Court orders Post Newspaper, Muvi & Mobi TV

The Lusaka High Court has granted an exparte injuction to restrain the Post Newspapers, Muvi Television, and Mobi International Limited from publishing speculative stories on results of the 2011 tripartite elections.

High Court Judge Jane Kabuka says “it is hereby ordered and directed that the defendants whether by themselves, servants, agents or whomsoever be and are hereby restrained from printing, publishing, running or carrying speculative stories on the tripartite election results held on 20th September, 2011 and subsequent dates and further from printing, or publishing or announcing election results before official results have been made by the electoral commission of Zambia.”

Judge Kabuka has further ordered that “if you the within mentioned respondents whether by yourselves, servants, agent or otherwise howsoever disobey this order you shall be liable to contempt of court and shall therefore be committed to prison.”

The three private media institutions have also been restrained from announcing election results ahead of, and prior to the Electoral Commission of Zambia verification and announcement.

High Court Judge Kabuka has since set September 23, 2011 as date for the interparte hearing.

The injunction was filed by Attorney general Abyudi Shonga.

  1. Whats with the internet media blackout? So what if the speculate it won’t change any outcome. Speculation is part of any free and fair elections and clamping down on it is very undemocratic and suspicious. Using the courts to clamp down on this is rather overkill and seems to be very telling about whats on the mind of MMD. Just what exactly is happening?

  3. Selective democracy indeed. Where one person or organisation has too much power. We really need to redefine democracy. So we all have to wait until ECZ sorts out it’s incompetence. For gods sake it’s only 3 million votes. It’s not the private media’s fault that you silly website was hacked. The private media saves the public, and we the public need an update.

  12. The biggest fear these guys have is that PF has not lost any of the 43 seats it won in 2006 but has instead grabbed more (about 20 so far) from MMD and UPND bringing the number to about 65. MMD has only 85 seats to share with UPND, ADD, UNIP and some independent canddidates. Things are not good.

    Oh, by the way, the ECZ web site wasn’t hacked. It just crashed because too many of you wanted to get there at the same time and have illegal treasonable thoughts of Sata winning. We are desperately trying to buy time for Ala Bee and all his appointees (including yours truely) to stay in power and office by fiddling with the numbers so that Sata “loses”. If all else fails, we will even blame PF for rigging and try and get the result nullified. Please maintain the “donchi kubeba” policy on this one as well.

    The river has run dry in urban constituencies now let the rural votes pass the final verdict bola ni 90 minutes. All remaining are rural constituencies. Zambia’s mandate come from compilation of every vote cast in all the 150 constituencies and not just the 33-70 being speculated on in the urban areas. Democracy is not just a preserve of the urban votes but every vote cast from boarder to boarder on the territory of our democratic country.

  16. This is very unfortunate. We can’t fail to announce results for places along the line of rail. We have electricity and computers calculators etc to help us. But Chavuma, Feira, Chadiza managed to give us results. The court also does what it failed to Chanda Chimba. I am MMD but not on such nonsense.

  22. Initially we were told that the ECZ website was hacked by pro-PF engineers and are posting pro-PF results.
    How is that possible, when we have always been referred to as “Kaponyas”. This sends a timely warning that do not take God’s people for granted.
    21st, century Kaponyas are sophisticated and tech savvy.
    No wonder they are forming the next govt.
    In fact the so called hacking is just a way of delaying the results. Be warned we already know these results

I was a monitor in this elections and I have the elections result for my polling station and the constituency dully signed and already announced and displayed here and we have communicated these results. Thats why we are saying we already know what the results are throughout the country. ECZ system is slow

  25. Chris Akufuna announced that results would continue to trickle into the elections centre the whole night and urged whoever wanted to stay with them overnight, to do just that. While muvi and the rest and barred by injunction from telling people results, ZNBC is showing a movie. Ridiculous!!! I expected to wake up to scenes from Mulungushi giving more results but alas ZNBC is showing a movie with only 33/150 constituencies officially announced. I smell big big trouble. You don’t need to be a rocket scientist to know things are terribly wrong in this country. Minimum common sense tells you what is really happenning. Sad day for Zambia. Yes, Lubinda was right, may be more should have been praying for justice, free and fair elections. Mwanawasa, this is what you left for us.

  31. Now this is absurd. What happened to press freedom? and why are they taking so long to verify these polls. They must have really dull people and very slow computers. Remember they were boasting of their election management system worth a fortune??? TOSS IT AND LET PRIMARY SCHOOL KIDS COUNT… They will do a better job.
    In my mind, the verification process is a simple as this:

    ECZ receives the results from totaling centre (ELECTRONICALLY) and the place a phone call to the returning officer.
    ECZ: Hello Mr. Returning Officer, We have received the following results from you.. please confirm… Michael Sata 12,000
    RO: Confirmed
    ECZ: Bwezani 1,000
    RO: Confirmed
    ECZ: Hichilema 200
    RO: Confirmed

    — and so on and so forth.. WHY SHOULD THIS TAKE more than 2 days for 150 constituencies?

Now is the time to put your money where your mouth is. Where is ECZ with the 48hrs nonsense? We are now remaining with 9hrs out of the 48hrs promised by ECZ to release of ALL results. 33/150 have taken so long. The other 117/150 will be out in 9hrs. Patience pays, we are waiting.
