The Zambian Voice has charged that the ruling PF is now victimising and harassing embattled DPP Mutembo Nchito.

Zambian Voice Executive Director Chilufya Tayali said his organisation does not agree with the manner in which the PF is handling the issue of the DPP.

‘Whilst we are one of the organizations that petitioned suitability of Mr Nchito as DPP right from the time when he was appointed, we do not agree with the victimization or persecution of the constitutional office holders when they do not perform in accordance with political powers or any interest as long as they are within the confines of the law,’ Mr Tayali said.

He said the provisions of the law must be followed to deal with purported erring constitutional officers adding that laws must not be circumvented to fix anyone, even if they are not popularly liked.

Mr Tayali said the statement by PF Secretary General’s Davies Chama over Mr Nchito is in bad test and contemptuous.

He said Mr. Chama cannot engage a High Court Judge in a manner he did as a secretary general of a ruling party.

‘Further we find it very unfortunate that PF youths have been incensed to marshal mob justice on the office of the DPP following the court order of Judge Chitabo. This should not be condoned in a constitutional democracy. It is anarchical for the PF youths to want to behave in such a manner,’ Mr Tayali said.

Youths from the ruling Patriotic Front have threatened and resolved to seal off Director of Public Prosecutions (DPP) Mutembo Nchito’s office following a stay of execution by Lusaka High Court Judge Mwila Chitabo against President Edgar Lungu’s decision to suspend him.

Former Lusaka District Secretary Ben Siwila says Judge Chitabo’s decision was an assault on the functions of the Office of President and the Justice System.

“Our position is that DPP Mutembo Nchito remains suspended as pronounced by President Edgar Chagwa Lungu in line with the powers vested in him.
To this effect, we as PF Youths shall cannot sit back and watch justice being short-circuited as we have witnessed with the stay of execution ordered by Judge Mwila Chitabo.” Siwila said.

He said to that effect, his youths had decided to mobilise and seal off the Offices of the Director of Public Prosecutions until the matter is resolved.
“As PF Youths, we shall mobilize and camp at the DPP until this matter is resolved.

Zambia is not a ‘banana republic’ where an individual or indeed their clique can continue to hold arms of Government at ransom.

We should also warn that we will not allow Mr. Nchito to take regular shelter in Judge Mwila Chitabo’s questionable protection.” Siwila declared.

    • On a serious note, according to arguments against Guy Scotts acting appointment, when Wina returns from USA, she cannot act as president unless Simbyakula hands over to Mr Lungu. Are they going to perform the handover in the ward? If not Wina is relegated to ceremonial status. If Simbyakula travels to handover to Lungu who remains as acting in Zambia and who is he going go handover to? The drama continues. We cannot have a period without anyone incharge. Give us a constitution, pilizi tapapata.

Tayali is right these PF candres just know about violence and do not follow constitutional laws.Who appointed Nchito despite some quarters not approving of his appointment.Just because President Sata is nomore you start victimising his appointee?Dont you know we voted for current Pf just to continue with late Satas vision but you start victimising his people soon after you started governing its very wrong.Everbody is watching this unnecessary firing and persecutions of late presidents appointees.EL was justice minister and approved of Nchito what has Nchito done in barely one month of El being in power which was not known before?

  9. Wow I never thought the day would come when I would actually admit that I agree with Tayali. Nchito is slowly gaining sympathy in the court of public opinion. The longer he fights this the more he exposes how desperate the PF is to please RB. This is all being done to thank RB for his support during the election. This is outrageous. Let the law take it’s course. Nchito may indeed be wrong but he has raised some valid concerns regarding constitutional separation of powers and judicial independence.

  10. I feel a sense of compulsion to evaluate the mental status of any man who comes to the defence of Mutembo Nchito or Fred Mmembe. These people have huge clouds of suspicion hanging over them and if you are a careful observer, you will note that HH and many other opposition leaders are very distant from this issue because they know very well that these individuals have cases to answer. The truth about Sata (MHSRP) is that he loved loyalty more than anything. Sata would ignore principles just to employ someone very loyal to him (the yes-sir type of loyalty).

  13. Mutembo was very successful in his profession as a lawyer even before he became DPP and so I do not think its an issue of a job or money or power.

    What I think is PF is desparate to let RB off the whoke from prosecutions. That is why they want Mutembo out. its very plain to see.
    These PF cadres if they are not controlled they will create curious. PF let us follow the law and respect the courts. Justice will prevail even if it looks slow.

    Let the law rule not cadres broking the offices no. when a ruling does not favor you do not take things in your own hands.

    • So you want to continue with Sata’s mistakes. ECL has in the last one month corrected most of the mistakes done by the Late MCS. The Guy Scott issue by appointing a Veep who can act as President. The appointment of the Chief Justice and not having a person acting for years. The initiation of
      Legislation to allow Deputy Ministers to act in the absence of the incumbent. The normalization of relationships with foreign countries. He wants to correct the mess involving the DPP, but you are opposing. What do you want?

  16. I have read the PF Secretary General’s comments on Judge Chitabo’ s Decision. There is nothing Contemptous. Commenting on a judgement does no amount to contempt. The problem with people from the UPND is that everything the PF does is wrong. They can even support Mutembo and Mmembe out of Opportunism. Such lack of Principles is sickening. What government can these people form when they change goal posts all the time in the false belief that this takes them close to Plot 1.
    Why is there the Judicial Complaints committee if the Judiciary has absolute powers and cannot make mistakes? Why do we have the Law Association of Zambia? Why do people win Appeals if the Judiciary cannot be questioned? The Judiciary is run by people who may be susceptible to Corruption. They are not infallible.

    • The Call by the SG of PF for the Judicial Complaints Commission to probe Judge Chitabo’ ruling on MUTEMBO is within , and provided for under the laws of Zambia. Also the question on why Judge Isaac Chali is giving one and only one Judge by the name of Mwila Chitabo to handle Mutembo ‘s cases is also credible. THERE IS NO CONTEMPT. Only a F*** will think this amounts to contempt.

  17. Just a bit of history: At the height of the liberation war in Angola two white Portuguese soldiers strayed into Zambia and were arrested. At that time the Chief Justice was a white man called James Skinner. When the case reached him, Justice Skinner dismissed the case as mere mistake by the accused since there was no marked boundary where these soldiers had crossed into Zambia. This sparked demonstrations and riots by Unip Youths against Justice Skinner and forced him to flee from Zambia. In short, I want to advise those in charge of our courts not to take the independence of the judiciary as absolute. As they make rulings, they must remember that justice is about people and their feelings must not be dismissed as a mere nuisance.

    • @Ngambela You are a F00L talking Rubbish. Why is Nchito afraid to defend himself in a tribunal? Why does he run to Judge Chitabo only, all the time? What has Lungu done in this case which you find so hateful, other than what as Head of State he is required to do.

  20. Jane @ 26.1, Ngambela is right. Lungu had a score to settle with Mutembo and went about it in a round about way, first sending Nguni & Co to Chongwe. This was followed up with “complaints from the public..” (short-cut for Nguni & Co). Lungu has rushed to set up a tribunal even before the court processes have finished.
