MMD loses another seat as Kasenengwa is nullified

The Supreme Court has nullified the election of MMD’s Victoria Kalima as Kasenengwa MP on account of electoral malpractices.

Ms. Kalima confirmed the nullification in an interview Monday morning saying she is disappointed with the loss of the seat.

Ms. Kalima has however assured the Patriotic Front that they will not win the seat despite wanting to have the majority numbers in parliament.She also said that the nullification of her seat is unfair on the part of the judiciary as it has been concentrated on the MMD alone.

The MMD has this year lost a record number of seats through nullifications by the Courts of law on account of electoral malpractices.

And the Former MP posted this on her Facebook page

My seats was nullified today meaning am no longer MP. Thanking God for the opportunity He gave my to be the youngest woman parliamentarian for a period of two years.

Thank you Lord for allowing the nullification of my seat. Am comforted that we have examples of Job in the Bible who went thru more things than me but your grace was sufficient and I know in my situation too your grace is sufficient.

After the 2011 General elections more than 50 Patriotic Front (PF) losing Parliamentary candidates petitioned the election results in their respective areas.

The MMD Parliamentary seats nullified by the Supreme court include:

  1. MMD’s Mkushi South parliamentary seat held by Sydney Chisanga – December 18 2013 by Supreme Court Judge Elizabeth Muyovwe
  2. MMD’s Solwezi Centra parliamentary seat held by Lucky Mulusa – December 10 2013 by Supreme Court Judge Elizabeth Muyovwe
  3. MMD’s Petauke Central parliamentary seat held by Dora Siliya- June 2013 by Supreme Court Judge Elizabeth Muyovwe
  4. MMD’s Malambo parliamentary seat held by Maxwell Mwale -January 2012 by High Court Judge Albert Wood upheld by Supreme Court Judge Elizabeth Muyovwe June 2013
  5. MMD’s Livingstone parliamentary seat held by Lukulo Katombora March 2012 by Judge Ernest Mukulwamutiyo

Recently opposition UPND president Hakainde Hichilema wondered what was hailed as a free and fair elections by many organisations following the PF victory in 2011, the same free and fair elections has led to so many seats, especially those belonging to the opposition, being nullified.

“Even worse, there seems to be a serious disjoint in the judicial system between the High Court and the Supreme Court. That raises suspicions because a number of seats that were upheld as duly elected at the High Court level have only been nullified at Supreme Court,” he said.

[pullquote]Where on earth have you ever seen so many nullifications and costly induced by-elections and yet people keep lining-up to go and vote again and again?,” he questioned.[/pullquote]

The opposition leader said with all these anomalies that have been identified in the electoral process, he wondered why the ruling PF government was so reluctant on constitutional reforms that would have addressed the ills of the electoral process among other things.

Mr.Hichilema said it is also important to clearly define what constitutes electoral corruption because to date, the PF have gotten away with a number of clear electoral malpractices such as open donations, intimidation of voters, violence, and fake promises even before they came into office and the practice has since continued.

Mr. Hichilema also said he was aware that the scheme by the PF, of wanting to have a parliamentary majority to enable them manipulate the constitution and other laws, was still active but reminded that the people of Zambia were getting sick and tired of such schemes. Zambians have become vigilante and can see through all these schemes, in case PF does not know.

“Can you imagine of the seven pending by-elections each costing about K10 billion (old currency), only Katuba in Central Province can be regarded as genuine due to unfortunate loss of an MP. The rest namely Malambo, Vubwi, and Petauke in Eastern Province, Mulobezi in Western Province, Zambezi West and now Solwezi Central in North-Western Province are basically PF induced by-elections and we hear more are still coming, and yet people are quiet,” he quipped.

    • But also the recent wins by PF have been characterised by ci Sata and his minions donating stuffs, is that not abuse and the need for opposition to ask the judges to act too. In Mansa, that old man Called Gay Scot donated chitenges and food in Senama area and Kapesha. The opposition too should also take on the Patriotic Fools.But considering that the judiciary is rotten too, nothing will happen.

      It’s now clear, the rate at which by-elections are being negatively engineered at the expenses of the economy and already empty treasury, professes true the Lies, deception, and sheer fraud in SATA’S ascendancy to presidency on the pro-poor ideology!! A cause for the ECZ to reassesses its ideals on electorate fraud and credibility!!
      Sata’s thirsty to amend the constitution to 2 terms of 10years each, thus the numbers in parliament is appalling!! Arise Zambians and Zambia from this loot!!!!

    • All corruptly won seats must be nullified. MMD thought they would get away with their corruption but it has caught up with them. This is a lesson to PF, NAREP, FDD and others: No corruption and bribery during elections. Thanks Supreme court for cleaning up our elections

    • Fighting corruption and crime is not a profit making venture. So you people looking at the supreme court judgements in terms of money are wrong. The police can burn fuel worth k300 to arrest a thief who stole a chicken worth K30. Will you say that the police made a loss? Don’t be stoopit

    • When Panga Family (PF) loses power, they will suffer the same fate. They have set the precedence, and for PF this would decimate them even more quickly than MMD that has existed longer. Watch this space!

      He further in the petition told the court that Kalima had uttered statements that if PF was voted into power, its presidential candidate then, Michael Sata would legalise homosexuality, stop the Food Reserve Agency (FRA) from paying farmers and that there would be no distribution of life prolonging Anti-reteral viral (ARVs) drugs to HIV patients.
      Zulu argued that these remarks might have influenced voters not to cast the ballot in favour of their preferred candidate.

