Chief Government spokesman Kennedy Sakeni has said that the Government would like to advise all those who want to play national politics to learn to be honest. Misrepresenting facts will not take them anywhere.

In a press statement to the media today Mr Sakeni said that the Former President Rupiah Banda has been requested by law enforcement agencies to answer allegations levelled against him in the ongoing corruption investigations.

He said that they have told him that whilst they respect his immunity, he should consider attending the interview to clear the air. “There is nothing unconstitutional about this,” Mr Sakeni said

“Mr Banda is immune to prosecution and not investigations. So, let him face the allegations levelled against him”

“Attacking His Excellency President Michael Sata will not take away the allegations that Mr Banda is facing. Let Mr Banda answer the corruption allegations because there is nothing illegal that law enforcement agencies have done,” concluded the statement

    • Don,is what he is saying true or false?The constitution is silent on investigations,only talks about prosecution and being sued.When FTJ’s immunity was being lifted in parliament,he cried that he was not given an opportunity to be head first.Do you remember this?If RB aveils himself for investigations and found with nothing,there will be no need of lifting his immunity.The exercise is actually to his advantage.The “cases” on which FTJ’s immunity was lift in parliament were never prosecuted because the offences were not investigated properly.This time investigations are being done properly and the stage they have reached is to clarify some issues with RB himself before taking them to parliament.What’s wrong with this?

    • This matter is very simple.Sakeni is a professional intelligence operative.It is simple logic that investigations start with digging all the claims against an accused person.Once this is done,it is upto the investigating officer/s to make up his mind as to whether there is sufficient material to warrant the interview of a suspect.Unfortunately,in the case of a former Zambian President it is not that easy that you merely issue a call out.There are legal procedures to follow as per our current constitution.That is where the problem is.

  10. We hear Justice minister Kabimba refused to be interviewed by the A.C.C over corruption allegations. The A.C.C is now summoning the former head of state. Can someone educate me on the differences between the two other than the fact that one is a former head of state and the other is a current Justice minister in the ruling party?

    • Let me educate you sir! ACC is a Kantemba organisation which is supposed to consult Sata before it can do anything. If Sata says yes then they go ahead and if Sata says no then the stop. This is what is called selective justice and investigation and any right thinking person ends up frustrated and annoyed because this is not how civilised states operates. Obviously in Zambia they are still miles away and very uncivilised in terms of justice system and politicians have no shame at all because no one is strong enough to hold them accountable. Those who try they are either suppressed on arreasted and intimidated- the country is not very condusive for critics and their families. I hope you have understood; this is a reason why KABIMBA is now left alone while BANDA wanted.

      The compelling difference between the two is the level of qualifications in law. According to the information before me, Mr. Kabimba is a qualified attorney whose areas of specialisations are criminal matters. On the other hand Mr. Banda is not trained in law but in economic related matters. Note that criminal laws of Zambia like in other countries do provide an opportunity for any person not to answer questions to him by the police/other investigative bodies if he/she deems it necessary. However, none coperation with investigators might in some instances work against the interests of the accused during court hearings. Mr. Kabimba has expert experiential knowledge in criminal matters i.e. high profile cases whereas Mr.Banda has no expert knowledge.

Why would your investigation teams have interests in questionning Mr. Banda about allegations levelled against him if it is clear that he enjoys immunity against prosecution? Any head of such professional investigative teams would instruct his surbodinates that there is no need to waste the agencies’ resources in pursing enquiries about Mr. Banda’s level of involvement in suspected criminal activities. We have to consider the interests of the state in this matter. The interests of the state form a core element which can lead to the lifting of Mr. Banda’s immunity against prosecution. The interests of the state have the teeth that which can bite the National Assembly which in turn is capable of making the immunity null and void or nugatory.

      The first stage of prosecution is when the Director of Public Prosecutions/the Attorney General takes a decision whether to prosecute or not, if the evidence is insufficient or contaminated or tempered he/she will decline to prosecute. The law/rule of evidence has to be adhered to, strictly in dealings. In some situations as it is the case of S.Africa, regional Attorney Generals decide individually whether to prosecute or not matters in their respective regions. But the National Attorney General has more powers than his regional counnterparts. After thorough interviews,an interviewee might incriminate himself or collaborate his accusers and this sets the foundation

    1.RB looted Govt.coffers without a doubt!
    2.RB enjoys immunity from prosecution and interviewing someone(RB in this case) during investigation is the first step toward prosecution
    3.RB can not be questioned in respect of what he is alleged to have done while in office owing to his immunity( pliz read the constitution)
    4.The first step PF should do is lift RB’s immunity and proceed from there.
    5.The way they want to approach pursuing RB may actually jeorpedise a very good case of corruption perpetrated by RB and his cronies icluding,among others,Namulambe!

  36. All indications are that nothing is going right in the country and the victims are the people. While other nations are making progressive strides Zambia has become a laughing stock in the eyes of the world. Ever heard of a country where for nearly two weeks the whereabouts of their president is unknown?

