The LUSAKA High Court has thrown out an application by Post Newspapers Editor, Fred M’membe, to dismiss contempt proceedings against him.
The Court has ruled that it will proceed to hear contempt proceedings against M’membe.
High Court Judge, Charles Kajimanga, says he is satisfied that the affidavit for contempt proceedings was duly deposed and sworn by Acting President, Rupiah Banda.
Judge Kajimanga also says he is not satisfied that there is no legal basis for vacating the exparte order.
On Tuesday, the Court granted the MMD presidential candidate permission to start contempt proceedings against Mmembe.
Mr. Banda had complained that the Post newspapers had disobeyed a court order restraining it from publishing defamatory articles about him.
The Injunction granted over the weekend stopped Mr. M’membe or his agents from publishing articles deemed as defamatory to Mr. Banda as MMD presidential candidate until the matter is heard.
However, before the injunction could be heard Mr. Banda said Mr. M’membe defied the Court order by publishing articles which he deemed defamatory.
This was one titled “RUPIAH A SHAMELESS LIAR” prompting the application for contempt proceedings.

THE Lusaka High Court has discharged Patriotic Front (PF) secretary-general, Edward Mumbi’s ex-parte injunction restraining the Food Reserve Agency (FRA) from extending the marketing season and increasing maize prices.
Lusaka High Court Judge, Thomas Ndhlovu, discharged the injunction yesterday after hearing FRA’s counsel and reading FRA executive director, Anthony Mwanaumo’s affidavit.
Mr Justice Ndhlovu said that it appeared that Mr Mumbi had not furnished the court with all the information at the time of the ex-parte application for the interim injunction on September 25, 2008.

The Lusaka High Court has ruled that Acting president, Rupiah Banda, should continue to enjoy presidential privileges and benefits.This is in a case in which the Anti-Rigging Zambia Limited sued Mr. Banda claiming that he had ceased to be vice president from the time he filed in his nomination papers for the presidential elections.The Anti-Riggin Zambia limited had contended that Mr. Banda was not entitled to perform presidential functions or the benefits of that office or use public resources to fund his campaign
But Lusaka High Court judge, Philip Musonda, ruled that article 43 (1) gave the acting president absolute immunity from having proceedings instituted against him in any court of law in respect of anything done or omitted to be done in his private capacity.The judge ordered that Mr. Banda will continue to act as president and enjoy the privileges and benefits attached to that office until the democratic process resolves the issue of the presidency.

Judges are not kind to individuals who go against their Orders. In this case Mmembe was taunting the Judge. Second is he will argue his case from the Cells… or after he served his jail sentence.

As I have constantly and consistently wrote, these races (30/10/2008 Presidential elections and Bemba-Tribalists eradication by Maestro Hhe.) are not for the TIMID souls. The two races called for well-prepared minds which leave out emotions in facing reality and the future.

Zambians need to appreciate the importance of having free minded people like Fre Mmembe and The Post. The Post is such an effective instrument to check the excesses of the politicians and also to let the public know the degree of corruption in the country. I have been following Editorial comments in The Post regarding RB’s campaign tactics where the poor villagers were given packets of sugar and told to vote only for him because he hails from the area. I strongly agree with The Post that in itself amounts to tribalism and tribalism should not be given any platform in Zambia. Zambian politicians have to mount clean campaign with aspects of integrity.
#237 and #238, I don’t think people should feel jealousy about your success by virtue of being a Tonga. Your success will inspire me and other progressive Zambians. It is ignorance and preposterous to think someone should not succeed because he/she is a Tonga. I believe that there is nothing wrong in being a Tonga. You’re a Zambian and deserve equal opportunities for education, employment and business. What matters is whether a particular Zambian has potential and capacity to run a business. I therefore find it extremely demeaning to look down upon a Zambian because of their ethnic group. I am a Mambwe but it gives me a sense of pride to hear about your success. Keep it up brother.
Fred Mmembe, The Post and his staff are a symbol of democracy and free press that deserves an accolade. Can you imagine what would happen if those guys were to silence The Post? I feel it’s gonna be like an Animal Farm where that bunch of crooked politicians would have a free reign. Trust me folks, and I agree with most of you bloggers in support of Mmembe and The Post that it is such a shame that some ignorant people on this blog have the audacity to say that Mmembe will finally put paid. I like the way my fellow bloggers have liken the scebario in which The Post were to be absent to the Chinese era of press muzzling.
