Current Cabinet stays for now – Speaker

SPEAKER of the National Assembly Amusaa Mwanamwambwa yesterday ruled that cabinet ministers appointed by President Mwanawasa will continue performing their functions under the current head of State, President Banda, until he makes changes to the composition.

He also said Minister of Defence George Mpombo would act as leader of Government business in the House irrespective of the vacant position of Vice-President in the executive.

Mr Mwanamwambwa made the ruling after Lusaka central member of Parliament Guy Scott (PF) raised a point of order on constitutional matters regarding the appointment of Mr Mpombo as acting leader of Government business in the House.

In the point of order, Dr Scott argued that Mr Mpombo could not act as leader of Government business because there was no substantive leader of the House.

He also argued that the two ministers of agriculture, Sarah Sayifwanda and Ben Kapita were appointed by the late President Mwanawasa and that they were not supposed to be in the House.

Dr Scott also said nominated members of Parliament were not supposed to be in the House because Dr Mwanawasa who nominated them died.

In his ruling, Mr Mwanamwambwa said constitutionally, the people of Zambia were required to go for general elections every five years.

He said this comprised local government, parliamentary and Presidential elections, which were commonly known as tripartite elections.

Mr Mwanamwambwa said what the people of Zambia did on October 30 was to carry out one of those three elections which was the Presidential election.

“Please note that cabinet was not dissolved, there was the acting President who carried out the function of Head of State up to the day of election.

Following the October 30 election, cabinet continues until dissolved if the President so wishes,” he said.

Mr Mwanamwambwa advised the House to note that where there were proper systems in a Government, the executive continued irrespective of the vacancy in that particular executive.

“Though it may not be visible to your eyes, the position of Government leader does exist. It is not necessarily held by the Vice President but any of the senior Ministers,” he said.

Mr Mwanamwambwa said Mr Mpombo was one of the senior ministers who could act as leader of Government business in the House.

On the two ministers of agriculture, Mr Mwanamwambwa said it was not new that Zambia had two ministers of agriculture.

He said this fact was known long ago and that if any member wished to raise the issue, they could have done so a long time ago.

Mr Mwanamwambwa said the only difference was that the two ministers were now both in the House and that they would stay there until the appointing authority decided otherwise.

“Since Parliament was not dissolved and you did not go for parliamentary elections, all positions continue, including nominated MPs, until the appointing authority decides otherwise,” the Speaker said.

  9. Mwanamwambwa is right, in the absence of a veep, the president or the cabinet can choose any minister to act as a leader of government business in the house. In fact Mpombo has acted before. There is nothing wrong with that. However, it is true Mwanawasa’s death has opened our eyes as we now can see that our constitution is not clear on many issues including nominated MPs.

Reminds me of a famous story of a DOG chasing a truck with full belief that it will never catch the truck, but one day the truck stopped and the Dog caught the truck and didn’t know what to do with the truck apart from bite the tyre and run back home into hiding with a tail between it’s legs. I wonder why RB is hiding from showing some leadership. If this guy had a plan he should have had his team running by now. Why is he linking the nominated MPs to the elected one and yet the appointing authority can drop them whenever he/she wants? This really mind boggling. If I were a nominated MP I would out of principle tender my resignation since the one who appointed me is dead. But can Zambian politicians do this? No!

  17. Guy Scott should know that it is the President that appoints Ministers and not the incumbent. Ministers swear allegiance to the President and not to Mwanawasa or RB as the case seems to be misunderstood.
    What Buy is doing is encouraging over-powerful leaders, leaders who fail to draw a line between the President and the incumbent.

RB you only have 2 years 11 months and some days to 2011 so work fast. How hard is it to come up with names of pipo to work with we need Cabinet now cos some ministers will not be working becos they don’t know there fate.

  27. The office of the president is an institution which is not an appointing authority, while the president is the appointing authority with the paower to hire and fire at will. Now here are 8 idividuals hired at the will of a now deceased individual. It is only right for the new president to request for their resignations and reappoint them – if he so wishes, since for now, our ambigious constitution gives him huge powers to dance on our heads. Last week, he cancelled a trip to Kenya at the 11th hr after being advised by the AG and CJ that instruments of power would have to remain in the hands of a VP or a cabinet minister who has sworn allegiance to him. Poor RB. No trip to Kenya to discuss DRC or SA to discuss ZIM! RB again cancells a trip to Western Province on Monday! The man is just confused and sleeping! When Mwanawasa was involved in a car accident as VEEP chiluba used to interchange the instruments of power between defence minister and Foreign affairs minister.

