LAZ speaks out against Wynter Kabimba’s conduct at ACC offices

The Law Association of Zambia has been inundated with requests from various stakeholders to comment on the alleged investigations by the Anti-Corruption Commission (ACC) of the two members of the Executive namely Hon. Wynter Kabimba and Hon. Geoffrey B. Mwamba. We as an Association have not commented on the matter in order to allow the ACC to carry out its work without undue influence. However, we were at the outset sceptical at the genuineness of the investigations considering that the two were serving cabinet ministers. We however, hoped that the ACC would act professionally.

The recent events surrounding this so called investigation are making us lean towards a view that the whole process is a masquerade by the ACC and the government to hoodwink the public that the government is investigating the two Ministers in an attempt to convince the public that Government is serious about the fight against corruption.[pullquote]The Minister of Justice being at the helm of the justice system in the country should be the last person to display the kind of behaviour broadcast in the press yesterday[/pullquote]

The behaviour of the Hon. Minister of Justice in firstly writing to ACC to demand for a report, secondly to threaten to sue them and lastly to refuse to be interviewed in the absence of his sympathisers or PF Party cadres is a mockery of the justice system and has only served to undermine the criminal justice system.

The Minister of Justice being at the helm of the justice system in the country should be the last person to display the kind of behaviour broadcast in the press yesterday. As a lawyer, the Minister need not be reminded that he swore an oath to defend and protect the constitution and this includes respecting law enforcement agencies. It has always been the practise that suspects are interviewed in the presence of their lawyers and not party cadres or sympathisers. We fail to see why the Minister should demand to be treated differently.

It is clear to us that for as long as the Hon. Winter Kabimba and Hon. Geoffrey Bwalya Mwamba remain in their positions it will not be possible for the ACC to carry out their investigations independently

Accordingly, if indeed there is a serious fight against corruption, we call upon the Republican President as appointing authority to send the two Ministers on Leave until the investigations are concluded.

We further demand that the ACC act firmly in dealing with suspects no matter what position they hold. The ACC have clearly acted unprofessionally in dealing with these matters and this selective type of treatment must stop with immediate effect. We doubt they would have allowed that kind of behaviour had it been from an ordinary member of the public

At the same time the ACC are urged to act speedily and professionally to conclude their investigations because the longer an investigation takes the more damage is done to one’s reputation should one be eventually exonerated.

    He says, hey guys you can not interrogate me. Unless in the presence of supporters.
    ACC fellas say ok sir, you may go.
    May be it can happen this way ni `pa zed, dont kubeba.

    • well on what grounds was he to be detained? firstly you cant say a minister is the same as an ordinary citizen anywhere in the world. the privileges they have are not the same. secondly any other ordinary citizen should be reasoned with on various issues that they have. i even see it on TV in law and order series

  3. I do not think Kabimba is a learned Lawyer! Suppose the ACC went ahead and interviewed Kabimba and the ACC appearing to be squeezing Kabimba, those cadres could have descended upon the ACC personnel!

  6. What do you expect from a government led by Michael Sata. The behaviour exhibited by Winter Kabimba is normal under this government.

I run the job board for the DallasPHP and about a third of the ads we publish are specifically asking for mrrfwaoek experience, particularly Zend Framework, Code Ignitor or Symfony. Frameworks DO add market value, but its in the job market, not the consumer market. Can a company gain credibility by choosing a mrrfwaoek? Maybe, maybe not. But a Developer can definitely gain credibility by knowing one (or more).

  7. Am very disappointed with how Mr Sata has decided to treat the allegations of corruption by his justice/secretary general. We don;t expect actions rom Mr Sata but just a show of concern is what we would have appreciated and his fight against corruption would have appeared at least genuine. what was corruption in MMD is now normal in PF. what double standards from the Head of State who lied his way to power. Nothing surprises me these days regarding Sata.

    . To think that this cabal was all over the place with fake commissions of inquiry to investigate corruption by the previous regime. The results were fat bank accounts for themselves, their relatives and tribesmen who sat on these money making scums. For a Winter it was a multimillion dollar oil deal and his own oil marketing company

I repeat, Levy Mwanawasa is dearly missed coz an embecile like this could not stay in power another minute.Leadership of the jungle,can only happen in Zambia (IN THIS DISPENSATION!) elsewhere this guy would have packed his entire career. How can ACC honestly work under this environment? step aside kabimba for justice to prevail.

