Siliya ignored legal advice – Solicitor General

The Solicitor General says Communication Minister, Dora Siliya, disregarded his legal opinion on the evaluation of ZAMTEL assets.

Dominic Sichinga says the Memorundum of Understanding signed by Ms Siliya last December, did not take into account all the advice rendered.

He said this during cross examination by Lusaka lawyer, Bonaventure Mutale, at the tribunal probing Ms. Siliya.

He said Ms. Siliya only removed her name on the MOU, included Zambia Development Agency as a party, and made changes to the two million US dollars fee to RP capital Partners.

Mr. Sichinga agreed with attorney General, Mumba Malila’s letter of January 5, which said Ms. Siliya had disregarded the legal opinion from the attorney general’s chambers.

He said Mr. Malila requested him to offer advice on the MOU and he had exchanged letters with Ms. Siliya.

The Solicitor General also said he met the Communications Minister in her office to suggest amendments to the MOU.

The MOU between the Zambian government and RP Capital Partners is designed to evaluate assets of ZAMTEL before the company is partially commercialized.

    If Minister Dora is finally found wanting by the TRIBUNAL, then it is only fair for the Minister of Justice, Veep, George Kunda to apologise to the Nation Zambia and also the President RB Banda also to do the same citing that they both did not know what they were doing.

But, what is wrong and bad is that the head of state is one a very corrupt chap and came in by corrupting, lying, and just abusing public funds. According to the report above you can not call for Dora to be caged the only option out there is that she is removed from her position or suspended or even moved to another department for failing to follow legal advice. But again for failing to do that what is illegal there unless they can find that she favoured a friend or something to award the contract she will be free to continue.   56. I understand that:
    1. The SG offered first opinion on 1 November
    2. The SG met with Dora and then offered a second opinion on 25 November. AG was away.
    3. Dora and the SG met and Dora suggested that the SG’s opinion was based on misinformation about what the MOU was about.
    4. SG revised his advice on the new information on 5 December.
    5. An MOU was signed on 22 December based on this advice. SG never saw this. AG returned.
    5 On 5 January AG nullifies the MOU
    6. On January 9 another MOU is signed… (we are yet to know whose advice it was based on).

  57. Whatever the outcome of this tribunal it makes me sad to realise that those who govern us act like little kids. If there is a cabinet at all, one would think that the AG would have brought up this issue with cabinet or the President. Instead, what I see are little egos fighting each other. What a shame! I hope the AG will finally tell us that the last MOU was signed on HIS advice, I hope. Otherwise, I can see Zambia losing money to the likes of Carlton maize deal and several others which in Kaunda’s days used to be kept secret due to either disregarding legal advice or following poor advice. Disregard of the AG’s advice, regardless of whether the result is a loss to the government or not, is harzadous to ones’s job security.   66. The SG’s approval was subject to a condition and if that condition was not met, the MoU was a nullity, even with Dora’s signature. This is clearly what prompted the AG to declare the MoU as such (nullity) upon his return. Engines, there is no need to confuse oneself with a straight forward matter like this.

It was supposed to be the Permanent Secretary, the learned Dr Mambwe, who declined to do so upon reading the conditionalities the SG had hinged his approval upon, conditions Dora was unwilling to meet.   68. #99 ShakaZulu Ka Sezangankona: you seem to be one of those that have followed the tribunal from news haedlines and not cross examination bulletins. just to help you the post newspaper usually has these bulletins although lagging behind they are a very good source of information and more reliable than headlines. the most important thing Mr Shaka is to understand the allegations against Sililya and then relate to what is being said. Law is a just vice without passion. even you allow emotion to take over your reasoning then you might not be able to follow legal matters. Now, Silwamba asked the SG as to whether it was Dora or the ministry who was the client for the simple reason that he too noticed Dora signed instead of the Permanent Secretary. Had the SG said Dora, he would have been found wanting at law because the AG’s clients are ministries and not ministers who come and go at the whim of the president or electors. He too like Dora would have been declared ignorant and his evidence declared null and void.

Again this shows that you are not following the cross examination because this same question was asked to both Dr Mambwe and Sichinga and they both said a minister can sign an MOU fro services and not Goods provided the financial implications are within the ministirial threshold.

Silwamba was simply asking the tribunal to establish whether the ministry or the minister was the client and if a certain recommendation was not followed then who did not follow the recommandation the ministry in conjunction with ZDA or the minister in conjunction with the ZDA director bearing in mind that both the Minster and the ZDA director signed.

  86. Solicitor General approved MoU

    SOLICITOR General Dominic Sichinga has testified that he conditionally approved the signing of a memorandum of understanding (MoU) between Government and RP Capital Partners for the evaluation of Zamtel assets.
    Testifying before the tribunal probing the conduct of Communications and Transport Minister Dora Siliya, Mr Sichinga said that he had seen several drafts of the MoU and rendered his legal opinion although not everything was considered.

The SG told the tribunal that he saw several drafts of the same MoU but “I did not see the final draft of the signed document.” Now now now, this is a very significant development because both Dora and the Vice President Kunda stated in their statements to PARLIAMENT that the Solicitor General and Attorney General had signed off the MoU. You can clearly see the extent to which these two were willing to go to cover up their misdeeds, smearing the August House with stinking blue lies. For your information Engines, I’m a QC so even if I’m not practising in Zambia, I understand common law very well.
