Sakwiba Sikota weighs in on the removal of the ‘ discriminatory’ presidential clause in the constitution

Opposition United Liberal Party (ULP) President Sakwiba Sikota says amendments to country’s laws should be a decision made by the Zambian people and not based on an individual’s interests.

Mr. Sikota’s suggestion follows the rising debate on the need to either amend or remove the presidential clause in the country’s constitution on grounds that it is a bad and a discriminatory law.

And Mr. Sikota has told Qfm news in a telephone interview that he is of the view that once people begin to fine tune what was submitted towards the new constitution the country may end up having a document that does not represent the wishes of the people.

Mr. Sikota says this is why he holds the position that the country should go with what people have stated in their submissions to draft constitution.

He notes that it is also important to be mindful that there are certain aspects that are discriminatory in any set of laws but that it is the extent to which they are discriminatory and whether the discrimination is justifiable.

The ULP president, who is also a lawyer by profession, says there can never be a perfect situation where there can absolute no discrimination in a set of laws.

He says even other countries around the world do have discriminatory clauses in their constitutions the more reason why one would not say that it is unheard of to have such a discriminatory clause in the constitution such as the presidential parentage clause.

  1. Yes bwana Sikota,zambia’s joke constitution is all about some individuals.Typical of PF hyenas they’ll hijack any clause in the draft constitution to suit their selfish motives.

    • Interesting discussions taking place to have Mulenga Sata eligible for takeover. The issue is that the entire constitution should be replaced by the people driven one. People like Scott should stop when he is being interviewed by the British media to avoid saying- these Zambians are submissive- it shows that he feels more British than Zambian. Recently he was being interviewed on BBC and he kept saying these Zambians are peaceful people, these Zambians should be patient- if he is Zambian he should say we Zambians, and that, I for one being Zambian… It is for this reason he should be removed. He is a continuation of British colonialism in Zambia.

    • Sata when he was alive said that no one should talk about the constitution as the current one is still fine- why is Scott talking about it with impunity- He no longer fears the cobra? Wait when he comes back as a ghost, he will be more dangerous.

    • These PF minions think they can change and influence the course of future events. No they can’t. All they can do is delay their fate. KING CABBAGE is gone and so will the PF in a few months from now.

    • hmmm muntu wandi nostradmus, nokuseka now should be copied to emulate other people sure. ninshi what will you be left with thats zambian. there is no right way to be happy, its a cultural thing and thats why I as a pan-africanist fight against subjecting our children and people to too much western culture without balancing it with our own culture either on radio or television. What we end up with is things like ba mdala ba nostradamus seeing something wrong in the way zambians laugh and preferring a latino laugh more!!!!!

    • @Zagaze. I used to be Patriotic to Zambia, until some PF (Patriotic Front) came in, and their first Lady brought that contaminating laughter of hers, now even the Sakwiba of those days laughs like Kaseba.

  3. Wishes of the people. Very good idea; but which ones?
    Of the Ruling Party: the current, past or the new ones to be elected?
    The people already spoke: Mwanakatwe; Nvunga; Mungomba Commissions. Which people are left to speak?

A constitution which is amended to suit certain individuals is not a good one.It can’t stand the taste of time because politicans come and go.We as Zambians should have the interest of all people not to satisfy political ambitious of (1) Mulenga Sata,(2) Given Lubinda and other politicans with questionable Zambian parentage.Zambia. Presidency is for bon fide Zambian citizens nowaday Guy cant act and we never act as Zambian President in absence of Michael Sata.

  5. ve—ry correct mr chimuti. we do not need to amend the constitution for the sake of mulenga sata or gay scooter to be eligible to stand as president. after all gay scooter was one of the people who amended the constitution in 1996 to bar kk from standing. am comfortable with the clause personally. we shouldn’t be lead by bamwisa

    • Where does Sakwiba take money he makes from MMD former crooks he represents, does he work for free? The guy looks impoverished compared to his name in society. He should be taking bus to buy some clothes in Swaziland or Lesotho. Lozi’s annoys me mwee, so educated but so careless…

  6. This one is just looking for a job. The way the tide is going is that Guy Scott is gaining influence, Kabimba will get rid of him then he will form a formidable party to challenge the ever becoming unpopular PF party. GBM will also join and finance this new party for 2016. All the Zambians will fall for this party and vote it in. Sikota will be vice-president, GBM will cry foul and resign to get us back where we are. Zambia is very predictable. We have been here before.

THERE ARE MANY STUPID UNIVERSITY GRADUATES ROAMING THE STREETS WHILE YOU HAVE THE SO CALLED GRADE SEVENS MAKING MILLIONS ALL OVER THE WORLD. LEAVE THE CONSTITUTION OPEN FOR ANYONE TO CONTEST. WHY ARE THE SO CALLED EDUCATED [PEOPLE SO SCARED OF GRADE SEVENS? WHY NOT USE YOUR EDUCATION TO DEFEAT THEM IN A FREE AND FAIR ELECTION INSTEAD OF PUTTING A DISCRIMINATORY CLAUSE IN THE CONSTITUTION?

    Sakwiba u r right. No constitution can be perfect. Parentage clause is just OK though WHEN CHILUBA INTRODUCED it he wanted to bar certain Individuals.
    But as things stand ZAMBIA has to b led by PATRIOTIC ZAMBIANS whose parents were born in Zed.
    LEAVE THT CLAUSE alone, giv us a ROADMAP on how will move to Presidential By-elections THATS ALL WE NEED. Whilst will b PRAYING for PRESIDENT SATA to quickly recovery.

  10. This nonsense of where you dropped your placenta and umbilical cord is a non-starter! You can be a Zambian by birth with both parents being Zambian but if you are not raised with good manners and values you can’t amount to a good leader Zambia dreams of.

    What we need to promote is the “rule of law” and not the “misrule of men”. All must be equal before the law and the risk of punishment for transgression must be severe! Corruption and adult delinquency always takes good root where the risk of punishment is slim!

    We need a system of governance that is able to guard our economy against the misrule of bad leaders and the starting point is a Good Constitution! Ultimately, it should not matter who sits on the throne as long as they are subject to the supreme law of the land!

  11. JUST REMOVE IT COMPLETELY. THAT LAW IS VERY DISCRIMINATORY AND IT IS SURPRISING THAT THAT LAW IS EVEN IN THE DRAFT CONSTITUTION. THIS IS NO AGE TO START DISCRIMINATING CERTAIN PEOPLE. ZAMBIA IS FOR EVERYONE WHO IS A ZAMBIAN- BORN IN ZAMBIA WHETHER HIS/HER PARENTS WERE BORN IN HEAVEN OR ON THE MOON. WHY IS IT TAKING SO LONG TO DO THE RIGHT THING OF COMPLETELY REMOVING IT. PLEASE, CAN WE HAVE IT REMOVED PRONTO.

  13. That’ s it. You make bad laws out of hatred for some other individuals to befit you and at the end of the day, the same bad laws work against you. Constitutional laws MUST be made not only for the benefit of current generations but also for generations to come. In most African countries, most constitutional laws are made out of dictatorial tendies the reason it will take ages for the continent to develop.
