I saw Musenge,coffin” witness tells court

A Zambia National marketers association (ZANAMA) cleaner at Chisokone market in Kitwe has testified that he saw Nkana member of parliament Mwenya Musenge at ZANAMA offices when the coffin was being brought at the market.

This is in a case where Musenge and eight others have been charged with riotous behavior and causing damage to property contrary to section 83 of the penal code Cap 87 of the laws of Zambia.

All the accused have denied the charge and are being represented by five lawyers Bonaventure Mutale, Leonard Kasumba, David Katongo, Fred Mulenga and Derrick Mulenga. .

The cleaner Hiness Kalunga aged 53 years of 1686 Chimwemwe township told the court that she saw smoke coming from the ZANAMA office where Musenga was coming from through the back door when a mob of marketers carrying a coffin was heading towards the office.

She said there was confusion at the market as marketeers stamped about and this prompted her to rush to the police station to inform the market leaders who where already at the station.

Another witness, a cashier at ZANAMA office, Fancy Kabaghe, 23 of 1972 Kwacha East in Kitwe said he heard the co-accused Zambia Traders and Marketeers Association (ZATMA) officials Chris Musunka, Evans Witika, and a Mr. Mpondela threatening that the office (ZANAMA) will be burnt down as the four were leaving the office.

Facts before the court are that Musenge David Katongo, Patrick Chongo, Watiki, Musunka, Jonathan Manda, Mulunda Mwaanza and Misheck Sipalo on January 7 this year jointly and while acting together unlawfully destroyed property belonging to ZANAMA.

The accused appeared yesterday for continued trial before magistrate Tamara Gondwe.

The state has called 10 witnesses in the case which has been adjourned to March 24 and 25, 2010 for continued trial.

  3. ok this is confusing: the MP is leaving a burning office while marketers where heading towards the burning office with a coffin? was there someone in the coffin? what was with the coffin anyway?.

  4. For you a broad, the whole thing was ignited by the apparent inertia by the Zambia Police to arrest the Zanama members who had killed a member of the ZATMA. It is claimed that Zanama can now do any thing since they are now a wing of State House.

  5. LT needs to improve on your reporting. This story is so incoherent it does not make sense at all. You need to give a background of a case so that those who are not familiar can follow what you are reporting on. Remember most bloggers are not in Zambia so they dont know exactly what the history of the case is.

  6. Don’t confuse Murder with riots. The police is trying to twist this to highlight more the issue of riots in order to surpress the fact that a person was murdered. CAN ANOTHER MURDER DOCKET BE OPENED PLEASE!!!!!!!!!! WE need to have ZANAMA Officials arrested for Murder.

A person was killed before the riot started…Can someone remind these people that Musenge no matter his intentions was at least expressing solidarity with the murdered person? What is the meaning of KAPOKOLA? Ukupokolola not the other way round!

  9. I can’t make head or tail of this news item. Very confusing! All I am thinking right now is, what happened to Data Protection? How come the addresses of the witnesses have been published?

  10. My Love Child. In courting reporting the address of the witness is necessary because anaother person could be bearing the same name and age so the address is needed for the writer to be protected from litigations. Court reporting is different from news reportingn I mere news article you can not such details. My dear don’t get confused get free advice if you not sure.

  11. This story is not well explained. LT please carry out proper investgations before you publish such stories. I think there is about three stories all combined as one.