    Section 112[1][c]”Any person who obstructs or in any way interefers with or knowingly prevents the execution of any legal process civil or criminal.Section112[2]Any person found guilty of a felony under sub section[1] is liable to imprisonment for 7 years.As State Counsel the behaviour of Kabimba is an embarrasment to the Legal profession and i hope the time will come when he will be called to account for his actions.

    • This is common and going to get even worse as the media start coenirvg more and more of these big domain sales. Every newbie domainer thinks they have big money domains, and expect a windfall of sales. They’ll all learn soon enough that domaining is not quick cash as they all anticipated!.

  13. Many of us have used the Kulima Tower bus terminus and we know that it is filled with PF cadres. ACC is located at Kulima, and as such, it is wrong to say he came along with the cadres. Also, come on, who would say that they wouldn’t want a little affection before a hearing. I am very confident that Kabimba will be found innocent but GBM will be found wanting. It is notoriously hard to link anyone person to an oil deal. Most details are done off the record!

These guys i now believe really that they just cheated their way into state house, look at the salary increases for themselves, fuel shortages, mealie meal shortages, barotse empty promises- they even send platoons to barotseland meanwhile they were busy condemning Rupiah on sending cops there, load shedding, they promised to give farmers 16 bags of fertilizer each but this time they give out in a tin, less than a bag each, deportations everyday, they compelled Dora to resign but now kabimba????? the list is endless anyway God knows why he allowed our minds to be deceived by these crop of bembas

  16. Jo Jo. lol. Kabimba is revolutionary. His humility, hard work and determination require that we respect him. H.E.MCS has repeatedly recognised and rewarded ba Wynter. State Counsel, Honourable, Secretary General, Third in Command etc etc. Most of you complaining are just being silly. Winter brought us fuel.

    • Cherry picking scripture to justify your point of view is underhanded. In light of the way he acted, he loses his credibility as  law abiding citizen even more so that he is a member of the Executive branch. Failing to call him out on that as citizens, regardless of what party you support, reflects a failure to recognize that we ought to hold leaders accountable when they fall short.

  19. We are expecting too much from these PF thugs. They simply dont have the capacity to satisfy the needs of our people. They were not prepared for these high level responsibilities because they thought they were going to lose the 2011 elections as usual !! You can even see from the quality of PF MPs no wonder they are poaching from the opposition.They have no quality MPs within their circles. PF= Zambia backward to UNIP era, UPND=Zambia forward with development.

  20. The behavior of this Winter/ JM/SG thing is that he thinks Zambians are docile to which i agree since we voted for PF even when their lies were so clear and straight forward for all .
    I wonder if at all we have a president in this nation or should i say the leadership vacuum we have at presidential level is the cause of Winter’s big hardheadedness = monster and not minister.

  23. I am a PF symphathiser but on this 1 ba Kabimba ifi tefyo! U are a Senior man behaving like a Jerabo, not even a kaponya can behave like this @ the police station, maybe @ the police post in Chazanga, saying paku ncita interrogate kamo na ba bululu na bapipanda babepo. Kwena apa Bakateka cite nipo cimo! Otherwise Pipo are annoyed @ this state of affairs. I rest my case.

  26. The conduct by Kabimba at ACC premises has the potential to seriously dent the image of PF vis-avis the fight against corruption as espoused by president Sata. He needs to do something quickly, if not immediately, to assuage the people that his campaign against corruption is real and that it has no sacred cows. Lack of action against Kabimba has the potential to deepen the angst being felt by Zambians against PF right this moment.

  28. This saga is a little embarassing. The Head of State should come out strongly to put things right. Clearly, Kabimba is above the law. Where are the police chiefs and what do they make of this sorry situation?

Mwanawasa let his ministers face the task force, courts and law enforcement agencies. If you remember very well even one of his ministers Gladys Nyirongo was imprisoned. I doubt if that will be the case for Wynter Kabimba and GBM, these will definitely go Scott free. A justice minister who is innocent would not have behavioured in such a manner, his not a leading example. Whats now wrong if HH also refuses to be interrogated in the future as the JUSTICE minister  himself has given an example. Go with thugs/cadres and say ask me in their presence. The other opposition leaders can do the same.Animal farm

  33. Zambia has a very compromised president. Its a shame. Ministers and certain Individuals are doing whatever they want without being disciplined, the Mahtanis, Kabimbas, GBMs, the Bwinjifumu mafias and the like are untouchables. Truly, things fall apart.
