UPND MP released due to insufficient evidence linking him to the the murder

United Party for National Development (UPND) Member of Parliament for Kalomo and Director of strategy and mobilisation Request Muntanga had been released from custody due to insufficient evidence linking him to the the murder of Patriotic Front (PF) cadre Harrison Chanda.

Southern Province Commissioner of Police Charity Katanga confirmed to the media in Livingstone today. Mrs Katanga also said that over 10 other UPND members that were arrested and screened to help the police with investigations in connection with various offences linked to the murder were released.

She said that among those that had been released were UPND Livingstone district spokesperson Neto Halwabala and party chairperson for elections Ackson Sejani.

Mrs Katanga also said that, despite being re-arrested on Friday, William Banda has been released on police bond and is awaiting court appearance soon.

She said that Mr Banda had other offences in Lusaka which are being investigated.

Mrs Katanga said that 13 people had been released after being screened by the police.

She said that one person that was not a member of the UPND had been arrested for conduct likely to cause breach of peace.

Mrs Katanga also announced that nine people had been charge for obstructing a police officer from carrying his duty and were on bail.

And yesterday, Magistrate Chola Musonda ordered the prosecution handling Mazabuka Member of Parliament Gary Nkombo’s murder charge to obtain necessary instructions from the Director of Public Prosecutions (DPP) within 14 days from yesterday so that the matter can be promptly tried in the High Court.

Magistrate Musonda said in default of his order, a preliminary inquiry shall be held by the Livingstone Magistrate Court in accordance with provisions of section 223 of the criminal procedure.

He made the order yesterday when Nkombo, 48, of 39B Mulungushi Road in Mazabuka, appeared for mention on a murder charge contrary to the Laws of Zambia.

It is alleged that Nkombo on February 26, 2013 at Livingstone in Livingstone district of Southern province in the Republic of Zambia jointly and while acting together with others unknown, did murder Harrison Chanda.

Magistrate Musonda said the offence which the accused has been charged with is not bailable and it is of paramount importance that he is tried expeditiously in the High Court.

He said his experience had shown that suspects faced with the same charge of murder, had ended up languishing in remand prisons without being committed to the High Court for trial.

“This case will be for the High Court to determine in an event that the case is presented before the said court for trial.

It is my view that all players in our justice system must be vigilant to ensure speedy trial of non-bailable offences,” Mr Musonda said.

Earlier, Mr Mwiimbu complained that Western Province Minister Obvious Mwaliteta brutally assaulted Nkombo on February 25, 2013 between 22.00 hours to midnight in full view of the police and no medical help was rendered by the police while no arrests had been made.

Mr Mwiimbu also displayed in court the Wednesday (February 27, 2013) edition of the Times of Zambia newspaper under a headline ‘PF cadre killed’ and read the part which read that Mr Mwaliteta physically confronted Nkombo in full view of the police.

The defence also asked why Mr Mwaliteta as well as Tourism and Arts Minister Sylvia Masebo should not be cited for contempt of court because the two made contemptuous statements on television on February 28, 2013 regarding the matter which was before court.

In response, Magistrate Musonda directed the legal team for Nkombo to draw up a formal charge or charges against the suspect or suspects in respect of the complaint.

He furthered ordered the police officer in charge at Livingstone Central Police Station to issue Nkombo with a medical report within 24 hours from the time of the order yesterday afternoon.

“In Zambia we are all bound to appear before the courts of law regardless of status or class. There is no one above the law, be it members of legislature, judiciary, executive or members of the public.

“We are all subject to the same law we have given ourselves. The ironic rule that all are equal but some are more equal than others in not tenable in Zambia,” he said.

As regards to statements made in the media, Magistrate Musonda said he would render a ruling in that respect on March 4, 2013.

    • Poor Charity Katanga, I think its time she found a job in NGO world, she has failed on that forced position by her uncle-in-law Sata. She was just messing up in Lusaka, she carries same silly attitude to Southern province.
      How can she command to arrest people without pronouncing the charge “.. you under arrest for… nothing”.

    • Myself and I believe the real issue in the Livingstone Violence is this chap Obvious Mwaliteta. Within two months he is connected to two deaths of PF cadres and in both cases it is Mwaliteta who is pinning the blame on the opposition. Something is strange here. Do you remember last month when his servant was found dead and bare foot by a roadside outside livingstone and this Mwalitate was quick to blame the opposition. Could it be that this recent death of Harrison Chanda was something that Mwaliteta Ochastrated. I think a good private detective needs to be hired by the UPND to get to the bottom of this Saga.

    • its the real criminal required here.. not UPND and not PF, the real people who killed 55years old man chanda who was sent from monze to livingstone to go and throw stones at children..
      or was he old man chanda trying to steal campaign money from children as results the children pulled him, he fell and died… the truth must come out!

