Retired teacher takes Government to court for non payment of terminal benefits

A RETIRED teacher has sued Attorney General Mumba Malila for allegedly failing to settle terminal benefits of K43million.

Andrew Zimba of Mufulira has sued Mr Malila as the defendant over terminal benefits which were outstanding from the time he was retired in 2007 in the sum of K43, 209,722-44.

In a statement of claim in the Kitwe High Court, Mr Zimba stated that the defendant refused to pay the terminal benefits which were in form of leave pay, costs and interests.

He stated that from the time of his retirement, he had not been paid his dues which remain outstanding since 2007.

Mr Zimba stated that the defendant has allegedly refused to pay his terminal benefits for no apparent reasons despite repeated reminders.

“From the date of the plaintiff’s retirement, the amount remains unpaid and the defendant has refused and neglected to pay outstanding benefits not withstanding repeated reminders, much to the prejudice of the plaintiff,” read the statement of claim.

Mr Zimba was seeking for an order for payment by the defendant for the total sum of K43, 209.722-44.

He was also seeking an order for payment of the interest and costs incurred.

  2. Should taking government to court be the only recourse for retirees to get their benefits? This is a sad development considering that politicians are paid promptly at expiry of their tour of duty

  5. civil servants should open their eyes…the idea is; increase the retirement age to 65, knowing so well that life expectancy is around 40-50 years..by the time someone is retiring he/she have few years before dying, so without lumpsum retirees will not enjoy their money

  7. Insulting the govt? What is govt by the way? Govt=parliament+Judicature+Executive. The word “insulting” does not seem to make sense. It is not an individual or group of peolple. It is an organisation comprising the opposition, ruling party and civil society.

  8. @ True, if you have nothing to say, shut up. There are pipo out there who have given their most productive years to the service of the govt. There is everything wrong with Shamenda pretending to know everything. If he wants to get his pension in peacemeal fashion, let him suit his red lips. But civil servants must get their lump sum. It is id-io-tic for the PF and Shamenda to think everyone is as foolish as they are. If civil servants squander their pensions, it’s their problem. Do these goons even read these blogs? They would have started making adjustments to respond to people’s needs.
