Electoral Commission of Zambia asks High Court to dismiss Lameck Mangani’s petition

THE Electoral Commission of Zambia (ECZ) has urged the Lusaka High Court to declare MMD’s Reuben Mtolo Phiri as the duly elected Member of Parliament for Chipata Central.

This is in a matter in which losing Patriotic Front (PF) candidate Lameck Mangani has petitioned Mr Phiri and ECZ as first and second respondents asking the court to nullify Mr Phiri’s seat and instead declare him winner of the July 25, 2013 by-election claiming Mr Phiri did not qualify to file for nominations for the said by elections, among others.

But the ECZ said Mr Mangani should not be granted any relief he was seeking because ECZ was on firm ground when it allowed Mr Phiri to re-contest the seat.

The ECZ said it did not breach the law when it accepted the nominations papers of Mr Phiri and subsequently declared him the winner adding that Mr Phiri’s nomination papers were accepted in compliance with the electoral laws.

The Commission denied allegations by Mr Mangani that it failed or neglected to perform its statutory duties when it accepted Mr Phiri’s nominations.

Meanwhile former Petauke Central Member of Parliament, Dora Siliya and two others have charged that it is unreasonable and irrational for the ECZ to allow itself to be dictated on a matter concerning conduct of an election.

Ms Siliya, former Malambo MP Maxwell Mwale and former Mulobezi MP Hastings Sililo have since urged the Lusaka High Court to quash the collective decisions of the judiciary and ECZ to block them from filing in their nominations for the by elections in their respective former constituencies.

The trio has through its lawyers submitted to the court that the statements that were issued by the public relations officer of the judiciary, Terry Musonda, acting Registrar of the High Court Chilombo Maka-Phiri and ECZ director Priscilla Isaac to stop them from filing were unreasonable in that they were made without being moved by any court process.

They said judicial pronouncements could only be made after being moved by a court process.

Ms Siliya, Mr Mwale and Mr Sililo further submitted that if the judiciary and ECZ had properly directed themselves to the provisions of the Electoral Act and acted reasonably, they could not have reached the decision that the applicants were ineligible to file their nominations.

And trial in which United Party for National Development (UPND) leader Hakainde Hichilema is charged with publication of false information relating to accusations that the PF had sent youths to Sudan to train as militias yesterday failed to take off as there were no State witnesses.

Lusaka Principal Resident Magistrate Aridah Chuulu adjourned the matter to November 21, 2013 but ordered the State to prepare itself and ensure witnesses were brought before court.

Mr Hichilema has meanwhile vowed that his party would soon embark on nationwide demonstrations to express its views on various issues against government’s advice for the party not to hold public meetings.

Mr Hichilema who accused the ministry of Home Affairs of violating people’s rights to carry out demonstrations said it was not illegal for UPND to demonstrate without notifying the police because getting police permission was proving difficult.

  5. Democracy is about votes and not court room decisions. This habit of FAZ seeking board room decisions when they loose should not spread to the rest of the nation. Lets accept a lose and move on because their is no success without failure. Nganaba ku kana ninshi naba ku kana. It will unfair to declare Mangani a winner coz people have rejected twice in less than 2 years. I just pray this case doesnt go to supreme court

  6. Wee wanyara!!!!. At first Mangani spoke sense when he said the people of Chipata had spoken through the ballot. The Chap was misdirected as usual by people that think they can manipulate law. Good lesson i think for, you have been rejected twice by the honorable people of Chipata Central. You have equally betrayed your own people, you have been an MMD traitor.
    Bwana just think of how to surrender the Lodge to that Mwenye whose money you used for campaigns. NEVER COUNT CHICKENS B4 THEY HATCH

    • @mk, do some bit of research and you will learn that apart from 18 seat in Southern Province, UPND also has 1 seat on the Copperbelt, 4 in North Western, 6 in Western and 2 in Central Province.

There preoccupation is to steal and be granted a state funeral at the expense of tax payers- Mangani must go back to Chizongwe and continue teaching the topic on “Farm implements- ox- drawn plough” which his pupils used to pass well.

  17. Lameck Mangani is a political “prostitute” who does not care for the plight of his own people in Eastern Province. The man is so confused that he has the cheek to insult our intelligence. This man publicly conceded electoral defeat to Hon. MP Mtolo Phiri, in view of TV cameras. This prostitute just suddenly turned into a chameleon when his fellow crook Kabimba started to twist the electoral laws to suit PF wish to overrun the National Assembly.

    WHEN WILL GOD EVER COME TO THE AID OF THE PEOPLE TO CLEAN UP THIS MESS IN ZAMBIA?

  20. I salute the ECZ and the High court for following the law. Mangani is not a God to tell the court or ECZ what to do. It happens when you are used to survive through politics, hence when one is out of them panic starts, we are not fools us who vote.

  21. He clearly demonstrated that he lost Chipata seat by hugging and thanked the winner Mtolo Phiri. Now he comes round to petition the same, it’s absurd and equally silly. Even if he wins the court case he will not be declared winner of the seat as he’s praying in his petition.

  24. (1) Mr. Lameck Mangani must be strongly reminded that the rules of democracy, as they relate to elections, are based on the fare game of numbers.

    (2) The elections in Central Chipata reveal that Mangani, under the PF ticket has LOST TWICE (2x times) on his bid to go to Parliament.

    (3) The people of Eastern Province have rejected the PF and Mpezen, especially where DEMOCRATIC RULES prevail and are respected my the Republican Laws to which the ECZ is bound to adhere to and safeguard.

    Besides, Lombe Chibesakunda will go down in the history of legal fraternity as the WORST WOMAN to have ever held the position of Acting Chief Justice. In few days to come Chibesakunda will be an eye-sore seen polluting the streets and shopping malls of Lusaka and South Africa. God Help US!