  37. If RB is as innocent as he says and loves Zambia then, he should like any law abiding citizen help the law enforcement officers carry out their duties. He should also look at the advantage of appearing before them in that it gives him the opportunity of clearing him self in the eyes of Zambians and the international community he has been courting of late.

    • OGA & PROUDLY ZAMBIAN – if you think your sick president has the right and that RB is just hiding behind immunity….why don’t you lift the immunity, since as you say, it can be lifted anytime! The fact is you PF villagers are less than 50% of the total number of votes that were cast at the last election. It means that more than 50% don’t like Sata, and may be that percentage has grown by now. It further means that you know that you can’t lift his immunity because you are scared of doing so, precisely because you have no grounds. Tell your sick president to be very careful how he manages this country, unless he wants to be remembered as the worst president in the history of Zambia. Infact he WILL be remembered as Zambia’s worst mistake ever..!!

  38. Evidently, Rupiah Banda will be called to answer one day. From the results of by elections in recent times, the PF is likely to hold an overwhelming majority of seats in the next parliament come 2016 and that immunity will be lifted. The Mwanawasas stayed in power for 7 years and yet they lead a more modest life in comparison with the largesse of the Bandas who were there for 36 months.
    When you look at Sata, Mwanawasa got him investigated and he cleared his name. As for Nevers Mumba, he has been evasive over his dealings as High Commissioner to Canada. Mumba is really a man of low morals in many regards.

  44. Every body is trying to impress the boss. Why don’t they do first things first, lift his immunity ( by the way this will done to SATA as well – if he will be around ) if they are serious about prosecuting RB, rather than scoring cheap points.

    If RB refuses to attend these interrogation, he can not be arrested – can someone tell the ACC boss to stop playing games . We have been waiting for prosecutions and convictions since PF to power and all we get are investigations!!

  46. why not just gather evidence and remove his immunity. In any case he has the right to remain silent and he surely will since it is clear that we have incompentent investigators who can’t proceed without the suspect incriminating himself. No wonder Winter behaved the way he did!!

  49. I think Sakeni is contradicting himself or the constitution is too. Because if i analyse what he is saying, its like it does not make much sense…check this out “Rupiah Banda is immune to prosecution and not investigations- Sakeni” and “the fourth president has been called for an interview -ACC.” Is it an interview or an investigation??? Lawyers educate us..pliz If RB:

    1. Refuses to go 4 the interview/ investigation whatever, what will happen?
    2. If he goes for this interogation but choses to remain silent then what?

    Pliz learned individuals educate us.

  51. If justice prevailed in Zambia almost all govt officials would be in prison. There’s very few if any at all who has clean hands. RB should have been investigated long before now. He removed abuse of office and dissolved the task force and that in itself indicated he was up to no good. His departing remarks were that he didn’t knowingly abuse public assets. What did he mean by that?

  52. Sakeni is very correct. Why do people want to twist the truth? Prosecution is different from investigation. I advise RB to attend the interview; its for his benefit. All these characters will not stand with him when immunity is removed. People like Nevers Mumba want to use RB’s name for their polictical mileage; for Sakwiba Sikota its business venture, he is making money out of it. RB need to be careful with these chaps.
    Whether RB likes or not, one day his immunity will be removed and Sakwiba will continue making cash on him; Nevers will never be President; and RB knows this very well.
    Please RB, attend the interview. Dont be deceived by these chaps

We are not as dull as your fellow PF cadres, please stop educating us on the difference between an investigation and a prosecution because it’s us who invented those terms! Go back to the national constitution and read it well, then go back to your sick president and explain to him that RB has said ‘NO’. The person who needs investigation right now is SATA himself who is running the country despite the fact that he is now so sick. What is he protecting? We don’t want another presidential by-election, he should just resign ahead of time. Then we can go on and elect a proper party and intelligent young leaders into power. Some of us are so tired of these i.d.i.o.ts….Lusaka city is now the dirtiest city in Southern Africa!! PF baboons!

  53. So what will ACC do if he doesn’t appear before them? arrest him and take him where ?because no court can prosecute him. And even if he appears and they find him with a case to answer they will have to wait for parliament to lift his immunity. The whole thing is circus. Let him for now till you find crimes against him and convince parliament to lift his immunity but remember you will be setting a precedent and it might affect even future Presidents of Zambia as soon as they leave office. Lets be careful!

  58. RB is within his rights to decline an “invitation” to assist with investigations just as anyone is. The Law does not compel anyone to attend to answer police/investigative questions especially questions that will incriminate oneself. It is incumbent upon the investigative wings to undertake necessary investigations and then charge someone with offence(s) where there is sufficient evidence to rely upon. thereafter they can “warn and caution” an individual over the information they provide during questioning and if the person exculpates themselves, they police can drop the charge and be open to face any consequences.All these sentimental opinions that RB is “not immune to investigations” is childish talk and asual aimed at exciting PF cadres.

  64. This corruption fight is selective and targeted at political opponents. There is a lot of politics. Even the PF itself is entangled in corruption. The Kabimba’s and others are all corrupt but ACC is scared to touch them. PF sort out the poverty of the country don’t witch hunt the same precedence you are setting will be on you.
