Simple but Realistic

Zambia’s fifth republican President His Excellence Mr Michael Chilufya Sata deserves a pat on the back for his gesture of overwhelming benevolence for appointing this able commission of inquiry to look into the matter of the Barotseland Agreement of 1964 and indeed the disturbances that occurred in Mongu/Limulunga on 14th January 2011.

INTRODUCTION:

The events of January 14, 2011should not be viewed as an isolated occurrence on that particular day or indeed over the months around that day. It must be understood from the background of the systematic negligence by successive regimes in Zambia to tackle the issues surrounding the Barotseland Agreement of 1964. It must also be understood that as long as the Barotseland Agreement shall continue to be neglected and ignored by the powers that be in Zambia issues like the Mongu Fracas shall continue to threaten the peace and security of this Nation.

This commission is therefore challenged to consider its mandate seriously so as to once and for all propose viable solutions to issues surrounding the Barotseland Agreement 1964. I say this with the hind knowledge that Commissions have come and gone without really making an impact over the issue irrespective of the vigorous participation of the Barotse people in such commissions pleading with the powers that be to resolve the impasse of the Barotseland Agreement 1964 ie Mvunga, Mwanakatwe and Mung’omba Commissions.

THE UNITARY STATUS OF ZAMBIA

Zambia became a unitary state in 1964 thanks to the Barotseland Agreement 1964 which paved way for Barotseland with the rest of Northern Rhodesia to proceed to Independency as one country and its peoples as one nation. It is often said that Barotseland or Western Province as the oppressors prefer to call it is an integral part of Zambia. The intention of this statement is usually to imply that Barotseland is just like any other province which is definitely not the case. The Barotseland Agreement 1964 had to be signed, simply because Barotseland was not just another province and unless we get to understand that basic fact we will never get the answer right to the Barotseland Agreement 1964 issue.

ABROGATION

The unilateral abrogation of the Barotseland Agreement 1964 in October 1969 by the Kaunda led regime clearly means that Barotseland is free to stand alone as a fully autonomous Monarch (Constitutional Monarch for that matter). According to the Vienna convention on the Law of Treaties if one part of an agreement breaches the terms of the treaty that breach sets the other party free of any obligations under the treaty.

SECESSION

Barotse self-determination activists are often referred to as secessionist in order to intentionally and maliciously victimize them. In truth the word secession does not apply in as far as the issue of Barotseland is concerned. In my humble understanding to secede is to subdivide a single object into more than one unit. A unitary state to me means a combination of more than one ‘state’ to make a unit. When two parts are glued together, depending on how tough the ‘tuff Stuff’ used is, there is always a chance of the two parts falling apart like Chinua Achebe seems to suggest by the title of one of his novels ‘Things Fall Apart’. If indeed the term secession does apply in this case, then it is the government of Zambia which is guilty of secession and has ceded Barotseland from the rest of Zambia by way of the unilateral abrogation of the unity treaty, Barotseland Agreement 1964.

CHANGE OF NAME

In the same year that the Barotseland Agreement 1964 was abrogated the then president of Zambia also invoked his power to change the name of Barotseland to Western Province without consultation with the Barotse people or Authorities. To the people of Barotseland the name ‘Western Province’ is a slave name. That is what slave owners used to do upon acquiring a new slave they would give that slave a new name like it or not. In similar style after KK broke the unity treaty Barotseland came under servitude to Zambian Authorities so he gave his new slave a new name! We resist the slave name with all the contempt it deserves and discard it henceforth. After all Barotseland is not a province but a sister state with the rest of Zambia!

CONCLUSION

There is only one remedy to this ailment, let Barotseland go so that it does not have anyone else to blame for the underdevelopment, unemployment and poverty that is so prevalent. This demand is not new, strange or unique. Just like when marriages fail there is separation and finally divorce. In the same way when unions between states fail they breakup. USSR, Yugoslavia, Eretria, and most recently Southern Sudan are just a few examples. In any case Barotseland will be a good neighbor to Zambia (or whatever that county would be called after Barotseland is not part of it) like it would be to all its other neighbours.

May I thank this honourable commission and each of you commissioners for listening to my simple but realistic submissions, I presume.

  4. The author failed to elaborate how exactly KK abrogated the agreement. He hasn’t clarified whether Barotseland was just Western province or includes southern, north west, copperbelt, central, parts of Angola, caprivi, parts of Botswana and Zimbabwe at the time of signing the agreement.

    • The building of this road was stop by the PF govt. It is the only road in the country that has been stopped by the tribal PF govt. If you new the relationship between cause and effect you would understand why some Lozis are calling for self determination. But then you are just too daft!

Yesterday i was reading the full Barotseland agreement signed on 18 april 1964.It focuses on ceding to Zambia and its people enjoying the full rights of Zambia but retain certain control over land and other issues but that clearly contradicts the Zambian constitution.The B.A also states that all questions on the B.A will be answered by the Zambian high court not a commission.The B.A is not reversible as long as Zambia exists.Infact it endorses the creation of Zambia and its birth.Lets not mislead people.GOD BLESS ZAMBIA.

Wantanshi you are right about the geographical position of the so called baroseland. with this in mind i dont see how workable this breakaway can be as this involves the govenments of zim, botswana,angola and namibia and not forgeting the chiefdoms in parts of southern,c/belt, central and n/western provinces.

