Mwenye urges Court to dismiss Tribunal injunction

Solicitor General Musa Mwenya has made submissions supporting summons for the High Court to dismiss the injunction for judicial review filed by suspended Judges.

Yesterday High court Judge Flugence Chisanga stayed proceedings of a tribunal appointed to probe the alleged professional misconduct of the three Judges who argue that it is illegal and premature.

The Judges who filed the injunction are Charles Kajimamnga and Nigel Mutuna.

The Judges filed the application for judicial review through their lawyers application by Erick Silwamba and company citing proceedural impropriety by President Michael Sata in constituting a tribunal to probe their alleged misconduct.

Judge Chisanaga adjourned the matter to tomorrow to allow the applicants time to file in a response before a ruling can be made.

Government is seeking to have the injunction revoked to allow the tribunal to start sitting.

The tribunal which was sworn-in by President Michael Sata on Tuesday this week was expected to start sitting tomorrow Friday 18th May.

Justice Minister Sebastian Zulu has described the injunction for judicial review filed by the Judges as illegal.

You understand well that when you want to move into the apartment or a house where you are, the apartment or house needs to be cleaned. So cleaning up the mess left in the last 20 years.. will help build Zambia. Corruption sucks..

Please take time to refer to the American Constitution and the way it defines the separation of powers between the three branches of Government. Most really need to further their education but again most of them did not even qualify to get to UNZA not even Evelyn Hone College and/or their equivalent so, what do you expect? They seem to be okay with the minimum wages they get.

    • Disclaimer: Not referred to Ba Wechipuba above, just reference to an average Joe, American’s included … thought I needed to make that clear even thought his point (Wechipuba) has some validity especially when it comes to cleaning house. I for one was actually a little naive concerning the judiciary and corruption therein but now, I am learning more with this case. Every objective individual can tell there are smoke screen issues just looking at the last 14 days. I like what I see.

  7. I have to praise the manner in which the Judiciary has exposed the Govt’s interference in the judiciary. Seb Zulu, justice minister, is now on record as instruction the Solicitor General to ORDER the courts to stay the injunction. This is a farce and it’s all about the K14b tax payers money. The nation should rise against M’membe and demand the removal of Nchito as well as impeach Sata. We can’t be focussing on in fighting battles as a nation when there are pressing issues to attend to. Get rid of the whole lot and we start again.

Why have the Other Judges resorted to putting in a Judicial Review concerning the President who has the Authority of the State?

    • You don’t seem to understand. In a democracy, the judiciary has the authority to question the behavior of a president. If he is found wanting he can be prosecuted. Except in this case, the president controls everything: the legislator, the executive and the judiciary. What a country.

    • The President is not above the law. If he breaches the constitution which he swore to respect he can be impeached and removed from office. He may be President but he cannot ride roughshod over the constitution. Without rule of law you are in dangerous waters and you may drown.

Down load the USA Contitution and educate us on the Separation of Powers of the Executive, Judiciary and Legislature and you shall see that we are miles apart from attaining the same. HE HAS BEEN LOOKING FOR OPPORTUNITIES TO DO SO. SO HE USED THIS CASE AS A PORN IN THE WHOLE GAME. THE IDEA IS TO FIND THESE JUDGES INCOMPETENT AND MANY OTHER THINKS WILL BE VOMITED ABOUT THE JUDICIALLY (AS WE HAVE SEEN FROM MOHAN EVEN WHEN WHAT HE IS SAYING IS OUTSIDE THE TERMS OF REFERENCE (THE DBZ CASE). THE JUDGES OR SOME OF THEM WILL BE FOUND WANTING AND THEN PEOPLE LIKE FR. FRANK BWALYA, LAZ, TIZ AND CALL FOR THE RESIGNATION OF THE CHIEF JUSTICE.   16. It is now clear where it all leading to. The target is the chief justice and other senior officials in the Judicially associated with MMD. The Judicially knows this. Sata has been looking for an opportunity…so they used the DBZ case as a porn in the whole game. It is clear those judges will be found wanting… Then LAZ, TIZ, Fr. Bwalya will demand for the resignation of the chief justice for incompetence. They would also demand more to be investigated. The Cobra will use that to go for Judicially in the name cleaning it (by putting their own) The only problem is they probably rushed and used the wrong case… and it may back fire…

Let the process begin and let the chips fall where they may but in the end, it is all good for the smart people of the Zambian Enterprise.     • “One land and one nation, is our cry, dignity and peace beneath Zambia skies, like our noble eagle in its flight.” Only kids born after the 70s or 80s think this is a joke for they were spoon fed without sacrificing anything. These judges were corrupt period, and all the more reason the President did not bother with a JAC because as judge Flu(what) Chisanga has ruled, they are birds of the same feathers and will do everything to protect each other.

Coachez and I were just signing our national anthem and you are asking me or him what level of education we have attained. Man, if only you knew … we are both academicians who are not interested in display our chains of degrees here. We own them not you, they make us who we are not you and we make tonnes of money using them not you. What concern is it of yours to know my level of education. It shouldn’t be, just as it shouldn’t be mine knowing how poor/rich your bank account could be, more probably the earlier than the latter.

I thought that the very essence of sending Musa Mwenye to appeal is to give the Judge a chance to prove for us all whether or not your actions themselves were illegal. Anyway, why are you in such a hurry? Judge Flugence Chisanga set 30th May to hear the review, that is barely two weeks from now. Surely this is not a matter of life & death, or maybe it is for your friends who are now threatened with bankruptcy and shame?

Please Judge Chisanga, do what is right, “do not be afraid or be intimidated” to borrow the words of the President to Judge Chikopo.

