HH questions the credibility of Zambia’s electoral process, after nullification of another seat

The nullification of so many elections leading to wastage of resources on by-elections after the 2011 presidential and parliamentary elections speaks volumes about the credibility of Zambia’s electoral process, says opposition UPND president Hakainde Hichilema.

Speaking after the nullification of the Solwezi Central Constituency election by the Supreme Court, Mr. Hichilema wondered what was hailed as a free and fair elections by many organisations following the PF victory in 2011, the same free and fair elections has led to so many seats, especially those belonging to the opposition, being nullified.

“Even worse, there seems to be a serious disjoint in the judicial system between the High Court and the Supreme Court. That raises suspicions because a number of seats that were upheld as duly elected at the High Court level have only been nullified at Supreme Court,” he said.

The opposition leader said with all these anomalies that have been identified in the electoral process, he wondered why the ruling PF government was so reluctant on constitutional reforms that would have addressed the ills of the electoral process among other things.

“It is also important to clearly define what constitutes electoral corruption because to date, the PF have gotten away with a number of clear electoral malpractices such as open donations, intimidation of voters, violence, and fake promises even before they came into office and the practice has since continued,” Mr. Hichilema said.

Mr. Hichilema wondered whether it was not a clear case of electoral fraud on the part of PF to win an election based on promising to restore the Barotse Agreement within 90 days and later denounce and arrest those advocating for it.

“Is it also not electoral fraud for the PF to have openly campaigned and won elections on the promise of delivering a people driven constitution within 90 days and later refuse to release even a single copy of the draft constitution after almost three years of being in power. Is it not fraud to win an election on the promise of lower taxes and more money in people’s pockets, yet reverse and remove fuel and mealie meal subsidies that has made the cost of living even more miserable?,” he questioned.

Mr. Hichilema said assuming the nullifications were genuine, it was therefore clear that the whole process was marred by corrupt activities,and abrogation of the electoral code of conduct which essentially nullifies the entire 2011 presidential and general elections.

“I am sure many more by-elections will be created through nullifications, in which sense, one would argue that maybe the Supreme Court should nullify the entire 2011 electoral process so we go for fresh elections than wasting money on piece meal elections that still amount to almost an entire parliamentary election,” he said.

Mr. Hichilema also said he was aware that the scheme by the PF, of wanting to have a parliamentary majority to enable them manipulate the constitution and other laws, was still active but reminded that the people of Zambia were getting sick and tired of such schemes. Zambians have become vigilante and can see through all these schemes, in case PF does not know.

“I love Zambia and Zambians, we are so peaceful and tolerant. For now, the PF are treating us like people who have to apologies even when our toes are stepped on. Where on earth have you ever seen so many nullifications and costly induced by-elections and yet people keep lining-up to go and vote again and again?,” he questioned.

He said what was even more painful is that the resources being wasted on these by-elections, were borrowed money as the government was basically bankrupt going by their appetite to enter into huge loans, because of their quest for power.

“Can you imagine of the seven pending by-elections each costing about K10 billion (old currency), only Katuba in Central Province can be regarded as genuine due to unfortunate loss of an MP. The rest namely Malambo, Vubwi, and Petauke in Eastern Province, Mulobezi in Western Province, Zambezi West and now Solwezi Central in North-Western Province are basically PF induced by-elections and we hear more are still coming, and yet people are quiet,” he quipped.

  1. We need a Public Protector like RSA has. An office above all the mediocrity of partisanship and cronyism. No amount of rules, firings, or concoction of policy will do. Start devolving power to the people through independent institutions so the judiciary can, in fact, get more support in their determination of these vices. Also shows the level of ethics in our society anyway.

    • No wonder Democracy is expensive bosses.Just because it is expensive to hold by-elections doesn’t mean that we have to let corrupt and law and breaking MP’s continue sitting in parliament.It was about time.

    • Is he supporting corruption or what? What is causing these bye elections and loss of millions is ELECTORAL MALPRACTICES. If HH wants the Supreme Court to entertain corruption, then he can go and hang. The supreme court judgement becomes law and if the PF do engage in those issues condemned by the Supreme Court, their their election will also be nullified.

