Police in Lusaka this morning broke-up a demonstration by United Party for National Development youths, to press for the resignation of Director of Public Prosecutions Mutembo Nchito.

Police broke-up the demonstration just as the UPND youths tried to join into Addis Ababa Drive from their party headquarters situated on Lagos road in Rhodespark.

The police who fought running battles with the UPND youths managed to apprehend some of the protesting youths who have since been detained.

QFM staffer Alexander Musokotwane who went to cover the demonstration was also beaten up be Police officers despite having an identity card.

Traffic on Addis Ababa drive was temporarily interrupted as the Police tried to restore order.

The UPND had vowed to defy a ban by the provincial police command not to go ahead with the demonstration.

The UPND and other opposition political parties are calling for resignation of the DPP over the K14 billion debt owed by the defunct Zambian Airways to the Development Bank of Zambia in which he was one of the Directors.

And Lusaka province Police commissioner Charity Katanga who led the police operation said Police will not allow lawlessness to take place in the country.

Ms. Katanga has further dismissed claims that the decision by police to stop the UPND demonstration was politically motivated.

She said that the UPND was supposed to follow the correct procedure in airing out their views to the public.

    • You need a permit to demonstrate. And the reasons must be justifiable, Mutembo Nchito’s case is in court and it’s not like he has been found guilty of a criminal activity… If all demostrations were allowed it would be lawlessness in the country.

    • Even the people that were demonstrating did not commit any crime. Where does it say that you should only demonstrate when a crime is committed? I see protests everywhere in the developed world.   17. As I recall pathetic fools supporters were behind the illegal demonstrations in Mongu last year on the 14th of Jan. Now they are against a demonstration by UPND? Anyway, with our clown Sata trying to woo investors in London, I think this would have been a great opportunity to show that Zambia is a mature democracy by allowing the demonstration to take place. I hate to think what Ukwa’s reaction will be if asked about this demonstration by some journalist in the UK.

Not long ago PF supporters where allowed to demostrate right within the High Cort premises. What kind of double standards are these, apart from if someone is applying Mugabe management; is it the reason for supporting him in Angola?

So, they have decided to demonstrate without a permit because it will never be given any  way.

As far as I know, there is no need for a permit to demonstrate as the public order act which required this was held to be unconstitutional so long ago I cannot even remember. The police are there to facilitate law and order during peaceful demonstrations. Threatening to beat up and actually carrying out the threats is not facilitating law and order. I am certain the police action will be challenged successefully before the courts of law that Mr Nchito’s friends ironically would like to see dissolved.

    • The did not demonstrate against Nchito in LPM’s Govt because back then Nchito did not have it on record as falsely and intentionally altering court records to advance the interests of his client neither did he have a judgement to pay K14b of tax payers money. If he did, believe me, it would have not gone this far with LPM, look at Mwaanga, Nevers and Kavindele, Nchito would have long gone by now.

Protests all over are normal methods of presenting opinions, grievances and appeals to those in authority that things are not well for everone in a nation. this is allowed in all democratic countries of the world and Zambia is at present one of them. Where danger is perceived those demonstrating are protected by the state security. When denied a permit people are not allowed to go on with their activity even during the time Sata was in opposition there are times when he was denied a permit but he did not force things by still going ahead. It is the police that did not give UPND the permit and not PF. The Police did a good job the only sad part is for the journalist who was beaten even though he had a card.   51. How has the issue of the Judges become a top UPND agenda while other political Parties dont see the need to protest and just watch as the due process of the law takes root. The President has been challenged through the courts and everyone has respected that, the tribunal has not gone ahead awaiting the due process of the law.

    The UPND wanted to protest aboiut the tribunal and the three judges, it is when they were taught by Police that the matter is in court that they altered the theme slightly to focus on resignation of the DPP.

