Hichilema fails to give impeachment reasons

UNITED Party for National Development (UPND) president Hakainde Hichilema yesterday failed to state the reasons for the impeachment of President Rupiah Banda.

Mr Hichilema, when asked about the statements by the UPND-Patriotic Front (PF) pact, failed to give the grounds for the impeachment of President Banda but instead said the Government should concentrate on addressing problems affecting the nation.

The UPND leader said in an interview that the Government should not breach the Constitution but govern in the interest of the people by attending to issues that citizens raised.

Pressed to state the reasons for the planned action announced recently by PF Nchanga MP, Wilbur Simusa and whether his party was part of the scheme, Mr Hichilema said he could not state.

“I cannot categorically state that but all I can say is that the Government should address the issues that people are raising,” he said.

Mr Hichilema condemned President Banda’s appointment of Lands Deputy Minister Michael Mabenga and Education Minister Dora Siliya despite them being cleared by the courts.

Mr Mabenga was acquitted by the magistrate’s court after the Parliamentary and Ministerial Code of Conduct Tribunal found him guilty and recommended that he should be prosecuted.

Ms Siliya was found to have breached the Constitution by the Parliamentary and Ministerial Code of Conduct tribunal but was found innocent on appeal in the High Court.

Mr Hichilema urged the Government to intervene in the go-slow at the University of Zambia (Unza) and resolve outstanding issues in the Health sector.

Meanwhile, a non-governmental organisation (NGO), Authentic Advocates for Justice and Democracy (AAJD) has said the plan to impeach President Banda was ill conceived because he had not contravened any law.

AAJD president Emmanuel Sikanyika said in a statement in Lusaka yesterday that President Banda had not contravened any provision of the Republican Constitution to justify his impeachment.

Mr Sikanyika said the president did not contravene the provisions of the Constitution as he only reappointed Ms Siliya after she was cleared by the High Court.

He said it was wishful thinking for the PF-UPND pact to start instigating initiation of impeachment proceedings against President Banda.

He said it was common knowledge that the UPND and PF pact was mooted with the sole purpose of causing confusion in the nation and thereafter reap from the unrest that may follow.

Mr Sikanyika said the UPND and PF pact was flat out inciting people to rise against the Government without any justifiable cause.

There is time for campaigns and time to settle down and deliver to the expectation of the Zambians. It appears RB is preoccupied answering back to the opposition instead being given time think of developmental issues.

    This is a dead end motion similar to Mr Hichilema’s 24 hour ultimatum on Dora Siliya which saw no action.

    Mr. Hichilema should state why he thinks RB should be impeached instead of dodging the issue. The opposition is just trying to stir up some trouble in the nation. There are not reasons as to why RB should be impeached.

    RB should finish his term and we shall give him another 5 years in 2011.

  8. On moral grounds RB can not appoint people who were once found guilty. Zambian courts are governmant controlled. We should remember that we had a disgraced Chief Justice in Chiluba’s gvt. Simenza and Sangwa are right to ask for the retirement of the two. The judges are easily summoned to state house, they are all unprofessional and full of sh#$%. Shriek should be removed. We are now an embarassement to the world for supporting an ***** like Mugabe who calls him MY RUPIAH BANDA. What a disgrace. Let us follow principled leaders like Obama who shunned Kenya for their electoral coruption and went to a Ghana with now a record of democracy.

  11. LT You are wrong, Mabenga was not cleared by any court. On the contrary the High Court recommended that Mabenga should be charged with a criminal offence. HH cannot reveal the strategy just like that because that would fore arm MMD

    I admire your duty to defend your husband (I am assuming he is your husband) but I think Maestro is a big boy and can speak for himself. He prides himself in his academic credentials and I am sure with all those credentials, he can make a statement all by himself without someone else coming to his defense but I still admire your passion.

There is no need for president HH to preempty a National Assembly motion by Parliamentarians when the time to move it will come at some point.

    Mrs Maestro, you are right. I did bid farewell and yes I did rescind my decision. There are two reasons I decided to rescind my decision.

    1.) Too many anti govt bullies on this website lashing insults at every govt official and what a bully needs is someone to stand up to them. I then decided to stay so I can defend good govt policy that the insulting armchair bullies always blindly criticized.

    2. ) Lusaka Times is a free service that gets most of its revenue from ads. Every blogger Lusaka Times loses affects their ad revenue. [tbc

  33. This is going to become a circus if it is not already. HH should know the reasons for impeaching RB before making his intentions public. You dont need to be a genius or great leader to see that. This only makes him look undecided and power hungry. Also, why is he the only one doing the dirty work within the PF-UPND pact? Is Sata playing a strategic game here? I think Cobra wants HH to make himself look immature and incapable so that the logical leader for the pact for 2011 is Sata. Either way, HH capacity to analyse situations is being brought into question.

