Police in Lusaka have recorded a warn and caution

statement from Post News Editor Chansa Kabwela for being in possession of obscene materials.

Post Newspaper Lawyer, Sam Mujuda, confirmed this saying Ms. Kabwela was interrogated at Lusaka Central Police for about two and half hours.

Ms. Kabwela was being queried over pictures of a woman who was photographed giving birth out-side the University Teaching Hospital in Lusaka, during a strike by nurses.

Ms. Kabwela is said to have come in possession of the pictures by the virtue of her job as news editor.

She later circulated the same pictures to some government officials in a bid to attract their attention over the effects of the strike by nurses.

The photos which have now been circulated on the INTERNET have attracted public out-cry.

During a press conference last week President Rupiah Banda condemned the circulation of the pictures and urged the police to investigate the matter.

Various media bodies that include -PAZA, Society for senior journalists and the Media Ethics Council also condemned the circulation of the pictures describing the action as an ethical.

The only person who should be able to raise a legal action against the beautiful woman. is the woman who was giving birth..She is the one who can have a valid claim of breach of privacy in the courts not ruphiah banda or the goverment.. really dissappointing

  7. Sad indeed.Where are jouranalism ethics? A friend of mine forwarded the photos to me and they are in bad taste.This editor being a woman should be ashamed of what she did. Our nurses are a disgarce especially that they are under oath to save lives.Nursing is more like a calling if you are money-motivated person,join lucrative professions like Law istead of putting a noble profession in disrepute.

  8. Leave the lady alone. I can only imagine how distraught she must have been when she saw the photos and the dead baby. She is a woman and it must have been painfull for her to see another woman suffering like that. I really doubt it if she is responsible for distributing those same pics on the net. It may have been one of those disgusting MMD cadres who thought it was porn!

  10. I don’t know what i think about the whole thing but I feel sorry for this poor woman because she is a mere front…i can bet my pension she had no say in the whole issue. The people behind it are not even being mentioned and if the worst happened she would be alone just like so many people before her who were made to risk their lives, fighting wars on behalf of The Post, being made to read insulting speeches written by someone else…today it has all been forgotten because new and more zealous disciples have been found. I guess that’s the price one has to pay for being someone’s public face without questioning the motives. All the best to her and I hope this won’t affect her husband Ngilazi’s career at ZNBC.

The police must be ashamed really to pursue such a case which is actually not going anywhere apart from wasting tax payers money in trying to interrogate an innocent and brave News Editor. If the pictures had been published in the Post Newspaper then maybe a different approach could have been taken. But why is it that the police can’t work independently? Everytime the Presidents utters some arrest-arrest, then the police wakeup from their sleep and blindly start pursuing a case they don’t even understand themselves. What a rot, Bane arrest proper criminals and concentrate on the billions being stolen at ZNBC , MOH and other government agencies. Peace

  22. the post were sent those pics by the dude who took em and then the post decided they cudnt show them pics in the paper and decided to instead send them to the a.s.s.h.o.l.e.s. in govt. predictably, they turned it into a political thing totally missing the whole point of why them photos were sent to them in the first damned place. it was to touch their consciences, which, i must admit, the post were naive enough to think it actually would. These mother-effers are so sick that they probably got hard ons when they saw these pics and labeled them porn. God do i hate this government…i really, really, truly do….

    Since President RB Banda said that he wishes whoever took the pictures in question well, I can only wish him/er well too. As a matter of fact, I believe the photographer did a good job in his/er efforts to get attention of the crises that emanated from the strike by nurses and others. This is because I have not been availed the contentious pictures to make a better analysis.

    On another note, it is gross irresponsibility of GRZ failure.

    How can the MMD GRZ justify its failure to have taken Mr Cardson Kabwe, a Zambian Medical Student, in Russia to have an operation there when his life was at stake for over 3 months?

    With this record of a warn and caution statement, I hope a court case will ensure out of this to curtail intimidation tactics.

Were they on strike too?

    Let the MMD GRZ become serious on issues of National Interest like these. The lest the GRZ can do is to thank the photographer and the POST for timely waarning to them with regard to the then ensuing events.

The leaders in Zambia are really pissing me off.They should have shown outrage that such a thing happened – the woman and baby being put in such a precarious and fatal situation ,instead your president sees porn in it!   159. Let us start with the victim herself. If she was consulted before distributing those pictures and she was fully aware about what that meant, then there is no problem. Chansa, whatever her name is, as a woman she must have been disturbed by that situation.   178. Any citizen has the right to report a suspected felon to the police, and that includes the Republican President. The Police have the duty to investigate and provide evidence to the DPP who has the prerogative to prosecute or not. So, what is the fuss? It is the DPP who must decide whether a crime has been committed and if it has, whether there is a chance of conviction. Why is the Post Newspaper Editor crying foul? And, I thought they are lawyers! Shame! If the judge agrees that the images were published (i.e. made available to a public person to look at and they are deemed indecent, this poor girl goes in. (Indecent publications Act)

  179. there is nothing indecent about those pics. The test which needs to be carried out is one applied generally in common law jurisdictions. That is a picture may be deemed obscene when, taken as a whole, the work has a tendency to ‘deprave and corrupt’ ‘(ie make morally bad) in parentheses a significant proportion of those likely to see it. Coming to our case here I don not see how corrupting those images were. How many people have access to TV and watch ER and actually see the actual birth of a baby on video to make things worse. If anything this woman does not actually have a case but the government officials themselves. She did not circulate these pictures in a manner that falls within the definitions of obscene material defined above i.e. it didnt make significant proportion of…

  187. I have not seen the pictures but from what I read some other organisations like NGOCC and the MISA Zambia has expressed displeasure with the picture. So while it may not be criminal, it is certainly leaves a bitter taste. Does that not sound like Dora and the RP

Further to your well-thought comment, there is a feeling in the private media in Zambia, particularly the Post, that they can report about anything with impunity – they have no intention to uphold public morals. The pictures in question are in very bad taste and this poor girl was so excited as to forward them to senior Govt. officers. It is sad that a fellow lady can be so disrespectful. Whoever took those photos and sent them to her (I hear it is the husband of the victim) was a very sad person and I think the public understands his anger. But Ms. Kabwela did, as beautiful as she looks is really sad. Either she is a very poorly trained journalist is just damn stupid. I have not heard anybody on this blog condemn the nurses who refused to attend to expectant mother – very unethical.

Imagine if the picture had been showing nurses on strike momentarily setting aside their grievances and rushing to help an expectant mother in labor – wouldn’t that have been a wonderful picture and story. If Ms. Kabwela breached any law, she must be punished accordingly. She is a very stupid lady.

It really hurts me big time to see a long time independent nation going on about rubbish like this…To be more clear this is just the government trying to cover up yet another shameful they have created without even knowing they created it themselves, I will not act like i know what caused the strike but this is very common with zambian universities! Lecturers and students alike, go on strikes! A closer look at it, its never really their fault. This is an issue orchestrated way from the top. For instance, we have a graet university but the time i actually found out that it has never been painted, man wasn’t i pissed…i mean WHAT? are we so poor that we cant even maintain a single tiny pride!
    And just to make it clear, i speak as a media practitioner that refuses to come back to zanbia…
