Dismiss charges against me – Chiluba

chilubaFORMER President Frederick Chiluba says the case in which he is charged with theft should be dismissed because it appears to be novel and mere fiction.Chiluba said this in his final defence submissions filed in court by his lawyers, Robert Simeza and John Sangwa on Friday.

This is in a case where Chiluba is jointly charged with defunct Access Financial Services Limited (AFSL)) directors Faustin Kabwe and Aaron Chungu for theft of public funds amounting to US$507,886.7
Chiluba is facing six counts of theft by public servant, contrary to Sections 272 and 2777 of the Penal Code, Cap 87 of the Laws of Zambia.

He says his case appears to be ill-conceived and intended to achieve political motives.

Chiluba has argued that no evidence was led from any factual witness to show what he did to warrant theft charges against him.

“Investigators appear to have had a predisposition from inception as they proceeded on a presumption of guilt. They presumed frauds and jumped to conclusions on legitimate transactions without taking into account explanations from the person who was knowledgeable about the transactions,” Chiluba says.

The thrust of the prosecution case is that Chiluba stole Government money, which left the Ministry of Finance through the Bank of Zambia into the Zamtrop account, an operational account of the Zambia Security Intelligence Service (ZSIS).

The account was operated and regulated by the ZSIS Act number 14 of 1998 and the 1970 Finance Charter.
Chiluba says as an MMD policy, the ruling party raised money from well-wishers and it was used to meet party needs.

He says the money he received for personal and party projects was to be managed by the ZSIS and that whenever he had a need to be met in from of payment, such payment would be met from the money held in the intelligence’s account.

Chiluba says the Zamtrop account has been subjected to three forensic audits all of which established that the account received a total of US$8.5 million from private sources.

He says his money is still in Zamtrop and he will demand it after the proceedings.

Chiluba says he used to send money for his children’s school fees in London to Zanaco and the money was initially kept as cash in the bank and credited to a miscellaneous ledger.

He says statements from two bank officials were that Zamtrop received other payments, which then ZSIS director-general Xavier Chungu advised that they were meant for Chiluba.

“The statement of Mrs Beauty Kaluba confirmed that some money was received for the President and put in Zamtrop but described this money as non Zamtrop because it was meant for the President,” Chiluba says.[quote]

He says the weight to be attached to his testimony should be dependant on whether there is any competing evidence from the prosecution on the matters he testified about.

Chiluba says where there is no evidence to the contrary contradicting his statement, his unsworn testimony should be believed, especially that there is evidence from both the prosecution and witnesses called by the defence, which corroborates matters upon which he was called to testify.

He says the charges brought against him for acts or offences allegedly committed while acting in his official capacity are legally incompetent as he is not amenable to criminal jurisdiction of any court in Zambia.

Chiluba says the National Assembly was clear when it clearly stated that Chiluba would only be amenable to the court’s jurisdiction in respect of acts done in his personal capacity while he held Presidential office.

He says the charges brought against him relate to acts purportedly done while he was performing the functions of his office and that his whole prosecution is unconstitutional and legally wanting.

Chiluba says as Republican President then, he did not qualify to be called a public servant and the charge against him under Section 277 of the Penal Code is legally wanting.

He says in count two where it is alleged that he stole US$125,000 on cheque number 6119, the evidence from the prosecution shows that the money was paid to DH Kemp & Company.

Chiluba says in count three where the charge is that he stole US$148,030 cash, the evidence from the prosecution witness is that the money was transferred by AFSL to E Florence in Scotland, adding “there is no evidence to the contrary.”

Chiluba said in count seven it is alleged that he stole US$123,980.25 in Lusaka but evidence from the prosecution shows that the money was paid to University of Hertfordshire and Christchurch College (for his children’s fees.)

Chiluba says in count eight he is alleged to have stolen US$27,906.48 cash in Lusaka on October 14, 1999 but evidence from the prosecution shows that the money was transferred to Cambridge Centre in London.

