Post Editor-in-Chief Fred Mmembe has been found guilty of contempt of court together with the Post Newspapers by a Lusaka magistrate court.

This is in the case in which Mr Mmembe and the Post newspapers are charged with contempt of court arising from an article authored by US-based Zambian Professor Muna Ndulo titled “The Chansa Kabwela case:A Comedy of Errors”.

In the allegedly contemptuous opinion piece, Cornell University Professor Muna B. Ndulo described the process against Kabwela as a “comedy of errors” and wrote that the obscenity case, which was widely decried as a politically motivated attack on the newspaper, was detrimental to Zambia’s image abroad.

Section 116 of the Zambian penal code criminalizes speech or writing that could prejudice opinion regarding an ongoing judicial proceeding.

The matter came up for judgment this morning before magistrate David Simusamba. In delivering judgment Magistrate Simusamba said the defence by Mr Mmembe that he was on leave at the time the article was published could not be considered by the court because he was the Editor-in-Chief of the newspaper.

In November last year, Mr Mmembe described his case as a tactic used by tyrannical regime against press freedom.  “Contempt of court is a charge that has been used by tyrannical regimes the world over against press freedom,” M’membe told the International Press Institute at the time. “We hope the judicial process will handle the case in a manner that preserves and promotes press freedom.”

Magistrate Simusamba has since reserved sentencing to Friday June 4,2010 at 09:00 hours.

  3. Its interesting how the court came about the conviction of Mmembe as he was on leave. Even in any work place if a person is on leave, you cant bring the person in to say you have a case to answer. E,g if something is missing in a section that person works, you cant say he stole because the person doesnt come for work. I normal thing was to have the POST convicted and the one who was acting at the time, if there is evidence. I think Mmembe will appeal.

How can he be so naive. Anyway he broke the law and throw in in jail for one year and let him test YAKUMBUYO for the weekend before granting him bail on Monday, as he prepares to appeal. Did he even pass his law exams or just buy his papers?

    We refer to Africa as primitive because law in Africa is not respected or obeyed. Law in Africa is there to be broken and the new independent Africa is even worse because there is no colonialist to put the African in his place with regard to respect for law and order.

    It is sad that the entire Fred Mmembe can stoop so low to disrespect the law only because the government refused to bail out his badly run and defunct company (Zambian Airways).

  20. This is interesting. The story from now changes to Convict Fred Mmembe. A convinction is convinction whetehr he spends an hour or gets a suspended sentence until he wins on appeal. These criminal elements at the Post Newspapers have began to taste the fruits of Judicial independence.

  21. Convicted Post Newspaper Editor Fred Mmembe is reported to have fled the country immediately after the court passed judgement and told him to come friday for sentencing. However the police say if the convict has indeed fled they will ask the service of interpool to arrest the convict and bring him back to Zambia to face justice. And the Law Association of Zambia are at a loss as to what it should do with a convicted member of the association.

  22. I feel sorry for Fred, but I am sure he will test the judicial process to its limits as he is entitled. But Iam sure he is intelligent enough as an officer of the court (lawyer) not to listen to dull individuals who want to have different laws for Mmembe and different laws for others. What maintains peace in a country is obedience of the law. If you believe Mmembe has a lot of support and should not obey the law, you will only create a lawless country where people who have beeen injured by Mmembe will not rely on the law for redress.   23. This is great news. Let the law take its course and if it means Mmembe appeals the sentence, he has a right to an appeal under the Zambian Law.
    There should be no interference with the judicial process in this case, unlike the FTJ Chiluba- Appeal don’t appeal saga.
    At least once this is resolved, the People of Zambia will be assured of an even bigger fight to have The Big Thief, FTJ Chiluba back in the dock.

  36. Dont worry I just saw convicted Post Newspaper Editor Fred Mmembe this afternnon with his disgraced Former Task Force on Corruption Prosecutor Mutembo Nchito. They all looked to be in high spirits. The rumour of the convict fleeing the country seems to be false. The convict had a backet and tropical sandals in readiness for possible jailing on friday afternoon. But I hope the magistrate feels pity on the poor guy as he is very sick and survives on ARVs and may not be able to cope with prison life even for an hour.

