The Lusaka High Court has granted MMD presidential candidate Rupiah Banda permission to start contempt proceedings against Post Newspapers Editor-in-Chief, Fred Mmembe.
Judge Charles Kajimanga has set Friday 3rd October as hearing date for the contempt proceedings.
The Judge permitted Mr. Banda to proceed with the contempt proceedings against Mr. Mmembe Tuesday after hearing his complaints.
Mr. Banda complained that Mr. Mmembe had disobeyed a court order restraining him from publishing defamatory articles about Mr. Banda.
The injunction granted over the weekend stopped Mr. Mmembe or his agents from publishing articles deemed as defaming Mr. Banda as MMD presidential candidate until the matter is heard this Friday.
However, before the injunction could be heard Mr. Banda said Mr. Mmembe defied the court order by publishing articles which he deemed defamatory.
This was one titled “Rupiah a shameless liar” prompting the application for contempt proceedings.
He further complains against the article published last week headlined ”Rupiah is desparate old man resorting to desperate legal action” in the Sunday edition of the Post newspaper.
Mr. Banda through his lawyer Christopher Mundia claims the article was in defiance and disregard of the injunction lawfully obtained.
Mr. Mundia alleges that the defamatory remarks and opinions in the Post were meant to portray Mr. Banda as a tribalist, dishonest and corrupt person.

I agree, everyone should have equal protection of the law. What is worrying is that Mmembe is a lwayer now and he surely must understand the basics of an injunction. How would he behave if it was Dan Pule disobeying his injunction? The Courts must be decisive here not to allow Mmembe think he is above them, press freedom never said go forth and insult pipo with impunity, not even public servants- they also have a reputation to protect. The case in court now is not even threatening the existence of the Post- just their credibility. They will just be asked to justify their use of words. RB should not pursue these cases now and request for an interlocutary injunction to be in place until after the lections in which case he can commence the trial either as a republican president or as an ordinary citizen. I did not know that a private individual could start contempt proceedings. Contempt of court is a crime which means only the state can prosecute the case. If RB thinks he is synonimous with the state then Zambia is in worse trouble than i thought.

His Excellency the President, Mr Levy Patrick Mwanawasa, SC has relieved Honourable Vernon J. Mwaanga of his duties as Minister of Information and Broadcasting Services, revoked his nomination as Member of Parliament and removed him as Chief Government Spokesperson and Parliamentary Chief Whip with immediate effect.
Furthermore, President Mwanawasa, SC has revoked Mr Mwaanga’s nomination as a Member of the Movement for Multi-Party Democracy (MMD) National Executive Committee, subject to ratification by the National Executive Committee of MMD.

There needs to be a balance between freedom of the press and professional journalism. The Post are free to report on FACTS and to offer political commentary but that freedom is not absolute. Publishing articles criticizing ONE candidate on PERSONAL issues that of little relevance to the presidential campaign is, in my opinion, an abuse of that right. If the Post wants to a remain respectable newspaper they should avoid resorting to partisan biases and personal attacks. Banda has a legal right not to be defamed especially before an election.

We all pay tax, and i pay over K3.7M and i am happy because I am contributing to my country.
I would rather live in a country that is making economic progress where i am paid a descent salary and pay enough tax to develop my country, than listen to someone who says i will reduce tax and yet spoil the economy to an extent where employers fail to pay descent wages.
Waht is the benefit of paying low tax (15%) tax on a K1M salary? I would rather get K10M salary and pay 35% tax, and remain with money in my pocket.

I would rather have a regime that will put enough tax of even 45% tax in the upper band and yet create an economic evironment where employers will find it easier to pay descent wages to workers than a regime that will reduce tax to as low as 10% but mess up the economy to an extent where employers can’t pay descent wages.

Reading through this blog, the reason is clear why M’membe and the POST behave like this.
They have realised that majority of the people have no slight capacity to analyse anything. All they say is “The post has said it, it must be true”. So M’membe has realised that he can think on behalf of these people and he has continued to write with minimum psycology and yet being praised by some circles of our people.
It is surprising that some people can openly say that they see nothing wrong with M’membe’s stories when even himself has seen that there is something wrong with what he writes.