He says the prosecution has lamentably failed to prove that he took the money he is alleged to have stolen on all the counts as no evidence of the taking was led.

As regards the allegation that he fraudulently converted US$123,980.25, US$27,906.48 and US$33,000 for the benefit of his children, Chiluba says there is no evidence to show what role he played in the transactions involving payments to universities and colleges, and cash collected by the children.

He says the fact that Chiluba had private funds in the Zamtrop is beyond dispute and it would appear that the prosecution’s contention is why private funds were banked in a government account.

“However, this is ignoring the fact that he did not decide by himself to use the Zamtrop account for his personal monies but was advised to do so by the mandate holder of the account, who was also controlling officer in his department,” Chiluba says.

He says the prosecution’s refusal to produce the Finance Charter was certainly not intended to advance the cause of justice.

“The prosecution deliberately suppressed evidence which would have showed that in fact the whole case, which arises from payment of monies out of the Zamtrop to private individuals, is unwarranted considering the peculiar nature of the account from which the monies were paid,” Chiluba argues.

He submits that investigators proceeded on the premise that all monies in Zamtrop were government funds and picked selectively transactions from the account, without regard to the fact that the account also banked monies belonging to him from private sources.

“Zambia prides herself in upholding the old tenets of justice and surely this is one case where the prosecution, despite the number of witnesses called, has clearly failed to prove their case beyond reasonable doubt. The natural consequence of this failure is that the case against me be dismissed with costs,” Chiluba argues

It is only in zambia. this man should be in prison by now. his crimes are so big that even a child now know chiluba former president of zambia stole some money. The mere fact that chilubas elderly sons were paid from zamtrop account does not mean chiluba is guity of theft.The prosecution has to prove what role he played in the transactions because his children where elderly and the payments where not done by chiluba himself but chungu. What if chungu and FTJs sons had private dealings? The prosecution’s contention is why private funds were banked in a government account, thats a good question unfortunately its not one of the allegations levelled against FTJ and as such he cant waste time defending himself on a crime he has not been charged with, similarlry he cant be guity of a non existant crime that does not even appear on the charge sheet.

  18. Based on the fact that Chiluba is a first offender in keeping privae money in a government account must allow those in power to forgive him. I believe we as a Nationa have learnt something or a lot from Chiluba FTJ’s case which allows us to hold all other presidents with the seriousness of the law in future. I think we are wasting to much of money that can be used to socio-economically develop Zambia on the Chiluba cases and so, dismiss the cases please.

    We just cannot call him a thief based on speculation. We need concrete evidence.

    Anyway, let us wait for the verdict. If they have failed to prove he is guilty, might as well do away with the case.

  40. In Zambia it is an offence to steal a little money. The cost of the court sitting during the trial becomes more costly than the amount stolen. Thats why poor people are jailed for six years for stealing a little because the court considers that ‘wasting their time’. Steal more than a Billion…ah you will not serve a day because even the trial judge will be admiring your courage and wishing they could be you. Thats why rich peole get off scot free. Unless he was playing sacrifitial lamb to gain popularity for others coz at the end of the day he never went behind bars was and is still enjoying all the benefits that come with his former status.
    Most importantly i think regardless of him wanting the prosecution to prove beyond, i feel the corrupt act comes into play when he uses the intelligence account for his personal use. It is also a public institution an account could have been openned separate from inteligence funds but monitored by the same.

    Now we wait for the prosecution’s submission. Why was the 1970 Finance Charter not brought into court as evidence? I think FTJ and his govt plundered the nation, but on this evidence alone, the court will acquit. This is like OJ’s case.

If there was private money in ZAMTROP account from well wishers, it is high time that for the sake of probity, Zambian law must demand that all donations be declared so that we see who is buying influence of our politicians.     The joke is hilarious but it attempts to illustrate the sheer scale of how systemic and institutional corruption has become.
    It goes like this;
    During the government of First Republican President, Dr. Kenneth David Kaunda, corruption was done with ‘dignity’ and under the table.
    During the government of Second Republican President, Dr. Frederick Chiluba, corruption was done in a ‘liberal manner’ and above the table!