The timing of the date of sentencing is to ensure that he spends the time in prison for the entire weekend as a punitive measure so that even as he wins at Appeal, he will have tasted prison! that’s the game plan. Because, if he was sentenced today, he could have already lodge the appeal and only have slept one night in prison, if at all, and been out tmoro… We know the Friday behaviour of the system!

    #45, Fred Mmembe has had all the freedom to report hearsays and innuendos and to write anti -Rupiah Banda editorials every day without any harassment even when he has injured innocent people. This is a free country. Mmembe has been found quilty by the courts for actions that undermine the ability of the judiciary to freely and fairly determine cases and dispense justice. The independence of the courts is as important as the independence of the press perhaps even more so.

    What would be interesting to know is how the laws of the Zambian penal code came into existence. Were they were designed to protect the civil society or the judiciary? I simply cannot fathom how publishing an article entitled “Comedy of Errors” ammounts to contempt of court.

    In my personal view, these laws are likely to stifle the very freedom of speech that the law should guarantee. For fear of being stuck in legal disputes, journalists and patriotic Zambians will not open their mouths. There is need to re-examine our colonial constitution and do away with unnecessary prohibitive laws. which are too vague and restrictive. Hopefully we can come up with new Zambian laws which protect Zambian interests.

Zambia needs order as the current exercise of unlimited freedoms by certain individuals which has no place even in western countries is potentially disastrous for the country.   60. If Mmembe is saying , in his defence, that he was on leave when the story was published then, to me , that implies that he had no control over editorial policy during the time he was on leave . So i’d have thought the magistrate would seek to identify the person who was acting in his capacity and therefore authorised the publishing of the article , rather than disregard at the outset(apparently) what i think is a credible line of defence. If Mmembe has been given the chance to identify who was ‘Editor in Chief’ at the time of the article , and has failed to do so, then this ruling would make sense to me. Otherwise it doesn’t.

  65. As a kid as was taught, first in Social Studies and then in Civics, that judges interpret the law. Kids are still taught the same thing today. My understanding of this is that judges make decisions according to what the law says. If that is true, then whatever outsiders say should not sway the decision of the judge as far as making judicial decisions is concerned. The law of contempt of court (in as far as commenting on matters that are in court is concerned) seems to me to presume that the judges are not intelligent enough and can be easily swayed by public debate. Why should a competent judge, one who knows and understands the law, be influenced or even be bothered by comments from a lay person who doesn’t know what they are talking about? Unless the judge has something to hide!!!

  69. I have always noted that Mmembe & his post have long lost the plot. The problem has been that the paper changed from covering facts, when it started, to just being personal. It started with Chiluba. Every day, from page was Chiluba on petty things like sex, him with a woman & his former wife. It extended to Levy: Cabbage etc. Even when he died i was not convinced by the post’s crocodile tears. Banda just automatically fail in with his lack of ideas.   75. There is something very wrong with the court system in Zambia. According to the magistrate his conviction is based on the fact that the article had said the Chansa case was a comedy of error. Didn’t the same court say RB’s case with this lady was a waste of time. You sentence Katele and others, and then you say Chiluba is innocent. There is just too much wasting time and thats why we cant develop. I will stand by the Post any day without them Zambia would be a comedy of errors where leaders continue stealing thinking who will find out…indeed only the Post can find out. All you grown men not supporting Mmembe its just plain jealousy.Do the right thing and maybe one day you will also have a business as big as the Post.

  76. My problem with Fred is that he puts his personal emotions in his articles and quotes the bible to justify what he is writing. Articles should be written on facts and nothing less. The nerve of you to attack leaders in the media and you yourself are a wife snatcher (fact), you fathered a daughter that currently lives in South Africa and you are not taking care of her(fact), You are gay and attend your private circle parties on a farm in Lusaka west (fact). So Mr. Bum plugger or maybe u are the one receiving becareful because your business is out and your current wife is no angel either. I just hope that new baby boy is yours.

