Government agrees to restore RB immunity and stop prosecuting him

FORMER President Rupiah Banda and the State have agreed to restore his legal immunity and stop prosecuting him following extensive discussions between the two parties.

This is in a case in which Mr Banda is seeking judicial review of the decision of the Speaker of the National Assembly Patrick Matibini to strip him of his legal immunity and subject him to criminal prosecution.

According to a consent order signed by the two parties, they want the decision by the National Assembly to be quashed and rendered null and void.

The two parties also want the court to order the restoration of Mr Banda’s immunity following his acquittal and that his legal immunity should be deemed as not to have been removed.

The parties also want the court to quash the decision of the Director of Public Prosecutions to prosecute Mr Banda for offences of corrupt practices and concealing gratification.

It was argued that the offences were not part of the allegations tabled before the National Assembly prior to the removal of Mr Banda’s immunity from prosecution and for this decision to be quashed.

“By consent of both parties each through their respective advocates, it is hereby adjudged that the following order be and are hereby granted: an order of certiorari to remove in this honourable court for the purposes of quashing the decision of the learned Director of Public Prosecutions,” part of the consent order reads.

In an earlier sitting before High Court judge Annie Sitali, Mr Banda’s lawyers indicated that they were conducting extensive discussions with the Attorney General following events that had occurred affecting Mr Banda.

Mr Banda’s lawyer Abyudi Shonga told Mrs Justice Sitali that it was most likely that a consent order would be presented to her because areas of difference had been resolved.

“We are asking for an adjournment…to allow the Solicitor General the comfort of perusal and perhaps more importantly, I am pleased to inform the court that extensive discussions between the parties have been ongoing for some time. I can confirm to this court that it is most likely that a consent order will be presented,” Mr Shonga said.

Solicitor General Abraham Mwansa said that was the correct position regarding the matter.

  1. In all fairness, this case is between ”The people of Zambia vs Rupiah Banda”. Until the peoples of Zambia are satisfied that no thieving took place, this case cannot be closed by a cohort of crooked individuals pretending to be representing wishes of most honest and hard working Zambians.

    • Justice delayed is justice denied. RB has been without immunity for over 4 years under pursuit of Government with all levers of powers to prove basis of the Kabimba/Namakando hate allegations. Lamentably they failed and denying restoration is criminal. Leave hatred with hatefull little calawags.It’s time to restore the dignity of our country. What culture are we opening up to that only schemes of destroying the institutions of ex-presidents? The same spirit in vanity was condoned to smear Dr. Kaunda and family for way too long only to prove that it’s hatred schema built on lies that he stole $4 billion. Taxpayers lose millions of dollars to sustain legal fees to cartels that engineer these lies against ex-presidents.

    • We shall reverse that decision after 11th August 2016. The resources the bandit stole was for the Zambian public, not PF. We can’t have a situation where public resources are plundered for the benefit of personal mutual friendships.

    • A criminal case (Against the Zambian people) is to be closed on the basis of an agreement? He should have been found guilty or not guilty; if not guilty why does he need the immunity? Now Henry can come back to Zambia; all he needs to tell the pursuants is “Ask my father, I was only his agent, he is the one who sent me do what you think I ought not to have done”. MCS (MHSRIP) must be turning in his grave.

    • How do these consent agreements work? The immunity was removed by Parliament. Can it be restored by some corrupt govt officials working for RB? Or will PF take the case back to Parliament, apologise for their earlier action, and ask that the immunity be restored?

      There are multiple articles with undeniable evidence that RB abused the office. You can guys can support the man but he knows that he is not innocent. Thats why Nchito was removed from his position bu Lungu and team. Time will still catch up with this corruption.

      Ba Sata PF removed RB’s immunity against protest from opposition. Why is Lungu PF restoring the immunity using consent order?

      Is it because Lungu ascended to PF presidency through Chama v Inonge consent order? Can a private civil matter be resolved like a criminal matter. Morality and law are different but i lean on the moral view.

      This one decision has confirmed that Lungu PF has abandoned Sata PF vision and embraced RB, line hook and sinker.

  3. This is Zambia we love where former presidents can do whatever they want and get away with it because they are above the law. Immunity is removed from them for the sake of exciting the public and later the siting president influence the decision to set free a former President. The late president Mwanawasa was above that and I think the late president Sata would have not sunk so low to let president Banda go free. The members of Parliament and ministers have let down this nation by stopping former Presidents from stealing. Is this the kind of MPS we want to present us?