  87. Under Third Republican President, Dr. Levy Patrick Mwanawasa corruption was done by even stealing the table of transaction! And everyone was chased out of the room except for the inner circle.
    Under Fourth Republican President, Mr. Rupiah Bwezani Banda, corruption is done in an awkward manner as there is no table to hide or transact from. Corruption is being done at owner’s risk. It is occurs in an open and empty room in a strange and cock-tail manner, but the risk of exposure is high. BE WARE!

  88. BACKGROUND
    What started as a personal tiff between Henry Kapoko and his workmate and girlfriend Rudo Tukuza Chitengu, has opened Zambia to a worst can of worms. Kapoko has a child with Rudo.
    In a fateful fight, Kapoko broke her arm. She accused him of having numerous girlfriends besides her and his wife. He also accused her of having recent flirtations with their boss Dr. Simon Kamwendo Miti.
    She made him pay K25 million for the assault charges leaving an agreed balance of K50million. When he finally paid the balance, she withdrew her compliant and the assault charges against Kapoko dropped.
    She however was not satisfied. She proceeded to unravel to the Anti Corruption Commission (ACC), Zambia’s worst corruption case that has implicated, Simon Miti, Former First Lady, Dr. Maureen…

  90. The ACC has since restricted assets worth over K3billion from Kapoko, and assets worth K700 million from Rudo Chitengu and an undisclosed amounts from other officials.
    Simon Miti’s expanse assets remain untouched. He has given to the authorities over the years, an attested declaration of his assets most of them acquired when he was Director of Public Health for Ndola City Council, Executive Director Ndola Central Hospital and Provincial Health Director.
    But he sold most of the declared assets and has acquired more valuable assets in Lusaka and the assets have enjoyed massive renovations and constructions.
    The scandal has rocked the country to the bottom. Many are disgusted with the extent of the fraud and the brazen nature in which perpetrators conducted it.

  91. BUNGLING OF THE INVESTIGATIONS
    The Anti Corruption Commission (ACC) received the complaint in March 2009. It acted with speed and restricted Kapoko’s stolen assets in an Executive Lodge, Best Home Lodge and 12 various motor vehicles. Of the 12 vehicles, 7 were retrieved from Kapoko’s female acquaintances!
    It is at this stage that when the full extent of the fraud was emerging and names of who was involved began to emerge, investigations began to stall.
    A combined team of investigators from the Drug Enforcement Commission (DEC), Zambia Police and the Anti-Corruption Commission was formed to meet the various sophisticated forms of crimes.
    The exposure was however, later done and 6 officials from Ministry of Health were named as perpetrators of the scam. Kapoko became the rogue- boy…

  92. Sweden and Norway immediately suspended aid to the Ministry of Health demanding that aid will only be restored after investigations were done and culprits brought to book.
    During the 6th Zambia International Business Advisory Council (ZIBAC), in Livingstone, President Rupiah Banda complained that persons involved in the K10billion scam were still working and no action had been taken against the 6 suspected persons in the scam.
    The President wondered why Secretary to Cabinet, Dr. Joshua L. Kanganja had not suspended persons so far under investigations even when assets suspected to be proceeds of the theft had been restricted.
    In an apparent defiance of the presidential directive, Kanganja was quoted stating that no official would be suspended until investigations were completed!

  93. This is the attitude that has strangely taken root.
    Task-force prosecutor and Zambian Airways Chief Executive Officer Mutembo Nchito has not been suspended from his official duties even when a warn and caution statement was recorded from him and his colleague, newspaper editor and shareholder Fred Mmembe. A warn and caution statement precedes an arrest.
    Officers being investigated are allowed to sit in their offices even when there is fear that they will tamper and destroy evidence.
    Kanganja must have quickly realised the folly of his statement and was later quoted that he was unable to act only because he has not been furnished with official details. He stated he had only learnt of the scandal from press reports.

