London Judgement not a UK case-British High Commission

The British High Commission has said that the London Judgement involving second Republican President Federick Chiluba was not a United Kingdom (UK) case.

A brief press statement from the Press and Public Affairs Section of the British High Commission today said that the London judgement was brought and pursued by the government of Zambia and not the British government.

The statement said recent reports suggest that there may be a misunderstanding with regards to the London judgment.

This was in an apparent reference to Chiluba’s UK judgement whose registration in Zambia has since been overturned by the Lusaka High Court.

The statement said that the civil trial was brought by the Attorney General of Zambia in the UK in order to recover funds which were transferred to the UK, mainly to an account held at Zambia National Commercial Bank Limited (ZANACO) in London, by the Zambia Ministry of Finance between 1995 and 2001.

Anyway, they are clarifying that it’s not the British that commenced the trial or pushed the trial but the Zambian Govt and rightly so since within legal procedure, in a bid to RECOVER the money banked there. So the Money was and is there. Now Kafupi will quickly transfer this money. Can someone tell me whether with the London Judgement Kafupi can touch this MONEY, OUR MONEY??? If so, an Injunction must be filed quickly.

  3. Wooooooow, whats this excitement about in the MIDGET’s camp? No one ever said this case was a British one! It was just decided in a British Court, initated by the Zambian Attorney General, for and on behald of the Zambian people, so this ka statement is a lame duck! Yaba! Now can plans be made by the Attorney General to secure our money that this MIDGET thinks is rightfully his!

  4. Unless if the Attorney General appeals to the Zambian Supreme Court soon the dribbler could transfer those monies! There should be other international legal instruments which can be used to bar him from getting the monies, the ones used to recover Abacha and Mobutu’s lot?

  5. When Levy saw the euphoria and rapture in the county each time Fred M’membe called Chiluba a thief, he partly used it to drive momentum for his support. In other words this was also political move from Levy’s point of view. He wanted to be his own man after being had hand picked by Chiluba

    Yes, Chiluba via Xavier Chungu stole the money that cannot be denied. As lawyers, George Kunda & Levy failed to do their home work from the start.

    Levy had good intentions to strip Chiluba immunity which led to all these explosives that have transpired. However, Levy did play politics to gain street and foreign popularity, especially from the donor countries. And the air waves were very good for him, especially from the EU Countries……

  6. The irony is that the chaps that had bungled & botched this entire case were a bunch of Lawyers. Thus, Kunda, Mwanawasa and all those other lawyers those were on the advisory committee at State House.

    Levy should have used some State Draconian Rule by locking up Chiluba. If he had locked up Chiluba, he was going to talk and negotiate the offer that was on the table from Levy to return part of the money. Besides, the immunity was removed and Chiluba had no defensive mechanism to play with.

  7. Levy is the one who pursued the case in his relentless effort to put FTJ behind bars on cases which could not be proved. Even when the cases were in court Levy kept interfering by putting pressure on the courts that they were too slow to cage Chiluba. Levy (mhsrip) was full of bitterness. I think if the courts had adequate burden of proof they would have incacerated FTJ. Don’t misunderatand me am not supporting theft of public funds or even corruption.

I can’t fathom that an untrained-legal mind like myself cannot see any legality in pursuing Kafupi in a foreign country when in his own country he is treated as a hero! Surprisingly, Roger Chongwe has been paid a substantial sum of money in foreign based judgment such as this lazo’s clear theft case. Perhaps it will be in order to request info from him to enlighten us?

  11. #2 This is in answer to various insunuations by Kafupi’s camp and RB’s psychophants that this was a colonial trial. However the British govt our former coloniser had nothing to do with this. The fact of the matter is that the Attorney General and Justice Minister in the name of George Kunda sued Kafupi in London on the Premise that Zambian public money was wired to accounts in Britain. It is on the basis of this that evidence of illegal money transfers would more likely be found in the UK than in Zambia. In the UK records are meticulously stored. In Zambia Chiluba and his cohorts distroyed the records of their plunder. This is why Kafupi was tried in the UK and found guilty because the UK records say so.

Especially after taming Membe, after giving Membe money through business deals e.g Zambian Airways etc, they became friends and worked closely to destroy Chiluba. And a lot of evils that Levy was doing against this Country together with Maureen could not be reported because they were freinds. After that it was all praise from Membe even when we could see some evils being done. but one day history will be rewrtten so that people will know the truth.