  54. The law which required the public to get a permit from the Police in order to demonstrate was repealed a long time ago after the the State Vs Christine Mulundika and others case. The Procedure is simply to inform the police 7 days prior to the demonstration so that they can provide a police escort for the march. It is NOT up to the Police to give permission. The Police can only guide on the route to be taken if there is a counter demonstration in the vicinity. The Right of Assembly is guaranteed by the Constitution. The Police by acting the way they did have breached the Constitution and acted outside the law. In fact in any civilised country, Charity Katanga and Stella Libongani have committed an offence by promoting lawlessness and any patriotic police officer should arrest them.

The iol for example have touched on the ministry of finance where the top three officials are Sata’s relatives. The accompanying photo is the unkempt Sata with a cross.   70. My dear brothers who are none Bemba, we have been trying to counter Bemba pomposity and insults for quite some time now but they seem not to go back on their evil ways. I wish to beg every sane Zambian to now back off and let them have their way lest you sin against the most high. It is indeed painful to be insulted and called names but alas that is how they are cultured. Allow the Lord to fight our battles after all he created us and scripture says, vengence belongs to God. Everybody else apart from them is a tribalist, a fool, bitter and can never rule. May God’s will be done and let those who are insulted find inner peace.

  72. I respect Mutembo so much and he is a very good criminal lawyer period. However the some of the allegations that have been made against him amount to criminal offences and he can only be cleared by the courts. Its trite law that the consent of the DDP must be obtained in order the state to proceed with any criminal matter. In view of the preceding position of the law Mutembo cannot consent to his own criminal prosecution and cannot gather evidence against himself to secure his own conviction. Therefore he must resign so that he can clear himself and all well meaning zambians should support the demands of upnd.

Sata is desperate to cling to power using Mugabe’s tactics! Violence!   78. My comment is simple.Madam Police offer, just few weeks ago,we saw youths in the name of University of Zambia students demanding that Chief Justice Enerst Sakala resign,which procedure did they follow and more over it was at the high court primises?

  83. Zambia is on the slippery slope towards becoming a failed state. The right of citizens to peacefully demonstrate is a fundamental hallmark of a functioning democracy. The Zambia Police force behave disgracefully in brutally breaking up a peaceful demonstration mounted by an opposition party. Where are all the noisy NGOs, SACCORD, FODEP, TIZ etc. The international community is watching. PF leaders and Zambia Police Officers like Ms. Katanga could find themselves indicted by the International Criminal Court when PF regime is forced out

  85. It is shocking how people think the police should give a permit. The role of the police is simply to take note and provide security if they have manpower to cover the event. Which clearly in this case they had manpower. There is no permit needed except when a nation is under state of emegency. Pls stop commenting if ignorance is your mid name. Police have no right to beat, not even white collar creminals like M’membe should be brutalized as they send many into poverty by stealing from them.

  86. Let us not bring partisanship in this debate. This is a constitutional issue of freedom of expression. Constitutionally, demonstrators do NOT need to request permission. They only need to notify police of their intention to demonstrate and police is supposed to provide secuity. The police have abused their powers by denying UPND the right to exercise their constitutional right.

  87. You were warned. There is no stopping the chain reaction of endless hardship coming to Zambia. Brace yourselves Definitely the calm before the storm. A lesson will be learned. What’s laughable is many argue it’s lack of education. Forgive me if I may point out to you that many have come and gone with the so called education you are talking about and have failed miserably. 
    So education is not lacking,  but the education of developing the mentality to have a vision to build, strategy and focus and having a common goal of development for the country on the whole and being united. Until that happens Zambia will remain the same.

    The problem with Zambia’s or Zambian politicians is it’s all about self, status, being the loudest and wanting to important and having the privileges that come with the job.     Some people like blaming the Eurozone for our economic downfall. Well,  if we can’t stand on our two feet then we never will and remain in poverty and suffer. 
    Pray for the current leaders of Zambia and pray that they seek wisdom, guidance, understanding and clarity. God bless Zambia.
