RB charged for not disclosing campaign materials received from a Chinese firm

Former Republican President Rupiah Banda has been formally arrested and charged with concealing of gratification contrary to section 36 of the ACC Act no.38 of 2010,involving nine (9) light trucks valued K471 million which he allegedly received from a named Chinese construction company.

The former president was charged and arrested this morning when he appeared for questioning before the Joint Government Investigations team at the Drug Enforcement Commission.

Particulars of the offence are that Mr Banda on dates unknown but between 1st January 2011 and 30th August 2011 received the nine trucks which property was obtained as gratification from SOGECAO Zambia limited a subsidiary of Anui Foreign Economic Construction company, the company that constructed Levy Mwanawasa stadium in Ndola.

He is said to have concealed the receipt of the nine trucks by registering them in the names of other people connected to him.

President Banda who arrived at 08:45 hours was interrogated for more than two hours, and only left the Drug Enforcement Commission offices at 10: 45 hours.

As he left the DEC offices Mr Banda could only afford a wave at journalists without uttering any word.

And Joint Government Investigations team Spokesperson Namukolo Kasumpa later told journalists that former republican president had been formally charged with concealment of nine light trucks that were used as campaign material by the MMD in the run up to the 2011 general elections.

Ms. Kasumpa explains that president Banda who will appear in court on 30th April 2013,has been released on bond of Kr 500 rebased and two working sureties.

The former president is already facing other corruption charges in courts of law.

  12. In my view, the allegations against RB lack credibility and a former head of state must not be subjected to such allegations unless they stem into human rights offences or extortion. This is by far the most unpopular prosecution against a former head of state compared to the support cases against KK and FTJ received.

    • You misunderstood the English there, let me dumb down for you- unpopular in the sense that very few Zambians support the prosecutions against RB.

  13. Ok this appears to be a silly charge. If RB is found guilty on this one then all MP’s will be locked up because everyone including HE MCS received donations or so called ‘gratification’ while campaigning. Please we need serious charges not these school boy charges.

Just as a lay man when it comes to law, I ask: Did he receive the gratifications in 1. in his personal capacity 2. as MMD president 3. as Head of State at the time? Mutembo must have water tight cases…..this one does not lok like one. Eric silwamba and Mvunga will feast on him during cross examination

  17. Why should a company that has been given contracts donate to a party? What where they expecting after this donation? Boot femo femo answer this question since you were and is still an RB sympathizer.

    • Valid point, stealing is stealing bakwetu be it a Kr100 or 141mil the word still remains the same “stealing” what i dont understand are the people who want us to ignore whatever happened in RB’s term of office. Ladies and Gentlemen someone must do something we cant just let this passby and say we care concentrating on development. People should learn to be clean when they are saving the people. I dont buy this crap of saying other countries are laughing at us… who cares let them deal with their own problems and we will sort out ours as well

  22. What is the case here; is it gratification or is it stealing of vehicles with no report of theft? Gratification for contruction of Mwanawasa stadium is not there, companies in Zambia can donate to any political party of their choice. How do confirm it was gratification? Stealing does not arise here, no one has ever reported theft of such vehicles. The PF are just Satanic.

    Please learn to think and reason. Boot femo femo is speaking from reason and not emotionally driven opinion. This is a Chinese company with 9 trucks that it has to transport back to China if it decides to keep them and at what cost? Many companies and foreign missions do the same and sometimes sale such vehicles off at giveaway prices (because it would cost too much to freight them back and perhaps no real value when back in China). Therefore not everything is sinister and let’s not jump to conclusions. This is why this Govt is being embarrassed by the court… Simply because they are being driven by hate and a desperate desire to “prove” RB has stolen. And he may have done that but bring credible cases.

    • What money are you talking about? He has not been accused of stealing public money. He has been accused of receiving a gift of trucks on behalf of MMD. How many gifts has Sata received from China on behalf of PF. Do you know?

A case is a case no matter how small it is……This man (RB) stole from Zambians.why shud he be free?Let us not be petty,we need to be serious as a nation and those who are calling for RB to be left alone are not reasoning.If such a trend continues,we will have almost all the presidents getting away with something while we are just watching.Let him just answer his cases and if foud not guilty,he will be free but if guilty,……he will join his friends where he belong.

How can the head of state be subjected to such allegations? i am totally confused and would like to hear from the former head of state the reason behind his concealing of the receipts and register those trucks in the names of those connected to him.I expect more interrogations so that RB can shade more light on that and let the law of zambia inflict what he will term ‘pain’ on him so that those guys in power will learn from his experience.

All the kick backs meant that the contractor had to increase the cost so as to recover from the project. No patriotism at all. The then ruling party MMD made shocking decisions to award contracts to very bad companies just to ensure they can swindle the future generations of the needed development; damn you who support such levels of corruption. Imagine if these chaps had 15 tummies; they would have been eating 90 meals a day!! Thats how selfish the so called leaders have been.

  31. i once worked for an international company where corporate Governance was very Serious, anyone receiving gifts (including gratification) or in whatever form exceeding US$100.00 needed to declare. By Concealing it alredday shows there was an ill motive, coupled with registering these vehicles in other pipo’s names also indicates otherwise. What GRZ is doing is to ask RB explain what were his motives in taking up the route he did. RB is an adult who could register anything in his name, just like MMD was free to register these vehicles under it. Besides i support the Clause that was being debated by Delegates on the new constitution about all parties declaring their sources of Finance in the campaigns and this to have a limit. This will indid help clean up the country. Good luck RB!

Why should a construction company give RB trucks and not sell them if they came from the construction of the LM Stadium? better still why didnt they give them to the poor workers who were helping construct the stadium? Dont forget that RB and sons are the ones that actually moved the construction from old dag site to the current site.

  33. There are many more cases. Remember late FTJ Chiluba’s cases RBB was blocking as well that can be a case. This man has many more cases pending just wait. He was very corrupt, in great magnitude. You had eyes but never saw, ears but never heard, mouth but you never spoke. But the reality is the Mambala was at it, its under his skin, corruption.

I think we have the right to acknowledge that in Zambia there is a lot of stupidity 🙂 All along we have told that the Mumembe/Nchito/Kabimba + Ukwaa cartel have serious, well investigated and documented corruption/serious crimes against RB. That was the reason they rushed to parliament, albeit through the back door, to have his immunity lifted. But now you bring out this case, gentlemen are we serious? A former President? Prof Chirwa (ZRL) has just told us of the corruption at his company, allegation against Wynter Maize and his friend GBM have been in the public domain for some time, the Masebos of this world, etc – what are we doing about these cases instead of going after old fellas wanting to enjoy their retirement money lol

  40. Mr Banda Received on behalf of MMD as then the Head of state who did Winter want to disclose to. Let them go and Take the $200,000 dollars SATA left at Tambo Airport in South Africa. He concealed the money. Lucky they just seized the cash. Those trucks on BEFOWARD are just Cost $4500 CIF.

    we need high cases of corruption like the oil deal. the Reals estates in the off shore.
    winter mwamba oil/pole deals to be vividly investigated and take the matters to court. not every day GJIT. What power do GJIT has apart from been a bootlicker team of winter that will keep embarrassing PF.