Issues that have been raised are genuine but just because they have been raised by an opposition leader, people want to throw the baby with the bath water. If I may ask, has there been any PF held consitituency that has beed declared void? If not, aren’t the same strategies of giving presents of chitenge material, salt or mealie meal the same strategies used by all parties? Chiefs in various places were all given “brown envelopes” as per tradition when visiting them in their chiefdoms. How then are these strategies considered mal-practice only when done by the opposition? We all know that its prohibited to use government vehicles for campaigns, but how many of these vehicles are in use in by-elections? Pls define electrol…

His break down in this article is very accurate to which has got me thinking how costly these kind of unnecessary elections have been at the expense of important prescious lives. Therefore, for now lets overlook his short commings that might have led to the petitioning of that sit and deal with this problem once and for all. Parly should find a favourable alternative in dealing with such happenings in the future, this is way too much, well done HH, offer some advice for the way forward since the feett are already trapped in the mud!

      United Party for National Development (UPND) has petitioned the election of PF’s Lawrence Evans as Livingstone Central Member of Parliament.

      The UPND filed their petition before the Livingstone High Court today through their lawyers Mwimbu Muleza and Company.

      The party has stated in their petition that the campaigns were marred with violence, intimidation and electoral malpractice by the PatrioticFront (PF) members and their agents.

      The numerous bye-elections are there because of flaws in the constitution namely (1.) The right of MPs to cross the floor, (2.) Rampant electoral male-practice legalized during the MMD era.

      A constitutional solution which I expected HH to have articulated instead of bleating like a pregnant sheep would do the following:-

      a.) If an MP wishes to cross the floor, let them foot the bill for the bye-election.
      b.) A parliamentary seat should belong to a political party for a 5 year term. Should an MP die or resign, elections WITHIN that party would be carried out under the scrutiny of the electoral commission.

Because of the flows in the electoral process and our justice system it is so easy to petition any election of ones choice. Again the problem is compounded when the courts have to decide whether indeed corruption or electoral malpractice did happen or not. At the moment any verdict at high court against PF will be won at supreme court .

      HH has clearly raised real concerns about the credibility of our electoral system which only a dull person can afford to ignore. These by elections have swallowed a huge amount of money which could have been used to improve the lives of the poor majority. This is corruption at it worst.

    • Apparently when the PF zealots see their BIPOLAR leader (Sata) trotting up down the country launching construction projects , some of which had already been launched by his predecessors they bow down and worship him thinking he is putting the money he cut from subsidies to good use. These rampant un planned projects are just a con to blindfold dull Zambians to think that the man is using their money properly, and yet he is stealing 50% and using 20% of the money to consolidate his strangle hold on Zambia through bye elections.
      I would have supported Sata ‘s fight against corruption if it was fairly implemented. But since it is targeted at silencing the opposition,I am not buying it . If it was fairly implemented then Masumba’s seat would have been nullified by now.

  9. Strictly speaking, the Zambian electoral process is incredible and almost all parliamentary seats were not rightly acquired in the eyes of the law, including the presidential seat, except the opposition did’nt bother to petition.
    I don’t blame the supreme court, they are just doing their job and they have consitutional powers to reverse high court decisions.
    If HH wants, he can petition the court to nulify the presidential seat even now ( if he is not barred by lapse of time).
    But I would rather the ACC and ECZ monitor the process closely during campaigns and disqualify candidates practicing corruption right from there ( the law to pave way for this) so as to avoid such petitions and wastage of resources after elections.

  10. In the case Dora Siliya, among the evidence produced by the petitioners was that Dora boasted during campaigns that she had nice breasts and a heavy bottom. According to them, this might have swayed the electorate. What nonsense! On the basis of this outright nonsense, the high court held that Dora was dully elected MP for Petauke Central but only to have the decision of the high court overturned by the supreme court!!!! This is the type of disjoint in the judiciary that HH is talking about, you clay heads. Can a sane judge nullify an election on the basis of an MP bragging about her breasts.

