The Grand Coalition on the Campaign for a People Driven Constitution in Zambia has said the amendments to the constitution passed in Parliament is not what the people of Zambia drafted but what the PF wanted.The Grand Coalition said the people of Zambia have clearly been duped by the Patriotic Front government and now it is trying to blindfold the citizenry to think that a new People Driven Constitution has been delivered.

They said one wonders why the PF government did not just adopt the National Constitution Commission (NCC) draft of 2010 and included whatever new clauses they wanted, than wasting so much money only to end up adopting some of the exact clauses in the NCC draft Constitution and using the same route the NCC proposed. In a statement to the media the Grand Coalition further outlined the implications of the exclusions or shooting down of some progressive clauses in the draft constitution.

Lusaka, 17th December 2015

The Grand Coalition on the Campaign for a People Driven Constitution in Zambia has been vindicated in its warning that the Parliamentary Amendment of the constitution is part of a well calculated ploy to deny Zambians a people driven constitution.

The people of Zambia have clearly been duped by the Patriotic Front government and now it is trying to blindfold the citizenry to think that a new People Driven Constitution has been delivered. The Bill that was passed is not a new constitution but amendments to the constitution. What they passed in Parliament is not what the people of Zambia drafted. It belongs to the PF and not the Zambian people. What happened in Parliament last week is part of the treachery that the Grand Coalition consistently warned Zambians to be wary about.

Recollecting how the final draft constitution was birthed, it is extremely treacherous for any person to alter the contents of a document that was compiled by the people of Zambia. One wonders why the PF government did not just adopt the National Constitution Commission (NCC) draft of 2010 and included whatever new clauses they wanted, than wasting so much money only to end up adopting some of the exact clauses in the NCC draft Constitution and using the same route the NCC proposed.

The implications of the exclusions or shooting down of some progressive clauses in the draft constitution are that:

  1. It limits citizens’ enjoyment of fundamental rights: The Bill of Rights has not been included in the amendments that passed in Parliament. This makes it difficult for citizens to enjoy their fundamental rights and freely participate in the governance of the country.
  2. The shooting down of the provision on Mixed Member Proportional representation undermines the participation of women, youth and persons with disability: The amended constitution has undermined the participation of women, youths and persons with disability in national affairs and they remain at the benevolence of the leaders which perpetuates dependence and political patronage. The submissions from district, provincial and provincial levels, which were clearly captured in the final draft, were clear that citizens wanted the constitution that guaranteed the effective representation of women, youths and persons with disabilities in line with the many international instruments Zambia has signed. It is clear that the MMD and PF do not want the marginalised groups to also participate in the governance of the country as demonstrated by their unanimous resolve to shoot down such a provision.
  3. The removal of the clause on Cabinet outside Parliament has undermined the doctrine of separation of powers: The amendment has also undermined the doctrine of separation of powers. We are in a subtle way going back to a one party state. The people clearly stated that in order for different arms of government to keep checks and balances on each other, Cabinet would have to be appointed from outside Parliament. This is working in other countries.
  4. It has stifled access to information and freedom of the media: The people indicated that they want access to information and freedom of the media to be guaranteed in the new constitution. These provisions are not part of the PF amendments passed in Parliament. This means the PF want to continue with this current trend of beating journalists, storming radio stations and disrupting programmes. No wonder threats on media institutions have become the order of the day from the Minister responsible of protecting the media and also no wonder the Access to Information law has dragged on.
  5. The amendments trashed the people’s submissions on voting on the budget: The final constitution says the budget must be passed by a two thirds majority, but the PF and MMD colluded to reject the people’s submissions, changing the clause to provide for a simple majority to pass the budget. This shows that they are so determined to continue with their lack of accountability in the management of national funds. It is sad that the PF could not learn from reasons that led to MMD being booted out-limited accountability that resulted in massive cases of corruption within government and officials.
  6. The amendments left out the provisions on Provincial Assemblies, thus limiting decentralisation: Among the clauses that were shot down was the provision on provincial assemblies, whereby the constitution defined how citizens would effectively participate in local governance. PF government with support from the MMD want to continue to centralise power and their talk about decentralisation is but just a lip service.

The way in which the PF have handled their amendment of the constitution shows they want to limit citizens’ participation in the democratic governance of this country. We have every reason to fear that the current human rights violations through the limitation of the enjoyment of people’s freedoms are just but a beginning of worse things to come especially ahead of the election. That is why the PF have dropped a number of progressive clauses so that they can continue to undermine the role of citizens in the governance of this country later on drags its feet to review the Public Order Act.

What has worsened our fears is the fact that the current process does not have a clear roadmap to give guidance and indications on what will happen next on the mutilated constitution. We have already seen that those in power just decide as and when they want to change or remove some provisions of the draft without consulting the authors of the draft: the people of Zambia. Without a roadmap and legal framework, they will get away with this without accounting to anyone. However, the time to account for their actions is fast approaching and as Grand Coalition, we are resolved to make it happen for them.

What the Members of Parliament have done is like a messenger who is sent to deliver a letter, but on the way the messenger decides to open the letter and change some paragraphs.

Once again like they failed with the economy, the PF have failed even at something that was within their control.

