Police in riot gear deployed at Parliament after uproar from MPs, speaker suspends session

Police in riot gear have been deployed at Parliament following opposition Members of Parliament uproar to Speaker Patrick Matibini’s ruling for a motion to remove former president Rupah Banda’s legal immunity to proceed.

This is despite the matter being before the court of law. Following the uproar, the Speaker suspended of the house for 15 minutes.

The uproar stated when the speaker ruled that parliament was was an independent institution that does not get orders from any other institution hence free to observe its own rules and procedures following a point of order from UPND Monze MP Jack Mwiimbu who questioned why parliament had obeyed court orders on the expulsion of MPs, but was failing to do so on this.

When the speaker insisted that the motion be moved despite court order, MPs resorted to heckling that made it impossible for the Justice Minister to proceed with the motion.

It is at this point that the speaker decided to suspend the proceedings.

And in a rare move, police in riot gear drove into Parliament grounds to the dismay of opposition MPs, who strongly demand the police officers leave Parliament.

    • Parliament will be failing as a democratic institution if it gets instructions from other institutions of the state.

      The speaker is very much in order to allow the motion to proceed.
      If Rupiah has nothing to hide let him clear his name.

      In two and half years, RB, his family and cronies stole more than the combined loot of chiluba and mwanawasa administrations

      I shudder to imagine where our country would been driven to if he decide to fight to stay in power despite a resounding defeat.

  1. Lynch mob mentality with no respect for rule of law or sepation of powers.The matter is before a court of law and courts cannot be subservient to a parly with politically inspired moves.

    • From the little law that I studied, I learnt that parliament was supreme and that judges could not tell parliament what to do. In fact parliament can pass any law provided the law does not contradict the constitution. The Zambian parliament can even pass a law banning smoking in London. Of course this kind of law would be impossible for our police force to enforce. The only thing parliament can not do is pass a law that binds future parliaments. I was puzzled to here that a lawyer was asking a court of law to control what the honourable members could and could not debate. Parliamentary privilege even protects members from being sued for libel.

    • Courts are there to interpret the laws passed by parliament. Judges would be exceeding their powers if they tried to gag parliament. Theoretically, parliament represents the will of the people.

    • Parliament is NOT supreme and can never tell a court what to do.The 3 arms of govt are independent with separate but equal powers and one cannot infringe on the powers of the other.If a matter is before a court parliament ought to respect that.

  2. Someone needs to tell Sata that Zambians did not elect him to fight Mmembe’s and Nchito’s battles. As the Church have put it there are many problems that needs to be fixed and lifting immunity is the least of those problems

    Why not shame the past regime by solving all Zambia’s problems?

    Mmembe and Nchito should not hold the country to ransom just because they want to settle the K14 billion score with the RB.

  3. Very disappointing state of affairs. If this can happen in the law making pillar of government how can we surely be confident in assurance of free and fair elections? There is really need to quickly deal with the constitution issues and effect changes by the people, for the people and of the people. However, I still wonder whether constitutional changes will still reflect the wishes of the people if change can be easily controlled with the snap of a finger of a few powerful men. They have already forgotten that they are in government for a temporal period. Governments always change, and at one time these guys will go and for some of them they will be so miserable that they will end up begging from even homeless dogs in the street. God is watching.

    What benefit will UPND have if it blocks the removal of RB’s immunity????

    I f UPND will answer correctly then they will have the people behind them. So far their party’s calculations are out of way and there just about to be engulfed in political doom.

    Stop associating yourselves with RB, its just a subtraction of your votes in 2016. These issue will be a political whip for 2016. PF Goverment is the most easiest to beat in an election, but UPND have used wrong fomulae.

  13. I missed the part where a fight broke out, bottles were being hurled, threats were made, fists flew and the police were called in as the fight spilled out in to the grounds… At least tell me there was a punch up and the JM has a black eye or there’s an MP with missing teeth. Anything?

  19. The opposition parties have now rallied behind their neo-colonial legal master Armstwist who is all out to make a lot of money out of them through him representing them in legal matters. Now even armstwist does not understand that Parliament is about his legal machinations. Parliament must be let do what is right. These opposition guys are pretending not to know what that short lived president did in his short reign. Sata Knows what he did. To know how the crockdile behaved in the lake you can only ask the hippo. Sata is not a child. He has seen, read and understand what the loot there was. Let RB be stripped of immunity and you will all know what there is to know. That corruption in 2.5 years was visibly evident to many but could just be a tip of the iceberg.

  22. RB’s immunity has finally been removed. 80 voted in favour of WK’s motion, which was backed strongly by Lubinda, 3 voted against and 4 didn’t vote.

  23. Watchdog Transparency International has supported calls for lifting Banda’s immunity so he can answer the charges against him.

Is it normal for people called who represent the poor to gang up just to help one man suspected of stealing the wealth of a nation go clean? what is the meaning of this? how do you describe such actions, are they doing it in the name of justice or just to cause harvoc? this is not normal indeed and i dont blame anyone who invited those military men, i bet people are meeting under the darkeness to prepare themselves, if you read btwn the lines you know what i mean, these guys want to cause riots, uprising, believe me you, i guess any sight of commotion brings joy to the opposition, why are they against the motion? let RB avail himself and answer all the querries, i foresee confusion in the next coming weeks, therefore, i hope someone is ready to protect poor Zambians from this madness.

  26. The opposition in Zambia is in total confusion and dont even know what to do. They have no wise presidents to offer them leadership. They walk out of parliament and the bill passes through, what wisdom is that? They have just helped to throw RB, the man they love to the wolves. The politics being promoted by HH and nevers are primitive and a disgrace to Zambia in the eyes of the international community.

Yes Rupiah immunity is lifted but I also want to do a citizen arrest on Kabimba and Gbm on suspected plunder of national resources, I want some advice frm lawyers on this blog on how I can go about this COZ AM TIRED OF THESE CORRUPTION FIGHTSWHICH ARE BASED ON HISTORY. My other request is on wether the leadership code can be brought back coz these ministers we have are enmassing riches like no mans business. Please help for the better Zambia.

  31. Parly is INDEPENDENT!!! So NO court can order it to do something!!!
    what people seem to be mistaking is the fact that parties have been expelling MP’s, who then have gone to court & fought these expulsions -So it isn’t Parly that has expelled them, hence they still sit in Parly as they are still recognised by parly as the duly elected representatives!!! So court orders in such cases are not directed to Parly BUT the political parties!!!

Mr speaker sir, Ben Kangwa asaulted a well respected zambian at zambian Embassy in Washington DC even the state house are aware of the situation ask mr francis chalabesa or ask mr sata even the ps in foreigner affairs on top of this matter mr Kangwa has been promoted to deputy Ambassador mr speaker sir, i know parliament is busy about RB what action state house are taking concerning this serious asault.we want to know the trust about this matter or you have to putr it on parliament to discus it its like bembas the can do anything and being promoted is that one zambia one bembe minus the rest.please action for Ben Kangwa we want him out people dont even go to the embassy because of him.