If and When the High Court makes a wrong JUDGEMENT, it is reversed by the SUPREME Court, But the wrong judgement of the Supreme court can only be corrected by the VOTERS although not always because voters then become compromised by the ruling party i.e. in politics. Lameck Mangani knows this very well.
    But other ‘mistakes’ of the supreme court have gone beyond the voters’ corrections.

    • Petition in which court? PF court? Time is a great equalizer, today PF might feel good and high that control everything but soon and very soon they will face the reality of life. This was exactly my argument – that if so many election results are nullified, this surely must have an impact on the presidential ballots as well,,and by extension, the election of the president is called into question. I had raised this argument when the election of Dora and Mwale were annuled by the Court. HH must have read my argument.

    • Being poor and living far below world set minimum standard of living is a big challenge in Zambia. If South Africa can show disapproval of their leader in public by booing him because of corruption and mismanagement of the country’s affairs I fail to understand why we Zambians are condemning HH when is complain about PF Government’s wastefulness on meager resources and selective justice. Because of poverty We as Zambians have accepted mediocre leadership which do not give hope. Why should we allow PF Govt to misuses our resources just to consolidated its hold on power when millions of our youths do not have good jobs, farming inputs is not yet delivered when its planting time now.   20. A suggestion to PF useful *****s: before you make comments on a presidential materialed discussion, hold a meeting and counter an argument logically. Look at arguments like; HH is under 5, cry baby etc.

    • What argument have you put forward that should warrant a meeting? You are simply serving face by trying to sound intelligent when not. Actually, it is amazing that HH is always wondering how MCS found himself President. This is because he has not understood the political landscape of this country and if he continues in his current path, I can assure you that he will fail once again in 2016.
      In 2011 RB run the most corrupt election process ever seen. MCS promised RB that most of these elections will be nullified as they were obtained under serious electral malpractice.
      The petitions have proved how rotten the system became and the nullifications are a lesson to all to refrain from their bad ways. HH should be lobbying for the constitution to have a better way of resolving nullifications.

      If you read and understood HH’s article properly, then you should have come across a part where he explains the reasons for raising concern and how to fix this broken electoral system by encouraging the Victoria toilet cleaner(Sata) to deliver the constitution which will clearly define what amounts to electoral fraud. Until all the forms of electoral fraud are clearly defined in the electoral code of conduct and written down in the constitution,such cases of seat nullification will continue to be the order of day even after PF is booted out of power.

  22. If there was electoral fraud as HH is alleging, what is stopping the aggrieved parties from taking these cases to court? If true the PF are vote buying, making donations even if in the name of development by Cabinet Ministers or Head of State, using violence or threats of violence during by-elections, why are the losing candidates quite? The courts are there for all. Take your complaints there and if the courts corruptly throw them out then you have all the reason to brand Zambia the most corrupt country in the world.

Do remember when he categorically warned the ACC to ask for permission from him before investigating his ministers. Are you telling me that you are less intelligent than Sata(The toilet cleaner) to know that what is at play here is selective justice mean’t to fix all the out spoken opposition MPs.

      The courts have been turned into his toilets where he can do as he pleases. He is the CHIEF INJUSTICE, without his consent no judgement can be executed freely.

      There are so many electoral petitions that have been tabled before the courts by the opposition but non of them has been acted upon due to selective justice.

  26. it would have been much better for the govt to concentrate on developing the country rather than inducing by-elections. you may strongly support pf govt, but if you can really deeply reason with a heart for the country, you would realise the wastage incurred in these by elections while the majority voters are in poverty.

  30. Some one is blaiming ILO for not creating jobs in Zambia, forgetting that money is being wasted on selfish by-elections. You cannot have it both ways. You either have by-elections to boost your numbers in Parliament and perpetual poverty or you invest the money to create jobs. You think ILO would fund your wastefulness as if they don’t have where to take their money? Moreover it is not their job to create jobs for Zambia it the job of gvt. Learn to look at national issues too, or else you’re a contributor to the current unhealthy shameful crisis in this country. If you have nothing constructive to contribute to the development of Zambia yet you want to live in this country as a citizen, I would advise you to just keep quiet and watch. You have nothing to offer! Zambia is a One Zambia One Nation democratic state. You are still sleeping thinking that Zambia will be one sector state, you are mistaken!