  94. Anna Chifungula came up with startling revelations. The theft was more than K10billion! It was over K27billion and the suspects were higher than the 6 initially announced.
    On Wednesday 27th May 2009, Police sealed Ministry of Health headquarters ‘to hand out suspension letters from the Secretary to Cabinet – Dr. Joshua Kanganja.’
    23 health workers were picked up.
    And all pointed fingers at Simon Miti!

  95. But the forces and persons accused are working frantically to frustrate or sabotage the investigations.
    Despite the public assurances and directives from President Rupiah Banda that there will be no sacred cows and that he will not shield anyone, it is clear that there are sacred cows and certain officials are being shielded.
    It looks like certain strong quarters are determined that the scam begins and ends with Kapoko.
    Kapoko stands scandalised and the revulsion from citizens against him is very strong. Donors are disgusted that the trail of the theft appears to be similar to that occurring in Malawi, Uganda and Kenya where millions of dollars granted for the fight against HIV/AIDS, Malaria, Tuberculosis and maternal and child care, are systematically stolen by officials and leaders…

  96. BUNGLING AND WRANGLING IN THE INVESTIGATIONS
    The investigations in the scam have reached an advanced but critical stage.
    Other beneficiaries of the scam are keen to promote that this was a mere case of financial indiscipline by a few junior officials. But how could juniors steal so much money for many years without detection or scrutiny? And the annual exposures by the Auditor General of misuse and theft of public money at the ministry have been ignored.
    ACC officers have been accusing officers from Zambia Police of corruption and that some received bribes from Kapoko and Miti, when they conducted earlier investigations.
    DEC officers have stated that earlier investigations at the Ministry of Health against Miti and other officers were always frustrated by interference from suspended…

  97. DEC Chief, Ryan Chitoba but they stated that they don’t understand why anyone would frustrate the investigations now in his absence.
    Police officers are also accusing ACC officials of dragging their feet and pretending to be conducting a thorough investigation they seem to be ‘serving outside interests’.
    Although all investigators insist that the preliminary report from the Auditor General establishing the theft of K27 billion should be the primary foundation for cases against Miti and others. They are wondering why some forces are promoting the notion that investigations should commence from scratch even in the face of the audit report.

  98. The wrangling is not innocent or is mere professional differences among officers. It appears to be undermining investigations from inside.
    And the wrangling has put investigations in jeopardy and disarray as it attempts to turn these investigations into a cold case.
    Similar divisions nearly bungled the Zambian Airways case.
    It is clear that, any moves against some powerful people and persons connected against the past administration are stalled as the infrastructure and fabrics Mutembo Nchito sew, remain intact.

  99. One senior officer remarked that the damage done to Law Enforcement Agencies and the Judiciary by Nchito and the powerful cartel will haunt Zambia for a long time. The institutions are sacred, and are expected to enjoy autonomy. They should be a natural place of Justice and a Sanctuary for the falsely accused persons. But the institutions have instead become a place of refuge for the ‘empire’ as they enjoy a literal ‘Mafia protection’.

  100. THE SUSPECTS
    DR. SIMON KAMWENDO MITI
    Miti is a medical doctor who early on began his career as an administrator.
    He was Director of Public Health for Ndola City Council.
    He was later made Executive Director at Ndola Central Hospital and was promoted to sit on the Central Board of Health (CBOH).
    He became a prominent player under Mwanawasa when he was appointed Health Permanent Secretary.
    He was the chief proponent calling for the abolition of Central Board of Health (CBoH).
    He succeeded to abolish CBoH. All resources and control under the ministry came to be under his direct and single authority. And it remain is so to date.