Talking about having a heart, PF bundled a 55years old man with his walking stick and wheelbarrowed him from monze to livingstone, gave him stones to throw at UPND children who defended themselves as a result old man chanda dies in the crossfire that, at least one story, the other story is old man chanda on his walking stick tried to steal from moneydesperate PF kaponyas from libuyu (libuyu is like chiboliya, those of you who donot know) so beat the crap out of him and he dies… so who has no heart?!!!!!

This is a challenge to NGO’s,the Church , Civil Service Organizations etc to come up with effective mitigation plans to ensure violence does not take root in Zambia and not just issuing statements alone. When violence takes place in a country, Ngo’s, the church and Civil Service organizations will not function properly because everyone will be running to protect themselves , prevention is better than cure. NGO’s and the Civil service start educating the masses through Bill boards, drama, songs,media etc especially the unemployed youths not to be used by any selfish politicians for their protection whether ruling or opposition.

  3. UPND be very careful of the traps being set before you, retaliation in the name of self defense is not the solution they will implicate you with a tag of violence. No one will know the difference between who is violent between PF and UPND. An example is Uhuru and Ruto of Kenya facing trial at the Hague .Uhuru is accused of retaliation. It seems you are being provoked by strategy and they may use this as one of the defenses for the commonwealth. There must be rolling on the floor with laughter because you played into their strategy. Exercise restraint no matter how you are provoked by them , Zambians will then make a judgement concerning who is a violent party. Continue documenting all violence and intimidations and continue sending them to international bodies for their urgent

    • My dear, being held without seeing a judge for more than 24 hours is actually quite common in Zambia. Not just under PF rule and in violation of the Constitution. Here is the Human Rights Watch report from 2009 of Zambia’s prisons; only 3% of inmates interviewed were brought before a judge within 24 hours, and the average length of time before seeing a judge after arrest was three months. http://www.hrw.org/node/89819/section/12. The criminal justice system has been doing poorly for quite some time now; not an excuse for PF certainly, but just a reminder of how entrenched the problems are.

    • .. There more than 5 cases to sue for..
      1.First Katanga should sue herself for arresting innocent people, because she can’t sue the system.
      2. Katanga should sue Sata for forcing her in a job she never wanted and can’t resign, forced labor.
      3. All those released should sue for defamation of character of course.
      4. Damages for mental and physical anguish by spending hours in police cell.
      5. Zambians should sue PF government for negligence.
      6. I will sue whoever is currently in-charge of Zambia, for emotional pain and daily awaiting for another funeral announcement.

Why not just say a member of PF had been arrested or Mr so & so had been arrested for this & this offense. Katanga has been so compromised that to align the name “PF” with wrong doing has become extremely difficult for her. The Lady is completely out of line and AWOL with basic international & acceptable police norms & procedures. This should haunt and hound her for a long time to come. A good cop must love & respect her suspects. Quite an ironical statement, but that’s how that profession is or else one is in a wrong job.

The PFstu.pidty was exposed when it was revealed that Mr Bauleni had been admitted in hospital at the time of the allegedly murder and that actually the UPND didnt take part in the Rufunsa Ward bye election when the murder was committed. These UPND men were just rounded up at the thoughtless orders of the now all too powerful Katanga and in the process valuable police time was lost resulting in missed opportunities to apprehend the real culprits. It’s like orders were given to arrest UPND leaders and do not worry about the PF. What a disgrace!

  10. Obvious Mwaliteta and Sylvia Tembo Masebo need to explain how Chanda died. When Gary is releasedas expected after the Livingstone bye elections these two plus Edgar Lungu and Charity Katanga should be promptly arrested and charged with obstruction of police investigations. We have a murder allegedly committed on the back of truck full of PF cadres and all the witnesses happen to be PF Ministers ( these Ministers have appeared on news programmes attesting to what happened). They will have a lot of explaining to do! They are the ones on trial!

  13. With all these develpments it is clear that President Sata is not interferering in all these issues and UPND are just entangling themselves in a lot due to hatred. If HEMCS wanted this could have been oppourtuny Time to fix him HH and should have learnt Boma ni Boma even if ulinama hafu, HH needs to reflect on these issues in his personal capacity and i call upon HEMCS to continue with his Big Heart indeed he seriously wants independency at ZP as has been demonstrated by ECZ please give him time to Rule Zambia as the majority voted for him. The police for sure know the culprite Gary Nkombo will come clean here.Even if we say and believe that the DP is a PF suppoter it will be difficult to find Gary with murder charge and commit him to the High Cpurt because Gary Nkombo was his coligues those who have been released.Secondly the truck was pf truck with pf cadres in ii when the alleged murder of chanda was carried out.This peace of information iam sure the police have it and they could have used to arrest the real culprete those who were in the truck the pf cadres.
