Pep stores worker ordered to compensate man he falsely accused of stealing a T-shirt

The Livingstone Local Court has ordered that Mike Kasoka, a Pep stores employee pay K3, 000 to a man he falsely accused of stealing a T-shirt from the store.

Before the court was Christopher Kaundula who sued Mike Kasoka for compensations for the embarrassment caused on grounds that on May 30, 2013.

Kaundula was stopped at a Pep store by the defendant and accused of stealing a T-shirt and was later taken to a store room where his trousers were taken off and searched which revealed nothing.

Facts before the Court were that on May 30, the complainant went to a Pep store and as he was about to exit the shop was stopped by two Pep
employees who enquired as to the whereabouts of a T-shirt sold in the store.

The complainant said he did not steal the T-shirt and the two among them was Mike led him to the store room where his trousers was pulled down and nothing was found on him.

They two employees later apologized but Kaundula refused their apology and requested to speak to the manager who equally apologized
but the accused was too offended to accept the apology.

He told the manage to compensate him for the embarrassment caused but the manager refused at which point the accused said he would go to the media without his trousers to go complain about the treatment he had received.

When he left the store he run into a police officer named Enoshi Lungu who advised him that no one has a right to conduct a search without a
search warrant.

He then proceeded and sued the two employees for false accusations and is seeking compensation of not more than K 10, 000.

The court noted that false accusations is bad and should not be entertained at this affects the accused greatly.

  1. Think before you act, now you will pay money for nothing ba Pep employee.!!! What you do today may come back to you someday!!! Accusing accusing as though you hv nothing to do ba shetani……..!!!! Do ur business and dont chess the clients…..

  3. Good for Pep stores employee. They are so overzealous to accuse without proof. They found their match. Who would steal a t-shirt from Pep. Most of those t-shirts cost about K5 in some shops while from salaula, one would get a white t-shirt at K1 or even 50 ngwee.

    • This has nothing to do with politics black mama, dont politicise every situation, that poor man did the right thing to takecare of the situation the way he did, yes there are hickups in the zambian courts but not every judge has personal vandetas with everyone, so this one must be recommended, going back and forth with every thing wont take us anywhere, lets grow up and be fair in our judgement, lest we all become fools!

  6. Thats why Zambians are POOR. This is a good case. The guy should have sued Pep Stores and not a security official. The officers were acting on behalf of the company. The guy should have sued Pep stores for not less than K500,000 (five hundred million Kwacha old currency). But Zambians are sleeppyyyy YAKI..

    • @Mike, trust me if he sued Pep Stores as an individual for 500pin KR he was not going to win. He might have even ended up with a case to answer. That’s the ugly side of life.

  7. Shop workers in Zambia should be educated on what to do in such circumstances by the employers….in the UK shop security are even not allowed to strip search suspects once apprehended, they have to wait for the police….as for store assistants catching thieves is not in their job description.

I would like to get the details of the man that was accused of stealing as the same thing happened to me here in western cape., Cape town I too was accused of stealing but would like to know what to do now how to go ahead by suing the store pls if anyone could assist pls leave ur comment on the comment board as I don’t know what to do with regard to this matter ur assistance will be appreciated thank you

  10. I know that every1 is entitled to their opinion but i wish u knew what realy transpired and u can’t condemn the pep employees who is one of them..If i had the ryt wud have told u what happened when we took da guy 2 da back..
