It is illegal for government to begin building President Michael Sata’s house-HH

United Party for National Development leader Hakainde Hichilema has accused the Patriotic Front (PF) government of being greedy in the way they are allocating funds.

Mr. Hichilema has told Qfm news that it is illegal for government to begin building President Michael Sata’s house before he retires.

Mr. Hichilema has charged that it is a white color crime because it unconstitutional to build Mr. Sata a house before he retires.

He explains that it is clear in the emolument act on when any President’s house should receive funds to begin building a house.

The UPND leader has since described the move by government not consider the past Presidents who do not yet have the houses built as greedy and unrespectful.

He stresses that President Sata’s act only becomes valid after he retires and when he is seating President.

This are the dangers of democracy are majority votes rule because it allows minions with questionable behaviour to rule.     • Very poorly done article. A clear indication of the calibre of graduates you get from education institutions that experience frequent disruptive closures coz govt has no capacity to manage them… And yes, HH is right.

    • If I can buy and or build a house from my own savings what of a President. This archiac Law that should be repealed. If as a President he doesn’t acquire a decent house before being or as Head of State tough Luck. NO MORE HOUSES FOR FORMER PRESIDENTS PLEASE.

      With Sata he continued living at Omelo Mumba even when he became President, nothing wrong with his going back there.

    • My dream is to see the formation of a FEDERAL REPUBLIC OF ZAMBIA in which each federal state will be ruled by an elected State governor and elected state regional MPs. Each state cabinet to be appointed from amongst the state regional MPs.

      While the Federal republican President will be elected from amongst the state governors or former state governors. Federal state MPs will knowns as senators and will be elected from each state. The republican President will nominate the federal cabinet from amongst the senators.

      Each state to be responsible for its economy and tax revenue collection. An agreeable % of each state revenue to be given to federal government so it can fund projects in poor states. Each state to recruit its own police force to be headed by an elected commissioner…

  2. let him build so that when he retires he go settles there. former presidents directed their energy in building their retirement homes in singapore, malawi, south africa and france. have they settled there? no. who is benefiting is it zambians? not even a zambian gardener has been employed in those houses.

    do you think HH can build a retirement home for Sata? very far.

      The constitution clearly states that a house shall be built for a RETIRED President not the incumbent. Sata is not a retired president, is he? Maybe he retired the moment got to power and handed over power to the Mmembe minion cartel.

      All you guys who support this mad SATA will be his victims soon. The man is not consistent. He flip flops a lot. If he will be well enough to campaign for the next general election, you will see how he will deal with his praise singers who make him unpopular in order to gain popularity. He will fire Kabimba, Nchinto and arrest Mmembe now that he is getting away with arresting journalists.

  4. Yes,its very wrong bcoz you can’t institutionalize good governance,build a tradition of order and instill respect for laws if some animals are more equal than others.All successful countries are built on laws and only the lesser,poorer ones on personalities.

  6. I thought Sata stopped drinking bottled water due to his compansion for the poor. Wouldn’t it be more prodent to sacrifice ‘large’ by giving up building a house for himself before retirement since he can afford to build himself a house?

  8. This is a matter that should be tabled in Parliament and debated by the law makers of the house. Despite this, it is quite clear that the word “retirement” simply means what it says and there is no point in wasting time on such a straight forward clear issue. The MPs are sleeping in the house.

    • Have you forgotten that SATA is a dictator who always wants his way of doing things without following the law. Sata started beaking the laws of Zambia a long time ago. Thats why he has clung to politics, because without being in power he is afraid all the atrocities he has commited in the past will catch up with him. For example he stole K2 billion meant to complete merzaf projects in KK era. The moment he realised that the UNIP was no more he quickly joined MMD in order to avoid prosecution. He diverted attention from the issue by persecuting KK to the point of even having him deported. SATA has done many things known by some of his cronies. He has already eliminated those he can not trust.

      Never trust this snake mad man SATA! He will soon turn against the very people propping up.

    • Washinton – Sata continued living at Omelo Mumba long after he had become President. My expectation is to give the normal 3 months notice to his tenant in June 2016 of his return to Omelo Mumba. The location and house is decent enough.

  9. The genesis of building a house for a Former head of state is that we do not get shamed when diginatories come to visit these Former Heads of States (Doesn’t say anything about surviving spouses houses).

    I therefore do not expect Government to continue paying either for Rentals or building a House for Regina Mwanza or Maureen Mwanawasa.

    Regina Mwanza had and has inherited a lot of decent Houses mostly in Ndola. Let her pick one from the many and start Living there.

    Maureen Mwanawasa, has inherited a lot of Houses both in Lusaka and Ndola, including 3 Farms. Let her choose one from the many and move there please.

    RB can move into one of the Mpundu Flats or any of the Houses he has around Lusaka, better still go back to the Farm in Chipata.