    • “In a rural constituency like Kasenengwa, a bicycle is only second to a motor vehicle, but the learned trial judge did not consider that. It is also our considered view that the September 20, 2011 election was a tripartite election…so whether remarks were directed at a presidential candidate, may have an impact on a parliamentary candidate of the same party,” judge Chibomba said.
      “We therefore declare and order that the election of Kasenengwa is null and void and the same was contrary to section 93 (2) of the Electoral Act. The same is quashed,” said Judge Chibomba.

  3. These bye elections are not doing any good to the Zambian economy. This is plundering of resources to its fullest extent. Kwena people responsible for the nullification are heartless. Channel the money spent on these created bye elections to meaningful development. We need the money in agriculture,education,health sectors etc.

    For some reason the unwashed masses in Zambia believe they are supposed to poor,sleep on the floor in hospitals with no medicines,drive on dilapitated roads,live in dilapidated houses and by expensive food, while dancing and singing praises to the demigods- the President and his cadres.

    • Yes they did. Including the Kapiri – remember that guy who was caught with a bag full of money.

      But looks like the judiciary is taking its sweet time on the case.

  10. The ECZ must up their game plan to avoid too many nullification of elected positions by aggressively making clear in black and white what parties can and cannot do in the period prior to elections.

    It can be done, and will reduce wastage of resources of the nation. We cannot afford to direct all our resources to one “industry” called by-elections.

    • On the other hand, Victoria, stay focused. When one door closes, God opens another. Don’t get bitter, keep trusting the Lord. When he opens a door, no one can shut, and when he shuts a door, no one can open it.

  11. You guys make me laugh! Judge Muyovwe is tonga from Monze. She is very independent and that is why she was elevated to Supreme Court. The comments here suggest that we have very short memories! We know that a lot of money was spent by the MMD in the last elections, to the extent that some MPS hid their loot in the ground! Am therefore surprised that people are complaining about nullification of results…what did you expect?

That money could have been used to pay those fired Nurses and people would not be dying needlessly. Elo look at our hospitals patients sleeping on the floor in this the 21st century. Misplaced priorities by these incompetent people in power. I think we need a revolution to sweep these useless politicians out of power. Something akin to a French revolution would be wonderful with the execution of the current Head of State and his minions for dereliction of duty to Mother Zambia.

    • @ LusakaBoy. you do not advocate for violence in order to change a course of a political system, what you advocate for is rigorous grassroots campaign and deliver the message to all levels of life, especially those that are hit the hardest and are the forgotten in society. Ask for international help/aid in election monitoring so there is no election and or vote rigging malpractices.

If the rot is as deep as we are made to believe by these myriad judicial interventions, ECZ must be rotten to the core to not have raised a finger during electioneering.   16. I think there is something wrong somewhere in the Judiciary system. There has no case which the high court passed which has been accepted by the supreme court to be the base of the resolution. This disqualifies the work done by the High Court. Which one now is the fair and true court? High court is a reject process by the Supreme and to me all petitions cases must be thrown to Supreme instead of wasting time through High Court which is a mockery by the Supreme Court.

    Judiciary is on crisis and something must be done. There is no Independence of Judiciary system as at now and no one will trust what is going on. This is just my opinion and own observation as to what is seen as at now.

  17. The decision has nothing to do with PF unless someone somewhere has proof. If the election was fradulant then let the law take its course. The same MPs forget about you when they are in parliment and seek symphathy when they have issues. Tell me which MP has said their allowance should be given to the aged even for a month?

      1. BY AVOIDING CORRUPT PRACTICES DURING CAMPAIGNS.
      2. BY ALLOWING CORRUPTLY ELECTED MPS TO CONTINUE SERVING.
      3. BY CHOOSING JUDGES WHO WILL NEVER NULLIFY ANY ELECTION REGARDLESS OF THE EVIDENCE OF CORRUPTION ADDUCED.

  28. Our courts are really to blame for being irresponsible in nullifying so many seats in a year without due consideration of the financial implications to the country. The Acting Chief Justice does not surely deserve to be in that office as she has clearly failed the people of Zambia.

  31. Sorry about the nullification of Victoria’s seat by Supreme Court yesterday.
    I think Victoria’s conduct in front of the cameras after losing her seat left much to be desired.

    She had no decorum and composure expected of her as a mature ex MP or indeed a respectable zambian lady which she no doubt is.

    I wish her a Happy 2014 nonetheless.

  32. I HAVE A BIG PROBLEM WITH JUDICIAL SYSTEM. WHEN WE COUNT THE PETITIONS THAT ARE IN THE HANDS OF THE COURT WE WILL DISCOVER THAT THEY ARE MORE THAN 70 WHY CAN’T THE COURT DEAL THEM AT ONCE SO THAT ECZ CAN DEAL WITH ITS WORK AT ONCE AND FOR ALL?
    SECONDLY IF WE SEE THE SCENARIO OF THE ECZ DOING THE VOTING IN THREES IT ALSO GIVES ME DOUBTS, WHY DONT THEY PUSH OR WAIT FOR THE COURT TO FINISH NULIFICATIONS OF THE OPPOSITION SEATS SO THAT THE BY-ELECTIONS WILL BE CONDUCTED AT ONCE?

    SOMETHING IS FISHING IN BOTH ELECTORAL PROCESS AND ECZ.