  13. The whole case has nothing to do with Rupiah Banda as portrait in other media circles. This case went down the drain from the start. The only winner from all this is the lawyers that got away with outrageous fees and a lot of money has been wasted. For sure Levy had some element of intent to square with Chiluba. He got sidelined when he was as a Vice President and was over taken by Sata, which become Chiluba’s lieutenant.   14. Which funds did someone steal from your mother’s bedroom? The case is a non-starter and is as foolish as the one who took it to a foreign court including his supporters here! If Roger Chongwe was given any money from a foreign stooge of a court’s judgment, that too was a scandal! Why is Zambia full of stone throwers who are full of hatred? This is why we lag behind. Bury your hutchets and move on!

    This is confusing. Just a few days ago, I was on a different mindset regarding this case. Now it is getting more plain to see that someone here is trying to hoodwink the people of Zambia in the name of international justice.If there’s anything wrong with Africa, then it’s definately about African leaders and how they are protected by the governments.

    The corruption and greed of these leaders, their unfairness and how they treat the poor is simply unbearable. The judiciary is now also appearing to be at the heart of a conspiracy, betraying the very norms that they are supposed to be upholding. In times like these, only the Media can awaken the masses to what is actually going on behind the smokescreen. We need the truth and nothing but the truth.

  21. There is no such money. If it was there it would have been recovered when the London judgment was made. After all, it was a judgment in Britain by a British court. And if it is there, the $45million, how would Chiluba access it? How come the British court did not establish which British bank was keeping it? Looks like we are so lazy and poverty stricken that we have started thinking with our feet, seeing a mirage of wealth where there is none. Someone is right, let’s concentrate on development that is where the money is. Reminds me of a proverb where a lazy man (no names please) whose father told him to dig in the fields to find hidden treasure, which turned out to be the man’s crop harvest after so much digging.

  24. No one ever said this was a British case. For once, we as Zambians need to start taking responsibility over what happens in this Country. How can we honestly allow this rubbish to continue happenning and yet we do nothing. Docility will not lead us anywhere.   25. I am not sure if my fellow countrymen can see what is in front of them based on most of the posts here. Yes Levy ‘went after’ Chiluba, but it was beyond doubt that Chiluba had stolen from YOUR COUNTRY. The registering of the judgement was essential in part because some of the assets were in Zambia, and you could only confiscate them by having the judgement recognised in Zambia. The failure to register the decision could be either due to law or merit of the case – I am not sure in this case, but what it means is that ZANACO London might be closed or the bank fined for money laundering. You have a simple choice, accept the local court judgement and your only Zambian bank will be turnished for money laundering or learn that glogalisation comes with global responsibilities.

  28. Zambia is not an island for some of you to think it is impossible to register this case. Zambia is a member of interpol and other organisations involved in organised crimes. It is there under this connections that if Pafi had stolen from Zambia and goes to France to live because of dipromatic tires and other agreed frame works pafi can be tbrought back to Zambia. The judicial system in Zambia is sad chapter and if this was 1990-91 the mmd wouldn’t have survived from the man today championing anarchy and destabilising the country William Banda. Anyway many with links to the Ruling Party are happy despite been given post in foreign missions by the person they are now calling names who can not defend himself (levy).     Your statement implies that the rest of the assets (major part) were in UK or Europe. Since there was no need to register the matter in UK, why didn’t you recover the assets there? Now if the money was in London why did they not just confiscate the money??? and also if the reason for taking the case to UK was because most of the funds went through ZANACO London branch then why do you need to register the judgement in Zambia? really this is so straightforward a case of excited lawyers who were trying to impress foreign powers and exposed our security system to ridicule. mutembo and membe have a lot to answer for as they know that Kunda was against this london case and he was over ruled by Levy and Mukelabai was fired and killed over the same. the time will come the whole…

  38. Hamaundu, the assets in the UK could have been confiscated if the Zambian Government had pursued this avenue. Registering the judgement in Zambia was also relevant to other defendants in the case. I know for a fact that some assets were identified in Europe, that had been obtained in an irregular manner. The funds that were in Zanaco as far as I am aware are still in a frozen account, hence my observation that the bank could be fined or closed for money laundering activities. Please do not think I am dull I am just giving my opinion based on information available to me at the moment. From reading further, my understanding is that the refusal to register the judgement is purely procedural, the state tried to register the judgement under the wrong laws.

  40. This was a case of money laundering which is illegal in the UK, Her Majesty’s government will never release this money to Kafupi. As for Hamaundu and Chinyama, commissions of inquiry await them once Banda is out of power.
