RTSA CEO Zindaba Soko’s case withdrawn

CHIEF Resident Magistrate Joshua Banda has threatened to stay the assault case by Road Transport and Safety Agency (RTSA) Chief Executive Officer Zindaba Soko and his brother if he committed any assault case.

This is a matter where Mr Soko 38, of Libala House No. 153/45/m and his brother Samuel Soko 30 of flat No. 18 Sesheke road Emmasdale were jointly charged facing one count of assault occasioning actual bodily on Mr Petro Phiri.

The duo whilst acting together did assault a Mr Phiri on December 13 last year around 17:00 hours at Care for Business Hospital.

When the matter came up for plea yesterday, Mr Phiri informed the Court that he was withdrawing the case for both parties to have time to reconcile because they came from the same area.

“If there would be anysimilar complaints or allegations, I will stay the withdraw and the case shall be re opened,” Mr Banda said.

Magistrate Banda withdrew the case persuant to Section 8 of the Procedure Criminal Code (CPC) because it encouraged the court to promote reconciliation in private matters and threaned to re-open the case should the accused persons found themselves with similar coplaints or allegations.

Mr Phiri of 32 Mwembeshi Road who is an employee of a named FGS funeral Palour told the court that he had withdrawn the assault case against him for purposes of peace.

“I am here to tell the Court that I want to withdraw the case so that we can sit down and have time to reconcile with the Soko family,” Mr Phiri said.

Mr Banda asked Mr Phiri if reconciliation had already taken place and responded in the affirmative saying the parties were all coming from the same area.

“Have you already reconciled?, Yes, Why have you decided to reconcile, because i want us to resolve this case as come from the same place, we have to reconcile for purposes of unit,” he said.

  1. Take it easy Zindaba. I know it’s not easy to land such a position and sober up just from being a transport officer/driver to CEO of such an organization.
