UNITED Party for National Development (UPND) vice-president Canisius Banda is on the verge of eviction after failing to settle his house rentals.
His landlady, Chali Tumelo, alleges that Dr Banda has been a difficult tenant in paying the rentals.
“He has been staying in my house for nine years and paying rent has been very difficult. Sometimes Dr Banda would pay rentals after a month or at times, it takes two months for him to pay. After so many defaults, we decided to give him seven days ultimatum in which to pay, but still he has continued defaulting,” she said.
Ms Tumelo said Dr Banda pays K5,500 per month, although the market rate in PHI is between K7,000 and K8,000.
“The money he is paying is very little. We have not increased rentals because he has been there for a long time. I had planned to evict him but he pleaded with us, and we gave him a chance because at the time, he had lost his wife,” she said.
Ms Tumelo said she entered into a new contract with Dr Banda, but he has continued defaulting, and that when she asked for the payment of rentals, he allegedly went to the extent of insulting her.
“I have all the text messages as proof of the insults he sent to my mobile phone. Dr Banda started treating me as though I was his tenant and he was the landlord. My lawyer and I have asked him to vacate the house on March 31st,” she said.
Ms Tumelo said she has asked Dr Banda to renovate her house before moving out.
But Dr Banda said the allegation is not true and that he has hardly known Ms Tumelo.
Dr Banda said some people are trying to taint his name because he is a politician.
Comment:But according to the law,you are supposed to give a tenant three months notice before you evict someone from a rented house which makes me wonder if this lady really has a lawyer.She also says he sometimes pays after a month and sometimes after two months,the question is when is he really supposed to be paying? Anyone who has a rental house in Lusaka like I do will tell you that you have to be extremely lucky to have a tenant who can consistently pay you after a month or two months for nine years.I smell something fishy here.This woman is being used.

The fact is he has been defaulting. Why can’t he build his own house for that matter and besides a man of that status (Vice President+Doctor+no house+over 40years=a fool at 40). Therefore, whether the lady is wrong or not, Vice President Dr Banda should own a house befitting his status.

I pay my rentals after every 3 months, does that mean that I don’t pay? Show us the terms of payment from the contract, it is not very common for people to pay rentals every single month, mostly, people pay 2-3 months in advance.
Canisius is one of the few honest politicians in this land. If he denies this Tumelo then he has very little contact with her. I would challenge this woman to publish those texts.

Surely the statement above is from a landlady with little or no appreciation of business. If you have a tent taking one or two months to pay you and he/she has occupied your house for 9 years, one should be thankful. Chances are that landlady is being used politically are high. For you own information landlady, you cannot give 7 days notice, that is illegal. Ask for legal guidance before, you have the courts put that notice on hold and your tent will leave in that house rent free till the case is disposed off in courts of law.
Im not so much concerned about his name being dragged into the mud, I’m more concerned with the fact that he has been renting for 9yrs. He is a doctor. It is shameful for someone at his age to still be renting.
This is strange. When someone has a mansion like HH, you say he stole money from privatisation. When Banda rents a house you say its shameful. What I know is that it is very expensive to build a house in Lusaka. Only big business men can manage. All others are stealing money in their work places to build, the so called deals, but thats stealing.

Canisius Banda is a renowned medical doctor who held high profile positions in the Ministry of Health for more than ten years before he joined politics. Given his prominence as a public figure, it is very easy fr him to obtain a mortgage from Zambia Building Society. I know many of his juniors at the Ministry who have built houses. There is just something wrong with him.

Dr Banda at your age you are still renting but we all know why. The money you where paid as salaries, your per diems, the salary advances the loans all went to ‘supporting’ others other than your own. Who doesn’t know the constant complaints from mai Banda when we met at kitchen parties and ofcourse since you come out as a holy man most of us thought she was lying…until she passed on…then you and your journalist ‘friend’ went live on television. How can you manage government coffers when you are a pauper? In fact he MAY HAVE A HOUSE but it may NOT be in LUSAKA but ELSEWHERE,where it could have been easier for him to build! Not everyone can own a house at the same time that is why in organised countries,Real Estate is real business because building is costly and returns on investment take time to realise. What we have in Zambia is a disorganized system where every person does for themselves as a result we have confused residential areas without adequate planned services needed in this modern time,shanties and repeated cholera outbreaks and a totally shabby looking capital city!

In these posts Zambians were doing what they know best – laugh at those who appear less able than ‘I am’ and stupidly envy those who seem to have more than ‘I have’. While personal initiative must be supported and encouraged, it is a whole big and complex issue how best we can better develop our spaces in Zambia and we have a lot to learn from elsewhere!
What does it benefit one in the long run to have a fancy mansion with no guaranteed good water, no serviced sewer and no street lighting to mention a few? Is that what we want for ourselves and as things are, will those services ever improve in the foreseable future?

I suspect Banda is renting this house for his side Kick. At his age and profile in society how can he still be renting a house and in PHI for that matter. This house he is renting is for a girlfriend.

This protection is largely achieved under the Rent Act by limitation of rent payable and provision of a substantial measure of security of tenure. The limitation of rent payable is achieved under the Act through:-
(a) the application of the concept of standard rent
(b) the provisions of section 10 (demanding or accepting rent in excess of standard rent or advance of rent exceeding two months standard rent is criminalized)
(c) Section 11 instances when the landlord may increase rent are circumscribed under the section.

I know this Chali Tumelo, that’s if she is the same lady I met in London Round 1980-85 or so. We lived at the You ng Women association YWCA, in Fitzrovia(Euston, Endsleigh Gardens), at a time we were all starting our studies. She was very intelligent and dedicated and a confirmed Christian. She was going to study Mechanical Engineering and was very studious, put us all to shame. I was doing my Computer Programming studies at the time.
The Chali Tumelo I remember was very honest and above board. I do not believe that she is lying. I believe her to be one of our brilliant minds and no wonder she has a house to rent to what is supposed to be opposition notables(yeah, notable for political mischief).
No reason for her to put up with this character. Apart from rent owed, he is defiling her house with ant-gov’t activities. HH has big enough a house to keep him rent free for a while. In any case if Treason is found in the Drilling allegation, the gov’t will house them for free …in Jail. Basic accommodation maybe not suitable for their pompous minds, but good enough to retrain them into proper respectful citizens.

The craving for wealth and power among UPND politicians is a no brainer. Haven’t you met them especially the aspiring candidates in person? They do not hide their personal or corrupt ambitions at all, maybe because they are so (over)confident that their messiah is a sure winner and they will just ride in his back. They think HH is unstoppable and so theirs is just to ride on his back. Seek them out and you will agree with me. They smell corruption and look like corruption itself? Only in Zambia do people laugh at people over 40 not owning thier own house! People own houses at different stages in thier lives! Just because you own a house at foundation level in John Lenge does not give you the right to birrate others! I had a pleasure to visit a former school mate who used to boast he had built a mansion when I was abroad. The house had no running water, electricity or doors. The only door the house had was the front door, the rest were improvised with chitenge.
I know Doc from his days at Chongwe clinic. The man owns property. It does not mean that when you rent, then you have no house. When i was tranfered to Chipata, i of course left my house on rent and went to live in a rented house. Others leave their houses to go and rent smaller and cheaper houses so that they can get profit from their much bigger houses. Suppose he publishes pics of his property and reasons why he is renting, what will people say?
