Parliament heard yesterday that Malawian Judge Lovemore Chikopa who was invited by Government to chair a tribunal instituted by President Michael Sata to probe three judges is still in Zambia.

In 2012, President Sata appointed Judge Chikopa to chair a tribunal to probe three Judges namely Charles Kajimanga, Nigel Mutuna and Philip Musonda.

Vice President Guy Scott told the House that Judge Chikopa was in the country and that the tribunal to be chaired by the Malawian Judge is still on.

“Mr Speaker, Judge Chikopa is around and the tribunal is on,” he said. He was responding to MMD Vubwi Member of Parliament (MP) Eustarkio Kazonga who wanted to know the whereabouts of Judge Chikopa following his appointment to chair the tribunal.

President Sata on April 30 suspended Justices Musonda, Kajimanga and Mutuna and appointed a tribunal headed by Justice Chikopa of the Malawi High Court to investigate the alleged misbehavior of the three Judges.

But two of the judges, Mutuna and Kajimanga challenged Mr Sata’s decision in the Lusaka High Court where Judge Fulgeance Chisanga granted them an injunction to prevent the tribunal from sitting to hear their alleged impropriety pending the full determination of the matter by the High Court.

Attorney General Mumba Malila, however, appealed to the Supreme Court saying the State was not satisfied with the ruling of the High Court

Let that guy go back to Malawi and for God’s sake, can we for once forget about wasting tax payers money on these unproductive commissions of inquiry. Pliz PF, if you have ears to hear, SEND THE MALAWIAN JUDGE HOME AND STOP WASTING THE MEAGER RESOURCES ON COMMISSIONS THAT DO NOT BENEFIT THE ZAMBIANS EXCEPT FOR THE COMMISSIONERS WHO RECEIVE FAT SITTING ALLOWANCES. OUR SCHOOLS, HOSPITALS, AGRICULTURA SECTORS AND ALL OTHER SOCIAL SECTORS ARE IN DIRE NEED OF FUNDS AND YOU HAVE THE AUDACITY TO WASTE THESE FUNDS ON USELESS EXECISES SUCH AS COMMISSIONS OF INQUIRY. IF YOU DO NOT TAKE HEED, JUST REMEMBER “WHAT GOES AROUND, COMES AROUND.”

    • You have lost your mind!The judicial system needs cleaning,clearing,kuwasha and it is long overdue.The system must be cleaned from the Local courts to the High court.I have been a victim of this rotten sytem and I know what Iam talking about.Cases have been disposed off in some courts through corruption too many times!!

    • I concur with you. We are spending a lot from our meager resources. But think of it this way. Is there any cheaper way to address issues relating to corruption in the judiciary? If the high court really is interested in ensuring justice to prevail instead of protecting their fellow judges they shouldhv given this tribunal to do its work. I’d indeed these judges were innocent this would be an opportunity yo clear themselves. I hv come accross very concerning information which points to the levels of curruption in the judiciary which scared me out of mt shoes. And if we keep sgying away from dealing with it then some day you and I willfall victims to the same vice.

    • This mad Scotsman and his just are using this Malawian judge to steal our monies. Where on earth can you have a senoir judge brought from another country to come and chair a tribunal that takes one year to take off? We can’t pay for this incompetance on the part of those governing us. I just hope this hungry judge has morals or is he the actual Chief Justice of Zambia. Sata has all these women appointees around him but pulls their skirts all the time. This is a ‘DONCHI KUBEBA’ on the women. He has never meant well. He never has respect for anyone not for even those that have given him children!

    • Chipoka my go!! Reforming the whole Judicial system does not need Chipoka but assembling a committee of Zambian experts and stakeholders to overhaul the entire judicial system. (Not just judiciary) . From Law schools, lawyers,police, prosecutors,legal bodies, to judiciary itself (attitudes must change and be underpinned on JUSTICE AS A CHERISHED IDEAL OF TRUTH AND FAIRNESS ) not as an abused commodity like we are witnessing now- Also on RULE OF LAW not of men- Equally important too, EVERYONE EQUAL BEFORE THE LAW regardless of status)

      Chipoka’s compromised integrity does not bring him any where close to this task nor qualify him for these delicate and treasured ideals of true justice. Neither can Chipoka come all the way from Malawi just to acquit FRED Mmembe-Nchito’s 14Billion

    • No wonder Fred Mmembe and his Post Newspaper has taken advantage of Zambians with no protests ever, to the extent of insulting them year after year (From phrases such as Hungry mouths, Stupid Minion, *****s, Fools, headless chickens, illiterates, Zambians short memory ,never learn , blind followers to Zambians are very easy to fool). And indeed he has fooled Zambians on many fronts from Justice Ngulube’s resignation, to Justice Sakala and many others. If Justice Sakala was removed from office on account of age by the Post Newspaper’s lobbying, why is Justice Lombe Chibesakunda( same over age) holding the same Chief Justice office?? Doesn’t this qualify Mmembe’s ill perception for Zambians as he describes them above??!! Indeed he sees them as “USEFUL.”

    • Its a smack in the face to all Zambian Judges and Justices with integrity that a judge from Malawi has to come and head such a commission, the provisions in our laws to deal with such matters have been totally disregarded on this issue. There seems to be a perception that everything and everyone associated with the passed regime is corrupt, this is wrong!

