“Am ready to testify against corrupt Judge Musonda”-Matthew Mohan

IN a dramatic turn of events, incarcerated business executive, Mathew Mohan has come out claiming that suspended Supreme Court Judge, Phillip Musonda, visited him at prison to coerce him not to testify against him if called as a witness before the tribunal set up to probe the conduct of three judges.

President Michael Sata suspended Supreme Court Judge Musonda together with High Court judges, Charles Kajimanga and Nigel Mutuna and set up a tribunal to investigate their conduct.

Media reports last week stated that Mr Justice Musonda had, three days after his suspension, visited Mohan at Chimbokaila Prison where the latter was currently serving a two-and-half-year sentence for theft.

But Justice Minister Sebastian Zulu, in a letter to the President, which was published by the Times on Saturday 12th May 2012, said Mr Justice Musonda had visited him at his office on May 9 this year where he denied having visited Mohan.

The judge also lodged a complaint that the Director of Public Prosecutions (DPP) Mutembo Nchito had conspired with the Zambia Security Intelligence Services (ZSIS) to fabricate evidence against him to destroy him.

Mr Justice Musonda claimed he did not even know Mohan.

But Mohan alleged yesterday at the Lusaka Magistrate’s court during a snap media briefing that he recalled that Mr Justice Musonda visited him and asked him not to testify against him during the tribunal sittings.

Mohan, who said he was ready to testify before the tribunal about the alleged corruption in the Judiciary, alleged that Mr Justice Musonda could not dictate to him what he should or not say.

“It’s true that Mr Justice Musonda visited me in prison and everyone saw him. I spoke to him and I do not know why he is panicking. He came to beg me not to testify against him in the tribunal,” Mohan said.

The former Ink-Tech managing director, after appearing before deputy registrar of High Court, Chilombo Phiri where he is facing corruption charges, said that it was shameful for Mr Justice Musonda to claim not to know him.

“Today Musonda is saying he does not know me, shame. In Bemba they say “Tabatuka ng’wena amolu yali mumenshi.” No one will stop me from talking the truth about how rotten and corrupt Mr Justice Musonda is,” said Mohan.

Mohan further said that he would not comment much on Mr Justice Musonda’s visit but only say “a beggar is not a chooser.”

He said, in a statement copied to his lawyers Bonaventure Mutale SC, Likando Kalaluka and Kennedy Kaunda from Ellis and Company, that Justice Musonda and his group would not tell him what to say.

Mohan alleged that Mr Justice Musonda first went to his lawyers but after failing to achieve anything, he went to offer him a reward to keep quiet over certain matters.

He said Mr Justice Musonda should not accuse Mr Nchito and ZSIS of anything because they were not there when they allegedly engaged in corrupt activities.

Mohan was yesterday expected to give his defence in a case where he and two others are alleged to have offered K10 million to a court interpreter.

Ms Phiri yesterday set June 28, as judgment day in the matter.

    • How does Mohan become a credible witness in the DBZ vs Zambian Airways case (refer to terms of reference). As much as I would like to rid to judiciary of corruption, Mohan’s credibility is highly questionable. I say, lets wait and see.

  9. The state is so desperate that it has to use a discredited witness? In a court of law Mohan would not be seen as a credible witness. He will say ANYTHING to secure his freedom. All this time and energy should be focussed on developing the country and not on trying to make sure that Membe and Nchito dont pay back what they owe.

  12. now this is a judge that the opposition parties in in Zambia dont want to have him investigated, uh? they have just lost my vote, 2016 am voting for Sata again…..most people are enraged just because this issue involves m’membe and nchito, who they think are the powers behind Satas presidency, the opposition hate them cause they view them as obstacles to their political agenda. but we have to remember that the two are actually not arguing against the judgement itself but rather the procedure and i dont care who is involved cause what is important to me is, did the judges really connive? did they follow the law? was there corruption in the way they handled this case?

  16. THE JUDGE IN QUESTION IS IN DEEP TROUBLE IF MOHAN AND OTHER INMATES WILL TESTIFY THAT THE JUDGE DID VISIT MOHAN. WHY WOULD A JUDGE VISIT A CONVICT IN PRISON IF HE IS VERY CLEAN. THIS WHOLE THING REALLY STINKS.

  19. It appears Mohan has already tried judge Musonda and found him guilty – through the press that is. How unfortunate. Besides, will his testimony be taken as serious considering he is a convict? And, if while he was speaking he had the same cheeky smile as the one in this picture then I doubt if he is being truthful. We will wait and see.