  78. # 96, I think you have a problem discussing issues. In one sentence you call Mmembe, gay and wife snatcher, what’s up with that? Most of you are jealous of the success of Mmembe. Single handedly he has made a brand name in the Post newspaper. When the nationally funded media is failing to function, he has managed to do what the all govt have failed to do in creating a viable media source. Times of Zambia, Daily Mail and ZANIS all three combined cannot out sell the Post. He is the Surf as in washing powder, Colgate as in tooth paste, and then there is the Post as in news media in Zambia. So, the statement about insulting is negated and probably you think when states facts about your failures that means they are insulting you. Can you cite the so called insults you stated?

  79. lets us respect our courts be it mmembe, katele, regina, kabwela we are all innocent until proven innocent. I dont know what has become of the post it used to dig deeper but now its a leading independent paper. it needs to be checked. all it does now is not to dig but quote expats at insults common duiker mpombo, sata, hh and foolish ngos. post had a good following but not anymore. any reasonable reader has stopped buying the paper. it carries nothing but championing its cause. no wonder they are scared of media regulation

  80. self regulation im sure you now understand why post is scared stiff of media regulation they want to break the law with impunity. membe is a lawyer and knows better what it means to write in a newspaper a matter which is before courts. the fact that he says he was on leave when the story was run means he knew it was contempt. he could at least produced a leave certificate b4 the courts. fred has always said he standsby what appears in the paper so for him to try to run away and risk innocent mujuda and amos is a shame. these two guys are in it for bread and butter. given chance they would run away like malido and many others did.

  83. He stole his current wife from an American guy that was sick with cancer. She abandon that poor guy while he was fighting for his life. Mazoka was very fond of that young man and he moved to Zambia to look after the Mazoka family after Mazoka died. Look what that young man got for all his efforts lord bless him.

  84. Oh, what a verdict! Anyway, The Post is not in jail; it will continue to expose wrongdoing. What beats my imagination is the magistrate wanting to study Fred’s Mitigation. It appeared to me he had not made up his mind to jail Fred and had to consult the invisible omega of Zambia. It was purely to ask whether to send Fred to Jail or not and ofcourse the instruction was send him to jail. And it appears true that he was instructed to jail Fred on Friday so that he spends the weekend in jail. Merceneries, you have your day today. Your day of reckoning is surely coming. Tomorrow we witness the augmenting of PF and UPND as they readies to deliver Zambia.

    We should just hope that the government changes and all the bootlickers are fired, since they are not professional. And, we should also hope that RB, his wife (for having received a salary which could have benefitted other teachers) and all those friends of his that have been acquitted or are on bail forever are imprisoned, and not forgetting Dr.Musonda. Insansa shinya ubulanda. Ama guys aba nabasamwa sana. I’m sure they know their time is coming. VIVA POST. We’ll continue reading your news. Can a person like Dr. Musonda even have a peaceful sleep. I wonder!

So someone steals in the health sector, Sweden suspends budget support, health ministry can’t cope, nurses strike for a month! there is total madness with people dying outside our only specialist Hospital, a mother with a complication gets no help and a baby dies in a car park, it is a horrible thing but a fact of what is going on, pictures are taken and given to the paper, one of the editors sends the pictures to ministry of health and womens rights groups asking them to do something about is soon becoz people are dying and dignity is lost plus it had gon oon for a month, instead of seeing the reality and doing somthing about it, president calles an image of a still born child partially born-distributing pornography, american Lawyer calls this comedy, paper runs it. then arrest fred 😮

  87. 110 how did you know he stole? these are adults, do you know if his wife told hime the full story before it got serious? do you know if his wif and ex where together? and since you said he was dying and coming to take care of the mazoka family at the same time I think you have no idea what you are talking about! you are proberbly a jealous person…besides who knows maybe fred is looking after the family…and maybe the woman run from her hasband she is old enough…no one stole anyones wife