  101. The rot at the Ministry is rooted in this single policy shift to abolish CBoH.
    After Mwanawasa suffered his first stroke in April 2006, Miti played a key role in evacuating him to his doctors in the United Kingdom.
    A month later Miti in his capacity as Mwanawasa’s Physician, held a Press conference with a team of doctors to declare President Mwanawasa, fit to hold office and participate in the coming elections of 2006.
    This spelt imminent death for Mwanawasa who was clearly not fit to hold office and after suffering poor health for many years, had deteriorated after the stroke. Concerns from his family and well wishers who quietly demanded that the President should stand down were ignored. Their pleas for Mwanawasa to take a deserved rest and allow his doctors to manage his illness…

  102. were shut out.
    The decision to urge Mwanawasa, to continue his work as president, was fatal as he was already plaqued by other serious diseases such as hypertension, epilepsy and diabetes.
    Political pressure prevailed and Mwanawasa stood for his second term. He died 2 years on 29th June 2008, when while on duty at the African Union (AU) meeting in Sharm El Sheik, Egypt, he suffered a fatal stroke.

  103. Staff officials at ministry of Health are reporting strange transactions that took place during the illness and death of President Mwanawasa.
    Miti has been a subject of numerous audit and police investigations.
    Previously audit concerns against him, which were also subject of criminal investigations, were shelved every time the investigations became serious. For example Miti was accused of overpaying Interhealth Technologies of South Africa. Interhealth handles all Zambia’s patients sent to South Africa for specialised treatment.

I am parrallel thread the first lady through the wife of Minister of Justice Vice President George Kunda has started distributing free thing in Central province as a campagin strategy for 2011 elections following President RB Banda’s full endorsement by MMD NEC as sole MMD presidential candidate in both the MMD convention elections and forthcoming tripartite national elections to be held in 2011.

    With Mr Chiluba FTJ’s possible being left scott-free, the MMD will emerge strong in Central, Luapula and Ntorthen Provinces.

    Sadly instead of working to uplift living standards of Zambians, the MMD is now busy fully campaigning for 2011 elections – 2 and half years before the scheduled elections. Very very unfortunate indeed.

    Prevention is better than cure.

  105. It funds the medical bills under local insurance and later makes inflated claims to the Ministry of Health. This has been a subject of constant audit concerns that even reached President Mwanawasa. After Mwanawasa’s intervention the audit concerns were ‘successfully concluded’ with the Auditor General in favour of Miti.
    At one time, internal auditors at the Ministry, even with-held K1.6bilion payments to Interhealth Technologies until thorough audits and reconciliations were done. Miti enjoy and Leslie Mbula enjoys a good relationship with Kelvin Thomas the proprietor of Interhealth Technologies.

  106. In similar fashion, Miti seems to have ‘inherited’ relationships and deals left by his predecessor Kashiba Bulaya and instead of abandoning the deals and relationships, since they attracted allegations corruption, Miti enhanced such relationships.
    Miti was also accused of owning Pharco, a company that was managing Medical Stores. The management contract has since been given to Crown Agency.
    Pharco was formed in 1999 and was previously called Sunrise. Maureen Mwanawasa formed a good relationship with the Italian owners. Later Brian Chituwo announced that Pharco would be manufacturing ARVs in Zambia

  107. The project only suffered setback when Sylvia Masebo took over the Ministry and refused to cooperate with the initiative. Masebo was later removed from the ministry and taken to Local Government.
    Miti and Mark Chona are also linked to having beneficial interests in Crown Agency in Zambia, owing to the roles the two played in ensuring that the Agency was given the Medical Stores management contract.
    But because of his favoured position with Mwanawasa, he seemed to have escaped any dragnet.
    Recently, he has stated that the wealth and properties he has were earned honestly and to this effect, he took the unlikely position of declaring them with in unsworn attestation to President Mwanawasa. President Mwanawasa acknowledged his letter in 2006.

  108. Miti also played a key role in evacuating ailing Former President Frederick Chiluba in April 2006 to Garden City Clinic.
    Chiluba however accused him of hiring a faulty and unsuitable plane to evacuate him. The plane nearly killed when one engine failed.
    Chiluba later accused Miti, Mutembo Nchito and Mwanawasa of tampering with his medical records in attempts that were designed to prevent him from accessing specialised treatment. This is after Chiluba supported the candidature of PF leader Michael Chilufya Sata in the 2006 elections.