  41. The life of Parliament is Five years. It does not matter whether the appoiting authority has died. Zambia is like Company if the CEO is dead the other directors and managers will continue with their work. PF normally has a problem in interpreting laws. RB my not understand the reason behind levy pickng the Mulongotis. It may have been to increase the number of Bembas in Paliament so as to give balance on regional representation in Govt. It may have been on consideration of family or friendships e.t.c. Its very, very apparent that RB doesn’t like all members of LPM’s team. After all they say, one man’s meat is another man’s poison.

  59. It doesn’t mean that when a President dies, all the appointments he made become null and void, Mr Guy Scott. If it were the case, then all constitutional office holders would have ceased to operate – imagine no Chief Justice, IG, Auditor General, Bank Governor etc.

If MMD was smart, they must appoint their candidate for 2011 as Veep, then people will know him and he can sale himself to the Zambians like they do it in Botswana.

  70. Ladies and gentlemen; we all know how urgent it is to have cabinet in place like yesterday. We folloed the constitution to have elections within 90 days because of the urgency to have a stable government after the death of LPM such that we didnt even allow updating the voters register thus denying many the orportunity to participate in the elections. It is certainly very un healthy to have so much time pass after the elections without the leader comming out with important pronouncements such as cabinet. What RB must know is that he is creating uncertainty not only for MMD but the whole nation and he will be to blame should anything wrong happens. Why allow speculations?

    The practice in MMD has been the he who delivers an entire province takes the VIP position so in this case he is suppose to come from western, N/western or central. Bwalya Chiti was promised the VIP position on condition that he delivers northern Province which he failed despite campagning hard. So the VIP will be Kabinga Pande we are just waiting for the anouncement. there are alot of people qualified for this position from all provinces but only one can be at any given time. so this criteria of delivering a province separates these brilliant men to arrive at one.

Also note that no two people can ever be identical…RB and LPM are two different characters and as such RB will need to form his own cabinet lest he puts the blame on the cabinet formed by LPM should he fail. Actually Magande has been shortlisted as the next Veep of the World Bank so he’s calling it quits with Zambian Politics.   82. Guys i totally agree with u ## 94, 121, 127 You see we have a president who came by accident. Its simple the guy does not even know what to do. In case he is not aware, which i believe he is aware, Mwanawasa wanted to come and appoint a new cabinet before he fell sick. A number of ministers were going to be axed. They have merely survived because the man is late. But this RB thinks that everyone is performing well no!!! This guy needs to look at key ministries such as Energy, Agriculture and others and make drastic changes if this country has to move. Who really is in control of this country??? RB no!!!!

It is surprising that most people are calling for Rb to appoint a cabinet.What he needs to do is appoint a Veep.There is already a cabinet in place and that is not his priority.The problem is people are used to “heads must roll” when a new governemtn or leader comes into power.This is a different scenario my friends.RB has worked with this cabinet under LPM and perhaps he does not see the need or urgency to change it.Regarding the nominated MPs.They were nominated by the office of the President and not LPM as an individual.Again, it is RBs discretion whether to fire them or let them stay.The Speaker is out of line to see it moral for two ministers to rep. one ministry.

Well the PF MPs are really the opposition, it does not matter what it is, they will oppose, that is one side, on the other hand I think there is a clear mis understanding of the law, I want to believe that when LPM was still in a stable condition, when RB was acting President, George was running matters in the house the time the salaries passed three readings in a record one day, so what has changed now? Bane let us not transfer streetism to parliament and adulterate the privileges therein.

    The position is not tied to the person but function. This being a bye election means that the person who takes over is not treated like a new cabinet. it can only change once he does reshuffles which we are awaiting …

  91. #150 KCC, The reason people have a “heads must roll” mentality is because the current crop of ministers in ineffectual and incompetent. If its broken, then you try to fix it. Now, you have a good point that RB may be comfortable and satisfied with the current line up of ministers and sees no need to replace them. RB should not base his decision to keep them on familiarity. That decision should be based on the ministers’ track record of service and management of their respective ministries.