    • such things only happens in the banana republic of zambia under PF govt,, those judges challanged sata´s decision in court and judge f. chisanga granted the injuction to prevent the tribunal from sitting,,, and that is still pending in court…. so what the hack is the chikopa thing doing sliding a phone in zambia??????

  2. Is this a priority?who really will save Zambia?Tribunal up to now still being contemplated my dear frends.look at how much was lost in failed commissions of inquiry,pliz Guy think about the people in the following way:
    1. Roads need expansion thru out Zambia.
    2. Infrastructure development still a priority
    3. Develop newly created Districts
    4. More medicines in our hospitals
    5. Investment in Research and Development
    6. Schools,Hospitals,and public building need refurbishment.
    7.Issues of unemployment,women empoerment and cleaning the towns.
    I know with pf critics is their backbone.how am i going to benefit from the tribunal?Pliz work and allow Chikopa to go bak.someone call the commonwealth it’s an issue now u called Chikopa it’s not an issue.Zambians wake up

    • You are right. what about results from all those commissions of enquiry, what good has come out of them?
      we seem to start things we never finish, our president talks too much, makes all sorts of allegations but nothing turns out.

    • Its very simple matter if you think.
      The judge signed a contract and will enjoy his allowances irrespective of any court action. And the Grz knows that we will pay his full contract value if we sent him back to Lilongwe.

  4. The judge lacks morals and one wonders what sort of judgement he will pass. How can he be off duty for so long when all he could have done was to defer his leave to such a time when his services are needed. He obviously cant be staying alone all this time, his family surely is also here and that means more tax payers money.

    • There more to the presence of this so called Judge than what meets the eye. Check with the malawi Law Association who are currently disputing the hastened appointment of this Chikopa as Supreme Court Judge on the expense of a host of other senior judges. This same judge was at one time debarred to practice in Malawi in the nineties because of issues of integrity owing to dubious dealings. The question is why….get the services of this Judge with a questionable track record to supretend over such an important matter ???

We want a Judiciary that is well vested with the PF manifesto so that judgements are swiftly made against the enemies of both the PF Party, The Post and you the people of Zambia . They are surely working.The other day an entire minister went to the airport to receive some outdated holograms worth K1billion to curb piracy of CDs and DVD’s not knowing that people these days are listening to music on Ipods,phones,internet,etc The guy who sold them must be amazed at his luck! Now they are paying some Malawian judge vacation money at the expense of their own people.They are trying to buy Mps from other parties so that they can carry out their skewed laws,pass judgement in favour of Mmembe and DPP Nchito all at the expense of the rest of the 13million Zambians.MPS please can you find out for us the total bill on Chikopa and what the justification is.PF cadrres please also explain to us what is going on with your party?

    • Imagine using a scratchable CDs or DVDs,why not use a Flash stick,cheap and easy to store music or Video files?

I bet even Guy would like to know as well but for the sake of his job, he has to be seen to be supporting Sata. I also think the cabinet meetings do not achieve anything, going by the performance of the President every time he appears in public.

    • Why are the corts taking long to rule over a simple matter? Do they think Chikopa will get tired and leave?Abuse of office applies to judges as well.

  20. Yes we need a clean Justice system from Local courts to the Supreme Court including the office of DPP and SG.
    Send that Chipoko back to malawi and let him come back when legalities surronding the tribunal are settled, for now we are just misusing funds. Has he no cases to attend to in malawi?

  21. Surely Judges are supposed to be honorable. What is so honorable about staying in another country at tax payers expense for doing nothing? This Chikopa guy should be arrested for crimes against humanity considering he is taking money that the Zambian Govt should be spending on hospitals and other amenities for the poor.

  25. Today the nation is being informed Judge Chikopa came to Zambia at the invitation of Zambian govt as reported by Dr Scott through in parliament. Several opinion being expressed is that Judge Chikopa is robing us tax payers, its Chikopa’s fault that is here, generally judges are at fault, his looks etc. The truth is nothing closer to what is being said. To begin with, Zambia never invited Judge Chikopa this the reason he was declared with an ilegal entry at the airport recentry. His coming to Zambia was at the wish of Mr Sata regardless of all qualified judges in Zambia. In fact the message sent out by Sata is that he has no confidence in Zambian judges. Zambia has emminent personalities with impecable reputation in juditial matters. Lets condemn Sata and PF govt, they fool us daily.

Someone should take record of the expenses associated with Chikopa and Michael Chilufya Sata will foot the Bill from his private money or assets will be disposed off to recover the lost monies.It is inconceivable that you can call on a next door judge and let them stay in the country for such a long time at tax payers expense. This will be one of the reasons to remove SATA’s immunity once he leaves office. Is it not cheaper to send him back and call him back when the courts finalize the issue.

  31. Why didn’t they send back the judge pending the outcome of the Court case and the VP is saying that the Tribunal is on-does it mean that he already knows the ruling of the Supreme court?

  32. Corruption comes in all forms and misuse of resources knowingly (even unknowingly) is one of the highest order of corruption. This Judge Chikopa must be a very dull judge to just sit around in a hotel and do nothing for over a year and just chew our hard earned resources. Surely, once it was clear that the tribunal was not going to take place Chikopa should have been paid his dues up to that time and told he will be recalled once the tribunal is set in stone to take place. Alas the Government is sleeping and Chikopa is milking it – disgusting