First I should doubt that once removed, it can not or should not be ‘restored‘ (it’s like virg!nity). Or even if it were to be ‘restored’ or the earlier decision to remove it is ‘reversed’, I would think only that arm of govt with the powers and mandate to do so can make such decision (i.e. Parliament with 2/3 majority). I don’t think the courts have or should have the powers to remove laws made by parliament. In other words this is law as it stands because an interpretation of the constitution had to be made and the decision passed in the house. That decision is law and final… the courts just interpret, translate…

The PF govt will have to go through the same channel (via parliament) to reverse that earlier decision. Maverick, thanks for the education but you could be wrong about the limits of parliament. “I don’t think the courts have or should have the powers to remove laws made by parliament” The courts you will be surprised in fact have the powers to overrule parliament if the laws passed there in are deemed to be in conflict with constitution. Just debating a point in law without lingering on whether the decision is wrong on right.

    • @Pakudya Salimbana, agreed… yes you are definitely right that parliament can’t overstep their powers. There are checks and balances among the 3 arms of governancet to ensure no one abuses their powers.

      Having said that the Zambian constitutionc can also be amended by parliament without going to a referendum as we have just seen recently. I understand only a 2/3 majority is required. I understand the immunity thing is more like a constitutional amendment.

      But even with great oversight from the judiciary, the judiciary can’t just scrap the law passed in parliament and signed by the president (who belongs to the executive branch), that would be an@rchy. I’m hoping that the best they could do is send the law back for further debate and potential amendment…

      1. Both, Constitution of 1996 and current amended Constitution do NOT have provision for restoration of immunity. That is a FACT.
      2. Consent Order (which is a civil matter) cannot be used to restore immunity from prosecution.
      3. If PF wants to restore immunity from prosecution, they will need to table Amendment Bill (white paper) in the Parliament and obtain 2/3 majority of ALL MP’s before it can become part of the Constitution.

    • Fred Mmembe has the marks of a demon incarnate sent by his master to cause havoc in Christian Zambia (John 8:44). He has at his disposal, Mutembo and Winter. Together, they answer to no other description than axis of evil. They are responsible for all the evil surrounding Sata’s death and many other untold evils.

After all we now know how “professional” our DPP was, he is so scared of the truth coming out of the tribunal that he will go to court repeatedly over the same matters in the futile hope that HH will become president and save his neck.

Article 98(10) of the Constitution (Amendment) Act, No. 2 of 2016 provides that: “Where a court acquits the person who held the office of President or who performed executive functions, of an offence for which that person’s immunity from criminal proceedings was removed, the immunity of that person shall, for all purposes, be deemed not to have been removed, without further proceedings.” Hate him or like him, RB is duly entitled to his immunity.

    • So why is he himself talking about ‘restoration’ of his immunity? As it turns out he wasn’t actually ‘acquitted’ by any court, readingt through this article. It sounds like he’s going to be let go through some shady version of ‘nolle prosquii’ based on his alliance with Lungu. There is always going to be a monkey on his back (speaking of a monkey).

      A proper innocent person lets a legal process of a trial to conclude and refusing any shady deals that would leave question marks over their innocence. Why the rush to make deals so close to the elections and in the absence of a DPP? Go figure!

Every Zambian knows RB is active in politics influencing PF and Edgar Lungu hence the talk of lifiting immunity. BUT PF flip-flap as usual think immunity can be lifted from some office. RB immunity was lifted by parliament, it will take parliament to restore it.

    • Concur with some sentiments. I agree that under PF we have seen a failure to prosecute successfully. As I said before, the Defence teams used can make money on the international stage and gov’t Prosecution teams must be changed over!! Maybe with these Defence teams.

  30. I have very little to say in position to this. The judiciary tried to hear all parties in the case. If the case could not be proved, be it so. It’s a warning to lazy opposition always mouthing off about theft by gov’t. It’s evidence that will bring successful outcome.

    Now we should all restore Mr Banda his dignity. He has only a case to answer before God Almighty. His conscious will judge him and in that court room he cannot escape.   38. It is saddening that there is no political leader who has refused to associate with corrupt individuals. They all welcome bad elements in their parties for the sake of winning the presidency. The old wizard from Malawi; William Banda, Dora Siliya, Sylvia Masebo, Maureen Mwanawasa, RB, etc these are questionable characters. I ask myself if it is worth voting, because none of these people aspiring for president are honourable. They just want to go and line their pockets. A warning to PF, if you are going to give RB his immunity, let Henry Banda come back, and have a heavily funded campaign like the one we saw in 2011 under MMD, you are gone. There is a lot going against you, do not add salt to injury.

  39. @ Mr Intellegent. You seem not to have followed the case well. No cash was paid from Zambia. That is why procurers failed to prove their case.
    Immunity cannot be restored under our constitution. That is an MOU like stating that the current parties will not continue with the matter.
    If new facts of theft image RB can still be arrested. Our prosecutors should have known better. There may have been some illegality, but surely not theft in the Niger oil saga.
