Henry’s charges can only be revealed if he presents himself-Inspector General

Inspector General of Police Stella Libongani has said that the charges against the fugitive son of former President Rupiah Banda, Henry can only be revealed when he presents himself for question before law enforcement officers.

The Inspector General was reacting to South African High Commissioner to Zambia Moses Chikane who is quoted as saying that his country cannot extradite Henry to their Zambian counterparts in the absence of charges.

Ms Libongani said it is now the responsibility of Interpol to avail the details of Henry Banda’s case to South Africa since the Zambian government has handed over the details to French based police organisation.

Henry, the most prominent son of former president Rupiah Banda is wanted for questioning in connection with the engagement of RP Capital Group to evaluate Zamtel assets at the cost of $2 million and the subsequent sale of the company to LAP Green of Libya.

The Zambian government has since reversed the sale of Zamtel and returned 100 percent ownership of the telecommunications company.

And Ms. Libongani has observed that intellectual property rights violation poses serious threats to the country than just economic loss to the rights’ holder.

She says the failure to protect intellectual property rights undermines confidence in the economy, removes opportunities for growth, erodes the country’s technical advantages and disrupts fairness and competitiveness in the market place.

Ms. Libongani said this at Lilayi Police College in Lusaka this morning during the opening of a five day decentralization training seminar on intellectual property enforcement organized by the British American Tobacco.

She says the focus of the programme is to ensure that at the end of the course, the police service should be in a position to decentralize the functions performed by the IPU unit at the police headquarters to other provinces of the country.

    Or did the writer of this article ‘misunderstand’, because apparently charges were made available to Interpol?

    Secret charges, suppressing the press – not a good way to start for the PF.

    • Charges are read to a person in their presence, and a statement recorded. You don’t convey charges through a third party. Where have you ever heard that a person has been charged before being arrested?

    • Is HB innocent or does he know he has committed crimes, therefore he cannot come to Zambia to answer for himself?

If she didn’t know what to say, she could at least have asked for a written questionaire and then given it to some professionals to answer it for her. It’s like the Zambia Police are refusing to act professionally otherwise they’ll be transfered to,er like, Shangombo.

  16. On point 1 – HB is innocent til proven guilty and pretty sure the government will work towards charges if they have the evidence. Until then the rest is just politics and international politics. South Africans have taken quite a rough ride trying to get that Brit Asian chap to face trials do they had a little tussle with Brit versus Sa versus human rights themselves:)

    On point 2 – I sincerely hope that IP in the constitution will be heavily revised and updated. I work in this arena and was once a victim of our own delay when my IP was being abused globally because it was still buried in a statute along with mining and pharmaceutical rights and working off 1911 British law where ‘natives’ were not covered… At any rate it forced me out of Zed after WIPO came the first time round.

  17. Ever since this woman threated to investigate her Uncle the Prime Minister C. Sinyinda, what ever she says is unless. All what Mr. M. Chikane was clarifying is that Henry is a free person in South Africa. SA High Commissioner to Zambia Moses Chikane has said that Former President’s Son Henry Banda cannot be handed over to the Zambian authorities just because they are needed for questioning. The High Commissioner said that his government would need solid charges before extradition can take place. Its only in Zambia that where you arrest people without solid charges.

  18. Henry’s return to Zambia may be complicated further by the fact that South Africa does not extradite people to countries that have a death penalty such as Zambia, no matter what nature of crime they have committed because of the Bill of Rights in their constitution.

    “Our Bill of Rights, which we take very seriously, does not allow us to extradite people to countries that have a death penalty,” Mr Chikane said, and continued: “It doesn’t matter if somebody killed a hundred people, we can’t extradite them to a country with a death penalty,” he said. – WHAT ARE YOU GOING TO DO STELLA LIBONGANI? EVEN A LAY MAN KNOWS THIS THAT THE POLICE CANT ARREST A PERSON AT ANY EMBASSY IN ANY COUNTRY.

  19. No wonder SA has refused to release him, Henry committed an unknown crime at an unknown time and date and whilst acting together with unknown people. As far as we are concerned he has no case to answer.

  20. She has a point in the sense that they have cleverly handed over the matter to a french group which will be able to hand charges to SA.

    Henry will then apply for assylum on grounds that he may be victimised in zambia. The libyan group will suffer loss and will start pushing pressure on SA to release him so that their case can have basis for compesation. Zambia has very little to lose if henry is not released but the libyan will go for his blood in SA.

  27. Henry was not a government employee. So what if he introduced or even got a cut from RP capital. It was a business transaction. The only problem here is that the government wants to punish him for that role. They can’t separate business no matter how bad the deal was from criminal acts. We got Zamtel let us move on with our lives. Henry will now become even more powerful like this. The more you fight the mafia the more powerful they become.

The SA High Commissioner was very clear and was even polite to spell the conditions out because as professionals you madam should have known the international conditions for extraditing someone. But you seem to be arguing with set conditions so what happens? You wont get what you want. The international community are just thinking you are dull, now.