You were crying day in and day out on some of the clauses that have been amended especially the 50% + 1, the Presidential running mate and the dual citizenship hoping that the PF Government would never attend to them in order to please your useless sponsors and continue to recieve dollars but the Govt has done what the people of Zambia had spoken through their submissions and now you have nothing to make noise on.     • This is One PF achievement and it will never be taken away from ECL’s legacy – the passing of the dual citizenship measure – within 10 months of taking the Presidency. By the way this clause will directly benefit Sara Longwe Clarke’s own very mixed race children she has from a European. She should have at least acknowledged the positives and not only focus on the minor and costly negatives

  5. Why is there seems to be no distinction between Grand Coalition and PF? If you want to critic start by discussing what has been passed in parliament. what is PF about 50%+1? What is PF about the running mate? Can the Grand Coalition and UPND state how the 50% + 1, the running mate and dual citizenship disadvantage the opposition. These proposals came from the Zambian people and not PF. For me these were the most important clauses we wanted. Appointing cabinet from outside parliament; women, the youth and persons with disabilities are non issues because no one is prevented from participating in politics. I don’t know of any clause in our constitution that stops any Zambian from taking part in the governance of the country.

  6. A New People Driven Constitution has been delivered to the people of Zambia. Even when one submits his draft assignment to the supervisor, not everything is retained otherwise they would be no need to review it.

  7. The complaints by the so Coalition are totally cheap and misplaced. Every Zambian knows that the hot issue was around the 50% + 1. Other issues were and are still very minor. Please, Coalition , give us breathing space now. Go and conduct a random survey and hear the people’s views. I advise you to go to Primary and Secondary Schools and interview teachers; go to churches and interview church goers; go to universities ( both private & public ) and interview students and a few other groupings and hear what they have to say about what Parliament in Zambia has done.   9. At least we have moved a step ahead. Lets not be too critical over everything. This mentality of wanting things to go exactly the way you want is retrogressive. Why cant you comment about other good clauses they have enacted? Because to you everything is wrong. Reasons have been given as to why certain clauses can not be implemented now, but you ignore all that. The best you should have done was to go article by article and state where they have done well and you agree with them and where you differ. No one has claimed that a brand new constitution has been delivered, to my knowledge not even the PF or myself or anyone else except yourselves. Even in parliament all MPs whether MMD, PF or UPMD were clear that they were debating amendments. The PF of Lungu (not of Kabimba, make the distinction) made it clear that it was not possible to take the approach of Grand Coalition given the prevailing climate in Zambia and the time available, they said everything else will be considered at the right time. Where were you when Kabimba hid the draft constitution which was only released after Kabimba was deservedly kicked like a bucket of waste water and Lungu came on the scene.

Are these characters telling us the current constitution in its entirety is defective? Passing of the new constitution with most of the clauses that people wanted is the most progressive we have had since we started trying to make a new constitution.   35. The Grand Coalition sounds very bitter and not prepared to examine this issue objectively. Yes, the constitution will remain defective with the clauses not yet implemented. However, the clauses passed signify a big positive for some of us. It does not mean we have to rest on our laurels. Let’s debate the rest. For what it’s worth, one has to credit ECL for the courage to facilitate the progress so far. As for the NCC findings, why did RB ignore them? Why did it not accept all of the Mungomba commission recommendations?

  37. In this one instance, I would say the parliamentarians failed to act beyond self interest instead of siding with the will of the people. By insisting that the president appoints ministers from with parliament they made sure that they had job security for their future jobs as ministers besides being MPs as well.

    My proposal is that all the clauses that the PF turned down should now be subjected to the National Referendum since the PF had assured us that the adoption would be done in two phases, parliament as a quick fix, and referendum later for the people to decide on the other clauses.

    I do not see our parliamentarians acting beyond self interest in some of these clauses because they are immediate beneficiaries.

  43. Below is what I submitted this afternoon in response to Lungu’s Constitution Bill signing bragging and I still stand by it (and agree with Sarah Longwe)

    ” Its the process of bringing about the new Constitution that was in contention – and still is, in my books. A referendum based Constitution is less subject to future ‘willy nilly’ amendments. The fact the clauses were put before those MPs is what was frightening in terms of the legitimacy of the Constitution. If many of the clauses have remained, its only a coincidence. The methodology could have easily seen a rejection of the significant submissions that people made. For me, this was still a mere amendment exercise in terms of process.”

    • Even after the referendum, Mps will still have to debate and pass it and presidential assent required to convert it into law. Room for amendment will still be present

  46. The American Constitution has been in existence for something like three hundred years but from time to time it is amended to adapt to changing circumstances. How often does one hear of the First Amendment, the Fifth Amendment and so on? And so amending a constitution is not a new idea and one can only speculate that the insistence of a new constitution by the Grand Chakuti has more to do with politics of the belly than having an amended constitution that serves the interest of the majority of the people. There could be need to amend parts of the constitution in future as circumstances change just like some Americans would want to amend the section on gun ownership because of the mass killings that have been associated with it.

  47. The difference is we have had a Constitution that has not really been ours. Once you ground your own Constitution that reflects your aspirations as a people, yes, in future if need be, you may amend some parts. But if we do not have a Constitution that transcends regime change or the socioeconomic base, we shall forever be suggesting new commissions by successive governments or subject it to numerous amendments to suit the caprices and whims of those in power at any given time. This is what we have been striving for – an ultimate people based Constitution. After a Referendum, this would not be subject to debate, but be written in the necessary language and Parliament merely passes it. Not the other way round. That those MPs represent us, is a myth.

  48. Our president His excellency Mr. E Lungu, who is a layer by profession and Dr. Ngosa Simbyakula know the difference between Peoples’ Driven Constitution and Parliament Driven Constitution. Because of greed and selfishness have decided to give us Parliament Driven Constitution. It is absolutely true that they have no respect and regard for peoples wishes. PF cannot keep its word-promised to give us peoples driven constitution. PF lacks integrity, respect and trust, that why we are being given a Parliament driven Constitution. It is a fault and greed of PF that’s why PF is “fighting” with LAZ, Grand Coalition, opposition parties for unjust cause.
