Zambian Voice happy with discontinuation of DPP’s case

The Zambian Voice has welcomed the decision by the Lusaka Magistrate Court to discontinue the case where a private Lusaka resident Newton Ng’uni drugged the Director of Public Prosecution (DPP) Mutembo Nchito to court on allegations of abuse of public office .

Zambian Voice Executive Director Chilufya Tayali said the law was clear that a sitting Director of Public Prosecution (DPP) cannot be prosecuted according to the constitution.

This is according to the press statement issued by Mr. Tayali to ZANIS in Lusaka today.

Mr. Tayali however observed that the discontinuation of Mr. Nchito’s case does not mean that the DPP’s immunity is not like that of the President which is explicit in the constitution.

He said the matter has remained with President Edgar Lungu to set up a tribunal according to article 58 of the constitution of Zambia to probe the DPP.

Mr. Tayali said the DPP may not function properly because public confidence has been shaken by the allegations.

He said therefore the President has an obligation to protect the DPP’s office.

Mr. Tayali has also commended President Lungu for not interfering with proceedings in court since the case started.

  1. It is not done, ECL will try other avenues to try to intimidate DDP. DDP should be left alone. Who hasn’t stolen? if you haven’t stone this man, everyone will walk way including ECL. Banda is the reason for this intimidation, 2016 is around the corner and ECL when out of office will have to account for this? DDP might be a thief but so many thieves are still stealing and killing innocent people, that is not an excuse but the system is broken even the way ECL was elected and even the way he is running the country is mockery.

    • Its amazing how these fellows CANNOT read what is in front of them…the national constitution is very clear about this particular matter…but yet again, the way the PF constitution was disrespect once apon a time…kaya!

  4. Ba tayali, isn’t it you just a few days ago who was saying the DPP could not enter a Nolle Prosequi in his own case? What has changed? You suffer from a serious case of NEIGHBOURHOOD SYNDROME. Now that the magistrate has dismissed the case, you agree. A journalist like you should always do research before commenting, you are not a common blogger like the rest of us. Shameless.

    • If ever one needed evidence as to why as a country we never develop, this is it.

      How and why we afford characters like this guy so much coverage boggles my mind.
      I mean this guy is on record just a few days ago saying all sorts of bad stuff about the nolle entered by the DPP. How he could possibly turn around and say this today is mind boggling.

      But that is not surprising to say the least, what is shocking is that the person who filed this report could not ask Mr Tayali how he reconciles he totally contradictory stances on this matter.

      Our tolerating characters like Mr Tayali reflects our lack of seriousness as a people. This man is facing charge in our courts of law for god’s sake. He shouldn’t be afforded even the slightest attention ever.

    • This is a U turn Tayali. I think this guy realized that Mutembo would not be prosecuted then he remembered his pending court case and did a U turn so that things are made easy for him when he goes to court. Kuwe! Double tongued coward!

  7. I totally agree with ‘Armchair Analyst’, why is it that a criminal is given so much space every day in the papers to say unreasonable things, misleading the masses?
    In fact he is not supposed to hold that position of Executive Director, I wonder how other member in that NGO feel about him.
