Barotse activists charged for tearing the Draft Constitution and denied bail

THE 15 Barotse activists accused of tearing the Draft Constitution yesterday appeared in a Kaoma Magistrate’s Court and pleaded not guilty to two counts of malicious damage to property and conduct likely to cause a breach of the peace.

The 15 appeared before magistrate Exhornobit Zulu when the matter came up for plea yesterday.

And Mr Zulu has denied the suspects bail because they are allegedly a danger to society and can easily organise other suspects on the police wanted list to flee.

Western Province commissioner of police Fanwell Siandenge confirmed the development to the Daily Mail in an interview yesterday.

The identity of the suspects was not immediately known.

The activists were arrested and charged on Monday in Western Province for allegedly tearing the draft Constitution.

The offence was allegedly committed on September 6, 2012 in Mongu.

And the 15 activists applied that they should be granted bail because they are entitled to bail.

But the prosecution objected to the application because the activists are a danger to society and “can easily organise others to rise against the people of Western Province and Zambia as a whole”.

The prosecution said the court should deny the 15 bail because if they are released, they would warn other suspects who are on the police ‘wanted list’.

The matter has been adjourned to September 26 for mention and October 4 for commencement of trial.

  3. While most Zambians were watching the game either at the Levy Mwanawasa Stadium in Ndola or in their homes, many fans in Western Province missed it as the province, with the exception of Sesheke, had no power. I thought they claim they have nothing to do with Zambia??

    • For those who do not know the meaning of “dimwit”, it means ‘deliberately insulting somebody’s intelligience’. And this is not fair. It is better to contribute according to what you think is right. Do not insult, please. Reason nicely and do not insult other people. We are all Zambians after all.

    • Of course we are all Zambians and I don’t remember stripping you off your citizenship! Point is Zambians have different levels intelligence !

You would do well to realise that the people of Mongu all the way to Sesheke as Zambians cried foul to ZESCO, a Zambian company over the power outage.  You should stop dreaming devilishly because you will just get hurt in the end. Lozis like bembas, ngonis, tongas, kaondes, lambas, lenjes as well as all other tribes living within the confines of the territory of the republic of Zambia, are all zambians including you mwana wesu. Grow up because this hateful attitude of yours will lead to your death. “He who courts disaster in the end gets his wishes.” United we stand as Zambians of all tribes, colour and creed. 

  6. Indeed a picture speaks a thousand words. This is a clear case of double standards by PF Govt. How do these guys sleep at night?    

    • It was the prerogative of the then MMD government in power to arrest Sam Mukupa, not the PF.  If they did not arrest him, then nindaba zako for they had all the powers to do that. The lozi activists tore the draft constitution written under the PF government, hence their receiving what they asked for.

  7. Teach them a good lesson they will never forget. These guys were becoming more powerful than Government while they are nonentities. Please give them a maximum sentence so that others should learn to respect government property..shaaa. 

    • Dear Truth. How about the PF guy in the photo tearing a copy of the constitution. What should be done to him for not respecting government property?

  8. Which all of you guys would for once concentrate on how to develop this country,——-please…please….please…Lusaka Times,Post news paper,Watchdog and all these other papers,how difficult is it to report on technology ?

    • Dear maps#10.  Good comment. Imagine if most of this brain power on these blogs was channelled to focus on how to harness ,say: –  Solar Energy at family level (e.g. Cell phones without ZESCO bills, Or make ZESCO pay you by feeding power back into main grid at family level etc…) Or exploring how to save on cement, and costs, without compromising on lateral (sideways) strength of walls in house construction, i.e. interlocking bricks etc….Or drying sliced mangos and packaging for export. (wife just bought a packet from TESCO packaged in Burkina Faso!. Chewed as I typed this.). These types of issues would spur a new level of thinking and development everyone is hoping for…    

    • Well said Maps and Brabus. But sadly as long as people keep on preaching tribal hatred, there will not be room for constructive and meaningful discussions. I have written several times for more educational and informative topics to be published here and several other forums but there’s just too much hatred based on tribal lines. Even despite being bemba, I have refused to subscribe to mwebantu.com or tumfweko.com because the propaganda is just the same.

IT’S A SHAME. I HATE IT WHEN OUR PAPERS ARE REPORTING A MINISTER INSPECTING A COMPLETED BUILDING OR ROAD AND ALL YOU SEE IN A PICTURE IS A MINISTER HIMSELF AND NOT THE BUILDING OR ROAD.     • Your purpoted break away is just a fallacy. Unless you want to let people killed. My understanding is Zambia is a product of Northern Rhodesia and Barotseland. So Zambia is Zambia. Any president who will ever let go on part of Zambia will be the most foolish ever. If I were Sata I would make sure this talk of splitting is silenced because its a destruction from people’s willing to develop Zambia. It won’t be as easy as Sudan. This is a different case. Just let Zambian people live in peace.

    Who ever commits a crime whether its a PF , MMD or UPND should face the wrath of the law of Zambia. If indeed that PF guy was tearing the constitution he should have been arrested period. But if they MMD government did not arrest that PF alleged tearing the constitution we blame the MMD government as a government which did not follow the law of Zambia  as you know very well. They could not arrest him may be coz they wanted to trade off with their wrongs in the judiciary. But for these guys since as Zambians we want to uphold the law, they must be jailed period.

Truth hurts we can still cage the man, mulandu siuwoola even after many years, so cage him too if PF is not corrupt after all all corrupt deals are being reversed so what stops them from caging this man for showing the whole Zambia that he disrespected the constitution document. PF is corrupt period, they will answer in 2016

  14. Let me see if i get this right, they were arrested for tearing up copies of the draft constitution or copies of the constitution? Firstly does one have buy a copy of the draft constitution or can one get a copy free from government offices? Either way what i do with document afterwards is none of anyone’s business (note that i am stressing “Draft”), i can understand the second charge as it was done publicly, but the first is none starter as far as i am concerned and as for the reason for not granting bail.. please!!! Do these guys even have legal representation.

  15. A sin is better seen on your friend! PF’s are quickly hiding under ” the government of those days dint follow the law ” but now that you know the law what should be done to all culprits! Dint the people in the current government insult, dint they tear the DC, dint they use UNZA radio for their politics! Zambians let’s become civilized. Remember to everything we do we shall answer for them! PF do the best for our country to avoid problems in the coming years.