  31. f SA has similar laws to Namibia, then what happens is that after a request, the person is arrested and brought before a magistrate and it’s up to the country that wants the person to prove before a judge why the person must be extradited. It’s up to the Zambian government to prove to the SA judge that Henry has committed crime and there is ground for him to arrested. The PF does not understand international law.

  32. People have been charged and tried in absentia…..charge hery and try him in absentia. Convict him in absentia…then if its Genuine SA will hand him over…No No abolish death penalty first…oweeee mayo! 4get it !

    • that would be very unfair as its things stands the zambian government has not given the international community to prove this guy is a criminal as opposed to hearsay which they have been doing all along. remember henry has no criminal record here in south africa and that will prove difficult to extradite him to zambia..

  33. I agree with you Lundazi Dweller, I mean what crime has he committed? I have never really understood the crime that Lap Green committed. EG-I am a prospective buyer and I sell myself well to a middle man who introduces me to you, the seller and your entire family, I pitch myself so well that you lower your price, I mean the gem is in your house. I do this not at gun point, no duress or any other promise except looking after it well, you fall for it, why should I be liable? Henry has no OBLIGATION to hand himself to the police at all; make their work easier, let them sweat it out. Look at how the FBI looks for people, maybe copy some ideas. So madam Stella please run to the AG for further advice on the extradition issue. Muno mu Zambia circus tayakapwe kanshi?  SWITCH ON!!!

  34. This is fishing a expedition and a total violation of international law. Mr Banda should not avail himself to a justice system operated by political cadres and no matter what he does or who he hires to represent him, the probability that he win the case is 0.00000000000000001. Libongani should respect international law and there is no government on earth that handover a suspect to be tortured.

Dora is inside without bail and before a trial for a bailable charge.   41. Comedy continues! I think the RSA High Commisioner summed it up well; this is a non-starter until specific charges are laid on the table. I bet you, we’ll be talking about this till 2016 (assuming we even reach that far!). PF should focus on governing while the police should silently investigate and only publicize when they make an arrest and charge the accused. Thereafter, the due process of the law should take it’s course. What we’re witnessing now is a circus full of clowns and entertainers.

  42. Ok, what the hell is going on here? First, ZP says Henry is a fugitive and seeks Interpol help to locate him. Then we hear, he is in Kenya, then we told by his father last week, that Henry has permanent residence in SA, where he is happily living with his faimly. This does NOT sound like a fugitive to me. Something is not adding up here. If the police are aware of his whereabouts, why not involve that country’s police wings to arrest him? I took the liberty to got to the interpol website: http://www(dot)interpol(dot)int/Wanted-Persons and there search fro Henry Banda. He is there, though there’s no picture of him. Bu the charge is definitely, FRAUD. So, what is the deal between, ZP and the SA official? Arrest Henry already, damn!!!!!

Inspector General it appears you as much as the President have no knowledge of the law my husband Mr Rajani Mathani says under South African law the Zambia Police Service is required to apply to the South African Courts for extradition of Henry Banda giving valid grounds then if the courts find the grounds deserving Henry will be extradited. Otherwise IG go suck eggs you are barking up a wrong tree

  45. The Inspector General of Police Libongani should be advised to work professionally, and NEVER act as a PF cadre. The life-span of her bread winner is about to eclipse in a few days time. She is openly participating in the persecution of RB’s Family.You better start reading science to get an alternate job for which she was properly trained for her BSc degree at UNZA. It will not be long when we shall be expressing alarm and disgust when we meet her on the streets. South Africa respects the Rule of Law and therefore will not cooperate to foster Kangarroo Courts in Zambia. We are cofident that God will answer the National Prayer to restore this country to normality. Let Libongani appreciate the meaning of parables!

  48. Hiding behind Interpol. Interpol is used when a fugitive’s whereabouts are unknown. When you know where the alleged criminal is staying, you simply apply to that country’s justice ministry for extradiction if you have an extradiction treaty with them. I am just wondering whether we have learned Police officers in Zambia. This is not even a case of the Police but the Justice Ministry and Attorney General in Zambia. What we are seeing here is pure political posturing to tarnish a person’s image. If Henry Banda turned up, they will lock him up, water board him until he turns witness against his father. This is all leading to getting at RB.

Tell your PF govt to spell out charges and offences Henry committed and hand them over to South Africa and if proven correct, South Africa is under obligation to hand over Henry to Zambian authority. In short she expects Henry to come to Zambia and will not do so as long as she is not ready to say the offence committed. Whose ball is this?

The police issue call out because they do not have logistics to get to the alleged suspect. So they (police) can sing all they want as an an alleged suspect you have a right to stay put.

      Look at your post in 69. It is clean and informative. That’s how civilized people criticize. The whole point of constructive criticism gets missed when you punctuate your utterances with foul language…that’s just plain insulting!
