PF Injunction hearing fails to take off, Atanga absent from court

The Inter Parte hearing between PF National Chairperson Inonge Wina and Bridget Atanga, and others from holding a General Conference yesterday, failed to take off.

This is because Ms Atanga was absent from court this morning, and the matter will now be heard on December 5th.

Bridget Atanga was appointed PF Secretary General by then party president Guy Scott, but was fired by Edgar Lungu yesterday.

Mr Lungu was elected PF President after going unopposed following failure by other candidates to show up at the General Conference.

But Acting President Guy Scott nullified the election of Mr Lungu because it was procedurally wrong, and went ahead with another General Conference which has elected Matero MP Miles Sampa as party president.

At the time the General conference was going on yesterday, PF National Chairperson Inonge Wina filed against holding another general conference for the purpose of electing another party president.

High Court Judge Mungeni Mulenga then granted Ms Wina an interim injunction restraining Bridget Atanga and others from holding another conference, after the one held over the weekend.

The court ordered that no adoption, election of the PF candidate or transportation of the purported delegations to the Mulungushi Rock of Authority should be done after the election of Edgar Lungu.

Mrs. Wina on December 1, 2014 obtained an injunction to restrain the PF from holding a general conference after the November 30 2014 conference that elected Edgar Lungu as the PF president.

    May there be a post 1964 president in Zambia. We are tired of selfish Rhodesians all in the name of experienced leadership. God is positioning this nation for a young leadership of the Calebs and Joshuas, not old fossils

    • The biggest problem in the PF is this PIG…… We are not bothers though, have elected Edgar Lungu and have started door to door campaigns.

      Any pig or cartel standing in our way will be crushed like a tonne of bricks.

    • He cannot be turning in his grave. He must be smiling very happily because what he planned is what is exactly happening. He did not want the party he formed to be taken over by anyone, preferring that it dies with him. This is how cruel Sata was that even in death, he wanted ‘ukufilila munsenga’ How do you explain his failure to quench the fires that were being stoked even when he knew he was dying. Save us this nonsense of saying Sata would be sad with the state of affairs. Remember the ‘Wynter, how is your is your fight with GBM going?’ remark by Sata?

    • People be smarter and read between the lines… all this is the work of one Fred M’membe. Sampa is just a pawn in all this… the likes of Kambwili and ba Mukamfwila were just being used and Kambwili being dnmb (chikopo) that he is didn’t realise until the very last minute. M’membe is simply using Guy Scott to execute his plan.

      Time is not even an issue here for them. HH is being endorsed by the people who read online blogs like LT and ZWD (2% of voters). With hunger and illiteracy, all they have to do is turn up at election day eve with bags of mealie meal, kapenta and Chibuku and PF will be in govt on January 21… unless of course HH campaigns harder as to educate these unsuspecting voters. Folks in Shang’ombo don’t even know what’s up but they read The Post.

    • Guy Scott’s convention is more valid than Inonge Wina’s. During Sampa’s election, Sampa got 900 votes while lungu got 5. In Lungu’s election Lungu was unopposed when it is clear that none of the candidates had withdrawn. Lungu’s election was premature because verification of delegates was still going on. All the other candidates understood this except one Edgar Lungu. Also Lungu brought thugs to the convention and threatened peace loving people of the so called PF enterprise. Inonge wina has no chance in a civilized court of Law.

      I hear you and people on blog sites do not realise that it is a different case on the ground and more so, when you travel away from the cities and towns.
      Only a week or so ago, I was chating politics with a relation (educated to grade 12) who simply said “I am PF and I shall be voting for PF”. My heart sunk and despite my repeated cry to examine the PF record, he simply saw it as a PF or MMD issue and for him, the PF is a better devil.
      M’membe understands this very well and it works wonders for him because when you talk news, you are talking Post Newspaper, Daily mail, Times of zambia, ZNBC and the censored MUVI and radio stations. The daily nation is making head way but not quite there yet.
      Zambia needs to “open” her eyes on to issue based politics.

He never prepared anyone to take over because of luck of trust…….What we are seeing now is a result of wanting(liking) to be a leader(In power) forever. Lungu will leave no stone unturned in his dreams of becoming Zambia’s president. Violence, Pangas, short cuts, bribes or even selling his integrity.