Ask all Indians they will tell you all corrupt judges now include the Chinese you and me ordinary Zambian have one no money, secondly our thefts are trivial to say the least, ask undercover cops too they know it all why do you think such caliber of people have it all, executive cars, farms owning Kabulonga, New Kasama, Ibex…… we need to clean up people…. Can we assume it is given that Musonda started ranting many things such as Inchito and the shushu would kill him? He also asked for early retirement until layer Kapumpa pumped sense in him to keep quiet. Yes , its wait and see…many judges and magestrates will be implicated. Just waite and see guys.

    • In law a criminal can testify against another in favour of a lesser sentence.This happens everywhere SA ,US etc.So don’t panic.

  25. Did Musonda visit Mohan at chimbokaila prison or not? We all know he did. What we don’t know for sure is what if anything was the purpose of his visit and what was discussed during the visit? The truth will vindicate either one.

I agree with u Bambo John @32, but I think this tribunal will reveal a lot of hidden Issues from the Chief Justice down to the lowest ranks; its a clever way by the president of initiating the cleansing process by the judiciary, since they themselves could not do it and which they will resist as we already see. What do u do in a country like ours where the constitution does not guarantee clear separation of powers!!! Again showing an urgent need to conclude the constitution review process.

Am very much disappointed with some of our bloggers,honesty how can a very clean Judge visits a convicted criminal in prison and you are there accusing the state of coniving with the prisoner.If you think the president was wrong on that one then the fight against corruption will remain selective.The major problem in our country is that there is to much political influence in the fight against corruption.Its either with the ruling president or the opposition political parties,how can you win the fight?

    • If the state connieve with M’membe and Nchito to deprive and your fellow citizens out of K14b, why can’t they connive with to discredit anyone bound to stand in their way. The fact that a confidential letter addressed to the president, from another top official, Seb Zulu, was deliberately made public with the full knowledge of Sata says a lot about what’s going on in Govt. The alleged visit to Mohan by Judge Musonda a stint by the state and the intelligence wings to rub mud over Judge Musonda’s face. Whether he is corrupt or not that would simply not happen. As a Judge he knows only too well that a convicted criminal has no voice whatsoever in a testimony before a court. Credibility matters in a court of Law

This is very interesting, if judge Musonda really wants Mohan not to disclose certain information to the state then i can now see how rotten the Judiciary was under MMD government.I do recall how Mohan was assisted by the likes of Judge Musonda to escape from police cells and some innocent police officers were arrested and put on interdictions because of these greed judges.

  36. Where and when is he going to testify, this mwenye? The tribunal headed by by the Malawian import has clear terms of reference, and all concern misconduct of the judges in the matter at hand, and not any other matters outside – unless the tribunal will be directionless. Then they will be acting outside their mandate, if they listen to anyone who has ever seen the judges corrupt on any topic. How understandest thou the TOR for this particular tribunal?

  39. Mohan meant to quote the nyanja saying ‘osatukwana ng’wena matako yakali mu manzi’ but it seems he thought it was in bemba or he tried to translate it into bemba hence the distortion in his quotation.

    Kindly avoid insults with me. Insults only undermine you on this public fora. And i also have a business to run and cant keep speculating on blogs all day. As in this case, I have never known a court of Law, never mind a tribunal that will give any time or credit to the testimony of a man convicted of theft and facing charges of attempting to bribe a court officer with murder looming in his shadows. However empty tins will no doubt get excited about this and I have no doubt there is no merit in this. In any case the terms of reference for the tribunal is specific to the DBZ v M’membe and Nchito. A debt of K14b owed the Zambian people (and I don’t know why you turn a blind eye to your money) therefore I don’t see the use of Mohan to the tribunal especially Sata.

    • It is easier for a man to rise from the dead than for a foo! to admit they were wrong.

      I have another prediction for you – Mohan will be allowed to testify before the tribunal. His track record is important in opening the can of worms the judiciary have been hiding from the public.

      Oh, and the 14 billion you are crying about – even if it was paid back, people like you and me would never benefit from it, but feel free to keep making noise about it

  43. Mohan is suddenly back on the picture. He is claiming to have met Judge Musonda and is threatening to “spill the beans”.
    A reminder – Mohan was locked-up for several cases(Murder, forgery). Judge Musonda and Kagimanga refused him a bail application. Mohan has tried to throw mud at the judge before. One time Mohan escaped from custody and he was being hosted by a Policeman connected to the then Task-force boss, and curent PF Permanent Secretary for Home Affairs. Mohan was being represented by Bonaventure Mutale, one of the PF lawyers.
    Question is, are we going to clense the judiciary using testimonies of proven criminals like Mohan, who seem to be seriously connected?