  109. Miti also played a key role in saving PF leader Michael Sata’s life when he evacuated Sata under short notice to Milpark Hospital in South Africa after he suffered a serious heart attack.
    At this stage Sata was a fierce opponent of Mwanawasa and government intervention was least expected. Miti’s decision was courageous. He hired a state- of-the-art air ambulance for Sata (probably after learning from Chiluba’s experience).
    Upon his return from this specialised treatment, Sata reconciled with Mwanawasa and abandoned the criticism against his government. Sata now enjoys a warm personal and political relation with the widow, Maureen Mwanawasa.
    Miti also played efficient roles in the evacuation of other senior officials such as Chief Justice Ernest Sakala. But Kashiba Bulaya also…

  110. played such key roles in the evacuation of important patients such as the Litunga, Mainza Chona, and others.
    Miti did not seem to learn from the pitfalls that befell his previous and strong predecessor Kashiba Bulaya. He walked the same path and his deals were more daring, more open and more sophisticated. Bulaya opened links with First Alliance Bank, Interhealth Technologies and other companies whose deals were enhanced under Miti.

  111. Whilst appearing before the Public Accounts Committee (PAC) on April 4th 2007, Miti differed with Auditor General Anna Chifungula and scorned her allegations and exposure of billions of funds misused, misappropriated or stolen from Ministry of Health.
    Secretary to Cabinet Dr. Joshua Kanganja had to intervene and pleaded with Miti to cooperate with oversight institutions. This was the public peek-view of Miti and the powerful backing he enjoyed under Mwanawasa.
    When Rupiah Banda assumed office, Miti was moved to Science and Technology.
    When Police searched and picked him up from his leafy and luxurious mansion in Lilayi, for questioning on May 30th 2009, Journalist had a torrid time to get confirmation from the police or the ACC. Journalists began to get conflicting information that…

  112. On June 3rd 2009, Police investigators decided to pick and charge Miti but ACC officers objected demanding that the docket be referred to the DPP for consent!
    Some investigators wondered why Miti was enjoying such treatment when his co-accused Henry kapoko had been detained for over 48 hours and was charged without much ado!
    Then moments from picking Miti, the arrest was thwarted by a purported call from President Rupiah Banda.
    President Banda has called for the arrest and prosecution of all culprits involved in the scandal and pledging that he would not shield anyone nor would he allow ‘sacred cows’.

  113. Miti’s docket was referred to the DPP and Chalwe Mchenga is said to have directed that the case was not prosecutable as the investigators have not established that pecuniary advantage was obtained by Miti in the K1.9 billion case! Will the case become cold?

  114. PAYMENTS TO KAHEKAM LTD
    Payments to Kahekam Ltd which have seen Kapoko charged started when Dr. Victor Munkonka, as Director of Public Health requested Miti on 26th December 2008 that Baby Packs be bought for Prevention of Mother to Child Transmission (PMTCT) program using the Global Fund.
    These Baby Packs were to be distributed to economically insecure areas.
    The tender was given to Melcome Marketing& Distributors who later declined to execute it as the Ministerial Tender Committee had given a difficult but deliberately impossible delivery period of 6 to 8 weeks.

  115. The Ministerial Tender Committee then split the supply contract into two. The contracts were worth USD280, 000.00 each and were given to Kapoko’s company (without Kapoko declaring interests) Kahekam Ltd on 16th January 2009 and Melcome Marketing.
    Miti signed the contract on 23rd January 2009.
    Both Miti and Kapoko were transferred to Ministry of Science and Technology and Local Government respectively.

  116. On 6th February 2009, Kahekam were paid advance payment of K1.9 billion which was 90% of the contract amount. Kahekam obtained a bond from Goldman Insurance and gave the Ministry to secure the funds.
    However, the goods have not been supplied. Although Kahekam officials, claim that Ministry of Health have refused to accept the goods as they came after the stipulated period and matters relating to the contract was a subject of criminal investigations by Law Enforcement Agencies.
    Melcome Marketing and Distributors have also not supplied.