    Unless both candidates are fools, the conflict must be much easy to resolve as the two conferences reduced the possible negotiating table to a bi-partisan affair.

    One has to accept the position of Vice President in the merger, if they can agree to merge. Perhaps the family can step in seeing that Edgar and Miles are related!

    If they do merge, my prediction would be that Miles would happily take the Vice President’s role, moves him from a member of CC to Veep of PF/CC and if they won January 20 elections from a Deputy Minister to Vice President. Not bad. I hope Miles took a Negotiations course on his Senior Executive Fellows program at Harvard Kennedy School. If Edgar and Miles don’t crack a merger by end of next week then PF is…

      WhAt Lungu needs to do is apply the good butcher method. He must remove all disruptive members out of PF.b sack, expel, sack until he is clear of them.

    • Have the authorities ever caught a witch flying on a broomstick in the country’s air space? Why are those so called witches always pictured sitting on the ground. Why can ’t any of Africa’s ‘flying witches’ be caught or photographed flying? Why are ‘magic birds’ & witches always pictured sitting? Why can ’t they be captured flying even if it is few centimetres above the ground? These are critical questions Africans have yet to ask.

Miles Sampa is just an ordinary member. Please respect the law you rascal politicians, you will destroy that country full of docile people.

    the best miles sampa can do is let edgar lungu as president.if indeed he is a true patriotic member who wouldn’t want the pf to die.
    The fact on the ground is that EDGAR LUNGU is the most popular candidate than MILES SAMPA.
    If by mistake miles sampa stands as pf candidate then pf is loosing.

  6. In negotiation theory, not turning up for a meeting/hearing increases the chances of striking a deal as it heightens the risks of failure for one or both parties. I would not show up for the hearings until 13 December, 2 days to the filing of nominations which would force the parties to reach a deal. Somehow one of the parties has more to lose, I would suspect Edgar and he is most likely going to make an offer to Miles which is fair and acceptable.

    Let’s see if both candidates can deal with complex negotiation problems, the kind they would face as national Presidents.

What we are seeing could very well be replicated at the national level because these are the very people who wield the instruments of power, including resources to holding the national presidential by-elections. We need to start mounting pressure from early on and demand that this confusion within the Pf should never extend at the national level.

    All it takes is for the so called Acting President, so called cabinet, etc to use state machinery and collude with the ECZ, the courts, the DPP, the police and move these elections to another date citing all sorts of excuses… or worse use and resources at his disposal; newspaper; bribe illiterate voters; temper with voters register; rig the elections (results or the ballot itself); if they can’t they will move dates. Watch!

    • “Within 90 days” period! Move the election date to where? Failure in PF to unite should not hold the other parties and the country to ransom!

  9. An injunction has to be served on the party concerned. It appears this was not done, the party concerned (Atanga) can not be expected to comply with it. Hopefully she has not gone to the Bahamas! Remember the case of Nevers Mumba, where the serving of the injunction did not happen and the courts held that he legally held the MMD NEC meeting which fired Chituwo, Simbao et al?

  10. It’s time for the PF to appoint a NEUTRAL, SKILLFUL and RESPECTED mediator to start the process of negotiation between the Edgar and Miles camps. This issue mark my words will not be settled without a negotiated settlement, with one accepting to be the Vice President of the Party and the country in case of Victory on Jan 20.

    If I were both candidates, I would get to the negotiating table fast, using this period to 5 December to strike a deal so that by 5 December, a common position can be announced and case settled out of court!

  12. Reality will dictate that Guy Scott could not have produced parallel elections alone but what is real is that a serious division exists within the PF. Lungu himself should not be seen as a saint, he has helped to fuel the rift with his association with thugs and perceived rush to seize power. The PF is at the moment in tatters. Things could not be worse with serious national issues to sort out especially the plight of farmers still waiting for their hard earned cash. The solution-get rid of PF. Good day.

Another injunction on lungu and samp restraining them from filing their presidential nomination & campaigning for themselves or any other person from campaigning for them until all the farmers are paid in full for 2013/14 crop. PF Govt should explain why they saw it prudent to divert money meant to pay farmers towards sata’s funeral. I am one of the agrieved farmers.

  25. A pity some bloggers are putting the blame on Sata for the mess going on in PF. Sata reminded you on several occasions that his ministers are dull. They all saw he was sick and kept quite instead of strategising the way forward. The members are themselves to blame. It is only sad that villages will vote for them regardless!

