), Mark Mushili, on grounds that he contravened the Electoral Code of Conduct by orchestrating a scheme to buy voters.
    There was contrasting jubilation outside the High Court grounds soon after the judgment as PF supporters thought the judgment would be in their favour. The PF supporters, however, could not believe as they stood shocked in disbelief while MMD supporters went into a frenzy.PF supporters were waiting outside the court premises with a mock coffin covered in MMD chitenge with a placard reading: “In Loving Memory of Mary Zambezi, Born 1991, Died August 27, 2007; Cause of Death: Patriotic Front; Place of death: Ndola Central RIP.”However, after hearing the outcome, one of the PF supporters smashed the coffin and tore the MMD chitenge, prompting police officers that had been deployed at the request of assistant registrar of the High Court, Justina Makasa, to quickly move in to avert a clash between the two camps.This was in the case in which losing MMD candidate, Mary Zambezi, challenged the election of Mr Mushili after last year’s September 28 tripartite elections.Judge Munalula Lisimba said the petitioner had proved seven of the 15 grounds on which the petition was based.It had been proved that Mr Mushili had himself or through his known agents bribed and treated would-be voters.The court heard that during the run-up to the elections, Mr Mushili held meetings at different localities in Twapia, Hillcrest, Chipulukusu and Kansenshi townships where he distributed cash and feted would-be voters.Mr Mushili had also published false statements about Ms Zambezi, calling her a prostitute.“The first respondent committed the illegal act of publishing false statements. In our society, calling a woman a prostitute is tantamount to social debasement and hints at irresponsibility, which was destructive for a woman vying for an elective position,” Mr Lisimba said.

    THE Supreme Court in Lusaka yesterday upheld the High Court ruling that, Emmanuel Munaile was the duly elected member of Parliament (MP) for Malole Constituency in Northern Province.Supreme Court Judge, Sandson Silomba, sitting with Chief Justice Ernest Sakala, Deputy Chief Justice David Lewanika, Judges Florence Mumba and Lombe Chibesakunda, passed the judgement on grounds that the petition was not signed by the petitioner herself.This was in a case in which Patriotic Front (PF) losing candidate, Matildah Mutale, had appealed against a High Court judgment that rejected her petition for not personally signing it before filing it with the court.High Court Judge, Tamula Kakusa, dismissed the case early this year.”Our position is that the appeal has no merit and we reiterate our finding that section 96(2) as read with section 2(1) makes it mandatory for the petitioner to sign the petition personally under her or his hand before presenting it to the High Court for trial and determination.”Having come to the conclusion that it is mandatory for the petitioner to sign the petition personally, we find that section 96(3) is at par with section 98(3) and 101(1) of the same Act as the consequence of filing a petition that is not singed by the petitioner makes the petition misconceived.Judge Silomba stated that the Supreme Court agreed with the lower court on the decision to dismiss the petition and that it did nnot err in law when passing judgment.He noted that section 96(3) of the Act, was intended to discourage frivolous petitions and has to be signed by the petitioner in person.Ms Mutale, among other things sought to declare the election of Mr Munaile null and void, declare her as duly elected MP for Malole and therefore, entitled to take her seat in the National Assembly and enjoy all benefits due to that office.Mr Munaile’s lawyer, Mutakela Lisimba, had argued that it was a mandatory requirement that the petition is signed by the petitioner in person and not through her legal representative and that an adherence to the procedure provided by the Electoral Act was of utmost importance.Mr Lisimba also submitted that the omission by the petitioner in not signing the petition herself was so fatal that it rendered the petition dismissible in its current form for want of procedure.He contended that any effect in the petition could only be corrected within 30 days, the period stipulated for bringing the petition to court. Ms Mutale’s lawyer, Robert Simeza, argued that the issue that had arisen rested on a proper construction of section 96(3) of the Electoral Act.Mr Simeza contended that the petition signed by the petitioner through her counsel was properly signed as counsel did not have an existence or life independent from a client.He argued that although Parliament used the word “shall” in section 96(3) of Act, no consequences were prescribed of non-compliance hence signing by the petitioner in person was not mandatory or directory

  11. THE Law Association of Zambia (LAZ) yesterday asked the Anti-Corruption Commission (ACC) to recommend the suspension of DEC Commissioner Ryan Chitoba and his deputy Jacob Koyi while investigating the financial scandal.

    And United Liberal Party (ULP) president Sakwiba Sikota has also called for the suspension of Chitoba and Koyi from duties pending the conclusion of investigations.

    LAZ president Elijah Banda yesterday said ACC should be mindful of the fact that the allegations against Drug Enforcement Commission (DEC) commissioner Chitoba and Koyi were serious.

    Banda said ACC should not be restrained by the fact that it was investigating a sister law enforcement agency but rather conduct its work professionally.
    “In their exercise of their work, anything considered to be an interference, ACC has the powers to do something about it,” Banda said. “If the commission is aware of anything that is making it difficult to reach potential witnesses, they have the power to restrain the DEC Commissioner from any interference in the performance of their duties. As LAZ, we denounce any moves aimed at restraining the investigation and interference with potential witnesses.”
    He said the ACC should be aware that its had unrestrained powers to conduct thorough investigations.

