Some people have Diplomas but NO Grade 12 Certificate, clarify this provision; UPND asks LAZ

United party for National Development Deputy Spokesperson has asked the Law Association of Zambia (LAZ) to give guidelines on the implication and interpretation of minimum qualification of grade twelve certificate.

In a statement released to the media, Mr Edwin Edwin Lifwekelo said that there was confusion and misunderstanding on this provision because the constitution stated that minimum qualification of grade twelve and this could be interpreted to mean that one still qualifies to stand with other academic faculties even if one didn’t have a grade seven or grade twelve certificate.

Mr Lifwekelo further said that we have doctors and academicians including politicians that never had a chance to do grade seven or grade twelve but have obtained a diploma or degree in other academic faculties.

FOR IMMEDIATE PRESS RELEASE

The Law Association of Zambia must give guidelines on the implication and interpretation of minimum qualification of grade twelve certificate. There is confusion and misunderstanding on this provision.

The provision says minimum qualification of grade twelve, meaning one still qualifies to stand with other academic faculties even if one didn’t have a grade seven or grade twelve certificate.

I have in mind people that never had an opportunity to do grade seven or grade twelve but have gone further to obtain a diploma or degree in other academic faculties, do you disqualify them on account of not having a grade twelve certificate, the answer is No.

We have doctors and academicians including politicians that never had a chance to do grade seven or grade twelve but have obtained a diploma or degree in other academic faculties.

The provision says minimum qualification of grade twelve meaning one can still have other academic qualifications and thus is qualified to stand as a Counselor, MP or President.

The Law Association of Zambia must therefore, provide leadership on this matter and give guide on the interpretation of minimum qualification of grade twelve. People have taken it that you specifically require a grade twelve certificate for you to qualify as a Counselor, MP or President which I think is not the case. I stand to be corrected.

  1. What I read is grade 12 or equivalent. Perhaps question should, what is equivalent to grade 12?

    • Those doubting GBM’s qualification to the Office of Vice President should also clarify this:
      Why does GBM even need to produce A Grade 12 certificate to be a Vice Presidential running mate? Can someone cite the the article which specifies qualifications for a running mate? I have not seen or read any! Since qualifications are not specified it therefore means anybody who aspires qualifies as long as he/she wins favor of the Presidential candidate & is picked as a running mate.

      Please do not hallucinate implied qualifications that because a Vice President assumes power whenever there is a vacancy in the Presidency then by implication He/She also needs to have G12 certificate. No!

    • The qulifications for MP apply in this case, i.e. minimum grade 12. So of course a diploma, which higher that a certificate qualifies. I thought UPND balaabusongo maningi.

    • Imwe ba Lifekelo/UPND suppose GBM is working @ Arizona Breweries processing Chibuku Bulk Beer but he his level of education is up to grade 6 term 3 drop out.He decides to obtain a 2 years Diploma in Chibuku Processing and intends to stand as a councilor under 2016 amended constitution.Then Mandevu Banda is just a school lever with full grade 12 certificate ONLY.Among the two who has a minimum of grade 12 certificate? If recruiters are recruting degree holders do they look just for degrees or high school qualification? Food for thought before even LAZ answers you.

      When one reviews the electoral results data, it is not possible to pin-point anything uniquely different in the voting pattern of Southern Province when a candidate coming from the same region stands… Here are some facts:

      In 2008 when RB (Eastern), HH (Southern) and Sata (Northern) stood, each of the three got the following results from their respective regions of origin (strongholds): RB got 74.46% from Eastern (and 20.79% from Southern); Sata got 70.47% from Luapula (and 4.78% from Southern); HH got 72.98% from Southern (with 1.30% from Northern! and 5.84% from Eastern!)… So which region voted the least for one who is not their own here?

      So where is this theory of Tribal or Region votes more pronounced or worse off for Southerners than other regions? I don’t see anything unique about southern region, apart from that they are even fairer to other contestants than other regions! You may wish to further review all Zambian election results…

    • The challenge we have is that most of our MP’s have very humble academic qualifications. Most of them have only managed to get to certificate level and that is why the idea of reading volumes upon volumes is very strange to them. The constitution was put up for public debate several times, it was later taken to parliament for further debate. If indeed our MP’s had some education, surely what Lifwekelo is talking about could have been pointed out and I am sure it could have been clarified.     • It is inferred the President and the Running mate should both meet the requirements. You can’t have a running mate who is 21 years old because if the position falls vacant the running mate will not qualify to be president, which requires one to be 35 years old.