    Sata should just go back to…

  11. Very dull thinking. Think of the money we are now spending to rent houses for RB, Maureen Mwanawasa and Regina Chiluba. Had their houses been built in advance we would have saved a lot of money. No wonder he cannot be elected president. He can’t see beyond his nose. What kind of economics did he do? The money so far paid on RB’s rent could have build more than two former presidents’ houses. He is now a bore to listen to because he lacks objectivity.

    • Dingiswayo, There is nothing illegal about the houses being built. For now they are just government houses. The sitting president may be allocated one after he retires. What is illegal with that. That is what we call in ‘simple term’ planning ahead. We know one day a sitting president will retire. Until he retires that house will remain a government house and can be used for other purposes. Go to court and not radio and prove your case.

He again complains when it gains and blames it on Sata. If that is objectivity to you then keep on voting for him, we the majority will keep voting for people we know mean well and can deliver.   15. If it is unconstitutional let HH tell his lawyers to go to court and challenge the government otherwise let him just keep quiet. By the way where has been lately? We haven’t seen him in public for two weeks. Is he also ailing?

  17. National Assembly is building an 18 bedroom house for former Speaker Amuusa Mwanamwambwa! I am sure the former Chief Justice may deserve a house if his conditions allow. There will come a time when 50 percent of the budget will go to building houses of former presidents, chief justices and speakers! can we afford this nonsense? Where are we haeding to as a country?

  18. hey john i like the way you are debating your points in a civilised manner.the point here is not about HH condenm sata o the govt he is tryn to make those checks and balances especially after alot of those campaign promises being a lie.i personally think he is in order to querry the project. what makes sata special alone to be built a house when he hasnt even clocked 2 years in power? secondly Mr john what if he fails to finish his term as president what happens in that case do you still continue to built o wat happens?am not sayn anything is going to happen but wat if he steps dwn o just other eventualities.

      If you don’t understand what the law says better to avoid making a fool out of your self. The law says a house to be built for a retired president not the incumbent. Unless you don’t understand the meaning of the word retired you can support Sata’s move.

      If sata gets away with it, then next year it will be all ministers to be built houses by government when the constitution does not provide for such. Then all the permanent secretaries and foreign service officials.where will it end.

      The point is there not enough money to afford such projects at the expense of deteriorating living standards, poor health facilities, and substandard educational facilities.

      If SATA is surely a man of the people he should have at least waited until the poor in shanties have their areas…

    Cap 15 of the laws of Zambia:
    4A. (1) In addition to the benefits set out in section four, there shall be-
    (a) assigned to a former President within a period of not more than two years from the date of ceasing to hold office, a furnished executive house built or bought in Zambia by the State at a place of the former President’s choice;
    5. (1) The pension and other benefits conferred by this Act shall not be paid, assigned or provided to a former President who is-
    (a) in receipt of salary from the Government; or
    (b) engaged in active politics.
    NOW JUDGE WHETHER IT IS LEGAL OR NOT

  23. What does the so called ‘LAW’ state about a dead President? Mwanawasa died in office and did not retire, do you still build a house for ‘him’? Who will be living in the houses built for dead former presidents? Chiluba and Mwanawasa. Is pension transferrable? I am lost!

Opposition is good, for those that have been questioning the relevance of opposition and divergent views should take note that the 100% salary increase came because SATA’s own private salary increase of 100% was exposed by those opposed to the wrong move and made it public. In his usual intelligence, our head of state decided to award all civil servants a similar percentage without considering the fiscal stability of the national coffers. The construction of a retirement home by a siting head of state would not have been an issue if there was no opposition. Of course there is nothing wrong in building SATA a retirement home, what is wrong is to build it before he retires as provided for. A considerable number of the so called untrue media reports have come to pass. Mr. Shamende take Note.

  25. Why should we build these utterly greedy individuals homes when the hardly spend their untaxed salaries whilst in office instead of retirement homes I propose we build a library for all to benefit. Don’t forget that we pay them allowances as well when they retire…only in Zambia.

  27. We like to complain day in day out. Complaining will never create solutions. We put the man in power let him serve his term and enjoy whatever benefits that still come with being president during the five years. When the man is no more we will sing praises to the man like we have never sang before…this is getting tiring. We all have a responsibility towards our country including HH who also promises to do a good job…but wait, we will also complain before his term is over, throw stones at him, call him names and so on and so forth. The problem is the people who are putting someone in power expecting and believing that this particular human being will bring salvation…HOW?!?!?!?!!!!!!

  28. Zambia under the PF administration shall remain a failed country and economy. Even when you examine the calibre of people who support the PF government, you will undoubtely discover that in one way or another, they are mediocre people who who don’ t support cardinal developmental issues. I further worry about the quality of MPs the Zambian Parliament have. Are they really MPs or what and what kind of debates do they hold in parliament ? From my own observation, it’ s quite true that they are only concerned about personal issues which have got nothing to do with national interest.