    And Sikota said the spate of searches and arrests of officers of the DEC were matters of grave concern.

    He said there was a need to ensure that there was no ‘witch hunt’ at the institution.
    “The recent transfers and demotions at DEC by Chitoba raise a lot of questions. In view of the fact that prior to these spates of transfers, demotions, searches and arrests, investigations were instituted against Chitoba and his deputy, there is need to suspended him pending the conclusion of investigations,” he said.

    Sikota said the allegations against Chitoba were sufficiently grave.
    He said in order to ensure that there was no interference with possible witness and evidence, those facing allegations should be on suspension.

    “What is currently going on at DEC will not only demoralise the workforce but also reduce the public’s confidence in the institution,” said Sikota.

    ACC director general Nixon Banda on Friday expressed worry at the manner that Chitoba was transferring employees suspected to be whistle-blowers in the abuse of authority of office scandal.

    Addressing the press, Banda said the ACC was studying the matter to see how it could help. He said the reported transfer of DEC employees suspected to have been whistle blowers could have been an administrative matter.
    “The current ACC Act does not contain the provision for the protection of whistle blowers but there is an Act that provides for protection of potential witnesses,” Banda said.

    Banda also said that ACC could not at the moment recommend whether Chitoba should be sent on forced leave or not.

  12. Good companies do plow into the community some of their profits. Schools like University of Zambia and the Copperbelt University would have not been closing down each year due to conflicts over staff salaries or student fees if some local and foreign companies were pumping some money into them rather than just leaving the corrupt government administrations and overseas aid to be the only source for funding.

    Individual well to do Zambians including professional sports men and women are also supposed to be helping out. Sadly despite being paid thousands of dollars as soccer coach or technical director and Faz president, our own Kalusha Bwalya doesn’t seem to have plowed some of his dollars or kwachas into community projects. I doubt whether he has ever or will ever start a Foundation to help the poor in our communities.

Mabenge today is mis or even quorted as having said anything against LPM,within 24 hours he would be locked up for theft he`s been shielded against all this time.With the same passion we have in denouncing the wrongs that FTJ did,let`s flow with that and speak out against LPM,CHITOBA,MABENGE,KATELE,MULYATA and anyone else who is caught up in this web of deceipt.

The Judge was not supposed to refer the case of Mabenge to any othe authority but to net the punishment. We should try to look both sides of the coin. I tell you if the president had intervened today all of us we would have pointing fingers at him. The court are weak they have to make a stand when making judgment. There is no provison in the Laws of Zambia where the its say the head of state can punish offenders alas his progressive of mercy. This is very clear. Look at Chiluba the president asked him to back the money but the man refused.     Zambian Defence Minister Loses Post Over “Corrupt Poll”
    The Times newspaper in Zambia reports that “Zambian politician Michael Mabenga lost his position as Defence Minister yesterday after the Supreme Court nullified his election to Parliament over corrupt activities during campaigning”. Due to these revelations, the Mulobezi constituency seat was declared vacant by Judge Dennis Chirwa, pending by-elections. “Mabenga won the 2001 general election, but the runner up candidate, Sikota Wina of the opposition United Parties, petitioned the court to nullify the vote. “Mabenga was then found guilty of using government vehicles, medicines, and constituency development funds for his campaign”, Chirwa said in his judgement.

  30. #30 Please join me in speaking out against such evil acts perpetrated by Machungwa,SATA and let`s fight and make sure LPM returns the land he grabbed from UNZA.For the resent PF nullification that`s a job well done by the courts and I hope that future elections will not be characterised by such illegal things.I don`t know why you`ve kept ignoring such a call I`ve been making about a new generation of politics.The problem I`ve noticed on this blog is that if someone detects something wrong in LPM or the MMD, then he should be TRIBAL or part of the opposition.Why can we just have a paradym shift and tackle issues objectively for the betterment of mother Zambia.If we can`t even be objective on the blog then it would be folly to expect objectivity in Parliament.Let`s try and rise above anything petty and make sure we shape our nation into a place that our kids and grand children would be proud to be a part of.

  31. Its simple and straight forward, i wonder why the VP can complain, Zambia is said to be a safe heaven . They are not strings attached when you came and invest as a foreigner so whay is the VP complaining. In Ghana when investors invest in a chiefdom the chiefs are paid royalties and they plough back in community by providing schools , healthcare and other social amenities. we dont specify in our terms when our investors take over so why should we complain????

In developed economies there are tax incentives for expenses on social responsibility expenditure.If we had similar incentives within our tax regime you would see greater participation by both local and foreign investors.I stand to be corrected, but this is lacking in Zambia and we should petition Govt. to include this provision in the existing tax laws.Ba Shapi, as much as your concerns about Chapi’s contributions are noted the venom with which you have addressed the issue is inconsistent with the spirit of accomodating diverse thinking and views.Please appreciate the reconciliatory approach in his replies.let us not get personal but maintain intellectual objectivity.I quote from your earlier posting: ” May every US $10,000 stolen from Zambians’ copper and cobalt sales by the criminals you are defending cost you the blessing of a child in your household.” Ba Shapi,honestly,is that a fair comment from a man of your obvious intellect??
