President Sata’s medical review board case mishandled , I’ll re-submit – Changala

Civil Rights activist Brebner Changala says he will resubmit his writ of mandamus for judicial review to seek relief on the decision or indecision by Cabinet to consider the question of the physical and mental capacity of President Michael Sata.

This follows High Court’s decision to dismiss his earlier application for judicial review in the matter he is asking the court to constitute a medical board to examine the health of President Sata.

The Court has dismissed his writ of mandamus on grounds that it lacked merit and was frivolous and vexatious.

But Mr. Changala has told Qfm news in an interview that he is of the thought the matter was mishandled.

Mr. Changala says this is because the matter was dismissed without him and the Attorney General, who was the respondent to the dismissed writ of mandamus, being given chance to be heard.

He says he also wanted the three judges to hear his matter as opposed to only one Judge.

Mr. Changala notes that to this end he will resubmit his writ of mandamus in the same Court next week on Monday the 14th of July.

    • You wont win but at least you can try Bwana Changala-But remember Zambia is not on the same level as UK or USA- I cant imagine David Cameron or Barack Obama disappearing for 23 days without anything about his location and everyone remains quiet and behave as if everything is normal. We have no opposition in Zambia currently. The only answer to avoid frustration is to take a passive approach- and say- let the future take its own cause or whatever will be will be- QUE SERA SERA- .

    • @Phiri- I agree 100%- At least many of the well informed Zambians know that Sata is having a cocktail of diseases and is not well. The Bemba people have a proverb or a saying that One can never hide a pregnancy- it will surely pop out one day.

    • Changala`s HIV viral load must have increased and CD4 probably dropped to 10. I`m pretty sure the virus has destroyed some of this man neurons and other nerve cells leading to neuropathy,Vacuolar myelopathy and confusion.

At least we see pictures on ITV, BBC, SKY, Daily Mail, Daily Star, Daily Express, Guardian, Channel 4, Metro, etc- not when one disappears to Israel and we only see a poor quality snap and give picture of birthday celebration and no one know where? Even though I feel sorry for whatever has happened to Sata after working so hard to go to plot 1, whoever is managing his sickness deserve to be condemned in the most strongest terms.

      Sata is now KING CABBAGE, whether the PF minions like it or not. He has only days maybe weeks to live. We shall hear what they will say when he finally passes on. The next government should hold an inquiry to find out who knew what , when and why they did not inform the nation about the president’s to health status.

      PF minions prepare your selves, heads will roll on this matter.

      Cases never rot they just shelved.

    • Him being on ARVs, as you mention, has nothing to do with the case at hand. For your information there is noone is smarter than the other ….. in man’s eyes maybe, but not God’s eyes. Some people are more bullies than others, yes, but doesn’t make them smarter.

    • My thoughts exactly… if only we had 10 Changalas and 10 W. Harringtons in Zambia or in our parliament, we would have removed mediocre from public office a long time ago. What I’m disappointed in the most is this toothless parliament. Changala and Harrington do their job while they are just there sucking public money with mediocre debating. Parliament has gone to sleep and the opposition should be making these cabinet ministers regret the day they accepted their jobs as cabinet ministers.

  4. That can only work in a country with a very high degree of judicial independence, & not here where judges are apointed by the president and can be dismissed by the same person through an inquiry tribunal.
    The judge might fail to make a good decision for fear of being suspended and investigated on different matters; in case the medical committee he orders to be consituted certifies the president fit.

    • Does Changala knows that there is no Attorney General in Zambia? There is no one to sworn in the newly appointed. So Changala’s is not ready, he is behaving like Sata in opposition, so frivolous.

  8. No point trying to salvage your bruised ego. Let the poor man recuperate or die in peace. The government hasn’t collapsed. There are systems in place to take care of this situation. Good governance is not about one person. He is not the sole signatory for government. Life will go on even in his absence.

    • you are there yapping from afar in uk. things are collapsing here in. ask any of your relatives how hard life has become coz of mismanagement of the country and economy. my salary for example was equivalent to $2000/m in september 2011 but it is now equivalent to $800/m. if you have brains you can calculate the impact it has left. dont just yap, get facts

    • If the government hasn’t collapsed where is the President since he returned from “wooing” investors in Israel. This is really laughable even a healthy fit Sata would be the last person one would send to sweet talk investors.

    • Bwana Matipa I appreciate your sentiments though you are obviously lying about your earnings. The figures you are quoting imply that the kwacha has depreciated by more than 50% over the period; which is not true.

  11. The only course of action open to Mr Changala is to appeal against the refusal of grant of leave. An apllication for leave to apply judicial review is heard by a single judge – and the parties need not attend at this stage.
    Indeed Brebner Changala is one of the leading Zambian freedom fighters today. His courage and tenacity are an inspiration to us all. The several actions whicb he has taken in the public interest,should serve as a reminder to PF that there are some Zambians, no matter how few, who will fight for the right thing. Brebner is our modern day hero and deserves the support of all progressive Zambians. Keep it up Brebener.

  12. Nothing wrong with a man pursuing what he believes is in the public interest. Whether it is granted or not, is another issue. As long as he genuinely believes in the cause, he is going about it legally and in good faith, there is no need to condemn or belittle him. He is worth more in his actions than numerous bloggers who just criticize and offer no solutions. In my opinion, MPs should be doing more to make govt. account for this ridiculous scenario. Organized public action to demand the same, would also be legitimate.

  15. @kavundula,your assertion of calculation is wrong,@matipa is maybe right to some degree,his drop in earnings should be in dollar conversion only but match by the unprecedented rise in essential commodities.its simply means in 2011 he used to save some money but today he has to hustle to meant his monthly budgets.

    • No my friend! @matipa is a liar or he is politicking as usual. By the way salaries have not remained stagnant since 2011. in fact, salaries have almost doubled in the civil service.

  16. I have missed the point. What is the issue? Say Changala has personal interest in the health records of Sata, is he willing to avail his own health records for Zambians to read? Or is it the issue of Sata leaving the country and returning without all the women and children, dancing and lining up the streets to welcome him? Or Sata should have called Changala before leaving the country. Ok the guy is poorly,so what? He is an elderly person and sooner or later he will meet his maker and so will Changala.

    of worth or exellence.
    Frivolous: Not serious; playful.
    Vexatious: Cause of annoyance or trouble.
    Was Changala playing? Wasnt he seriuos?

If this fool goes ahead to resubmit his trash to the court, the court should this time around dismiss his case with high costs for cheapening it with frivolous and vexatious submissions.

  24. i hate some comments people make. we know sata is not superhuman no wonder his illness shud not be hidden.secondly, the issue of being hiv positive has nothing 2do with this case.thirdly, take time to reflect on sata’s utterances when levy was sick even when it was known.i conclude that changala is pursuing a legitimate cause. the president is a national asset and people have every right 2know his health.

  27. Since our judges seem to grow cold feet to do their job, I suggest we call no other than our Malawian judge Chikopa to come and help out on this constitution issue. Now I understand why even MCS had to ask for assistance from Malawi; our judges need to go for fresher courses at ‘ZIALE’ starting with the lady chief justice.
    Where is Kabimba and all the other noise markers in PF. Kambwili, GBM and the incarcerated Inkhosi yaba Bemba Sosala must be having a field day over ‘achimwene’ MCS situation.