  117. Miti has since written an exculpatory letter and report to President Rupiah Banda pleading his innocence. He recently suffered personal tragedies. His mother and young brother died in a road accident that has left his wife, wheelchair bound.

  118. HENRY KAPOKO
    Henry Kapoko was an unknown figure before the scandal and he is a Human Resource Officer at the Ministry of Health, on transfer to Local Government.
    The media have placed him at the centre of the K27 billion scandal.
    Kapoko’s lodge, Best Home Lodge was constructed over the last 3 years (Since 2006). It seems to have been built from funds paid for workshops held at this Lodge by the Ministry of Health.

  119. In 2008-9 other ministries, such as Cabinet Office, Science and Technology (Miti’s new Ministry) ‘innocently’ held workshops there too.
    Other government institutions that have recently held workshops at Best Home Lodge are National Aids Council (NAC), Ministry of Works and Supply, Ministry of Finance and National Planning and the Auditor General’s Office!
    His companies Kahekam Ltd and Hesaka Enterprise were given billions worth of business by Ministry of Health.
    Kapoko is currently appearing in court for a K2.2 Billion botched deal to supply napkins to the Ministry of Health. The ministry paid him ago K1.9billion as ‘advance payment’. The goods were not supplied during the contract period.

  120. Other than his social mischief, Kapoko remains an unknown figure. Many say that if he behaved like other ‘rich’ civil servants, he would have remained in the shadows. Many civil servants who accumulate wealth have become experts at mimicking the larger and poor workforce that comprise the civil Service that suffer from poor pay. They are ‘experts’ at behaving poor! (Meshing in the civil service environment by wearing cheap Chinese suits, worn-out shoes and pursuing all sorts of allowances)
    Kapoko instead chose a life-style of an American Gangster. He was seen driving a GM Hummer; he showered expensive houses, cars and gifts to his numerous girlfriends. This spelt his downfall.

  122. ESU NURSING SCHOOL LTD,
    The School based at a private house in Roma Township in Lusaka, received K7billion in 2008 alone by purporting that it was training nurses and mid-wives. It is owned by a Ministry of Health official Joshua Ushibantu Simpaya.
    Government institutions training nurses and mid-wives never receive or enjoy such lavish financing. These institutions are in deplorable conditions and require immediate financial support to renovate the infrastructure and retain key trainers.
    It was clear that this school was specifically set up as a vehicle for theft and fraud. What kind of school has the acronym ‘LTD’ at the end of its name!

  123. The Royal College and Algoninquin Management Consultants
    Various schools and consultant firms were created to obtain money for training and facilitating workshops. Most of these are owned by Ministry of Health officials such as Simpaya and Mrs. Nora Mumba Mataka (now retired).
    These schools were created and became perfect vehicles for stealing money from the Global Fund.

  124. WHY AND HOW MAUREN MWANAWASA AND SURESH GUPTA.
    The Ministry of Health keeps vast amounts at First Alliance Bank. Although this account is a mirror account for the account held at BOZ, it enjoys large transfers and holds billions frequently.
    The CEO Suresh Gupta is implicated because of an ‘off ledger account’ he keeps. It contains funds for numerous persons. It is alleged that Maureen Mwanawasa has USD10 million under this arrangement.
    During the illness and demise of President Mwanawasa, Health officials are all in agreement that Miti, and others did a ‘major deal’ where Maureen and Miti collected undisclosed amount of money from Ministry of Health Account at Bank of Zambia.