  34. It is very clear that Rupiah Banda style of leadership is not asertive. Personally I would not want to wait for for his term before I raise my finger. The presidency is not a bed of roses where you want to retire and sleep. He has to work and the fruits have to be seen. I personally would not want him to impeached because thats a non starter.   37. To those complaining about the impeachment of President RB Banda plan, why are you panicking for impeachment is provided for in the Constitution. Those provisions for impeachment are not decorations, but instruments to effect when it is necessary.

    So, just give the UPND-PF PACT a benefit of doubt as they do their work. Just a reminder to all, even the Information Minister for Saddam Hussein during the last USA-UK war on Iraq used to make jokes about his government sending the allied forces back in bags as dead men, but where is he today?

    As for president HH and the PACT’s development plan, just go to Zambia and see how they are doing things.

From the story one can deduce that the reporter one HH to say something but but he was not interested in answering that question. Not willing to answer and failing to answer are two different issues. Let sense take precedence over nonsense. It is also becoming clear that this Lusaka Times website is biased in reporting, everyday we read of government pronouncements and very little of developmental issues or problems that people are facing. Please be original and not biased

  50. Reading through some of the bloggers’ views one can tell who is benefitting from Rupiah Banda’s hopelessness and dictatorial practices. Can anyone of Banda’s beneficiaries tell us just one good service that this president has done for the people of Zambia since assuming office? He is ripe for impeachment for breach of the constitution by his appointing to office of people with questionable characters.

  52. Red Lipstick points out on #42 that the MP’s salaries where increased. What she (I am assuming its a female I am talking about) forgets to add is that the opposition MP’s voted for the motion to increase the salaries.

    Red Lipstick also points on point 2, 6 and 7 and she excludes the global financial crisis which has led to the slump in the copper price.

    Concerning her point on number 5, she forgets to add that the maize crisis was not caused by RB’s administration and is going to be countered due to the maize surplus we have this year and the FRA commencing the maize buying process.

    I cannot comment on her point on number 3 because I do not have verifiable data on this claim.

    Red Lipstick makes her comment as if RB is the root cause of these problems. Silly really.

  53. I can see there are very few bloggers here that would make good Military Generals. Dont mistake HH’s silence that he is being meek and some even saying his tail is in between his legs. If HH had to give his reasons for impeachement, the PACT would lose the element of surprise, which is a very powerful tool in defeating your enemies (eg Shaka). But can you tell me what it is that the president has committed to NCESSITATE such a constitutional remedy??

  56. #51 -Red lipstick things have got worse for all of us in the world due to the global recession. Chances are that whoever was in power at this time would have had the same problems as RB. I dont think miners losing their jobs is due to RB. Inflation is not that high atleast by African standards (dont forget Zimbabwe). In any case the reasons you give are not impeachable. Just because you think somebody is not doing a good job does not mean that is an impeachable offence. Additionally, I think to cement democracy in Zambia, the call for impeachment should be coming from ordinary people not MPs in parliament. Remember how the whole country stood together against Chiluba’s third term bid that was supported by Sata? Do ordinary people know what impeachment is?

  59. Ghostrider – the opposition wish to impeach the president is now public knowledge. If they have a case against him, it is our right as Zambians citizens to know what that case is. So you think it would be correct for them to keep tight lipped as to the offence Banda has committed until the motion comes up in parliament? Doesn’t the Zambian public have a right to debate the impeachable offence amongst themselves and with their representatives the MPs? Lets not forget that MPs are supposed to speak on behalf of the people that voted them into office. So keeping quiet about this very important issue goes against all democratic principles.

  62. Bloggers, I am so disturbed with the poisoning of ex intelligence chief, Xaviour chungu! Not that I support him as an individual but I feel his blood “is spilled” by the late president. Why? I do not think it is good to take an intelligence chief to an open court! I do not mean he shouldn’t have been interrogated, I feel it should have been done in another way. The way things atand now is that its either he goes to jail for ever or killed ( as is his poisoning today – today’s POST). Even his wife died in mysterious circumstances! May someone share with me on this issue!

I think it would be healthy for democracy in Zambia if we were all informed as to the ramifications of the impeachment process should it succeed.     This has been the cry of many Zambian that we need a strong opposition. Strong in the sense that they explain to majority Zambians (the illiterate and Kaponyas) and to the few educates what they intend to do. So far the effort has not been good enough. Our hope is that the PACT will perhaps make a difference. Impeaching RB is really never a priority that is why HH (in my opinion) declined to answer and instead said RB should concentrate on solving national problems. The PACT has a long way to go!

    Thus, there is really nothing to fear about the impeachment motion, but every gain even to become more confident in discharging his job should it happen that President RB Banda is made to pass through the impeachment proceedings and win the vote.

Thence, the call to “crucify” the man.
    Furthermore, 2011 does not mean automatically removing him from office, already he is out issueing NRCs to his three strongholds, Eastern, Western and N.Western. This is being labled “rigging” and therefore the opposition would not wait to be embarrassed again but use the nearest available weapon. That’s my view!
