Court rejects Mmembe’s appeal

Lusaka High Court Judge, Charles Kajimanga, has refused to grant Post Newspapers Editor-in-chief Fred M’membe leave to appeal to the Supreme Court.

This is against a ruling that allowed Acting President, Rupiah Banda to start contempt proceedings against him.

Judge Kajimanga threw out M’membe’s application to dismiss contempt proceedings against him for allegedly defying an injunction.

The order of injunction restrained the Post Newspaper from publishing libelous words against Mr. Banda.

In a hearing conducted in chambers on Wednesday, Judge Kajimanga also dismissed M’membe’s application to stay committal proceedings pending appeal.

He said the High Court had the discretion to grant or refuse to grant leave to appeal to the Supreme Court against its decisions.

The Judge said the likelihood or lack of the possibility of the appeal succeeding was a major consideration in exercising such discretion.

  19. Zambia’s then largest opposition party, Mr. Anderson Mazoka (May His Soul Rest in Peace), contributed enormously to the establishment of the Post Newspapers. He defied all odds to financially see the Post off the drawing board at the time when Anglo-American Corporation still dealt with the stubborn Kenneth Kaunda regime. He took the right risk for the sake of the nation to defy the political status quo of the UNIP days. Even when that man was unjustly, unfairly and at times immorally criticized by your tabloid, he never made any attempt to sell his shares as one blackmailer at your institution had schemed.

  26. I personally blame the MMD New Deal for the Post’s behaviour. For a long time the Post with a lot of inpunity and disregarding matters in court, continued to comment endlessly on FTJ’s cases. In fact they found him already guilty. Sadly NO one in the MMD leadership led by an eminent Lawyer (LPM) ever censored the Post for their actions largely becos it did not affect them since it was directed against their enemy (FTJ). Now the Post is on them (MMD) and suddenly they have cried foul. It teaches us that lets do the right things all the times whether it affects you or not. The High court refused to allow him to appeal. The Supreme court is higher than the High court, and canot be overuled by a lower court, so Mmembe seems to be in a fix for now.

  47. The POST must understand that they are not the custodians of the law. The simple fact is, even a person who has been found ‘red handed’ committing a crime is yet entitled to defend himself. You dont pronouce him guilty regardless, more so, if it is outside your jurisdiction to do so.

    The POST declare people ‘thieves’, ‘liars’ and all other such unethical pronoucements disregarding manner and route.

    The matter here is that we are calling wrong as wrong. Whether M’membe wins the cases or not is not an issue here. I think the issue here is more of moral than legal.
    M’membe has ustilised the fact that he can see some people who are relactant to think, and has taken advantage and he is abusing the priviledge of running a media firm to do what is wrong.

Certainly I agree that but for the Post and the various exposes we wouldnt have had an inkling as to what RB is all about, be that as it may ‘freedoms’ (including the freedom of speach which the Post will undoubtedly rely on) as contained in any constitution is not a limitless right.   69. Fred we are aware that past glory you are swimming in was fought for and sustained by senior journalists worth their salt who have since left on their own or have been frustrated to leave. These patriots in the true sense fought for real press freedom at the time founding editor Mr. Robby Makayi was at the helm. We also know that the late Jowie Mwiinga who took over for a short time from the seasoned journalist, had to leave for the sake of integrity. These two and others who include former special projects editor and one of the true founders, Masautso Phiri, worked tirelessly and were most often jailed. Thats squarely what Mr Justice Kajimanga has to determine…hats off to him if he makes a bold decision either way. My feeling is that what ever the outcome Zambia will be the overall win in the sense that a judgement for RB means we now know the bounds of freedom of speach and we then know when not to mouth off and a judgment for Mmembe would mean, in my view, license to shoot your mouth off any old way.

  74. Ferd Mmembe,your inertia in dealing with issues surrounding DEC, more especially when it comes to Mr. Chitoba and his relative Peter Chingaipe, is not a secret matter. We are all aware Mr. Chingaipe was sent to our institution to protect Mr. Chitoba’s and a named minister’s interest. Fred you are also aware that Mr. Chingaipe can only be removed after finalizing his purging of suspected whistle blowers through the replacement of the intelligence personnel with Mr. Chitoba’s relatives one of whom is Isaac Musonda who used to stay with Mr. Chingaipe.

    The courts are there to declare people ‘innocent’ or’ guilty’, not the tabloids.

    You must be aware of ‘unethical practices’ in journalism and to pronouce judgement for any tabloid is unethical. That puts any unethical tabloid susceptable to prosecution.

First we all agree that the post is not above the law. secondly any person who feels agrieved with the post’s story has a legal right to take the post to court. thirdly the post has a right to defend itself. All thses things are in play in this particular case and therefore we should all now wait for the judge to make a ruling. At the moment it is 1 – 0 to RB since the court threw out Mmembe’s application of appeal to the supreme court. May justice prevail.

  139. People are forgetting that this is just a presidential bye-election and NOT a general election. Do you know why RB’s strong MPs are quiet? They the ones who hold the key to the Presidency. If you win in 80 of your strong constituencies plus the 26 disgruntled PF constituencies, you are home and dry. Sata is fighting a losing battle. But may be HH can scoop part of the votes in his strong constituencies plus part of the 26 disgrunted ones. Lusaka and CB will be evenly dirtibuted this time round because some of those 26 are from these provinces. I will be in Matero and i want to see if Sata will win in Matero. Watch the space.

Everyone should have their day in court yes, however an appeal is a way to be heard in court, so Fred is asking for another day in court, to provide more evidence in his favor or to show that the lower court erred in applying the law. The fact that RB is the acting president plays a big part on the court’s ruling and as Zambians we need to educated our selves and also fight for freedom of speech and complete separation of powers.