  125. President Rupiah Banda also alluded to this fact where he stated that ‘’some (fraudulent) transactions were taking place during the illness of the late president.’’.
    One of the allegations by Ministry of Health officials have pointed to moves by Maureen and Miti to purchase a life support machine which was meant to be installed in State House, when there where moves to transfer Mwanawasa from Paris to State House until a transition was managed.
    There were immediate security concerns that the public knew or suspected that President Mwanawasa was brain dead and certain officials including Maureen were accused of keeping the President artificially alive for their own selfish political interests.
    Chituwo even sent quotations from Paris, France to Miti indicating that government…

  126. needed to spend over USD1million to buy such a facility.
    Discussions were held between Dr. Joshua Kanganja, Intelligence Chief Regis Phiri, David Kapitolo (Zambia National Tender Board) and Simon Miti to see how Ministry of Health or Ministry of Finance could urgently procure the equipment under secrecy.
    It remains unclear if the USD1million meant for this purpose was actually released but some Ministry of Health officials are certain that the money was released through Bank of Zambia to Miti.

  127. It is the move to establish these transactions amongst many that is attracting intense interests from Maureen’s backers, who are determined to protect her.
    The allegations sprouting against Maureen are so many as she is alleged to have dipped her ‘sticky fingers’ in all major deals. Mwanawasa’s family also disown her when it comes to allegations of theft, fraud and corruption against her.
    The say they know that Levy Mwanawasa had in most cases, no idea what Maureen was doing including her moves to contest the Presidency. They state that President Mwanawasa when learning of some activities would intervene and stop such transactions.

  128. ‘The Global Fund to Fight AIDS, Tuberculosis and Malaria, an international financing institution, invests the world’s money to save lives. To date, it has committed US$ 15.6 billion in 140 countries to support large-scale prevention, treatment and care programs against the three diseases.’

  129. One example is the investment made in Zambia by an Arab Oil company, PETRODA. Anthony Grant, a Finance Bank official and currently Managing Director for Finance Bank Congo, introduced Petroda officials to Maureen.
    Petroda is said to have rewarded her with handsome payments and given her beneficial but unregistered interest in the company.
    Despite the serious shortage of empty land inside Lusaka, Petroda were quickly given prime portions on Alick Nkhata, Kafue, Kabwe, Makishi and Katimamulilo roads. The petrol stations sprouted across the country and have emerged as good business rival to BP and Total. Petroda has built an ultra modern Head Office in Rhodespark in Great East Road.
    Her benefits from such deals are said to be kept for her by Rajahn Mahtani and Suresh Gupta.

  130. SURESH GUPTA
    Gupta is well known as a ‘man of trust’ in his community and is among the directors of Astro Holdings which owns a large business empire. It has First Alliance Bank, Furniture Holdings (Furnishing World, Carpet Centre, Office World, Optron and Superior Furniture), Yeti Motors, Astro Works and Dil Restaurant.
    Gupta is known to trade in ‘Trust Bonds’, the informal banking arrangements where persons keep money without official declaration. Though the risk of losing such monies is high, many persons engaged in dirty and money laundering activities tend to keep funds this way as it is safer under the circumstances.

    One such LPO was issued by Ministry of Works and Supply worth K12billion. Gupta used this LPO to regain a Hyundai Franchise which was under threat. Hyundai contended that Yeti Motors were not selling enough stocks to warrant the franchise. Yet this ‘fake’ LPO was used to obtain a credit line in London to support Yeti’s importation of new orders.
    After the 2006 elections, Mohan was arrested together with MMD activist and young lawyer Chongo Musonda on the allegations of fraud.

    The political temperature has dramatically changed with an electoral pact signed by two major political parties. The MMD has been in power for 18 years and seems to be suffering from lethargy and fatigue.
    The party requires renewal and rebirth if it is to stand a good chance of retaining power, and Banda should pioneer the mammoth task that lies ahead.
    He needs to renew public interest in the party as it is the vehicle that would make him win or lose the next elections. It is strange that the party has not even conducted 2009 card renewal events and activities which have been held since 1992!
    He also appears to sit atop an unresponsive government structure that is resistant to his changes and vision. It needs a shake-up.

Interesting enough the it now appears like the passing phase will not only be about sleepinh in jail for a few days and then getting bail, but being free after having won the case or having had it dismissed because they has been lack of evidence.