      Come on stop playing semantics game here if you are GBM yourself. There is no article which says being a man you can’t go into the female public toilet, that does not mean you should go just because it is not in the article. Common sense please bwana

    • The clause same Grade 12 representing a minimum of high school Qualification? We have many Zambians that have attended school overseas. maybe to MAKE IT VERY CLEAR LET THEM AMEND IT TO HIGH SCHOOL qualification.

Should the UPND who for the past years have labelled their opponents illiterate Kaponyas be questioning this grade 12 thing?       Your example of public toilets is highly misplaced. Do you realize that at the top of the door it is always labelled Male/male symbol or Female/Female symbol. That is the article that stops you from using a toilet meant for the opposite gender.

      So stop defining qualifications by inference. Equally by inference when something is silent it may imply no rules or qualification apply to the specific office. So GBM will file in his nomination on technicality. Otherwise I foresee the elections postponed because someone can sue & request the supreme court to interpret the law. The sooner you realize the weight in my argument the better if you had hoped to fix GBM on qualifications.
      Refer me to a specific article in the constitution…

The Preseident ECL was always reminding Zambians to study and understand this new amendments. Where you guys that you are now not sure on the requirements of grade 12 as minimum.       But as Lifwekelo asks someone may have gone up to Form III & got employed as an Accounts Clerk in the 70s or 80s. By experience he got accepted to do CABS, later ZDA & later ACCA? Isn’t He/Her better qualified than a mere G12? I once had a work mate like that & is now retired.

    • My sister had a form three certificate in the 70’s and she went ahead and did a course in nursing/nutrition. Similarly, most of the old Policemen who went to Lilayi or Kamifinsa in the 70’s and early 80’s are actually form threes. Don’t argue you were not there!

    • It looks like UPND has within its ranks fake diploma and degree holders without Grade seven certificates. This says a lot about characters who want to hoodwink Zambians into believing that they are economic managers. I hope HH has a grade seven certificate.

    • Bandawe – The entry qualifications to those Diploma programs must have stated Grade 12 or Equivalent – or the applicant must have met an entry Aptitude Test to show that they met the entry requirement, possibly equivalent to Form V/Grade 12.

  3. Trying to Justify selecting GBM as running mate Ka..Uko. So GBM has a Diploma in business but not Grade 12 certificate?

    I’m yet to be shown somebody who has a PhD but no Grade 12 certificate or equivalent..maybe in UPND or Does Dr Cassius Banda also not have a Grade 12 or form five certificate. Uko the plot thickens in UPND

  4. No matero university qualifications. To get a diploma, the pre-requisite is for one to have done some kind of post primary education. If you only have a diploma without any supporting pre-qualification like a form 3 certificate, then that diploma should be flushed down the toilet.

  5. But how were those diploma obtained without Grade twelve Certificates?. A degree or a diploma can only be issued with a full grade twelve certificate.

      A University can admit anyone it choses for consideration for the awarding of a Degree. EVEN IF THEY NEVER WENT TO SCHOOL!

      And they can issue a Degree to persons that have even NEVER EVEN STUDIED AT THAT UNIVERSITY!

      There are many “Doctors” that have these degrees especially “Honorary” ones.

      You are certainly a joker. An honorary doctorate can be given even to a kaponya. But you can’t use an honorary a doctorate if you are looking for a job! You have to have an earned doctorate called the PhD to get you a job. And you can never ever get a PhD without a Grade 12 certificate. Just give me one example of a PhD holder who has no Grade 12 certificate.

  6. This is an ambiguous piece of legislation. It requires serious interpretation before we have a chaotic nomination process. Edwin instead of asking LAZ (who in most cases are viewed as interested parties) ask the judiciary itself. Its their job to interpret the law.

  11. Grade twelve or equivalent is a bare minimum.
    Those who, for whatever reason didn’t have access to grade twelve, but were admitted to college or university education as adults on the basis of their abilities, understanding and experience, subsequently qualifying for the award of a diploma or degree must qualify to run for any political office under the Constitution of the Republic of Zambia.

    Don’t be tunnel “visioned”. Education is broad minded and flexible. It gives opportunities to people through innumerable avenues.