    Miles Sampa has “won” the elections at the “Scott approved general conference”. Unfortunately the returning officer has not declared him to be “the winner’ of yesterday’s “election” due to the injunction..
    The cartel is evil, it is saddled with debt. The cartel is a monster with multiple heads. When one head was cut off by Michael Sata the Past newspaper cried and cried and cried, but it soon realized that it had multiple heads and decided to soldier on.
    Zambians are warned to look out for the cartel. How do we do this? Just watch what the Past newspaper writes and you will tell which politician not to support. In case of doubt, don’t support anyone or anything that the Past seems to support. Sometimes it condemns a named individual…..

E.g. look carefully at today’s Past editorial: “..What will happen to Lungu and his supporters if… they lose their court case? Are they…..willing to accept the candidate who has been elected at a general conference they walked away from? And if they win the court case, do they…expect the other group which remained at Mulungushi to work with them?”
    Interpretation: they are silent on the other candidate.
    Conclusion: The cartel/Past is pushing for the “other candidate”.

  29. I have no problem with Scott. I thank God for him. If it was not for him to put up the madness of such fellas as lungu and his kaponya fraternity we would be witnessing carnage of the worst. I can’t wait for Jan 20 to see these kabovas out of my sight. The Lungu camp is full of unschooled and irresponsible thugs who does not deserve the reigns of power. GUy stand your ground and sort them out. Do not give up whatever betide. You have our blessings.

    • I think you give Scott too much credit. He also has his own agenda, nothing to do with democracy at all.

      He has no conflict resolution skills whatsoever. He has not displayed the qualities you would expect in a leader, least of all charisma. He couldn’t even harness the warring factions and negotiate, negotiate, negotiate until a compromise was found.

      Instead he compounds the problem by holding a seperate conference, just after the (allegedly) illegal one had been held. He should have ironed out the error of the first one (through the courts and/or through sheer charisma and personality) before taking the party AS ONE to a united convention.
      This is simple and logical and the only reason he did not follow this simplistic formula is that he has an agenda… continued….

  30. The sad story about this whole saga is that the owner of the party must be turning rapidly and furiously in the grave. No wonder he never let Guy act not even once.

    • Yes Guy scott has own baggage. But he is more sober and exercises discernible reason. The reason why lungu’s GM was illegal was that there was accreditation process going on before voting could begin. All the other candidates obliged. Why didn’t Lungu do the same? Silver masebo went to advised the lungu camp to stop their voting process, but she was nearly attacked by lungu’s thugs serve the police. Lungu is deceieved by the excitement of cadres. He will be shocked. I do not know what you see in him to qualify him as presidential material.

  31. For the undecided, it would help if someone could provide profiles of candidates. I am particularly interested in reasons for voting for Edgar Lungu (or Miles Sampa) and the PF over other presidential candidates.

    An analysis which does not have insults, lies and personal hatred would be much appreciated.

  32. The only reason everyone gives for supporting EL is that “he is popular”, that MCS (MSRP) “left him with the Instruments of power” before he (MCS) went off to meet his maker!
    This I may interpret to mean that:
    1- MCS knew he was being shipped out of Zambia for the final time, that he was aware of his impending death….
    2-MCS did not understand the law, nor consult those that have dedicated life to studying it (who were at his disposal I may add). Had he done so, he would have realised that leaving his chosen one with the presidency did not necessarily mean he would be the PF president and so national president in waiting.
    If 1 above is true, then MCS did his PF members a ‘donchi kubeba’, hoping that when he goes, this confusion would occur.

    Lungu ‘inheriting’ the presidency is ludicrous. He has been given a free pass, simply because the guy died, and in Zambian culture a dead guy is a good guy. Despite the ills and incompetencies that are evident (to those that allow themselves to look), people still want to perpetuate the dead ‘good’ guy’s incompetencies.

    Why?

    Because we lack the self-esteem that allows people to demand the best for themselves.

  34. Edger is worthy to lead pf but he is not a sober minded man if he wants to win let him not result into violence and riots. If he truly has supporters no need for him to pay or tell them to riot. Remember in the times of king cobra people wanted to riot but sata was In for front stoping them. That’s the heart I want to see in edge and let him use his brain to convice this educated fella’s not him using the uneducated marketeers in the name of corruption NO
