RB sent Major Richard Kachingwe to Nigeria for the oil deal

A second state witness has today testified in the case where former president Rupiah Banda is charged with abuse of authority how he was told to conceal the presence of the then MMD national Secretary Major Richard Kachingwe’s presence in Nigeria where he had gone to the offices of the Nigerian national petroleum company.

Mr. Alex luhila 62 of house number 406 Kudu road in Kabulonga Lusaka a former Zambian high commissioner to Nigeria told the court that during the time when he was high commissioner, he was told by authorities to receive an envoy or guest from home with due respect.

Mr. Luhila testified that during his course of duty he also had briefings with his staff who told him that there was an envoy that came in and out of Nigeria without meeting with him.

He testified that it was during that period that he got concerned and gathered his courage to phone State house and he was told that the then president Banda had a meeting but could leave his message which he did.

He testified that president Banda called him and told him not to doubt his authority to appoint a special envoy.

Mr. Luhila told the court that three weeks later, he received a telephone call from president Banda who told him that there was a special envoy who was going to Nigeria to deliver a message and he obliged to the directive.

He told the court that When he drove to meet the special envoy, he found out that it was Major Richard Kachingwe and they drove together to a place called four towers where offices for the Nigerian national petroleum company are situated.

He testified that he was told to wait in the foyer upon arrival while Major Kachingwe proceeded to another office where he only spent less than ten minutes and came out with a brown khaki envelope in his hands.

Mr Luhila told the court that as they were leaving the premises, Major Kachingwe told him not to tell anybody about his presence in Nigeria.

He testified that Major Kachingwe also refused to use transport that was organized for him by the high commission to take him to the airport because he had to travel back to Zambia on the same day.

Chief resident magistrate Joshua Banda has adjourned the matter to tomorrow for continued trial.

  2. So if Kachingwe went to Nigeria, and came out of the office with a brown envelope, does that give enough evidence of corruption? awe sure mwe. R B will win this case if this is the evidence you have.

    • You must be very dull. I am sure your IQ is among the lowest and wali ichikopo sana ku skulu. The issue here is not about the brown envelope Kachingwe received but the fact that Banda was personally involved in this transaction of oil procurement which has never been received despite paying US$11 million on it

  3. the man remained in the foyer and is not privy to what kachingwe discussed and what he was carrying…this is no evidence at all but hearsay which caanot be admitted in court.looks these guys are just fishing in dry fish ponds

      Kachingwe is the main witness in this matter. This guy was just laying a foundation so that when kachingwe come to testify the judge will have a clear picture of the scam.

    • There is so far no evidence to support the case. Did this chap produce a taped phone conversation? Even if he did he has failed to incriminate RB. What was in the brown envelop, was it plain papers, nairers, us$, £ or rands?

    • The truth is established where they are two witnesses. the man who is testifying has laid a good foundation .Can we really trust RB?Zambians wake up this is the end of RB.Now what willl Banda say ?

    • No Zambian will ever trust RB this is his down fall. why not sending minister of energy, or Finance minister why involving an mmd party secretary ?wait for the major to testify this is a lower court RB will be cross examined and his answer will be no or yes.

  5. And Kachingwe will testify later that in that brown envelope, there was cash. Isn’t that hearsay? Please show the judge evidence printed on hard copy and also remember not to photocopy

    • In less than 10 minutes the meeting was over and Kachingwe came out with a Khaki envelope.How big was this Khaki envelope.Was Kachingwe struggling to carry it?

  7. Lets wait for Major Kashingwe, the story continues. Ni super story iyi you gata Love Zed non stop entertainment , from the Professors to Mayuka, then to RB now the ball goes back to one Major Kach Kach….

  8. Now we are getting there, sounds like a movie, hushed airport arrivals, hurried return flights, big brown envelopes and special chauffeur driven cars. I think RB is in a very tight corner with no way to escape. I am sure there will be more breath-taking revelations to follow.

    • It seems clear that Kachingwe is the one who wanted the meeting to be hush hush. RB even rang Luhila to expect Kachingwe. Major seems to have done a deal for himself. All will become clear. Kachingwe is fake.

    • This money is actually Nigerian and not Zambian…. You may argue he abused his office but this just the Nigerians given an African country crude oil at a subsidized price and the country selling it on the international market and pocketing the difference.

      And yet the African countries never remember this good deed only complain about Nigeria. Maybe thats why they have $50billion in foreign reserve and even South Africa does not have that much. Last I remember Zambia had about $1billion

  10. So it is clear that KACHINGWE is the STAR witness. So all we need is to tear KACHINGWE apart as an unreliable and incompetent witness. Kachingwe is a hired gun and we just need to show that he has the motivation to lie against RB. Kachingwe has no money and is probably being fed by the state. Kachingwe lacks the integrity that would make him a star witness. Kachingwe has problems with MMD and is willing to do anything to strike at anything and anyone. But why direct his anger at RB? Is his anger against NEVERS not enough??. i cant imagine that this is the same guy who went to court and claimed that ALL THE MMD Campaign materials including trucks were geniunely procured. Any way, lies have short legs. infact, it will be dangerous to convict a RB on basis of evidence adduced from one KACHING

    • The issue here is not about campaign material but the oil transaction Banda influenced whose proceeds we have never seen. Yes Kachingwe said the campaign materials were genuinely acquired but I don’t remember him ever saying that the oil transaction was genuinely carried out

    • Kachingwe merely delivered a message to Nigeria and in return he took back an answer.He has no idea what were the contents of the envelope he was delivering and carrying back to RB.

What a witness PW2. these are cardinal to criminal proceedings where the prosecution has to prove the case beyond any reasonable doubt. now you remain in a foyer, you did here the discussion, you saw a kaki envelop. The phone call came from the President and RB. ooooooh. Surely, Major did even see the Nigerian Presido. 4-0
    Kach is not RB. Kaki paper is not money……..more action movie.

  15. I think Nigeria has no brown /Khaki envelopes.. kachingwe went with an empty brown envelope in readniess for Niras.. I’m told RB hired a jet for Kachingwe. But Kachingwe said ‘boss we need some change’.. ‘let me use the low cost nigerian air-bus’. To which RB responded ‘ there is plenty for every-one malume. Take it easy in lagos’ …But with Kachingwe, ‘once a soldier always a soldier’, as soon as the mission was accomplished, he rushed back home.

    1. RB wrote a lettr to Nigerian PRESIDENT to ask for oil. The original is with Y’Adua in his grave.
    2. Konga decided to keep a photo copy of the request.
    3. Major Kachingwe went to Nigeria, surreptitiously, and went to the Nigerian Petroleum Co. and came out with a brown envelope.

    No crime yet committed.

  18. But why are the two reports (LT and ZWD) so different from the same court room. Please we want to be informed correctly without bias. The LT report does not contain cross examination from the defence, the ZWD report leaves out the state witness side. Whats going on Kanshi? It is our tax money at stake here.

    • I am just as bothered by the lack of unbiased reporting in this matter. This is political trench warfare …all sides have dug in deep and are unwilling to concede any ground, on anything! All the while, it is the ordinary Zambian who is the loser!

  22. @27, interesting observation. This story here would actually give the impression that the photo copy of the letter that was found in Konga’s house was actually allowed as part of evidence, which is not the case because had that been the case, RB would have been under pressure. All these other examiinations and cross-examinations seem to be just some fishing exercises.

  24. If this is true then Banda has a case to answer, why do African Presidents loose their heads when they get into their office. I cannot rule out the fact that somewhere he did dip his hands in mucky waters, the money has always lived a careless life.