  13. I think the article will definitely bring controversy and may require a rulling by the Constitutional Court. I take it the use of the word “minimum” is the problem in the article. It may mean someone with a higher qualification such as a certificate in tailoring or catering may qualify to stand as president, mp or counselor even if they only reached grade 9 in secondary school. #foodforthought

  15. There is no ambiquity, only confusion. Veep is automatically leader of business in parley, imlpying he is an MP and therefore requires a minimum grade 12 qualification under the new constitution. If anybody has a diploma because he was able to pay to avoid producing a grade 12 certificate to be enrolled in the diploma program, they should forget being VEEP, even being ordinary MP will be a pipe dream with our new constitution.. This is what the people of Zambia included in the new constitution and so it stands.

    • Dr. Canicius Banda diligently earned his qudalifications. I was with him at David Kaunda Technical Secondary School from 1987 to 1989, thereafter, he was selected to go and study at UNZA. Subsequently studied medicine at Ridgeway campus. Do you still have a problem with that peope?

  20. Where were you Lifwekelo to start getting confused now after the law has been passed? Having a diploma in whatever without G12 qualification is like crossing the bridge before you reach it. The question Lifwekelo should ask is CAN ONE BE ADMITTED TO TAKE A COURSE AT DIPLOMA OR DEGREE LEVEL WITHOUT GRADE 12 QUALIFICATION? Yes we have known of conferred degrees like the one queen Elizabeth gave to one Odell who never went to secondary school but became famous and rich through his works.

I say so b’coz i have a sister who graduated in 2014 with a diploma in early childhood at pagron college of edu in Kabwe, she had no maths & science when she was accepted same applies to GBM he has no grade 12 certificate but he has a diploma.

    • Small colleges are mainly after money from desperate students. That’s how come the enrol even those that do not meet the minimum entry requirements. However in most cases these students end up not writing their final college exams since these exams are administered by ECZ or TEVETA that demand for proper entry grades. In that case the college would have already reaped its tuition fees and the student loses out. Its therefore important that students re-write GCE to improve their entrance grades prior to their final college exams if they had entered without the necessary grades.

    • Benson. You do what is known as a bridging course. Masters is a degree. Masters is a degree you obtain as a Post Graduate Qualification with some having a diploma or any equivalent as a pre-requisite for admission. I know a number of guys who have Masters and MBAs after obtaining Diplomas

  24. I must say that I am really very confused with the turn of events. Before the president signed the Constitution it was a well know fact that UPND was party of educated intellectuals. The talked and bragged about this fact in every post. They also insinuated that PF is for illiterate Kaponyas. What has changed today? we are seeing more and more complaints about a simple grade 12 certificate coming from educated camp today. Surely in this day and age can a grade 12 certificate be an issue. I was also under the impression that a grade 12 certificate or equivalent is prerequisite to higher education now how can someone have much higher education without its prerequisite?

  25. It helps to be educated but it is not the measure of one’s ability, competence or even intelligence. That is why, personally, this ‘grade 12’ requirement is one clause that I am not comfortable with. There are other ways of testing one’s philosophy and understanding than using an abstract academic threshold. Some people will definitely be discriminated on this score.

  27. There will be questions with this clause. For example, in some cases you can study for a Ph.D with only your first degree – no need for a masters. You can equally have a ‘trade’ certificate or diploma without a grade 12 qualification. Where does such a certificate stand?

  29. This Likwelo guy is answering his own questions, just for politicking. I don’t see any ambiguity in the clause. ‘minimum‘ means ‘minimum’ (i.e. the lowest common denominator). What this means is if I produce a degree or diploma conferred by a recognisable, reputable and legitimate higher learning institution, I qualify and I don’t have to produce a high school certificate – pay attention to the 3 key words used. This is usually done so because it is inferred that in most cases (but not always), the prerequisite to be admitted into a diploma or bachelor’s degree is high school certificate. It very rare (particularly in the Commonwealth countries) to find admission to higher education without the school certificate prerequisite as a minimum. In rare cases, work…

      In these rare cases, work experience and other tacit knowledge and skills, and life experiences may be used for admission. Again rare. But regardless of how one was admitted, diploma or degree is hierarchically higher than a school certificate, so a person should still qualify.