    • Stop lying. The 1964 Barotse Agreement specifically refers to the place now called Western Province. Western Province was known as Barotseland. Kaunda renamed Barotseland as Western Province in 1969. So please dont bring spurious and manufactured lies about the issue. You are a very dull person bereft of any decency. It is very st.upid and dishonest 4 some people on this thread to create stories about the Copperbelt, Caprivi, Botswana or Zimbabwe. You are just being silly! The Barotse document (Agreement) which Kaunda, Mwanawina and Duncan Sands signed was specifically for Western Province which was then known as Barotseland. So please stop your dishonesty!   20. It is sentiments like this that have hoodwinked the larger Lozi populance!!

    First, such sentiments have led to underdevelopment in WP because even private investors have been chased away because they are perceived as foreigners.

    Secondly, such sentiments have made Lozis want nothing to do with anyone that is not Lozi, what a shame.

    Thirdly, when people cannot see beyond tribal lines (educated or not educated), everything is either Lozi or not Lozi and this limits our thinking in terms of development and finding solutions to our problems – it is easy to blame anything that isnt working on non-Lozis because life is either Lozi or not Lozi!!

If at all it were possible to debate this without either side feeling insulted or rejected then one would actually have a unique insight in to why other tribes were duped with a few words and yet a more extensive document was needed for BA. At time of independence the territory known as Zambia had several unresolved border disputes. Even a basic geography book in the 70’s told you which ones. Add Congo to the list of those mentioned already. BA is an incovenient truth and will get kicked down into the future to be another generation’s problem to solve. Insulting each other is pointless, fake tribalism and shows selective ignorance. Keep the BA debate in the open and calm down. Zambian peace is preferable and so is tolerance. We do not have to agree with each other.

  23. Prince Litia Litia, I do agree with you that the agreement should be restored forthwith, because it has never been implemented. Where I do not agree is where you say the province should separate from Zambia. Nevertheless, if the agreement issues are not resolved, as in any case where two parties do not agree, their should be an agreed way forward to resolve the issue either torugh arbitration, or indeed negotiations. But yet I agree with you that the agreement be restored, and I think that is what we have heard from government in the recent speak in parliament by Hon Nathaniel Mubukwanu. Perhaps the concern here is that government have not spoken clealry on the steps being taken to restore the agreement and the timetable to that.

What was the pre existence status of Baloseland in relation to the Federarion of Rhodesia and Nyasaland? I believe at that stage KK was not leader of Zambia as she was non exist. How did the colonial master look and regarded this province in relation to delimitation within the coming of the new sovereign state of Zambia. What terms were in the agreement in which you inorm us that there were two indipendent teritories “one Zambia another Baloseland”. This being the concept you enspouse implies Baloseland would not have been part of Zambia. I suggest and put it to you that Baloseland was just under the colonial rule as any other

  30. The Problem is that we understand ‘Restore’ of an agreement in a different way. For us at state house, we only restore that which has been damaged or lost its original form. We agree that the agreement lost its orignal form and we shall restore it. But does restore mean secession? No! Because with secession it means u have no interest in being togehter. but if we restore which is what all lozis are saying then we continue as one zambia one nation. Its sad and infact stupity by some people to think that when PF said we shall restore they meant we shall separate. In simple words all we said is that we shall perform and rule barotse as the 1964 agreement.

There is nothing Kaunda can explain because that piece of paper not a document clearly says all questions on the B.A will be handled by a future Zambian high court.The B.A establishes Zambia as a future state which it is now.Can it be reversed?I dont think so.Any one with a problem can go to the high court of Zambia not Angola,Namibia or Zimbabwe.In my view Kaunda is hero because he outsmarted the Barotse people.We owe Zambia to him and many of his smart coleagues.If we reverse the B.A then we go back to Northern Rhodesia of which still Barotseland was a party.This becomes complex.     The truth is we Zambians have been accepting mediocrity, greed, poverty, tribalism and declining moral standards for a long time!   37. So, is it just a coincidence that Barotseland became independent at the same time as Northern Rhodesia? Or it is because the two regions worked together as one before independence. 

    I think it is arrogant for westerners to want to break away, in the name of broken agreement, after we (northern rhodesia) helped them break free from British protectorate.

    I continue to doubt whether there is any good to recognise or honor any demands of self-determination from any tribe in Zambia.

    What tickles my sentiments in the lecture at hand is how this Prince Litia manipulatively uses the word “simple” to diminish the complexity of the case in an attempt to persuade the commission that there should be no difficulty at all in accepting his submissons.

    @ Ricky Bobby – it might be of interest to you to note Barotseland was autonomous even when so called Northern Rhodesia, Southern Rhodesia and Malawi were a federation. Your sentiment is probably shared by others but innacurate. Those wishing to ‘divide and conquer’ recorded their exploits quite openly. Times have moved on but the uniqueness of BA remains how much recorded history dating back to the 1800’s is available. I wish it wasn’t so emotive an issue for there is a lot that can be learned and we miss it coz we get heated up by words of others.

  55. Labelling of a people exercising their God given rights as tribalists is a scheme hatched long ago to have Zambia dominated by a certain region. Ask KK. He knows this very well, and he resigned over it “The Night Without a President”. People from other regions asking for a stake in the Governance of the country are labelled Bantustan or Tribalists. See how a young leader from a known region is being sold as an apparent heir to MCS. The Barotse people (my Nkoya matriarchs included) have been cowered for too long. Now it’s over. It’s either BA 64 is restored to allow the Barotse to determine their own destiny and development agenda, or, failing that, secession together with regions that feel can do better with Barotseland than with Zambia.

  62. Prince Litia, you have stated your case to the commission very well. But the issue of slavery cannot end at the Bulozi being enslaved only. The Nkoya and Luvale people whom the Lozis look down upon do not want to be part of Barotseland.
