Taking Draft constitution through Cabinet first is against consensus and unnecessarily provocative

Political Activist Mbita Chitala has said following the completion of the work of the Technical Committee on the Constitution, the view held by some of our compatriots that our cabinet must first deliberate on it and produce a White Paper is not only against the consensus we have made as a united people since 1991 but is also unnecessarily provocative.

Dr.Chitala said the consensual view is that the only role of those who are governing us is to facilitate us subject the draft constitution together with all clauses where there was no consensus, to a referendum of our people.

He described the attempt to subvert this process as an exhibition in dishonesty and is unnecessarily divisive.

“I fear for the future of my country if this intransigency is allowed to frustrate our yearnings. However, I am steeled in the fact that the people in their unity of purpose will still triumph to peacefully change the current one party discriminatory constitution and have a more democratic constitution of their choice,” Dr.Chitala said.

President Sata refused to budge to pressure to release the final draft constitution to the public.He said the draft constitution will NOT be released to public until it goes through Cabinet.President Sata said the country still has a valid constitution which should be upheld by all.

  1. Wow people will say anything to get into power…according to the link in 2011 Mr. Sata said that the country only needed a strong constitution that will protect all citizens in the country unlike the current situation where citizens are not secured.
    the citizens have never been more insecure in the history of Zambia than now Sir!

    • No need to rush ,the current constitution is okay for now.We can afford to wait for a proper process take place before the new constitution is availed and implemented as long as it will be before 2016.You rush you crush.

    • @Ndobo, you got my point. Those women can’t be allow to participate in any Zambian matters and especially pictures or they will subjected to be undressed with sexual admiration which is allowed in Zambian constitution..
      If the new constitution will have “stoned” like you are wishing me, then Ndobo I prefer to keep the colonial constitution.

  2. Lets follow the right procedure please.There is no need of rushing things.I know the opposition wants it to be implemented as quickly as possible because it is their only hope of getting into plot one(state house).Rome wasn`t built in a single day.It is about time we followed order.

    • Whether with or without the new constitution, Sata is going out in 2016.

      He would have improved his chances of being re elected in 2016 if he can release the constitution now because that would give him a positive campaign tool.

    • Fair point. People want changes be it electoral, executive power limitation, dual citizenship, clarity, enhancement and solid constitutional rights to be a more secure, informed and protected nation. I disagree that the sole reason is plot 1 access but it may be a factor for some. The country has an exciting opportunity to make constitutional change and people want to be a part of it. I think excitement and feeling like a valued partner in the process should not be condemned and misconstrued by the powers that be as I see far more of that as the interest than flipping leaders by constitution. This will be a plus for PF who would have earned bragging rights but it’s hijacked itself and now in a wrestling match with its own forgotten good intent.

      The “right process” is to release the draft constitution to the public including the Zambian Govt. that was what was promised in the terms of reference (instructions) for the technical committee. It is every bodies document so why is Govt now tring to have a preview of it in secrecy before availing it to us? There is simply no justification as to why Govt should do anything other than release the document. It is not about the opposition or anyone rushing for plot one as the new constitution will not guarantee anyone easy passage to that plot but certainly reduce the scope at which the PF can manipulate your freedoms. So the question is who is desperate here? The people or this Govt?

  3. Those who voted for MCS hoping and praying that he was a changed man, well, look at the fine mess you have have put us into. The charateristics of this man are well known, who can forget the back-stabbing and expelling of MMD members during the 3rd term campaign? He was never and will never be a man of his word, kwasila!! This just shows how messed up we are, always depending on the will of one man to give the entire population what we are craving for. FTJ f’kd us up, Mwanawasa grew cold feet, RB chose to listen to red-lipped George Kunda (RIP) and derailed the process and now its MCS’s turn.

      RB was certainly doing the best things for Zambia and I now have no doubt that the NCC under his watch would have delivered this same constitution the PF want to brag about. The problem was Mmembe. RB was on the wrong side of this traitor, and therefore Mmembe used his print media to “influence opinion” and the public against RB

  4. Technically speaking there is no damage aside from self inflicted chaos at this stage. This comes down to the ability for the government to consider whether their approach is currently damaging their initial good intent or are too stubborn to consider a different approach. They have clouded the airwaves with their own conflicting statements on release dates and methods then confusingly adopted an approach where they behave like Zambians with alternate views should be treated as enemies of the state. They have lost the PR battle but it is within their hands to end this positively by showing positive leadership and responding with a less combative attitude to a public matter that does not call for smoke and mirrors. Be open, approachable and deal respectfully with all stakeholders.

    • True. That’s why it is being made clear to him that he is not being followed down the dark path and needs to separate what he is mandated to do from his control freak tendencies. Elected by the people to represent all which includes those who don’t want him there – he should be working to prove he deserves the role but enjoys shooting himself in the foot.

  6. Challenging government in a democracy is the right of citizens. Very often, governments then gives the public what the public is asking from government. When it comes disagreement, it is necessary to allow government to remain custodian of common good. This can last until there is change of heart or change of government. During this tedious process of wait and see, it is absolutely necessary to remain calm and composed. The present scenario is politically vexing because the urgency that is being portrayed is misleading. It can lead to half-baked solutions. Can’t you see how Uganda is proceeding on sexuality? That is exactly what Zambia is also doing. The pandora goes back to the very beginning.

  12. I warned you ALL at the general elections: it would be a grave mistake to vote for a ‘snake’ and turn a blind eye to honest and right thinking candidates. There you are now; the cobra is spitting venoms into your eyes. Do the right thing before it transmutes itself into a python and swallow the whole lot of ye.