      Now there would be shoddy institutions conferring shoddy diplomas and degrees out there. This should be what UPND needs to focus their efforts and attention. And this where the Ministry of education come in (or UNZA, CBU, Examination Council of Zambia, colleges, etc.). I believe they would have records of institutions they recognize as legitimate or equivalent. If not they would write to them to seek answers.       They have the right to reject a qualification (diploma or degree), purely from a technical standpoint, not political. When I moved overseas to do my degree, my uni didn’t give me ‘credit’ ffor the 2 years I studied at UNZA because they didn’t recognize it or thought it was inferior. My wife’s teaching diploma wasn’t recognised either and was asked to go and do a uni degree. I guess my point is ‘minimum’ should not be an issue or a point of contention. However the diploma or degree obtained may raise some questions and this where the definition and boundaries should be drawn.

      By the way I thought the question should not be a LAZ QQn to interpret, but rather the department of education. The law is straight forward, but educational…

The law is straight forward, but educational qualifications and what they mean, I believe, is what they are trying to seek. This ‘minimum’ qualification language is very common in the job markets and education admission.

    • Iwe don’t be a full. The Bonstitution Bill was debated and passed in Parliament. Its not the people of Zambia who passed it. Is Lifwekelo a member of Parliament? You also know very well that in Parliament, UPND members tried to block the Bill arguing that the Constitution should be passed through a referendum. You also claim that its a people driven constitution. What? Is a Bill of nine clauses a Constitution? How far did you go in school anyway? Do you even know a clause I wonder?

  38. Guys let us look at this as an opportunity to make money. It appears at this speed if one opened up a night fast track Nursery school you can have even Politicians like GBM enrolling. Look at the potential that has been created by starting nursery night fast track schools all the way to grade 12. There is good money in there.

Like all politicians including HH and his uPMD, MMD may have ranted about Sata’s lack of qualifications, but the ECZ did not ask for the qualifications mentioned by MMD and MMD did not challenge that at nomination.   40. I’m just wondering who these upnd fellows would have blamed if the referendum which they wanted was used to adopt the constitution. Worse still if lots of funds were injected in the referendum and later on flops due to numbers. Upnd is a party which is visionless and no direction. Of anyone thought it’s pf you were wrong.   42. Just to add my voice to this debate. Like everybody else who thinks normally, I agree that Lifwekelo and uPMD should have read the Clause before debating. To my knowledge their MPs (including lawyers) debated without mentioning the clause. Therefore it was not amended as uPMD wnats now. And don’t suggest that PF tampered with the Clause or rigged the amendment (as uPMD always likes to cry like a baby).
    As for those who may not qualify, they are very few, so what is special about them compared to many others who equally will not qualify? To enter the police force, one must be able bodied, is that discrimination? Yes it is, but we live with it because we understand the necessity of an able bodied man for that kind of work. Are they not the ones who are in a hurry to get rid of Lungu from State House and replace him with underfive at the earliest opportunity, even today? Or am I mistaken like they are?   44. Life keloid and the entire UPND are very dull! This document was there for people to read through before it became law.
    There is a very good and strong reason a grade 12 certificate was designed. It’s an assurance to any higher examining body that one will get a natural progression in other higher and difficulty courses as they progress.
    If you can’t pass at grade 12, how do you expect to understand and pass difficulty courses at college or university level?
    It’s like one rushing to get a fake masters degree without an under graduate degree.

  48. This part of the law is discriminating and should be revised as soon as possible. It is true that we have people who dropped in grade nine and went to study at those trade schools which were common in every provincial headquarters back in the days. Most of those people got diplomas and other went further to get degrees etc. Therefore, it would be unfair to ask aspiring candidates to produce grade twelve certificates only. We should encourage the populace to get trade qualifications and let us not limit to people to grade twelve like it is even free to acquire it. It is a pity that we still ask for grade twelve leaving certificates even when we want to hire someone with a masters and some years of experience, I wonder what the logic is!

  49. We need to familiarise ourselves with Qualifications certified by the Zambia Qualifications Authority.Zambia has adopted what is called a National Qualification Framework. A trade certificate is Equivalent to Grade 12. Some Institutions do not require attainment of School Certificate for One to enroll in an Educational Program..   50. Yes for now, things are justified on the leadership qualifications. I wonder why people complain to everything! That current assented constitution has passed through several stages from districts, Provincial and finally National level. And that qualification slot as contributed by the same Zambians has always been there. When President Lungu delayed just for a week to sign it, the same people called him names that he was fearing or they needed to Doctor it before signing.
