President Edgar Lungu has pardoned jailed musician Clifford Dimba, alias ‘General’ Kanene, who was convicted of defiling an underage girl and sentenced to serve 18 years.
The President said this is in exercise of the powers vested in him by Article 56 of the constitution of Zambia.
The President said this when he toured and commissioned the procured Agricultural equipment for the Zambia Prisons Service at Mukobeko Maximum Security Prison in Kabwe today.
The Head of State has urged General Kanene to be an ambassador in the fight against Child defilement.
This should be an outrage to all Zambian women and women all over the world.What message is President Lungu sending?
He even has the audacity to say Kanene should be an ambassador against child abuse? Seriously? Jameson what did you drink before you uttered such a sentence..and this is the person leading an entire country?

He was CONVICTED by the SUPREME COURT and no by acting magistrate you effing jerk.
If he was wrongly convicted as you claim, even with the benefit of legal representation which he had, he could have very well preferred an appeal to the Supreme Court. Of course, the facts and law were decidedly against him so the presidential pardon was a convenient way of circumventing the legal process. But to what end? Should presidential pardons be exercised in this manner? Only time will tell!

President Lungu’s presidential pardons are a mockery to the judiciary and the people of Zambia. Judges labour to convict criminals at great cost to the tax payer and only to be rewarded with presidential pardons. Presidential prerogatives must be used with wisdom. They go beyond the president as a person to cover the wider society. Okay Kanene is free today but where does it leave other similar convicts languishing in jail, the victim girl and her family and the other girl child who has been or is at risk of being defiled? No serious president takes decisions that demoralise his own people who are working hard to protect the vulnerable in the society. Sex exploitation is being fought vigorously in the world while our lawyer president is taking delight freeing perpetrators. Shameful…

I would be the first person to slap harsh sentences on rapists and defiled. But the case of Kanene cast doubts on the claim. The girl’s age was never established, she is said to have accented and the matter only became defilement when the parents intervened and she looked physically mature to be with a man. Tayali could have gone in had he not played it smart. That girl/woman wanted to sacrifice Tayali to cleanse herself so that she is not blamed by the fiancé she’d betrayed!! At law ignorance is no defence. The burden of proof is on the accused to prove that the girl was of legal age of which Kanene failed. In any case Kanene is a married man and therefore guilty of adultery. When you consider these you begin to wonder whether president Lungu is of sober mind to lead this country for the lawyer he is. Lawyers are supposed to be champions of human rights but the conduct of president Lungu leaves much to be desired and the law association should comment on the conduct of their member in the interest of safeguarding the interests of the vulnerable in society from the so called powerful.

With so many cases involving defilement in Zambia you’d think Lungu would have used this opportunity to send a message this will not be tolerated any more in our society. If this age thing really applies then 80% of marriages in rural areas would dissolved and the men jailed. IN the villages, once a girl drops out of grade 7 at 14, the only option remaining is marriage. At 18, you are too old, too experienced and too finished to marry any serious man. Even in urban high density areas, this rule applies. You can pretend otherwise, but is the reality. General Kanene is a free man of the city.
I do not know who General Kanene is but I think this decision on the part of HE ECL has dealt a serious blow to the fight against defilement and Gender Based Violence in general. While we are all aware that the HE has such authority Constitutionally to do what he did, he should have at least listened to his conscience. My thoughts.

So here are the actual facts. Education levels for women mean that girls still have to marry at a young age. Prostitution is rife, and there is a possibility that the girl in question was under age. She may have had two children out of wedlock, and is in a vulnerable position. A popular musician, at the worst, raped a minor, at best, was caught soliciting a prostitute. A president has used his power to overturn a judicial ruling for political gain. There is a pervasive culture of shaming women, inherit at the highest level of government.
Defending these facts means defending a backwards-looking…