    • Sheikh, the judges are not refusing the investigation or the Tribunal but they have recourse in law, why shouldn’t they use it? Why should they sit on their rights? Legal people advise us that each and every person, judge included, have right to be heard and one is innocent until proved guilty. Why in your wisdom should this not be availed to them? You are a blogger who needs to gain some education and not the other way round. If there is a loophole in the law then at the appropriate time the Executive should come up with a policy and address it through the Legislature.the Judiciary is there to implement what the other branches of the Govt has decided. So don’t blame the judiciary. Right or wrong, let the judges also be heard. No short cuts!

  27. We say no to a tribunal which was formed irregulary. Why should UKWA cry foul when he messed up by listening to those his foolish masters. We want a clean corruption fight by clean people not UKWA and his corrupt friends. Twakana, Judge Musonda is guilty thats why he was running like a headless chicken. Kajimanga and Mutuna are men of integrity, speaks volumes of where they come from. But Bembas have let us down so far. You can insult me for all I care but I am stating a fact.

  28. Musa Mwenya is wasting Judge Chisanga’s precious time. The judge has committed that she will start hearing the arguments on 30th May. Why cant Zulu be patient? Is he getting a cut from Judge Chikopo? A stay is not a judgement. The judge just wants to weigh the actions of the president to determine if he acted reasonably and was not being arm twisted by Membe. I see nothing wrong with what judge chisanga has done.

  29. Sata is creating arnach in this country. He wants too many short cuts. His friends and financiers can go directly to him and complain and their case washed out like it happened with matani, membe and nchito. What of us the poor masses? can we be allowed to enter state house gates to complain. Sata wants to create two legal procedures in Zambia, one for his rich friends and another for us the poor people. How can the DPP enter a Nole prosequi (wash out) in matani’s favour when he owes matani billions of Kwacha. That is corruption. Of course matani went to state house to complain and the president directed that he be aquited

  30. Remember this same sata that set up a commission of inquiry to find out how finance Bank was grabbed from matani. But before Zulu finished gathering data, this illiterate gave the bank back to his rich friend. More than K1trillion of tax payer’s money was pumped into this bank by the Bank of Zambia to sustain it after the Bank Run it suffered. Part of this public money is still sitting into this stinking bank owned by sata’s rich friend matani. Sata is doing nothing to have this money transfereed back to BOZ. Perhaps he has got a cut already from Matani. Maybe thats why he has no intension of contesting in 2016. The guy’s nest is already feathered.

  31. I been following discussions on this matter from a facebook page on the Zambian peoples parliament. It all seems that the best way for all High Court and Supreme Court Judges to do is tro resign. you will never be independent with the precedent that will be set 2moro by yourselves. Leave those pieces of Silver and save your faces. As with TIZ, we know where the problem is. Its all about the personal vandetta against Judge Musonda over the Dora Siliya matter. So, now Zambia is worse off than when we had the MMD. Those judges will never get any fair hearing.

Musa Mwenye has betrayed Judge Kajimanga in particular in the sense that Musa is what he is today because Judge Kajimanga employed him.  Judge Kajimanga sold the firm to him when he was appointed as Judge and continued to conduct business in the name of Kajimanga.  He exploited a competent secretary Ms Gloria Kazhila (MHSRIP) until she died because he paid her peanuts and died with depression.  Mumba Malila is a personal friend who has decided to dance to Ukwa’s music or Ukwa has decided to not listen to the learned counsels as he is known to be un teachable.  The truth will emerge and Ukwa is headed for a down fall.  Presidents come and they go but Judges retire when they attain the retirement age and not prematurely because one doesn’t want to pay K14billion.

  36. Countrymen, No one doubts there is corruption in the judiciary. The issue even in a work scenario is that the grievance procedure has to be followed. Even a prostitute in the streets has to be charged and arrested according to procedure.

  44. Guys,especially those blogging from the diaspora and the like minded ones at home,should endeavor to see what harm a corrupt Judically can inflict on a nascent democracy like Zambia. The tribunal has not commenced its sitting and people,may be relatives and close associates to the implicated judges, want to subvert and usurp the President’s constitutional powers through their unreasonable rantings on this site. No one is infallible, and untill you are found with a case before the courts with corrupt elememts at the helm, you will never appreciate what the HE MCS is trying to do for the poor who have no means to bribe these judges. Justice should be accessed by every one without regard to ones status,economic or otherwise. Alot of complaints have been levelled against high judges.

All we can see now is to what length the state is willingly to destroy the justice system all to serve Mmembe and Nchito and not the ordinary Zambians whose K14billion was taken in the during day light.

The problem is that this culture was brought about by Mmembe and the post constantly and openly insulting the presidency, to an extent that some people have been rewarded for inuslting that office in the name of Malumbenga whose editorials are there just got to the archieves at The Post.

  50. Mmembe killed the case for the tribunal even before it was hatched. He personalised our President so much in his stupid editorials as if he was Membe’s personal president and not of Zambia. By ‘Michaelising’ our president, Mmembe has made the case appear to be a favour by the president to his friends. That being the case and in all fairness, Mmembe’s excitement has brought us to the unfortunate situation where the president should declare interest in this matter as should the DPP.   57. This judge must be invesgated for stopping the government from probing corrupting in the judiciary. Who know what she is protecting or hiding? And what power does she have to oppose the president? Come on do not let her go scoff free for her actions, they might be distroying evidence or tampering with witnesses during this period. Get this lady start talking. The president has not fired those three judges, why are thy refusing from being probed, and why is this lady of theirs according them ill conceived escape from wrong doing?

  58. I thought this tribunal was going to help these Judges clear their names. They are instead fighting. Any skeletons?????
